Mental Disability Law: Cases And Materials, 3rd Ed (2017), Michael L. Perlin, Heather Ellis Cucolo, Alison Lynch
Mental Disability Law: Cases And Materials, 3rd Ed (2017), Michael L. Perlin, Heather Ellis Cucolo, Alison Lynch
Books
This comprehensive casebook covers all areas of civil commitment law, institutional rights law, community rights law, sex offenders law, and the Americans with Disabilities Act. Mental Disability Law also explores all aspects of the criminal process, including all criminal competencies, the insanity defense, trial practice issues, sentencing and the death penalty. It is the only casebook available that considers the important factors that have shaped mental disability law — sanism, pretextuality, heuristics and false “ordinary common sense.” The third edition includes expanded new sections on therapeutic jurisprudence and international human rights law.

The Fourth Amendment In A Digital World, Laura K. Donohue
The Fourth Amendment In A Digital World, Laura K. Donohue
Georgetown Law Faculty Publications and Other Works
Fourth Amendment doctrines created in the 1970s and 1980s no longer reflect how the world works. The formal legal distinctions on which they rely—(a) private versus public space, (b) personal information versus third party data, (c) content versus non-content, and (d) domestic versus international—are failing to protect the privacy interests at stake. Simultaneously, reduced resource constraints are accelerating the loss of rights. The doctrine has yet to catch up with the world in which we live. A necessary first step for the Court is to reconsider the theoretical underpinning of the Fourth Amendment, to allow for the evolution of a …

Protective Effect Of Anti-Phosphatidylserine Antibody In A Guinea Pig Model Of Advanced Hemorrhagic Arenavirus Infection, John M. Thomas, Philip E. Thorpe
School of Integrative Biological & Chemical Sciences (Formerly Dept. of Biology)
Objective: Host derived markers on virally infected cells or virions may provide targets for the generation of antiviral agents. Recently, we identified phosphatidylserine (PS) as a host marker of virions and virally-infected cells.
Methods and Materials: Under normal physiological conditions, PS is maintained on the inner leaflet of the plasma membrane facing the cytosol. Following viral infection, activation or pre-apoptotic changes cause PS to become externalized. We have previously shown that bavituximab, a chimeric human-mouse antibody that binds PS complexed with β2-glycoprotein I (β2GP1), protected rodents against lethal Pichinde virus and cytomegalovirus infections.
Results: Here, we determined the antiviral activity …
Strategic Law Avoidance Using The Internet: A Short History, Tim Wu
Strategic Law Avoidance Using The Internet: A Short History, Tim Wu
Faculty Scholarship
We are now some twenty years into the story of the Internet's bold challenge to law and the legal system. In the early 2000s, Jack Goldsmith and I wrote Who Controls the Internet, a book that might be understood as a chronicle of some the early and more outlandish stages of the story. Professors Pollman and Barry's excellent article, Regulatory Entrepreneurship, adds to and updates that story with subsequent chapters and a sophisticated analysis of the strategies more recently employed to avoid law using the Internet in some way. While Pollman and Barry's article stands on its own, …
Information Gaps And Shadow Banking, Kathryn Judge
Information Gaps And Shadow Banking, Kathryn Judge
Faculty Scholarship
This Article argues that information gaps – pockets of information that are pertinent and knowable but not currently known – are a byproduct of shadow banking and a meaningful source of systemic risk. It lays the foundation for this claim by juxtaposing the regulatory regime governing the shadow banking system with the incentives of the market participants who populate that system. Like banks, shadow banks rely heavily on short-term debt claims designed to obviate the need for the holder to engage in any meaningful information gathering or analysis. The securities laws that prevail in the capital markets, however, both presume …

Al Hill: A Grandmaster Has Passed, Henry Paul Monaghan

Al Hill died on December 5, 2015 at the age of 98, outlasting most of his contemporaries. Al had taken senior status when I came to Columbia Law School, and I succeeded him in the course on federal courts. The little I saw of Al left me with the firm impression of a warm, gentle, affable, caring human being. I did, however, know Al’s work quite thoroughly. And while a memorial is no occasion for an extended review of Al’s long and distinguished academic career, I would like to draw attention to a particularly shining period: Al’s contributions to federal …

