Nursing Skill Mix, Nurse Staffing Level, And Physical Restraint Use In Us Hospitals: A Longitudinal Study., Vincent S. Staggs, Danielle M. Olds, Emily Cramer, Ronald I. Shorr

Manuscripts, Articles, Book Chapters and Other Papers

BACKGROUND: Although it is plausible that nurse staffing is associated with use of physical restraints in hospitals, this has not been well established. This may be due to limitations in previous cross-sectional analyses lacking adequate control for unmeasured differences in patient-level variables among nursing units.

OBJECTIVE: To conduct a longitudinal study, with units serving as their own control, examining whether nurse staffing relative to a unit's long-term average is associated with restraint use.

DESIGN: We analyzed 17 quarters of longitudinal data using mixed logistic regression, modeling quarterly odds of unit restraint use as a function of quarterly staffing relative to …

Prediction Of Cyp2d6 Phenotype From Genotype Across World Populations., Andrea Gaedigk, Katrin Sangkuhl, Michelle Whirl-Carrillo, Teri Klein, J Steven Leeder Jan 2017

Prediction Of Cyp2d6 Phenotype From Genotype Across World Populations., Andrea Gaedigk, Katrin Sangkuhl, Michelle Whirl-Carrillo, Teri Klein, J Steven Leeder

Manuscripts, Articles, Book Chapters and Other Papers

PURPOSE: Owing to its highly polymorphic nature and major contribution to the metabolism and bioactivation of numerous clinically used drugs, CYP2D6 is one of the most extensively studied drug-metabolizing enzymes and pharmacogenes. CYP2D6 alleles confer no, decreased, normal, or increased activity and cause a wide range of activity among individuals and between populations. However, there is no standard approach to translate diplotypes into predicted phenotype.

METHODS: We exploited CYP2D6 allele-frequency data that have been compiled for Clinical Pharmacogenetics Implementation Consortium (CPIC) guidelines (>60,000 subjects, 173 reports) in order to estimate genotype-predicted phenotype status across major world populations based on …

Fetishizing Copies, Jessica Litman Jan 2017

Fetishizing Copies, Jessica Litman

Book Chapters

Our copyright laws encourage authors to create new works and communicate them to the public, because we hope that people will read the books, listen to the music, see the art, watch the films, run the software, and build and inhabit the buildings. That is the way that copyright promotes the Progress of Science. Recently, that not-very-controversial principle has collided with copyright owners’ conviction that they should be able to control, or at least collect royalties from, all uses of their works. A particularly ill-considered manifestation of this conviction is what I have decided to call copy-fetish. This is the …

Law Library: 1859-2017, Barbara H. Garavaglia Jan 2017

Law Library: 1859-2017, Barbara H. Garavaglia

Book Chapters

The Law Library was established in 1859 as part of the Law Department and continues to be "maintained and administered as a part of the instruction and research operation of the Law School." The library has been considered the "apparatus" of the Law Department and "the lawyer's laboratory." Indeed, this underlying view led the library to build a comprehensive collection that would provide "the means necessary for original investigation" and "permit scholars to do research work in any field of law, regardless of country or period." The collection development policy--to collect primary sources of law: statutes, civil law codes, court …

Mandatory Arbitration In Consumer Finance And Investor Contracts, Michael S. Barr Jan 2017

Mandatory Arbitration In Consumer Finance And Investor Contracts, Michael S. Barr

Book Chapters

This chapter focuses on the use of mandatory pre-dispute arbitration clauses in a subset of consumer contracts – those involving consumer finance and investor products and services. Arbitration clauses are pervasive in financial contracts – for credit cards, bank accounts, auto loans, broker-dealer services, and many others. In the wake of the recent financial crisis, Congress enacted the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010 (Dodd-Frank). Dodd-Frank authorises the new Consumer Financial Protection Bureau (CFPB) and the Securities and Exchange Commission (SEC) to prohibit or condition the use of arbitration clauses in consumer finance and investment contracts, …

Visual-Linguistic Semantic Alignment: Fusing Human Gaze And Spoken Narratives For Image Region Annotation, Preethi Vaidyanathan Jan 2017

