Current trends indicate the number of qualified sports officials continues to dwindle. Therefore, this research sought to better understand reasons for initial entry, continuation, and potential discontinuation with officiating, while also identifying problematic issues, and potential solutions. Content analysis was utilized to examine five open-ended online survey responses from 2,485 referees. The results indicate that Enjoyable Affiliation (58%) and Remuneration (14%) were key to referees becoming involved in officiating. Those two themes, Enjoyable Affiliation (75%) and Remuneration (14%), were also identified as important to retaining officials. Physical Limitations were mentioned by 58% of the respondents regarding why they plan to …

Frequency Of Chronic Gastrointestinal Distress In Runners: Validity And Reliability Of A Retrospective Questionnaire, Patrick B. Wilson

Human Movement Studies & Special Education Faculty Publications

Gastrointestinal (GI) symptoms may affect up to 90% of competitors during endurance races. Studies have typically assessed GI symptoms retrospectively or only over an acute timeframe, and information on the validity and reliability of the questionnaires employed is lacking. This investigation aimed to estimate the frequency of GI distress experienced by runners over 30 days and to establish the validity and reliability of a retrospective GI symptom questionnaire. Runners (70 men, 75 women) recorded GI symptoms with a prospective journal for 30 days. Retrospective GI symptom data were then collected after the 30-day period on two occasions within one week. …

Abortion In A Post-Truth Moment: A Response To Erwin Chemerinsky And Michele Goodwin, Aziza Ahmed Jan 2017

Abortion In A Post-Truth Moment: A Response To Erwin Chemerinsky And Michele Goodwin, Aziza Ahmed

Faculty Scholarship

In Abortion: A Woman’s Private Choice, Erwin Chemerinsky and Michele Goodwin respond to the crisis of abortion rights in our current political moment. While preserving the right to abortion is an ongoing challenge for reproductive-justice advocates and lawyers, the arrival of a new Republican administration led by Donald Trump and a Republican majority in the House and Senate heightens these concerns. In the face of ongoing and new threats to abortion access, Chemerinsky and Goodwin argue that abortion should be treated as a woman’s private choice. I agree with Chemerinsky and Goodwin, as all supporters of abortion rights should. …

The Selection Of Litigation Against Government Agencies: Evidence From China, Wei Cui, Zhiyuan Wang Jan 2017

The Selection Of Litigation Against Government Agencies: Evidence From China, Wei Cui, Zhiyuan Wang

All Faculty Publications

We test the relevance of the selection theory of litigation in a contemporary, civil law setting, using Chinese judicial data that span 25 years regarding lawsuits against government agencies. Civil law systems may be characterized by lower costs of litigation and lower rates of settlement than the U.S. legal system, and therefore the presence of selection effects cannot be assumed. We show that selection effects are indeed manifest in Chinese administrative litigation, and suggest that this may be explained by hidden or intangible litigation costs. Our test for selection effects builds on the approach of previous U.S. studies and potentially …

Flexible Regulation Scholarship Blossoms And Diversifies: 1980-2012, Cristie Ford Jan 2017

Flexible Regulation Scholarship Blossoms And Diversifies: 1980-2012, Cristie Ford

All Faculty Publications

This piece reviews the 198 US law review articles that were most influential within flexible regulation scholarship (which includes meta regulation, responsive regulation, reflexive law, principles based regulation, new governance, and more) between 1980 and 2012, which also discussed innovation. It is chapter 4 of a forthcoming book on financial innovation and regulation. The analysis demonstrates that across this time period, flexible regulation scholars advocated for regulatory structures that were permeable to three main non-legal forces: market forces, deliberation and community norms, and industry standards. The image that emerges is of a diverse scholarly community, within which many adopted economics-derived …

Paying For Attendance: Using Incentives To Combat Chronic Absenteeism, Madeline H. Meth

Faculty Scholarship

Students with poor attendance miss opportunities to learn social and academic skills.' They perform worse on achievement tests. 2 They are also less likely to graduate.3 A student who misses school in as early as the first grade is significantly more likely to eventually drop out of high school.4 Individuals who drop out see a significant loss in earnings and are more likely to be jobless; women who drop out make about 60% of what female high-school graduates earn, and men who do not graduate lose approximately $9,564 in annual wages. Because high-school dropouts earn less than those …