Universities are charged with equipping the next generation of graduates with the skills and knowledge to benefit both the businesses they will work in. Analytics are the skills needed by both for profit and non-profit operating businesses. For example, in August of 2013, Forbes printed a post on the Forbes Insights blog by Daniel Keherer titled ‘Analysis Shows Jump in Marketing Analytics Jobs.’ The Definitive Guide to Marketing Metrics and Analytics (Dholakia, 2015) has been freely made available by Marketo. Harvard Business School Press has also published a book titled ‘Competing on Analytics: The New Science of Winning,’ by Harris …

In Let the Games Begin: Jurisdiction-Shopping for the Shopaholics (Good Luck With That) Mark Albanese defends the National Conference of Bar Examiners’ grading practices as essential to assuring reliability given the variability in grading between UBE jurisdictions. In addressing the claim that it is possible to achieve different outcomes on the same test by the same candidate if taken in different UBE jurisdictions, he describes how NCBE monitors jurisdiction variation to ensure grading consistency. Those of us concerned, however, with the possibility that the jurisdiction in which a candidate takes the Uniform Bar Examination (UBE) may make the difference between …
Luck, Justice And Systemic Financial Risk, John Linarelli
Luck, Justice And Systemic Financial Risk, John Linarelli
Scholarly Works
Systemic financial risk is one of the most significant collective action problems facing societies. The Great Recession brought attention to a tragedy of the commons in capital markets, in which market participants, from first-time homebuyers to Wall Street financiers, acted in ways beneficial to themselves individually, but which together caused substantial collective harm. Two kinds of risk are at play in complex chains of transactions in financial markets: ordinary market risk and systemic risk. Two moral questions are relevant in such cases. First, from the standpoint of interactional morality, does a person have a moral duty to avoid risk of …

Improved Performance Of Gene Set Analysis On Genome-Wide Transcriptomics Data When Using Gene Activity State Estimates, Thomas Kamp, Micah Adams, Craig Disselkoen, Nathan L. Tintle
Faculty Work Comprehensive List
Gene set analysis methods continue to be a popular and powerful method of evaluating genome-wide transcriptomics data. These approach require a priori grouping of genes into biologically meaningful sets, and then conducting downstream analyses at the set (instead of gene) level of analysis. Gene set analysis methods have been shown to yield more powerful statistical conclusions than single-gene analyses due to both reduced multiple testing penalties and potentially larger observed effects due to the aggregation of effects across multiple genes in the set. Traditionally, gene set analysis methods have been applied directly to normalized, log-transformed, transcriptomics data. Recently, efforts have …
Accounting For Prosecutors, Daniel C. Richman
Accounting For Prosecutors, Daniel C. Richman

What role should prosecutors play in promoting citizenship within a liberal democracy? And how can a liberal democracy hold its prosecutors accountable for playing that role? Particularly since I’d like to speak in transnational terms, peeling off a distinctive set of potential “prosecutorial” contributions to democracy – as opposed to those made by other criminal justice institutions – is a challenge. Holding others – not just citizens but other institutions – to account is at the core of what prosecutors do. As gatekeepers to the adjudicatory process, prosecutors shape what charges are brought and against whom, and will (if allowed …

Who Needs Men? Titania’S World And Shakespeare’S Argument For Marriage In A Midsummer Night’S Dream, Bob De Smith
Faculty Work Comprehensive List
What is the best context for understanding and enjoying Shakespeare’s A Midsummer Night’s Dream? The play was probably written in 1594-95, then just before or after Romeo and Juliet. With its farce of tragic love in the play of Pyramus and Thisby (“‘very tragical mirth’” 5.1.57), is the play a witty rejoinder to that of the star-crossed lovers, making the pair of plays an exercise in the range of romantic genres?

