Professional Practices (Art 399), Shateanna Stewart

Professional Practices (ART 399)

I create clay forms that are distressed, altered, textured and colored. Most take a utilitarian form, but not exclusively. I am interested in connecting to the medium and getting lost in the creation of the piece. I am not interested in perfection, but rather find the most amazement in what it is we are capable of; changing a chunk of clay into something wonderful and surprising. My main focus is on the creation of something beautiful that hopefully enriches my audience in the same way it does me. With the goal of creating organic beauty in mind, I found clay …

Non-Native Mangroves (Rhizophora Mangle) Of Moloka'i, Hawai'i: A Socio-Ecological Analysis, Casey Lynette Lewis Dec 2017

Non-Native Mangroves (Rhizophora Mangle) Of Moloka'i, Hawai'i: A Socio-Ecological Analysis, Casey Lynette Lewis

Dissertations and Theses

The formation of novel ecosystems by non-native species poses management challenges that are both socially and ecologically complex. This complexity necessitates consideration of both ecological dynamics and social attitudes and perceptions. Red mangrove propagules were introduced to Moloka'i, Hawaii in 1902 to mitigate the effects of soil erosion and they have since spread along the coast and to adjacent islands creating novel habitat. Non-native mangroves in Hawai'i present a unique case study to examine diverse social attitudes and perceptions resulting from a long history of land cover transformations on the Hawaiian Islands, socio-cultural diversity of involved stakeholders, and the potential …

Who Wrote The Books: A History Of The History Of Student Affairs, Anna L. Patton Dec 2017

Who Wrote The Books: A History Of The History Of Student Affairs, Anna L. Patton

Journal of Critical Scholarship on Higher Education and Student Affairs

This historiography offers a critique of the common narrative of student affairs history by considering the ways in which the history of student affairs is mediated by those scholars writing the texts. Student affairs professionals and scholars are regularly engaged in reflection on current practices, trends, and concerns within the field; however, it is equally important to continue looking back into our professional history. In this paper, I employ a process of historiography to critique the way in which the history of student affairs is mediated by those scholars writing the texts. A historiography seeks to tell the history of …

Field Investigations On The American Dog Tick, Dermacentor Variabilis, In Northwest Ohio (Acari: Ixodidae), Kelly M. Micher, C. Lee Rockett Dec 2017

Field Investigations On The American Dog Tick, Dermacentor Variabilis, In Northwest Ohio (Acari: Ixodidae), Kelly M. Micher, C. Lee Rockett

The Great Lakes Entomologist

Ecological investigations on the American dog tick, Dermacentor variabilis, were conducted in two metroparks located in Lucas County, Ohio. Adult tick surveys were conducted in 1989 and 1990. For both years, adult tick activity began in late April, and adult ticks were most abundant from early May to mid-June. Observed activity had ceased by early August, producing a unimodal pattern of activity. Sunny days with temperatures between 24 ° and 32°C were most conducive to adult tick activity, and adult ticks were most abundant on grass trails and in meadows. Using nest boxes inhabited by white-footed mice, immature tick …

United States V. Osage Wind, Llc, Summer Carmack Dec 2017

United States V. Osage Wind, Llc, Summer Carmack

Public Land & Resources Law Review

The Osage Nation, as owner of the beneficial interest in its mineral estate, issues federally-approved leases to persons and entities who wish to conduct mineral development on its lands. After an energy-development company, Osage Wind, leased privately-owned surface lands within Tribal reservation boundaries and began to excavate minerals for purposes of constructing a wind farm, the United States brought suit on the Tribe’s behalf. In the ensuing litigation, the Osage Nation insisted that Osage Wind should have obtained a mineral lease from the Tribe before beginning its work. In its decision, the Tenth Circuit applied one of the Indian law …

Toward A Deeper Appreciation Of Participatory Epistemology In Community-Based Participatory Research, Karie Jo Peralta Dec 2017

Toward A Deeper Appreciation Of Participatory Epistemology In Community-Based Participatory Research, Karie Jo Peralta

