In June 2017 the D.C. Circuit issued a judgment that essentially reaffirms the constitutionality of current appointments procedures for administrative law judges (ALJs) in the Securities and Exchange Commission (SEC). After conducting an en banc hearing in the case, the en banc court split evenly over whether the ALJs are “Officers of the United States” subject to the constitutional requirement of appointment by the president, a department head, or a court of law. The evenly divided vote resulted in the affirmance of the D.C. Circuit’s earlier panel decision finding that the ALJs are not “officers”—continuing the court’s split with the …

At a medium sized university with a small department of art and no specific art library, art majors and minors can feel that they have no place within the academic library. At Valparaiso University, a collaboration between the university’s Department of Art and library culminated in a Student Art Purchase Award. Faculty from both departments collaborated to create an experiential learning opportunity that includes the application process, production and finishing of fine art pieces on a professional level. This ongoing, annual, experiential learning opportunity culminates in a juried art presentation, and purchasing of art for a permanent art collection within …

Affirmatively Replacing Rape Culture With Consent Culture, Mary Graw Leary
Affirmatively Replacing Rape Culture With Consent Culture, Mary Graw Leary
Scholarly Articles
The debate concerning affirmative consent consists of two camps: those who assert people must affirmatively establish a desire to engage in sexual contact and those who believe this is an unattainable standard. However, this is not where the debate should start and end. This paper argues that the movement towards affirmative consent in sexual contact will reduce the occurrence of sexual assault. Criminal law sets the backdrop for this paper, but the author recognizes the limits of criminal law. In order to combat sexual assault, there must be a multidisciplinary response. By providing a comprehensive definition of affirmative consent and …
Big Bank Boards: The Case For Heightened Administrative Enforcement, Heidi Mandanis Schooner
Big Bank Boards: The Case For Heightened Administrative Enforcement, Heidi Mandanis Schooner
Scholarly Articles
This article first considers the possible liability of the JP Morgan board in the London Whale matter. This discussion is not meant to assign liability in that case. Rather, the London Whale episode is considered as a springboard to a broader discussion of big bank officer and director liability. While it may be tempting to shrug off the regulatory implications of the London Whale episode because the losses did not threaten the solvency of JP Morgan, the significance of such management failures should not be ignored. Effective management of large banks is essential to financial stability. The type of poor …

Amending The Corporate Crisis Renewal Model: Lessons From Oil And Palm Crises In West Africa, Vincent Manzie
Amending The Corporate Crisis Renewal Model: Lessons From Oil And Palm Crises In West Africa, Vincent Manzie
Dissertations, Master's Theses and Master's Reports
This dissertation amends the Crisis Renewal Model of corporate rhetoric based on analyses of two multinational organizational crises in Nigeria and Cameroon. The Renewal model revises the dominant apologia model of corporate crisis rhetoric to focus on strengthening relationships with stakeholders following a crisis rather than solely on repairing or restoring reputation. Yet while the renewal model redresses the classic Aristotelian premises of apologia, the Nigerian and Cameroonian situations call for a significant reframing of rhetorical strategies in response to the colonialist legacies, cultural traditions, political volatilities, and socioeconomic particularities of these contexts. The research questions driving the dissertation are: …

Effects Of Group Selection With Yellow Birch (Betula Alleghaniensis) Retention On The Understory And Sapling Layer In Northern Hardwood Forests, Megan A. Petras O'Neil
Dissertations, Master's Theses and Master's Reports
Gap partitioning theory predicts that changes in microenvironment conditions found within a forest opening promote diversity in forest ecosystems. Under this theory we would expect to see variations in tree and understory diversity throughout and surrounding a forest opening. In order to test this theory, we examined manmade openings with legacy-tree retention in a northern hardwood forest located in the Upper Peninsula of Michigan. This work is part of an ongoing study that was started in 2003 with the creation of 49 openings centered on a reserve dominant or co-dominant yellow birch (Betula alleghaniensis Britt.). The primary objective of …

Effects Of Wildfire Severity On Early Successional Dynamics In Boreal Peatland Complexes, Elizabeth Ernst
Dissertations, Master's Theses and Master's Reports
The Arctic-boreal region is experiencing changes in climate, trending toward warmer summers, resulting in a greater occurrence of wildfires with longer burning periods and higher intensities. Drought-like conditions dry surface fuels, leading to a higher probability of ignition, even in lowland peatlands. Previous work has been done to characterize post-fire succession rates in boreal upland sites, but much less is known of fire effects and early successional dynamics in lowland peatlands. Areas surrounding the Great Slave Lake in Canada’s Northwest Territories experienced exceptional wildfire activity in 2014 and 2015. These fires burned a variety of ecotypes, including bogs, fens, other …
Fluorescent Probe Development For Fructose Specific Transporters In Cancer, Joseph Fedie
Fluorescent Probe Development For Fructose Specific Transporters In Cancer, Joseph Fedie
Dissertations, Master's Theses and Master's Reports
Carbohydrate transporters or GLUTs of the major facilitator superfamily (MFS) are responsible for transporting sugars into the cell and have been of research interest for decades. Disruptions, mutations, and over-activations of GLUTs have been linked to a number of major diseases including cancer, obesity, and diabetes. Differentiating between transporters is incredibly difficult due to highly conserved structures, and so specific targeting between transporters has proven a complex challenge. GLUTs are highly flexible in their conformations however exactly what will and will not pass through the transporter is ambiguous at best, and many attempt to target these transporters have failed.

