Human Rights: From Legal Transplants To Fair Translation, James M. Donovan Jan 2017

Human Rights: From Legal Transplants To Fair Translation, James M. Donovan

Law Faculty Scholarly Articles

The current regime of international human rights suffers from three shortcomings: First, it has failed to adequately address the reality of cultural diversity. Second, the formalized human rights treaties have been ineffective in their ability to compel states to reform their behaviors, and third, the uncontrolled growth in the number of human rights weakens the impact of appeals to that standard.

Although treated as independent problems, this paper finds that these three limitations are sufficiently linked such that a remedy to the first will simultaneously resolve the others. Parts I and II of the paper describe how the imposition of …

Maintaining Religious Identity In Hiring In Faith-Based Schools: A Comparative Analysis Of Australia And The United States, Keith Thompson, Charles J. Russo Jan 2017

Maintaining Religious Identity In Hiring In Faith-Based Schools: A Comparative Analysis Of Australia And The United States, Keith Thompson, Charles J. Russo

Law Papers and Journal Articles

Even as Australia and the United States (US) are becoming increasingly secularised, they retain a significant number of faith-based primary and secondary schools. Aware of the tension between changing societal norms and the freedoms associated with religious institutions, the main part of this paper is divided into two sections. The first part surveys the relevant constitutional and anti-discrimination laws in Australia and the US along with exemplary litigation on how these statutes are applied. The second section offers six suggestions for school administrators who are wrestling with the challenge of preserving the faith-based ethos in their schools in the face …

Intersectionality And Feminist Pedagogy: Lessons From Teaching About Racism And Economic Inequity, Lisa Cunningham, Pao Lee Vue, Virginia B. Maier Jan 2017

Intersectionality And Feminist Pedagogy: Lessons From Teaching About Racism And Economic Inequity, Lisa Cunningham, Pao Lee Vue, Virginia B. Maier

English Faculty/Staff Publications

This paper utilizes Rochester, NY, as a case study to argue that approaching race intersectionally and across disciplines creates a stronger model of feminist pedagogy. It is based on our work in the classroom and on the Fisher Race Initiatives—a series of three interactive workshops we created on our campus to create change in the aftermath of the Michael Brown shooting in Ferguson, MO, and in the subsequent rise of the #BlackLivesMatter movement. Our goals were to promote dialogue on race, to expose participants to factual information on race, and to emphasize the intersectional causes of poverty in the Rochester …

Consecration Brings Forth Zion, Not Just Disaster Relief: An Examination Of Scholarly And Prophetic Statements On The Law Of Consecration, Richard D. Gardner Jan 2017

Consecration Brings Forth Zion, Not Just Disaster Relief: An Examination Of Scholarly And Prophetic Statements On The Law Of Consecration, Richard D. Gardner

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Active members of the Church of Jesus Christ of Latter-day Saints covenant to obey the law of consecration, and although I have long felt we discuss it too little, more Saints seem to be taking notice. Various historical and doctrinal opinions have been expressed on the law and on the “united order,” including some insightful and some unusual opinions by Kent W. Huff in his book Joseph Smith’s United Order.1 Using this book along with the contributions of several other scholars and Church leaders as a basis for discussion, I explore the history, meaning, and future of the “united order” …

Policymakers' Perceptions Of Oral Pre-Exposure Prophylaxis Introduction In Tanzania: Findings From Implementation Science Research, Population Council Jan 2017

Policymakers' Perceptions Of Oral Pre-Exposure Prophylaxis Introduction In Tanzania: Findings From Implementation Science Research, Population Council

HIV and AIDS

There is limited evidence from Tanzania to inform decisionmaking on whether and how to introduce oral pre-exposure prophylaxis (PrEP) to adolescent girls and young women (AGYW). To help fill this evidence gap, the Population Council in collaboration with the National AIDS Control Program and CSK Research Solutions Limited conducted implementation science research in one urban district (Dar es Salaam) and one rural district (Mbeya) in Tanzania to explore policymakers’ and key stakeholders’ perceptions and attitudes toward the introduction of PrEP to different groups, including AGYW, as well as to identify key issues that must be considered prior to its introduction. …

