Corporate Deferred Prosecution As Discretionary Injustice, Peter Reilly
Corporate Deferred Prosecution As Discretionary Injustice, Peter Reilly
Faculty Scholarship
A recent federal appellate court ruling of first impression permits the resolution of allegations of serious corporate criminal wrongdoing by way of an Alternative Dispute Resolution mechanism called Deferred Prosecution, without appropriate judicial review. This Article describes why this ruling is ill-advised, and suggests how other courts might address these same legal issues while arriving at different conclusions. This Article argues that if federal prosecutors are going to continue using Deferred Prosecution Agreements (“DPAs”) in addressing allegations of corporate criminal misconduct, then that discretionary power must be confined and checked through meaningful judicial review. The overriding concern with the appellate …

How Teachers Who Use Restorative Approaches Come To Adopt A Restorative Justice Mindset: A Phenomenological Study Of Process, Timothy L. Loomer
How Teachers Who Use Restorative Approaches Come To Adopt A Restorative Justice Mindset: A Phenomenological Study Of Process, Timothy L. Loomer
Doctor of Education (EdD)
Zero tolerance policies and exclusionary practices that involve punitive responses to student misbehavior often result in undesirable outcomes for students and schools. In response, some schools and districts have adopted and implemented a behavior management program based on restorative justice called Restorative Approaches. The educational literature contains initial findings that show restorative approaches have promise for reducing exclusions, creating community, improving the teacher-student relationship, and more. Teachers whose schools use restorative approaches may go through a process to adopt and implement aligned approaches in their classrooms. The goal of this phenomenological study was to identify the process through which a …

State Reform And Respect For The Rights Of The Disabled People: A Reflection On The Olmstead Decision The Case Of New York State, Roseanne L. Flores
State Reform And Respect For The Rights Of The Disabled People: A Reflection On The Olmstead Decision The Case Of New York State, Roseanne L. Flores
Publications and Research
Individuals with serious mental illness are often forced to live in institutional settings which limit their freedom and rights to become fully integrated into the community. The Olmstead v. L.C., 527 U.S. 581 (1999) decision ruled that states must provide individuals with disabilities the opportunity to live in the most integrated settings based on their needs. Since that time several lawsuits have been filed on behalf of individuals with disabilities against states for failing to comply with the Olmstead decision. New York State is one such state. The purpose of this paper is to describe the lawsuit which was brought …

Evaluating The Efficacy Of An Attachment-Informed Psychotherapeutic Parenting Program For Incarcerated Parents, N. Laura Kamptner, Faith H. Teyber, Nicholas J. Rockwood, Dolly Drzewiecki
Journal of Prison Education and Reentry (2014-2023)
An attachment-based, psychotherapeutic parent education course was created for incarcerated mothers and fathers to improve their ability to provide positive parenting and a more stable home environment for their children. The current study assessed the effects of this parenting curriculum on parents’ tendencies to be abusive, their sense of efficacy and satisfaction as a parent, their psychological distress, and their knowledge of child development and positive child guidance strategies. Results of pre-post assessments showed a significant improvement in parents’ sense of efficacy and satisfaction in the parenting role; their knowledge, skills, and behavior as a parent; their understanding of child …