PRISM: A Journal of Regional Engagement

The purpose of this article is to advance an understanding of a key philosophical underpinning that is necessary for projects to become authentically community-based, that is, an epistemology that is “participatory.” This theory of knowledge has critical importance for realizing Community-based Participatory Research (CBPR) in regions around the world. To demonstrate the significance of participatory epistemology in CBPR, this article examines and rethinks traditional CBPR approaches through a community-based lens, presents a critical understanding of the link between CBPR theory and practice, and offers a perspective to move beyond the typical theory-practice debate. The central message for future community-engaged scholars …

Community Engagement In A Former Steel Town: The Role Of A Living-Learning Community, Stephanie A. Wilsey, Alicia M. Welty, Wendy V. Whelpley Dec 2017

Community Engagement In A Former Steel Town: The Role Of A Living-Learning Community, Stephanie A. Wilsey, Alicia M. Welty, Wendy V. Whelpley

PRISM: A Journal of Regional Engagement

Prior research indicates that Living-Learning Communities (LLC's) can help promote college students' community engagement. This applied research, a mixed-methods program evaluation, investigated the extent to which an LLC situated in a mid-Atlantic former steel town enhanced college students' community engagement and feelings of attachment to the community. The evaluation involved interviewing and surveying current and past students from the LLC as well as community neighbors living near the LLC. Results indicated that students increased their feelings of connectedness to the community and neighbors expressed a desire for long-term engagement with City House. The program evaluation suggested multiple contributors to student-community …

Reciprocity And Reflection In Community-Based Study Abroad Courses In Rural Costa Rica, Genny D. Ballard, Sarah Murray Dec 2017

Reciprocity And Reflection In Community-Based Study Abroad Courses In Rural Costa Rica, Genny D. Ballard, Sarah Murray

PRISM: A Journal of Regional Engagement

This manuscript will examine two high-impact practices in academia, community-based learning, and study abroad. The authors discuss the benefits of both practices and how pairing the two can benefit not only future educators but future leaders. This model provides students with the opportunity to become more globally competent through their time in another culture. Throughout this immersion, college students taught English in the context of reading, mathematics, science, or social studies. Critical and analytical reflection was a significant aspect of their college course. At the conclusion of their community-based study abroad course, students were asked to synthesize a final report …

This paper provides an overview of the pilot project, which was implemented at two Remke Market stores, the preliminary findings, and the lessons learned from working with multiple partnering agencies.

Close Enough For Government Work: Proving Minimal Nexus In A Federal And Firearms Conviction: United States V. Corey, Barbara H. Taylor Dec 2017

Close Enough For Government Work: Proving Minimal Nexus In A Federal And Firearms Conviction: United States V. Corey, Barbara H. Taylor

Maine Law Review

In United States v. Corey, Alvin Scott Corey was found guilty of possessing a firearm as a felon. Although Corey's possession of a Smith and Wesson shotgun violated Maine law, Corey was prosecuted in the United States District Court under the federal statute 18 U.S.C. § 922(g)(1) and its penalty statute, § 924(e). On appeal, Corey argued that one of the requirements for his conviction, proof of the statute's jurisdictional element, had not been satisfied because that proof rested on expert testimony based, in part, on hearsay. The First Circuit Court of Appeals, in a split decision, affirmed Corey's conviction, …

Protective Claims For Refund: Protecting The Interests Of Taxpayers And The Irs, Kristy M. Bowden Dec 2017

Protective Claims For Refund: Protecting The Interests Of Taxpayers And The Irs, Kristy M. Bowden

Maine Law Review

The Internal Revenue Code provides taxpayers wishing to claim a refund of an overpayment of taxes with a simple, straightforward provision setting forth a taxpayer's right to make such a claim. Additionally, regulations exist that provide for the procedure to be followed in order to claim a refund, further clarifying what is expected of the taxpayer. Unfortunately, not all situations that give rise to the right to claim a refund are so straightforward and simple. Taxpayers may find themselves in a situation that seems to have very little direct connection with tax, but may nonetheless result in significant tax consequences. …

Scientific Evidence And Forensic Science Since Daubert: Maine Decides To Sit Out On The Dance, Thomas L. Bohan Dec 2017