Conflicted Curricula: An Analysis Of The Relationship Between Afro-Jamaican Communities And Education In Postemancipation Jamaica, Zachary Roper Jan 2017

Conflicted Curricula: An Analysis Of The Relationship Between Afro-Jamaican Communities And Education In Postemancipation Jamaica, Zachary Roper

Theses & ETDs

This thesis examines several institutions involved with the education of Afro-Jamaicans following the abolition of slavery throughout the British Empire in 1838, as well as the response of Afro-Jamaicans to the curricula that was offered. This thesis fits under the genre of colonial history and submits itself as a study of the relationship between colonizers, or colonizing agents, and the colonized. The former category applies specifically to imperial governmental bodies which actively funded and articulated policy pertaining to education during this period, the local legislatures of the island, and the Orthodox Baptist establishment on the island. The “colonized” in this …

Negotiating The Arts: Development And Displacement In The Case Of 411 New York Ave, Christina Harn Jan 2017

Negotiating The Arts: Development And Displacement In The Case Of 411 New York Ave, Christina Harn

Theses & ETDs

In my research I identify competing frames of discourse surrounding art and urban displacement in a contested development project in the DC Office of Zoning (DCOZ). This thesis follows “411 Artist’s Union”, a group of artists and cultural workers protesting to preserve their grassroots art studio, performance and commercial space and prevent a boutique hotel project planned by the new owners of the building. I use a frame analysis to examine case documents and the transcripts of DCOZ hearings and meetings of the months the case was heard (October 2015- June 2016). I examine the tension between cultural development strategies …

Both Home & Not: An Exploration Of Belonging A Play, And Analysis Of Theater As Research, Jacob Alexander "Quake" Cooley

Theses & ETDs

In June of 2016, I traveled to Buenos Aires, Argentina in order to conduct research about what it means to be at Home, to Belong, and to be an Outsider. In total, I interviewed 18 people on the subject, all of whom were born and raised outside of Buenos Aires, and nearly all of whom were immigrants to Argentina. At large, their responses to my research questions provided compelling stories and unique opinions, unforgettable personalities and wholesome insights. I then represented these people and their stories on stage, in what became the soaringly ambitious Both Home & Not, New College's …

Sexual Minority Women’S Gender Expression, Connection To The Lgbtq+ Community, And Self-Esteem, Shelby Statham Jan 2017

Sexual Minority Women’S Gender Expression, Connection To The Lgbtq+ Community, And Self-Esteem, Shelby Statham

Theses & ETDs

“Sexual minority women” (SMW) is an umbrella term that refers to those whose sexual identity does not align with dominant heteronormative sexual practices of the majority culture, such as lesbian, bisexual, queer, and others. This study aims to understand the competing gender expectations SMW face in dominant culture, which emphasize femininity, with gender expectations in LGBTQ+ spaces that emphasize masculinity. Additionally, this study will examine how these competing accountability structures impact SMW’s relationship to the LGBTQ+ community and their self-esteem. A quantitative survey and supplementary qualitative data found that masculine gender expression has little association with SMW’s psychological sense of …

Formation Kinetics Of Copper Nanoparticles In Phosphate Glasses, Robert Forrest Smith Jan 2017

Formation Kinetics Of Copper Nanoparticles In Phosphate Glasses, Robert Forrest Smith

Theses & ETDs

The kinetics of copper nanoparticle precipitation in barium-phosphate glass matrices was studied. Barium-phosphate glasses containing 10 mol% of the nanoparticle precursors Cu2O and SnO were prepared using a melt-quench technique. The samples were heat treated at 530, 540, 550, 560, and 570 °C to precipitate metallic copper, while simultaneously collecting UV-visible absorption spectra. The peak optical density of the surface plasmon resonance (SPR) is assumed to be proportional to the volume fraction of precipitated plasmonic copper. The development of the SPR is analyzed within the framework of classical particle nucleation and growth (Kolmogorov-Johnson-Mehl-Avrami) theory. The activation energy for diffusion based …

