Creating Accountability With Interstate Cooperation: Unauthorized Water Use Enforcement On The Klamath River, Luke Fowler, Isaac Castellano
Public Policy and Administration Faculty Publications and Presentations
While lacking coercive power to compel enforcement, interstate compacts create accountability through multiple sources and layers connecting enforcement behavior to oversight. Using logistic regression, we test a model of accountability and enforcement of unauthorized water usage on the Klamath River. Findings indicate unauthorized water usage is far more likely to be reported and enforced on the Klamath River than on neighboring rivers in the same counties. Conclusions indicate the increased institutional layers of interstate compacts lead to more accountability and stringent enforcement and reporting of unauthorized water use.

This Article concludes that most types of use restrictions do not have sufficient legal justifications. It first reviews the many possible applications of use restrictions and discusses five potential doctrinal bases to justify them: (1) apply an “ongoing seizure” doctrine; (2) create a purpose test for the exclusionary rule; (3) re-define a “search” as including the processing of information, not just its collection; (4) make the purpose of the data collection a factor in determining whether collecting the data is a search; and (5) limit which government agencies are allowed access to the data that is collected. Relationships between racial / ethnic minorities and law enforcement officers in the United States have long been a topic of concern. Given that Hispanics represent the largest racial / ethnic minority population in the United States, the nature of their collective and individual relationships with law enforcement is a topic worthy of empirical examination. Surprisingly, however, there is limited research specifically focusing upon the beliefs, perceptions and attitudes of Hispanics regarding law enforcement officers. In 2008, leading U.S. counties adopted innovative treatment courts specializing in the unique needs of veterans with substance abuse and other legal issues. Since then, pro-veteran advocacy has aided in the continued diffusion of additional veterans treatment courts (VTCs), with more than 300 county and state-level VTCs currently operating in 46 states across the country. Though the lens through which veterans are viewed may be positive in the public eye, institutional support for these wayward veterans appears to vary across levels of government; therefore, while some posit the increased social utility of budget-friendly VTCs, others suggest that VTCs offer favorable …

The Women’s Land Army brought together rural and urban sectors of the United States in a climate of national and regional crisis. By the time the country was cast into war, the agricultural sector was already caught in a downward economic spiral that drove away laborers. With demand falling, and farms propped up only by experiments in subsidy and parity, when military and industrial jobs emerged in urban areas, farm laborers became scarce. At the same time the war created jobs for men outside of the agricultural sector, farm prices recovered and demand soared, forcing farmers to look to women …

The purpose of this study was to determine the prevalence and correlates of post traumatic stress disorder (PTSD) symptomology among correctional staff, using a sample of staff who work in an adult facility for the Kentucky Department of Corrections (KY DOC). Participants (N=775) were asked to complete a written survey to indicate not only demographic variables (age, race, education, and gender) but also the amount of violent and traumatic events experienced, the duration of employment within the KY DOC, whether they were assigned to a custodial/security role, and whether they worked in a maximum security facility. Japan has a career judiciary. The Courts Act of 1947 provides that judges may be appointed from among prosecutors, attorneys, and law professors. In practice, however, the vast majority of judges come from a fourth category, “assistant judges,” who are appointed directly upon completion of the legal training program and typically serve through retirement. This continues a career tradition that dates back to the late nineteenth century. For nearly that long, the Japanese bar has been advocating that the career system should be abolished and that a substantial portion of the judiciary, if not all judges, should be drawn from …

In September of 2016, Ahmad Al Faqi Al Mahdi was convicted in the International Criminal Court (“ICC”) for the intentional destruction of several World Heritage sites during the 2012 conflict in Timbuktu, Mali. This conviction was hailed as a breakthrough after years of frustration with the lack of enforcement of international laws prohibiting the destruction of cultural property. It was also the first conviction of its kind, and advocates of cultural preservation have celebrated it as a much-needed general deterrent in North Africa and the Middle East, where iconoclasm has become a favorite tactic of various state and non-state actors …

