The Effect Of Perpetrator Remorse, Victim Gender, And Photographer On Victim Blame In A Case Of Nonconsensual Photograph Sharing, Katlin J. Rhyner Jan 2017

The Effect Of Perpetrator Remorse, Victim Gender, And Photographer On Victim Blame In A Case Of Nonconsensual Photograph Sharing, Katlin J. Rhyner

Theses and Dissertations

Emotional expression is often used as a way to determine a person’s intent for social situations. In a courtroom, when a perpetrator expresses (or fails to express) remorse, not only the perception of the perpetrator may be altered, but also the perception of the victim. This difference may especially be the case in a situation where the victim is viewed as having a high level of culpability for the crime, such as if the victim took the picture and sent it. Furthermore, the gender of the victim of the crime may influence how the victim is perceived, such that women …

Walking In The City: Koji Nakano’S Reimagining And Re-Sounding Of The Tale Of Genji, Isabella Ramos Jan 2017

Walking In The City: Koji Nakano’S Reimagining And Re-Sounding Of The Tale Of Genji, Isabella Ramos

Scripps Senior Theses

Imagined Sceneries is a work written by composer Dr. Koji Nakano of Burapha University, Thailand for two sopranos, koto, light percussion, narrations, soundscapes recorded in Kyoto, Japan in December 2015, and digital projections of Ebina Masao’s 1953 print series Tale of Genji. Imagined Sceneries’ reimagining and “re-sounding” of Heian Kyoto relies on a balance between what is imagined and what is experienced in performance. Its many elements collectively explore multiple layers of Japanese histories, soundscapes, environments, and sensibilities. Using Michel de Certeau’s concepts of the city, this thesis journeys through Nakano’s imagined spaces.

Masculinity On Women In Japan: Gender Fluidity Explored Through Literature And Performance, Jessica M. Perreira

Scripps Senior Theses

The first half of my thesis are my translations from Yumi Hirosawa’s Onna O Aisuru Onnatachi. The first translation is excerpts from a high school girls journal documenting her realization and acceptance of being lesbian, and her time with her first girlfriend. The second translation is a report by a freelance writer on three different lesbian bars in Shinjuku Ni-Chome. The most notable bar is an onabe bar called Little Prince. Onabe in the simplest terms are women who dress and act like men. Onabe are important to the research portion of my thesis because they allowed me to research …

The Rise Of The Far Right: Explaining Popularity And Potential Influence, Vanessa Rosato Jan 2017

The Rise Of The Far Right: Explaining Popularity And Potential Influence, Vanessa Rosato

Scripps Senior Theses

The 2016 election cycle has shown a dramatic radicalization of the right, featuring elements such as out-group demonization, law and order rhetoric, and populist strategies that have not been so prevalent in the US since the rise of Nixon’s Silent Majority in the 1970s. The UK has experienced a similar ideological shift, though its emergence has perhaps not been so notoriously outspoken. All the same, the fervent anti-statist and anti-elitist narrative employed by the Leave Campaign is starkly similar to language historically associated with the populist rhetoric of the Far Right. Drawing on analyses of economic, socio-cultural, and geopolitical trends …

Edges Of Resting And Going: The Possibilities And Limitations Of Recovering From Chronic Fatigue Syndrome In A Dance-Training Environment, Daisy Sanders Jan 2017

Edges Of Resting And Going: The Possibilities And Limitations Of Recovering From Chronic Fatigue Syndrome In A Dance-Training Environment, Daisy Sanders

Theses : Honours

Chronic Fatigue Syndrome (CFS) is a common but poorly understood condition that includes limited exercise tolerance. Exercise undertaken via a balanced, holistic approach in which exertion is balanced with rest is recommended in recovery from CFS. This research project investigated how a contemporary dance-‐training environment can/cannot support recovery from CFS. This investigation is significant given that fatigue, burnout and overtraining are prevalent in dance-‐training environments. The project drew on the fields of exercise physiology and somatic inquiry to design a purpose-‐built program of Graded Exercise Therapy and implement it within a tertiary dance-‐training environment. The project was undertaken as practice-‐led …