“What We Are Doing Here Is Small But I Think This Is The Future”: Two Case Studies For Establishing Agricultural Intentional Communities As A New Social Movement, Mariana Bonilla Jan 2017

“What We Are Doing Here Is Small But I Think This Is The Future”: Two Case Studies For Establishing Agricultural Intentional Communities As A New Social Movement, Mariana Bonilla

Theses & ETDs

This undergraduate thesis poses the question: in the face of global issues regarding food security, environmental degradation, and social inequality, are there any grassroots communitarian solutions to making sustainable and equitable food production systems that challenge the progressivist industrial growth model, and if so how do they manifest? My field research examines two case studies of agricultural intentional communities and I posit that these non-cohesive and sporadic communities cropping up worldwide, although not actively engaged in any legal or political struggles, are enacting real social change at the level of the lifeworld and thus, constitute a New Social Movement. I …

10 Square Miles Of Food Justice: How Ithaca, New York Is Breaking Bread To Bridge Communities, Julia De Aragon Jan 2017

10 Square Miles Of Food Justice: How Ithaca, New York Is Breaking Bread To Bridge Communities, Julia De Aragon

Theses & ETDs

Through personal interviews and analysis, this thesis examines the impact of community involvement and anti-oppression collaboration on the food justice movement in Ithaca, New York. It analyses published work on race and power dynamics, and the role communities play in environmental justice. This thesis concludes that while a certain degree of social inequality and disparity exists within the Ithaca food movement, it can be resisted through intentional engagement of disenfranchised communities by locally organized grassroots initiatives and programs, and increased collaboration between these initiatives and programs.

The Antidepressant Effect Of Serotonin Uptake Inhibition, Michael P. Bailey Jan 2017

The Antidepressant Effect Of Serotonin Uptake Inhibition, Michael P. Bailey

Theses & ETDs

Selective serotonin reuptake inhibitor (SSRI) antidepressants are among the most prescribed, and most researched pharmaceuticals. In spite of this, the details of how they attain their antidepressant effect remain incompletely understood. Early research into depression focused on the modulatory effects of monoamine neurotransmitters, while more recent approaches have sought to characterize depression in a complex systems framework. Much progress has been made in identifying the processes involved in mediating the antidepressant effect, including alteration of functional connectivity in large scale networks of the brain, glucocorticoid signaling, and activation of neural plasticity and neurogenesis in the hippocampus. Taken together, these suggest …

The Importance Of Considering All Children: A Content Analysis Examining Academic Articles Pertaining To Children With Disabilities On Playgrounds, Cristina Harty Jan 2017

The Importance Of Considering All Children: A Content Analysis Examining Academic Articles Pertaining To Children With Disabilities On Playgrounds, Cristina Harty

Theses & ETDs

In this thesis I study how scholars in the United States have been discussing, since 1990, best practices for the use and development of playgrounds to enhance the formative education of children with disabilities. My content analysis is informed by three conceptual frameworks: Symbolic interactionism, labeling theory, and the role of constructed environments and interactions. I offer a contextual introduction, addressing the history of treatment of people with disabilities in the United States, the rise and accomplishments of the Disability Rights Movement and the role of playgrounds in American society. As part of the content analysis, I analyzed the terminology …

Aporetic Justice And Its Impossible Possibility In Derrida, Levinas, And Critical Legal Theory, Kasia Burzynski Jan 2017

Aporetic Justice And Its Impossible Possibility In Derrida, Levinas, And Critical Legal Theory, Kasia Burzynski

Theses & ETDs

This thesis explores the possibility of justice in the law and does so through a critical and contemporary understanding of American law. Chapter one begins with an examination of critical legal studies (CLS) which, it argues, makes considerable moves toward an understanding of justice but stops short of developing a robust theory. A version of CLS from Marianne Constable is offered as an exemplar and most of the chapter is devoted to a treatment of her book Our word is our bond: how legal speech acts where she asserts the linguistic and rhetorical nature of the law and of justice. …
