Norwegian Phrase, Devan Reische

USU Student Folklore Fieldwork

One of my grandmother’s favorite phrase, and I’m not going to get this right at all. One of her favorite phrases was, ‘Stor, Stor, sta litt, sta vett.' And that means ‘big head and little sense.’ And that was one of her favorite phrases. That’s lovely isn’t it. I am sure I got that a few times.

Body-positive groups such as Body Positivity, Fat Acceptance, and “Fitspiration” have millions of followers. This research dissects the rhetoric used in Instagram posts related to self-love and positive …

Improving The Social Behavior Of High School Students With Behavioral Challenges Through Self-Management Technology, Kathryn Dooley Dec 2017

Improving The Social Behavior Of High School Students With Behavioral Challenges Through Self-Management Technology, Kathryn Dooley

Doctoral Dissertations

Students with Emotional and Behavioral Disorders (EBD) struggle with social behaviors (Bradley, Henderson, & Monfore, 2004) such as distractibility and impulsivity (Wagner et al., 2004). Self-management strategies have been used effectively to increase on-task behavior and decrease off-task or inappropriate behavior of students with EBD (Briesch & Chafouleas, 2009a). Additionally, self-management applications for the Apple iPad have led to improvements in the social behavior of students with challenging behavior (Bruhn, Vogelgesang, Fernando., & Lugo, 2016; Bruhn, Vogelgesang, Schabilion, Waller, & Fernando, 2015b; Vogelgesang, Bruhn, Coghill-Behrends, Kern, & Thoughton, 2016). However, a gap in the literature in the use of self-management …

Sherlock Holmes Meets Rube Goldberg: Fixing The Entry-Into-Force Provisions Of The Comprehensive Nuclear Test Ban Treaty, David A. Koplow

Duke Journal of Comparative & International Law

The Comprehensive Nuclear Test Ban Treaty (CTBT) is widely heralded as the most important international legal instrument for arresting the nuclear arms race and impeding further nuclear proliferation. Concluded in 1996, the treaty has been signed by 183 countries and ratified by 166. But it has not yet entered into force, because of its unique requirement that it not become operational for any state until it has been ratified by all forty-four countries designated in its Annex 2. Thirty-six of those Annex 2 states have ratified, but there is little prospect that all of the other eight (including the United …

Superintendents’ Perceptions Of Online Education For Principals, David Rutledge Dec 2017

Superintendents’ Perceptions Of Online Education For Principals, David Rutledge

Student Theses and Dissertations

The proliferation of online educational leadership programs has led many aspiring principal candidates to complete their entire degree or licensure program online. While the online education is convenient and flexible for the learner, there is sparse research to determine the acceptability of online degrees in educational leadership, especially among school superintendents. School superintendents actively act as the gatekeepers into the field of educational leadership. The purpose of this study was to gather and analyze the perceptions of public school superintendents regarding online education for principals. The research questions posed sought to determine superintendent’s perceptions concerning the value of educational leaders …

Evaluation Of Cadmium Bioaccumulaiton Of Periphyton And Aquatic Invertebrates Within Tributaries Of The Buffalo National River, Jacob Rollins Mccauley

Student Theses and Dissertations

The Rush Mining District, located along the Buffalo River in Arkansas, has a significant history of metal-mining operations. The tails and spoils of these operations deposit heavy amounts of raw ore into streams, including the deposition of cadmium, a minor constituent. Periphyton and invertebrate samples from two creeks within the Rush Mining District were measured for cadmium. Additionally, two creeks with no history of mining were sampled. Periphyton samples from mining sites had significantly higher concentrations of cadmium than samples collected at control sites. Invertebrate samples were classified into trophic levels before analysis. Invertebrate samples collected at treatment sites only …

Respectability & The Quest For Citizenship, Angela M. Banks Dec 2017

Respectability & The Quest For Citizenship, Angela M. Banks

Brooklyn Law Review

Within the United States there is a long history of immigration and citizenship law and policy being shaped by the idea that certain immigrant populations are a threat to American society. Such ideas justified the Alien and Sedition Acts, the Chinese Exclusion Act, the enactment of new deportation grounds in 1917, and the adoption of national origin quotas in 1924. The repeal or revision of these laws has required discrediting the immigrant threat narratives justifying them. Immigrants have done this by demonstrating their respectability—their commitment and adherence to mainstream American values, norms, and practices. Scholars in the humanities and the …

The "Blurred Lines" Of Copyright Law: Setting A New Standard For Copyright Infringement In Music, Joseph M. Santiago Dec 2017

The "Blurred Lines" Of Copyright Law: Setting A New Standard For Copyright Infringement In Music, Joseph M. Santiago