Design Of Robust Hydrogel Based On Mussel-Inspired Chemistry, Yuan Liu
Dissertations, Master's Theses and Master's Reports
The structure of catechol is found in mussel adhesive proteins and contributed to both wet-resistant adhesion and cohesive curing of these proteins. A synthetic nano-silicate, Laponite was incorporated into catechol-containing hydrogels and the hydrogel network-bound catechol formed strong reversible interfacial interaction with Laponite. The contribution of incorporated catechol-Laponite reversible interfacial interactions to the mechanics of hydrogels constructed by different strategies was studied. In the first strategy, Laponite and catechol were introduced into the double network hydrogel (DN) via the free radical co-polymerization of a catechol-containing monomer, backbone monomer, and crosslinker. The introduction of catechol-Laponite interactions significantly improved the compressive strength …
Design Automation For Carbon Nanotube Circuits Considering Performance And Security Optimization, Lin Liu
Design Automation For Carbon Nanotube Circuits Considering Performance And Security Optimization, Lin Liu
Dissertations, Master's Theses and Master's Reports
As prevailing copper interconnect technology advances to its fundamental physical limit, interconnect delay due to ever-increasing wire resistivity has greatly limited the circuit miniaturization. Carbon nanotube (CNT) interconnects have emerged as promising replacement materials for copper interconnects due to their superior conductivity. Buffer insertion for CNT interconnects is capable of improving circuit timing of signal nets with limited buffer deployment. However, due to the imperfection of fabricating long straight CNT, there exist significant unidimensional-spatially correlated variations on the critical CNT geometric parameters such as the diameter and density, which will affect the circuit performance.
This dissertation develops a novel timing …

(The Work Of) Play In The Age Of Electronic Reproduction, Alexis Newton
(The Work Of) Play In The Age Of Electronic Reproduction, Alexis Newton
Dissertations, Master's Theses and Master's Reports
Electronic technologies have allowed for the mass (re)production of new media artifacts on a previously unachievable scale. While media across the board have been effected by the scope of such technology, videogames specifically provide an interesting and generative point of contact in the digital world. Videogames bridge gaps between the academic, political, and popular often unintentionally and unconsciously in ways that other new media artifacts and technologies cannot. But, while this is so, there seems to be a gap in discourse that brings together virtual and embodied experiences in order to create a more cohesive and holistic understanding of the …

The Finger Lakes area has some of the most unique geologic features in New York State including much evidence of the impact that glaciers have had on this environment. The area is rich in Devonian and Silurian era fossils, drumlins, U-shaped valleys, and glacial erratics. With all of this evidence it is easy to imagine a class of students outside in the environment examining these structures and developing conclusions about their origin. However, students in the Finger Lakes area are generally taught about the geology of the area using traditional techniques utilizing technology and diagrams in the classroom. In this …
Minimizing Run Time Of Finite Element Analyses: Applications In Conformable Cng Tank Modeling, Paul M. Roehm
Minimizing Run Time Of Finite Element Analyses: Applications In Conformable Cng Tank Modeling, Paul M. Roehm
Dissertations, Master's Theses and Master's Reports
REL Inc. has proposed a CNG tank that deviates from typical cylindrical storage methods. The goal of REL working with Michigan Tech is to minimize mass and meet NGV2 safety standards for pressure and drop testing for this tank.
The model has undulated outer surfaces and Schwarz P-surface internal geometry. To accurately mesh this, a small element size is necessary; this creates a model with millions of elements. In explicit analyses, this requires a large amount of computational resources to run.
This report focuses on methods to reduce model run time without reducing accuracy. Methods covered include creating symmetric building …
Investigating The Importance Of Detail Interest Level And Learning Objectives On The Seductive Detail Effect, Kay Tislar
Investigating The Importance Of Detail Interest Level And Learning Objectives On The Seductive Detail Effect, Kay Tislar
Dissertations, Master's Theses and Master's Reports
The inclusion of interesting but irrelevant details in instructional materials may result in the seductive detail effect, in which the details interfere with learning, recall, and application of core material. Although numerous studies have documented this effect, questions remain about exactly when it occurs, as various factors moderate the effect (Rey, 2012b) and confounds make it difficult to interpret previous results (Goetz & Sadoski, 1995). Here, two studies examined the role of seductive detail interest level and the availability of learning objectives on performance, while controlling for possible confounds. Study 1 found no evidence for either an objective or seductive …
