ABSTRACT
AN ANALYSIS OF CORRUPTION IN CHINA: THE GUANXI NETWORK OF CHINESE HIGH LEVEL OFFICIALS AND GOVERNORS
Xiangru YIN
Corruption is considered as one of the biggest hurdles faced by the Chinese government, as it has the effect of thwarting economic growth by perpetuating poverty and income inequality, and discouraging foreign investments into the country. However, unlike other countries, China is a special case because of the Chinese concept of guanxi that highlights the importance of maintaining relationships and networks. This system helps to better understand corruption in the Chinese context. The rules of guanxi are deeply embedded in Chinese …

Principles Of The Hidden Heritage Of Correctional Education And Prison Reform, Thom Gehring
Journal of Critical Issues in Educational Practice
Abstract
In all fields of education, theory is in advance of practice (MacCormick, 1931, p. xii).
This essay provides a summary of the historical research themes of the Center for the Study of Correctional Education (CSCE) in the field of prison reform and its leading edge, correctional education. Those themes have been applied at CSCE’s system of parolee schools, the California State University, San Bernardino Reentry Initiative (CSRI). The essay addresses the professional contributions of four contributors or heroes of the correctional education: Alexander Maconochie at a penal colony in the South Pacific, William George among juveniles in New York …

On April 4, 2011 the U.S. Department of Education’s Office for Civil Rights (OCR) released a Dear Colleague Letter (DCL) reminding higher education institutions (HEIs) of their obligations under Title IX to respond to complaints of sexual misconduct. The 2011 DCL was meant to be a guidance document to assist HEIs in complying with Title IX, but many higher education administrators expressed frustrations concerning some of OCR’s requirements. Since releasing the 2011 DCL, OCR has opened more than 200 Title IX investigations at HEIs across the nation. When OCR concludes that a HEI has failed to comply with Title IX, …

Identity Crisis: Understanding How American Males’ Self-Perception And Experiences Impact Their Educational Attainment, Jo Yarketta Hawkins-Jones
Dissertations
If you google African American males, the top results include the following words and phrases: poverty, incarceration, locked out of employment, struggle in the classroom, and high school incompletion. Likewise, research continues to show that disadvantages in education and in African American communities are responsible for many Black males’ poor academic achievement and social outcomes. However, there is one key element missing from majority of the research on Black males, their perspectives.
This dissertation addresses how the personal and educational experiences of low-income African American males, who dropped out of school, influenced their self-perceptions and decision regarding their educational attainment. …

Sustainability and Social Justice
Health care for the homeless is a major problem in American communities. Understanding the gaps, barriers and limitations in this system is imperative to providing homeless populations appropriate care. This research aims to understand the gaps in the homeless system of Worcester, Massachusetts through interviews with hospital staff and employees of agencies working with the homeless population. Analysis revealed an extremely divided system between provision of health care and provision of social services to Worcester’s homeless population. Across these two systems there was limited to no collaboration, communication and understanding. In order to provide more adequate care to homeless individuals, …

Sushmita Diyali
Around the world, women are marginalized and their liberty has been violated despite women rights and movement. The women and girls are still treated as subhuman. They are subject to sexual exploitation, sexual slavery, and a forced labor. The problems of women based discrimination are widespread all over the world and trafficking of women issues is taken as the most intolerant criminal activity in the earth. Though the world is advancing but Nepal is still dragging behind and its one of the problem is sex exploitation. Human rights of …

Virtual Futures: Transfiguring Borders And Transcending Boundaries, Brittany Marie Pickens
Theses and Dissertations from 2017
This project argues that mind uploading and virtual reality are the most likely solutions to the human-driven climate change that will render the Earth unlivable. Drawing on scientific research, the speculations of science fiction, and critical theory, this project first argues that this solution is most probable because it exploits current capitalist trends and does not demand the sacrifice of luxury; concomitantly, it functions as a solution to problems outside of climate change and human survival regarding human health, progress, evolution and [interstellar] exploration. This project further explores: 1) what problems mind uploading could solve and to what extent; 2) …