Afterwards, the author examines the imposition of the death penalty on Puerto Rico and the challenges it has faced based on the due process of the fourteenth amendment. The article concludes with the stating how the death penalty is as another expression of the U.S. Congress plenary powers over …

Equality And The Defence Of Provocation: Irreconcilable Differences, Isabel Grant, Debra Parkes Jan 2017

Equality And The Defence Of Provocation: Irreconcilable Differences, Isabel Grant, Debra Parkes

All Faculty Publications

Recent amendments to the defence of provocation have limited access to the defence to those who are provoked by conduct that, if prosecuted, would have been an indictable offence punishable by at least five years imprisonment. The paper argues that these amendments are both over- and under-inclusive and fail to confront the central problem surrounding provocation which is that it privileges loss-of-control rage often in the context of male violence against women or in response to same-sex advances. The paper supports the abolition of the defence of provocation but only if mandatory minimum sentences for murder are abolished providing trial …

Working Conditions For K-12 Distance & Online Learning Teachers In Canada, Michael K. Barbour

“Teacher unions in Canada have had concerns about developments in online learning, but have generally been supportive if they have felt conditions were appropriate,” according to the Director of Research and Technology at the British Columbia Teachers’ Federation (BCTF). This sentiment has been echoed by the researchers involved in the annual State of the Nation: K- 12 E-Learning in Canada. These researchers have also underscored the fact that teacher unions have also been active in conducting research to investigate how teaching in the distance education and online learning environment is different than teaching in the classroom, and what impact that …

Characteristics Of Real-Time, Non-Critical Incident Debriefing Practices In The Emergency Department., Nur-Ain Nadir, Suzanne Bentley, Dimitrios Papanagnou, Komal Bajaj, Stephan Rinnert, Richard Sinert

Department of Emergency Medicine Faculty Papers

INTRODUCTION: Benefits of post-simulation debriefings as an educational and feedback tool have been widely accepted for nearly a decade. Real-time, non-critical incident debriefing is similar to post-simulation debriefing; however, data on its practice in academic emergency departments (ED), is limited. Although tools such as TeamSTEPPS® (Team Strategies and Tools to Enhance Performance and Patient Safety) suggest debriefing after complicated medical situations, they do not teach debriefing skills suited to this purpose. Anecdotal evidence suggests that real-time debriefings (or non-critical incident debriefings) do in fact occur in academic EDs;, however, limited research has been performed on this subject. The objective of …

Identifying Problems And Solutions In Changing State Legislation Regarding Licensed Clinical Social Workers Providing Private Independent Mental Health Services, Dianna Cooper-Bolinskey

All-Inclusive List of Electronic Theses and Dissertations

State regulated social work practice began in the 1960s; by the mid-1990s, all of the states within the United States regulated the profession through licensure. The purpose of licensure was ostensibly to protect the public and the profession; however, legislation defining social work practice varied vastly from state to state. The variation existed not only between states, but also within licensure categories with regard to the scope of practice of the social work profession. Licensed clinical social workers in some states could practice relatively independently, as they had the ability to diagnose, provide psychotherapy, and bill Medicaid, Medicare, and third …

Operationalizing Humility: A Model Of Situational Humility For Christian College Student Leaders, Scott T. Barrett

All-Inclusive List of Electronic Theses and Dissertations

This research study explored how college student leaders operationalize humility in their actions and what leads individuals to act with situational humility. There is a rise in narcissistic tendencies in college students (Twenge, Konrath, Campbell, & Bushman, 2008a, 2008b) and a decline in overall character traits (Burns, 2012; Hunter, 2000; Liddell & Cooper, 2012). Opposite the vice of narcissism sits the virtue of humility (Emmons, 2000; Exline & Geyer, 2004; Peterson & Seligman, 2004; Tangney, 2000). Using a grounded theory approach, the researcher looked to discover the process of humility development. Twenty six in depth interviews were conducted at three …