Visual-Linguistic Semantic Alignment: Fusing Human Gaze And Spoken Narratives For Image Region Annotation, Preethi Vaidyanathan

Theses

Advanced image-based application systems such as image retrieval and visual question answering depend heavily on semantic image region annotation. However, improvements in image region annotation are limited because of our inability to understand how humans, the end users, process these images and image regions. In this work, we expand a framework for capturing image region annotations where interpreting an image is influenced by the end user's visual perception skills, conceptual knowledge, and task-oriented goals. Human image understanding is reflected by individuals' visual and linguistic behaviors, but the meaningful computational integration and interpretation of their multimodal representations (e.g. gaze, text) remain …

"Playing The Game Or "Buying In": Charter School Teachers And Professionalism In An Era Of Choice And Accountability, Beth Louise Wright Jan 2017

"Playing The Game Or "Buying In": Charter School Teachers And Professionalism In An Era Of Choice And Accountability, Beth Louise Wright

Dissertations

Charter schools were initially created with the intention of empowering teachers to implement school and classroom strategies in accordance with their educational expertise. Such autonomy and respect for teacher expertise indicates a commitment to teacher professionalism. Yet charter schools have also have higher rates of teacher turnover and hire fewer credentialed, experienced teachers. In the context of shifting and contested notions of teacher professionalism, charter schools provide insight into how teachers fare under contemporary educational policy arrangements. This comparative qualitative case study investigates how charter schools have lived up to their theoretical promise for teacher professionalism. The study finds that …

Bankrupt Marketplace: First Amendment Theory And The 2016 Presidential Election, Leonard M. Niehoff Jan 2017

Bankrupt Marketplace: First Amendment Theory And The 2016 Presidential Election, Leonard M. Niehoff

Articles

In this article I advance two arguments. The first is that 2016 was a particularly important year for freedom of speech and the press, although not for conventional reasons. The second is that hte events of 2016 revealed that one of the essential components of our democracy - the central role that free expression plays in the democratic process - is in a state of serious dysfunction, if not crisis.

Are Trump's Attacks On The Media Adversely Affecting Public Opinion?, Leonard M. Niehoff Jan 2017

Are Trump's Attacks On The Media Adversely Affecting Public Opinion?, Leonard M. Niehoff

Articles

Both during the election cycle and as president of the United States, Donald Trump has enthusiastically and aggressively attacked the media. On Twitter, in speeches, and at rallies he has repeatedly deployed his favorite “f words” against mainstream broadcast, print, and online news sources: “fake,” “fraudulent,” “failing,” and (phonetically) “phony.” Some attacks have been personal to individual journalists, some have been more institutionally focused, and some have been made in contexts that appeared to create physical risk to reporters who were present. But whatever the variation in lavors, the frequency of the attacks has remained constant. Indeed, Trump has devoted …

Why Sports Law?, Sherman J. Clark Jan 2017

Why Sports Law?, Sherman J. Clark

Articles

This essay argues that sports law can be more than just a fascinating and topical subject with great appeal to those who work or hope to work in the field. It can also be a valuable intellectual and pedagogical enterprise—even for those who do not or will not work in sports. In particular, sports law can be a useful and clarifying lens through which to study the law more broadly. This is because sports enterprises and issues tend to put unique and potentially illuminating pressures on the law. Ordinary or unexamined assumptions often break down or prove inadequate when confronted …

The Death Of The Firm, June Carbone, Nancy Levit Jan 2017

The Death Of The Firm, June Carbone, Nancy Levit

Articles

This Article maintains that the decision in Burwell v. Hobby Lobby, which referred to the corporation as a legal fiction designed to serve the interests of the people behind it, signals the “death of the firm” as a unit of legal analysis in which business entities are treated as more than the sum of their parts and appropriate partners to advance not just commercial, but public ends. The Hobby Lobby reference to the firm as a fiction is a product of a decades-long shift in the treatment of corporations. This shift reflects both an ideological embrace of the free-market-oriented “agency-cost” …