Juneau: Notes From The Bus, Cara Makuh
Senior Theses
This creative writing project is about a week I spent alone in Juneau, Alaska. All time and travel was spent on foot, bus and boat. Alone, I had many different experiences, and every time I interacted with a new person, that isolation became a shared experience, if even for a minute. Each day started out a blank slate, and eventually wrote itself into a story with a unique identity of its own as each day does as we travel through seconds and minutes that build up into completed days. Social interactions with so many different people turns them from strangers …
Need For Speech-Language Pathologists In Juvenile Detention Centers In Arkansas, Jessica R. Stephenson
Need For Speech-Language Pathologists In Juvenile Detention Centers In Arkansas, Jessica R. Stephenson
Rehabilitation, Human Resources and Communication Disorders Undergraduate Honors Theses
Young offenders in juvenile detention centers (JDCs) have a higher than average incidence of communication difficulties. There is limited published research on incidence of communication disorders and intervention techniques on this population in Arkansas. Speechlanguage pathologists (SLP) have been implemented in the JDC setting in other countries to determine if having speech-language therapy services will benefit juvenile offenders with their legal experiences and their lives post release. The limited research that is available identifies the need for a full range of speech-language therapy services to lower recidivism rates and provide offenders with the necessary tools for functional communication. The first …

Expungement, Defamation And False Light: Is What Happened Before What Really Happened Or Is There A Chance For A Second Act In America?, Doris Deltosto Brogan
Working Paper Series
Should an individual whose criminal record has been expunged have a cause of action for invasion of privacy, defamation or false light when a media outlet refuses to “unpublish” or correct the original report of her criminal charge? Outside of George Orwell’s world, can a fact that once existed be willed away by a court order, making the once-accurate report false, or “constructively false” and so give rise to a cause of action?
The impact of being swept into the vortex of the criminal justice system, even if as the result of only a minor charge, and even if that …

Disproportionalities in school discipline exist for children of color and those in other marginalized categories. Researchers consistently discover that the disparities cannot solely be contributed to differential behavior, indicating that these students receive different treatment and disciplinary processing. Seemingly, ineffective discipline systems and practices in schools are one of many components contributing to the disproportion. Although changing the inequities in schools and in disciplinary approaches is warranted, analysis of the potential for existing programs to curtail negative student behavior and reduce disciplinary infractions such as referrals, suspensions, and expulsions in all races and groups of students is necessary. A possible …

Despite a long history of racism in the United States, many contemporary Americans believe racially-discriminatory attitudes and practices against minorities no longer exist and that we live in a post-racial era in which skin color does not determine an individual’s prosperity or social mobility. Indeed, today many white Americans do reject overtly racist behavior. However, although racism no longer presents itself in ways as obvious as during slavery or Jim Crow, racially-discriminatory attitudes and practices are still engrained in American society, but present themselves in new, obscure, and sophisticated ways. This tendency for racism to morph can be seen in …
The Replacements: Conflicting Standards For Obtaining New Counsel Under The Sixth Amendment, Sharon Finegan
The Replacements: Conflicting Standards For Obtaining New Counsel Under The Sixth Amendment, Sharon Finegan
Cleveland State Law Review
In 2006, the Supreme Court handed down a decision in United States v. Gonzalez-Lopez emphasizing the importance of a defendant’s right to counsel of choice under the Sixth Amendment and holding a denial of this right constitutes structural error, requiring automatic reversal. Following that decision, several federal circuit courts and state appellate courts have questioned how to apply this right to circumstances where the right to choice of counsel and the right to appointed counsel overlap. When a defendant seeks to replace retained counsel for appointed counsel, should the standard governing his motion fall under the right to choice of …

Due to many factors, women in substance abuse treatment are at high risk of contracting the human papillomavirus (HPV) and developing cervical cancer. Despite this, the likelihood of accessing preventative healthcare, such as a Pap exam, is low. Substance abuse treatment facilities may be suitable access points for preventative cervical cancer screening. Using secondary focus group data, this qualitative narrative analysis examines answers given by women in substance abuse treatment regarding knowledge, experiences, barriers, and facilitators to Pap exams. The purpose of this analysis was to further understand how this population views Pap smears in order to guide best practices …

How Media Today Influence Public Opinion On Black Victims And White Offenders With Regards To Race And Crime, Destiny Adams
2017 Spring Honors Capstone Projects - Archive
The media plays an integral role in modern American society. On any given day one person may read news stories from newspapers, television, magazines and social media that all cover the same story from varying angles. This allows news stories to be sensationalized, and the effect it has on public opinion is extremely influential. Therefore, the media’s reporting of crime oftentimes perpetuates stereotypes and biases towards certain races more than others. I conducted a content analysis of news coverage on three black male victims and three white male offenders to examine whether or not a bias existed when it came …