Brooklyn Law Review

In 2014, rock legends Led Zeppelin were sued by a relatively obscure band, named Spirit, for copyright infringement over the use of their iconic 1971 song “Stairway to Heaven.” Just a year before, musicians Robin Thicke and Pharrell Williams found themselves in the same position over their hit song “Blurred Lines.” Both cases, tried in the Ninth Circuit through the same signature “extrinsic/intrinsic” infringement analysis, had different outcomes—Led Zeppelin was victorious, while Thicke and Williams lost. These differing outcomes help to accentuate the problem with applying the typical copyright infringement tests—ones used for any type of artistic medium—to music. Music …

"Waiting On The (Music) World To Change": Licensing In The Digital Age Of Music, Gabriella A. Conte Dec 2017

"Waiting On The (Music) World To Change": Licensing In The Digital Age Of Music, Gabriella A. Conte

Brooklyn Law Review

The music industry appears to be thriving with constant record breaking sales and more ways to listen to music than ever before. But behind the scenes, government regulation has struggled to adapt to changes in the industry, leaving industry players uncertain of the bounds of copyright. Decades ago, the two most prevalent Performing Rights Organizations—entities that collect royalties for songwriters and publishers based on public performances of their musical compositions—in the United States, ASCAP and BMI, entered into consent decrees to assuage antitrust concerns. Last amended over fifteen years ago, these decrees govern the music licensing practices of a vast …

Secrecy For The Sake Of It: The Defend Trade Secrets Act, Lauren Rayner Davis Dec 2017

Secrecy For The Sake Of It: The Defend Trade Secrets Act, Lauren Rayner Davis

Brooklyn Law Review

With foreign economic espionage and national security concerns thrust to the forefront of the discussion, Congress nearly unanimously passed the Defend Trade Secrets Act after a concerted effort by the executive branch, federal law enforcement, and intellectual property scholars. While this landmark legislation provides the long sought-after grounds of original federal jurisdiction for trade secret misappropriation claims, the statute also offers litigants a powerful remedy—the ex parte seizure provision. This unprecedented provision in trade secrets law allows a plaintiff, with no notice to the defendant, to file an application with the court requesting that U.S. Marshals seize and hold the …

Strictly Speaking: Courts Should Not Adopt Strict Scrutiny For Firearm Regulations, Andrew Kimball Dec 2017

Strictly Speaking: Courts Should Not Adopt Strict Scrutiny For Firearm Regulations, Andrew Kimball

Brooklyn Law Review

A militia right or an individual right? In District of Columbia v. Heller, the Supreme Court of the United States declared that the Second Amendment protects an individual’s right to a firearm outside the context of a militia. While pronouncing the individual right to a gun as fundamental, the Court declined to define an appropriate standard of review to assess firearm regulations. Thus, the Heller decision opened the floodgates for legal challenges to firearm regulations across the nation. Absent direction from the Supreme Court, many lower courts reacted by applying intermediate scrutiny, but in Kolbe v. Hogan the Fourth Circuit …

Circuit Rift Sends Sound Waves: An Interpretation Of The Copyright Act's Scope Of Protection For Digital Sampling Of Sound Recordings, Elyssa E. Abuhoff Dec 2017

Circuit Rift Sends Sound Waves: An Interpretation Of The Copyright Act's Scope Of Protection For Digital Sampling Of Sound Recordings, Elyssa E. Abuhoff

Brooklyn Law Review

Digital sampling of sound recordings itself has become an art—an art that has given rise to hit songs that have out-charted the songs they sampled. Yet there is a debate within the music industry and legal field over whether there is a de minimis exception for the unauthorized use of sound recordings. In the summer of 2016, in VMG Salsoul, LLC v. Ciccone, the Ninth Circuit departed from the Sixth Circuit’s unpopular 2006 decision in Bridgeport Music, Inc. v. Dimension Films by holding that the Copyright Act allows for a de minimis exception for the unauthorized use of sound recordings. …

Effectiveness Of Social Work Reentry Programs At Preventing Recidivism, Daniel C. Grijalva

Publications and Research

Each year in the United States, thousands of individuals are released from prisons and must reintegrate into society. Ensuring these individuals obtain adequate employment upon release is key to keeping them from returning to the penal system. This paper examines different social work programs that attempt to secure employment for ex-offenders. This paper reviews the obstacles these programs face and considers how social workers can improve the effectiveness of these programs at preventing recidivism. This paper acknowledges that some of these programs have achieved moderate success in preventing recidivism but recognizes the need to research current programs’ methodologies so that …