The Relationship Between Self-Efficacy And Teachers' Ability To Integrate Technology, Robert Hickson
Doctoral Dissertations and Projects
This study sought to evaluate the self-efficacy of teachers with regard to the integration of technology within the curriculum. The purpose of this study was to determine if there is a relationship between teachers’ self-efficacy within the classroom and their ability to integrate the technology available in the classroom. A quantitative, correlational study was performed. The sample was a convenience sample of 64 instructors at the middle grade level of a South Georgia school district. Middle school teachers were surveyed at one point in time, using Media and Technology Usage Attitude Scale (MTUAS) and the Teachers’ Sense of Self- Efficacy …
The Girl Factor: How Single-Sex Learning Environments Affect African American Girls' Discipline Referral Rate, Devonne Lampkin
The Girl Factor: How Single-Sex Learning Environments Affect African American Girls' Discipline Referral Rate, Devonne Lampkin
Doctoral Dissertations and Projects
The mission of the single-sex education is to provide learning environments that will bring out the best in each student and will provide opportunities for success that may not be available in co-educational settings. Several explanations have been suggested for differences between single-sex and coeducational settings in educational processes and in student outcomes. Schools that implement single-sex schools do so with the hope of decreasing the social pressures and distractions that will lead to a decrease in office discipline referrals which unenviably lead to suspensions. The purpose of this ex-post facto casual comparative study examines the impact single-sex schools have …

Over the past decade, the United States has experienced a stunning 65% decline in undocumented immigration. While politicians seem unaware of this change, firms that once relied on local undocumented workers as a low-wage labor force feel it acutely. Such companies have increasingly applied to sponsor temporary migrants from abroad (sometimes called “guest workers”) to fill empty jobs. In 2015, the number of migrant workers entering the United States on visas was nearly double that of undocumented arrivals—almost the inverse of just 10 years earlier. Yet notice of this dramatic shift, and examination of its implications for U.S. law and …

The Great Etf Tax Swindle: The Taxation Of In-Kind Redemptions, Jeffrey M. Colon

Since the repeal of the General Utilities doctrine over 30 years ago, corporations must recognize gain when distributing appreciated property to their shareholders. Regulated investment companies (RICs), which generally must be organized as domestic corporations, are exempt from this rule when distributing property in kind to a redeeming shareholder.
In-kind redemptions, while rare for mutual funds, are a fundamental feature of exchange-traded funds (ETFs). Because fund managers decide which securities to distribute, they distribute assets with unrealized gains and thereby significantly reduce the future tax burdens of their current and future shareholders. Many ETFs have morphed into investment vehicles that …
Prospecting For An Hiv Vaccine, David Brett-Major, T. A. Crowell, N. L. Michael
Prospecting For An Hiv Vaccine, David Brett-Major, T. A. Crowell, N. L. Michael
Journal Articles: Epidemiology
Human immunodeficiency virus (HIV) sets several challenges for the development of a preventative HIV vaccine. Predictable, protective natural immunity against HIV does not occur and so unlike most other diseases for which vaccines exist, there are few guideposts from natural infection. Nonetheless, six vaccine efficacy trials have occurred. One in particular, the Thai trial called RV144, showed partial protective efficacy and potential ways ahead to a better vaccine approach. This coupled with other lessons from studies of acute infections as well as an increasingly complex knowledge of HIV-related vaccine immunology bring hope that a vaccine solution might be reached for …

Journal Articles: Epidemiology
Arthropod-borne viruses (arboviruses), such as Zika virus, chikungunya virus, and West Nile virus (WNV), pose continuous threats to emerge and cause large epidemics. Often, these events are associated with novel virus variants optimized for local transmission that first arise as minorities within a host. Thus, the conditions that regulate the frequency of intrahost variants are important determinants of emergence. Here, we describe the dynamics of WNV genetic diversity during its transmission cycle. By temporally sampling saliva from individual mosquitoes, we demonstrate that virus populations expectorated by mosquitoes are highly diverse and unique to each feeding episode. After transmission to birds, …

On September 7, 2016, four of the nation’s newspapers of record weighed in on the connected crises in crime and policing. The New York Times revealed the tensions between the Mayor’s office in Chicago and several community and professional groups over a plan to overhaul Chicago’s police disciplinary board – a plan developed in the wake of the shooting of an unarmed teenager, Laquan McDonald, and the release of a video of that killing. The Wall Street Journal related a vigorous defense of New York City’s “broken windows” policing strategy – a strategy that has been a recurring source of …