Scientific Evidence And Forensic Science Since Daubert: Maine Decides To Sit Out On The Dance, Thomas L. Bohan

Maine Law Review

In 1993, the Supreme Court of the United States stated that with the federal adoption of statutory rules of evidence in 1975, the common law rule for determining admissibility of scientific testimony was superseded, and that thenceforth admissibility of scientific testimony was to be determined solely by Federal Rule of Evidence 702 (Rule 702). The Frye standard had been adopted in one form or another by most of the federal circuits and by many of the state courts during the 70 years preceding Daubert. Referred to as the “general acceptance” standard, the Frye standard--although adopted in a variety of forms--had …

An Economic Analysis Of The Law Surrounding Data Aggregation In Cyberspace, Johnathan M. H. Short Dec 2017

An Economic Analysis Of The Law Surrounding Data Aggregation In Cyberspace, Johnathan M. H. Short

Maine Law Review

The emergence of technological advances has traditionally created new and unique legal problems. The solutions to counter these problems are often drawn from our legal traditions and adapted to an ever-modernizing world. However, as Professor Coase opined at the dawn of the communication technology revolution, “lawyers and economists should not be so overwhelmed by the emergence of new technologies as to change the existing legal and economic system without first making quite certain that this is required.” Examination and reflection, in other words, is paramount to instituting a sound legal framework to encompass developing legal problems in technology. This Article …

Desperately Seeking Solutions: Using Implementation-Based Solutions For The Troubles Of Information Privacy In The Age Of Data Mining And The Internet Society, Tal Z. Zarsky

Maine Law Review

Our personal information is constantly being recorded, stored and analyzed. Commercial entities watch our every action, storing this data and analyzing it in conjunction with information acquired from third parties. These entities use this knowledge to their benefit (and at times, our detriment) by discriminating between various customers on the basis of this personal information. At the same time, in the media market, large conglomerates can now provide specifically tailored content to individual customers on the basis of such data, thus potentially controlling their perspectives and impairing their autonomy. The expanding use of data mining applications, which enable vendors to …

Freeing The Mind: Free Software And The Death Of Proprietary Culture, Eben Moglen Dec 2017

Freeing The Mind: Free Software And The Death Of Proprietary Culture, Eben Moglen

Maine Law Review

The subject matter we are going to talk about is variously named and the words have some resonances of importance. I am going to use the phrase “Free Software” to describe this material, and I am going to suggest to you that the choice of words is relevant. We are talking not merely about a form of production or a system of industrial relations, but also about the beginning of a social movement with specific political goals, which will characterize not only the production of software in the twenty-first century, but the production and distribution of culture generally.

Tahoe-Sierra Preservation Council, Inc. V. Tahoe Regional Planning Agency: The Reemergence Of Penn Central And A Healthy Reluctance To Craft Per Se Regulatory Takings Rules, Philip R. Saucier Dec 2017

Tahoe-Sierra Preservation Council, Inc. V. Tahoe Regional Planning Agency: The Reemergence Of Penn Central And A Healthy Reluctance To Craft Per Se Regulatory Takings Rules, Philip R. Saucier

Maine Law Review

In Tahoe-Sierra Preservation Council, Inc. v. Tahoe Regional Planning Agency, the Supreme Court held that a moratorium on development imposed during the process of devising a comprehensive land use plan did not constitute a per se taking of property requiring compensation under the Takings Clause of the United States Constitution. The scope of Tahoe-Sierra, and thus its ultimate impact on Supreme Court takings jurisprudence, had been severely narrowed and redefined by the courts since the landowners first alleged a taking over fifteen years before the issue was ultimately decided by the Supreme Court. It is important to note that this …

Budzko V. One City Center Associates Limited Partnership: Maine's Unique Approach To Business Owners' Duty To Remove Ice And Snow, Jennifer A.W. Williams

Maine Law Review

In February 2001, the Maine Supreme Judicial Court, sitting as the Law Court, decided for the first time in Budzko v. One City Center Associates Limited Partnership, what duty of care a business landowner owes to business invitees regarding the accumulation of ice and snow during a storm. Terry Budzko slipped and fell as she was exiting One City Center, the building in which her employer leased office space. The steps had not been shoveled or sanded and a snowstorm had been progressing throughout the day. The Law Court, placing heavy reliance on the factor of foreseeability, held that “[b]usiness …