Low college graduation rates continue to be a great concern for institutions of higher education. There is a need to examine and employ strategies that will help students cope, persevere, and graduate. The purpose of this qualitative phenomenological study was to examine the perceptions of Christian college students to determine if they identify spirituality as a mechanism to help them cope and persevere at a 4-year urban public college. Social cognition (Bandura, 1986), self-efficacy (Bandura, 1977), and student involvement (Astin, 1984) provided the theoretical framework. Five research questions guided the study. Prosecutors, as representatives of the public in the criminal justice system, are the sole advocates for “the People” in a criminal case. Thus, prosecutors are expected to maintain a particular level of integrity that would ensure a fair and just representation of the People. Despite this expectation, the wide discretionary authority prosecutors hold makes it virtually impossible to regulate their conduct. Furthermore, the First Amendment of the U.S. Constitution protects many expressions of viewpoints, and such protections extend—albeit to a limited degree—to prosecutors, thereby giving them even more discretion in how they decide to handle their own cases. In forensic DNA typing, omitting the DNA extraction procedure and adding the sample directly to the polymerase chain reaction (direct PCR) mixture has several advantages. Without extraction and purification, there is less of a risk of sample loss, sample mix up, or contamination. This study tested the feasibility of direct PCR using the Qiagen® Investigator® 24plex GO! Kit, a megaplex kit that amplifies 22 polymorphic STR markers and the Amelogenin sex determination alleles. Test samples included blood, saliva and skin cells on porous substrates, specifically denim, white cotton, polyester fabric, and paper tissue. Glass slides were used to represent non-porous …

Unmanned aerial vehicles (UAVs), also known as drones, are an innovative technology that has received significant interest from the law enforcement community. The size and ability, technological capability, and cost effectiveness of UAVs make them an attractive tool for law enforcement agencies to utilize in the course of operations, including domestic surveillance. Despite the potential benefits to the society, public perception of police UAV use is mixed, and “Not Over My Backyard (NOMBY)” attitudes relevant to Fourth Amendment privacy concerns are consistently demonstrated across studies related to public perceptions on this emerging technology.

United States expansion following the Mexican-American War served as the catalyst for a reinvention of American Federalism. While much of the historiography traces the accretion of sovereign power in the national government to events caused by the divisions between northern states and southern states, there is an important and understudied East to West component of the process by which sovereign boundaries changed. Canyon de Chelly sits on the Northeastern border of the Kayenta region in Arizona. Because of the position in which they sit, those who lived there likely lived a unique experience when compared to the rest of the Kayenta cultural tradition, of which they are considered a part. By examining the skeletal remains of the canyon occupants, this study is able to reconstruct the demographic profile (age and sex), aspects of health (pathology, stature), analysis of trauma, and aspects of labor (robusticity and entheses) to create the first, modern, complete skeletal analysis of remains recovered from Canyon de Chelly. Digital forensics is a multidisciplinary field encompassing both computer science and criminal justice. This action research compared demonstrated skill levels of university students enrolled in a semester course in small device forensics with 54 hours of instruction in mobile forensics with an emphasis on physical techniques such as JTAG and Chip-Off extraction against the skill levels of industry professionals who have completed an accelerated 40 hour advanced mobile forensics training covering much of the same material to include JTAG and Chip-Off extraction. With the 2012 congressional mandate that the Federal Aviation Administration promulgate rules allowing the use of small unmanned aircraft systems (commonly called drones) in U.S. airspace, many have expressed concerns about potential invasions of privacy by both private citizens and law enforcement agencies. This article provides a survey of the state and federal case law and legislative responses to such concerns through August of 2016, with a detailed focus on legislative enactments creating crimes related to civilian drone use and regulating the law enforcement use of drones to collect evidence in criminal investigations. Accountability in the corrections system is essential to protecting the well-being and safety of inmates. To provide a better understanding of the methods of ensuring the humane treatment of inmates, this article traces the history of Kansas’s jail inspection policy, beginning with passage of the state’s 1973 jail inspection statute. An examination of the legislative history of Kansas’s inspection statute and jail inspection reports, in addition to oral history interviews with corrections officials, reveals that the statute was effective in providing accountability and producing measurable improvements in jail conditions. In recent years, considerable national attention has been focused upon cases in which police officers used deadly force that resulted in the death of private citizens. The officers often contended that the use of deadly force was justified under the circumstances. Prosecutors then presented these cases to grand juries to determine whether criminal prosecutions were warranted. Some prosecutors have elected to provide full grand jury reviews that include the presentation of exculpatory evidence or at least evidence favorable to the police. Although prosecutors have no constitutional obligation to provide such reviews, those who elect to provide full grand jury reviews …

Since at least the days of Prohibition there has been a discussion regarding the professionalism of the individuals involved in the American criminal justice system. From the police officers being required to have some college education along with months of academy training in the law and procedures of the justice system to attorneys being mandated, after college, to complete a 3 year program of formalized academic training in the law and passing a state administered exam of competence, the requirements that determined competency have increased as society and the law have become more complex.

The following qualitative research study focuses on the substance abuse treatment experiences of men who have sex with men. Current research in this area indicates that while these men sometimes seek treatment for substance abuse issues, their treatment experience can be compromised due to personal fears or ignorance on the part of treatment staff members or others in treatment (Cabaj, 2008; Cheng, 2003; Hellman, Stanton, lee, Tytun, & Vachon, 1989).