A Retrospective Exploration Of The Factors Affecting Domestic Violence Among A Sample Of Older African American Women: An Interpretative Phenomenological Analysis, Jacqueline Burse
Social Work Dissertations - Archive
African American women experience domestic violence at a rate that is 35% higher than the domestic violence rate of White women. Moreover, African American women encompass 8% of the U.S. population but account for 22% of domestic violence-related homicide victims. African American women are at greater risk for facing economic difficulties, homelessness, unemployment, and health and educational disparities due to domestic violence. However, little attention has been given to the lived experiences of older women who are domestic violence survivors. No extant literature related to the experiences of African American survivors of domestic violence from a retrospective lens was available, …

Pilot Program To Provide Hiv Pep To Sexual Assault Survivors, Ellen Stahlman
Senior Theses
Currently, South Carolina has no standardized guidelines for the prescription and financial obligations for HIV prophylactic treatment post sexual assault. With South Carolina’s high rates of sexual assault and HIV/AIDS, there should be implementation of a program to address these issues. In 2014, South Carolina Office of Victim Assistance (SOVA) contacted the USC Immunology Clinic along with Palmetto Health Richland hospital in order to implement a pilot program in order to provide funding for sexual assault survivors’ treatment preventing HIV. Much communication had to take place in order for all aspects of the process to work efficiently. Emergency departments first …

“Social justice is both a process and a goal. The goal of social justice education is full and equal participation of all groups in a community that is [co-created] to meet the members’ needs. Social justice includes a vision of a community that is equitable and all members are physically and psychologically safe and secure” (Adams, Bell, & Griffin, 2007, p. 1). In the process, one is used to going straight to issues of social justice before connecting by building trusts and relationships. Empirical Challenges To Studying Terrorism And Homicide, Joseph K. Young, Erin M. Kearns
Empirical Challenges To Studying Terrorism And Homicide, Joseph K. Young, Erin M. Kearns
Criminology and Criminal Justice Faculty Publications
The study of terrorism has bridged multiple scholarly domains. Terrorism is discussed within political science as a form of political violence (Crenshaw 1981) related to civil conflict (Findley and Young 2012) and interstate war (Findley, Piazza, and Young 2012). Terrorism is studied within criminology as a form of criminal violence along with homicide and assault, and under political crime as a form of oppositional action put alongside sedition and treason (J.I. Ross 2006). In scholarly work, it is becoming increasingly more common to see works on terrorism connected to political violence (e.g., Thomas 2014) or political crimes (e.g., Chermak, Freilich, …

This article addresses what remedies should be available to a criminal defendant in Maryland who has been identified in an extrajudicial identification procedure that does not comply with the present statutory requirements. Part II of this article provides an overview of the present due process test for evaluating the admissibility of extrajudicial eyewitness identifications, the present Maryland iteration of that test, and alternatives to that approach that have been adopted in other jurisdictions. Part III reviews recent legislative reforms to extrajudicial identification procedures, which are required in Maryland as of January 1, 2016. Section IV.A of this article argues why …

Comment: Prison For You. Profit For Me. Systemic Racism Effectively Bars Blacks From Participation In Newly-Legal Marijuana Industry, Elizabeth Danquah-Brobby
University of Baltimore Law Review
Historically, blacks have been prosecuted and convicted across the United States at significantly higher rates when compared to whites for marijuana-related crimes, despite the fact that studies indicate marijuana use by whites and blacks is relatively equal. Further, individuals with lower economic means were dually susceptible to conviction as a result of less vigorous legal representation.
Now, laws have legalized marijuana for medicinal purposes in twenty-six states, along with a small portion of states (seven) legalizing marijuana for recreational use. Yet retroactive ameliorative relief is not widely available to those who were convicted under circumstances that are now legal, and …

Intimate partner violence (IPV) is a pervasive public health problem across the United States disproportionately affecting women and children. IPV has four primary categories of violence: physical, sexual, stalking, and psychological aggression. This dissertation utilized an interpretative phenomenological as well as a directed content analysis approaches to better understand leaving experiences of survivors of IPV. The study consisted of semi-structured interviews with 19 survivors of IPV who had left an abusive relationship and were living in either an emergency shelter or transitional housing. Participants were recruited from several domestic violence agencies. Interpretative phenomenology served as the framework for understanding the …