Beyond The Reach Of States: The Dormant Commerce Clause, Extraterritorial State Regulation, And The Concerns Of Federalism, Peter C. Felmly Dec 2017

Beyond The Reach Of States: The Dormant Commerce Clause, Extraterritorial State Regulation, And The Concerns Of Federalism, Peter C. Felmly

Maine Law Review

The Commerce Clause of the United States Constitution provides that “[t]he Congress shall have Power ... [t]o regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.” Interpreting this explicit grant of power to Congress, the Supreme Court has long recognized the existence of an implied limitation on the power of a state to legislate in areas of interstate commerce when Congress has remained silent. Under what is referred to as the negative or “dormant” Commerce Clause, the federal courts have thus scrutinized state legislation for well over one hundred years. In the past several …

Taking Care Of Business And Protecting Maine's Employees: Supervisor Liability For Employment Discrimination Under The Maine Human Rights Act, Katharine I. Rand Dec 2017

Taking Care Of Business And Protecting Maine's Employees: Supervisor Liability For Employment Discrimination Under The Maine Human Rights Act, Katharine I. Rand

Maine Law Review

On the heels of federal legislation prohibiting employment discrimination most states, including Maine, have enacted their own civil or human rights statutes aimed at eliminating discriminatory behavior in the workplace. Like its federal counterpart, Title VII of the Civil Rights Act of 1964 (Title VII), the Maine Human Rights Act, enacted in 1971, prohibits employers from discriminating on the basis of race, gender, age, religion, or national origin and provides a civil remedy for victims of employment discrimination. Moreover, like Title VII, the question of just who constitutes a liable “employer” under the Maine Human Rights Act has been the …

Hiv And The Ada: What Is A Direct Threat?, Dawn-Marie Harmon Dec 2017

Hiv And The Ada: What Is A Direct Threat?, Dawn-Marie Harmon

Maine Law Review

Anne, a surgical technician at a local hospital, recently learned that she was HIV-positive. She works in the emergency room and, as a part of her job, she hands surgical instruments to doctors performing emergency surgery. It is a fast paced and unpredictable environment. Her hands often come in contact with sharp instruments. Although Anne has never put her hands into a patient's body cavity, there is a remote possibility that she may need to do so in the future. There is always a possibility, however small, that she will cut herself and come into blood-to-blood contact with a doctor …

Time To Reconsider Nullum Tempus Occurrit Regi - The Applicability Of Statutes Of Limitations Against The State Of Maine In Civil Actions, Sigmond D. Schutz Dec 2017

Time To Reconsider Nullum Tempus Occurrit Regi - The Applicability Of Statutes Of Limitations Against The State Of Maine In Civil Actions, Sigmond D. Schutz

Maine Law Review

Many states, including the State of Maine, take the position that they have, essentially, an infinite time within which to bring a civil action. The basis for the State's claim of immunity from statutes of limitations is the old English common law doctrine, “nullum tempus occurrit regi”-- literally, no time runs against the King--which purports to exempt the State from statutes of limitations of general applicability unless statutes expressly provide otherwise. There has not been a Maine Supreme Judicial Court (Law Court) opinion mentioning the nullum tempusdoctrine since 1955, but the doctrine continues to be actively asserted by the State …

Ethics, Law Firms, And Legal Education, Milton C. Regan Jr. Dec 2017

Ethics, Law Firms, And Legal Education, Milton C. Regan Jr.

Maine Law Review

A rash of recent corporate scandals has once again put professional ethics in the spotlight. It's hard to pick up the Wall Street Journal each day and not read that authorities have launched a new investigation or that additional indictments are imminent. Stories of financial fraud and outright looting have galvanized the public and shaken the economy. What ethical lessons can we draw from these events? Two explanations seem especially prominent. The first is a story of individuals without an adequate moral compass. Some people's greed and ambition were unchecked by any internal ethical constraints. For such deviants, no amount …