The aim of the current study was to assess whether technical performance relates to positional running demands of elite Gaelic football players. Over a period of three years (2014–2016), four elite Gaelic football teams were monitored using GPS technologies. Four hundred and thirty-two individual player samples were collected from 52 competitive matches. Video analysis software was used to code technical performance indicators in all games. Pearson’s correlations were performed between all technical variables and total distance (m) and high-speed distance (≥17 km h−1). Total ball in play time had small to medium effects (r = .233 to .390, p …

Dangerous Liaisons: Social Science And Law In Domestic Violence Cases, Joan S. Meier Jan 2017

Dangerous Liaisons: Social Science And Law In Domestic Violence Cases, Joan S. Meier

GW Law Faculty Publications & Other Works

This article explores the fundamental differences between law and social science in how they ascertain truth, through examination of a popular domestic violence “typology” which is increasingly used in child custody litigation. The paper examines how courts and evaluators have used the typology to minimize or ignore a parent’s past domestic violence. It also reviews the empirical research to determine whether courts’ understandings of the typology’s “types” are empirically supported. Although the typology has been widely touted as empirically based, the research indicates significant contradictions and gaps in the research, and suggests that there is little empirical support for the …

Gender And The Tournament: Reinventing Antidiscrimination Law In An Age Of Inequality, Naomi R. Cahn, June Carbone, Nancy Levit Jan 2017

Gender And The Tournament: Reinventing Antidiscrimination Law In An Age Of Inequality, Naomi R. Cahn, June Carbone, Nancy Levit

GW Law Faculty Publications & Other Works

Since the 1970’s, antidiscrimination advocates have approached Title VII as though the impact of the law on minorities and women could be considered in isolation. This article argues that this is a mistake. Instead, Reinventing Antidiscrimination Law attempts to reclaim Title VII’s original approach, which justified efforts to dismantle segregated workplaces as necessary to both eliminate discrimination and promote economic growth. Using that approach, this Article is the first to consider how widespread corporate tournaments and growing gender disparities in the upper echelons of the economy are intrinsically intertwined, and how they undermine the core promises ofantidiscrimination law. The Article …

Jane The Virgin And Other Stories Of Unintentional Parenthood, Naomi R. Cahn, June Carbone Jan 2017

Jane The Virgin And Other Stories Of Unintentional Parenthood, Naomi R. Cahn, June Carbone

GW Law Faculty Publications & Other Works

In this article, we contrast the roles of intent, function, biology and marriage in establishing legal parenthood, focusing on differences between elite and non-elite reproduction. Central to these differences are the distinctions between intent at the time of conception and birth of a child versus the assumption of parental roles that occurs after birth, and between functional roles that correspond to formal agreements or institutions and those which arise through less formal arrangements.

LGBT families have used the concept of intent, as it originated in ART cases, to argue for recognition of families of choice, without either biological ties or …

Heteronormativity In Employment Discrimination Law, Naomi Schoenbaum Jan 2017

Heteronormativity In Employment Discrimination Law, Naomi Schoenbaum

GW Law Faculty Publications & Other Works

This symposium Essay responds to the EEOC’s new decision to interpret federal employment discrimination law’s ban on discrimination on the basis of sex to include a ban on discrimination on the basis of sexual orientation. It argues that although the EEOC’s decision does provide cause to celebrate, ongoing heteronormativity in federal employment discrimination law will continue to stand as a barrier to equal employment opportunity for gay workers. First, Title VII provides an exception to the sex discrimination ban in the context of intimate spaces, allowing, for example, only women to be hired to serve as labor and delivery nurses. …

The Evolution Of Global Legal Pluralism, Paul Schiff Berman Jan 2017

The Evolution Of Global Legal Pluralism, Paul Schiff Berman

GW Law Faculty Publications & Other Works

Global Legal Pluralism is now recognized as an entrenched reality of the international and transnational legal order. Indeed, wherever one looks, there is conflict among multiple legal regimes. Some of these regimes are state-based, some are built and maintained by non-state actors, some fall within the purview of local authorities and jurisdictional entities, and some involve international courts, tribunals, arbitral bodies, and regulatory organizations.

It has been approximately 20 years since scholars first began pushing the insights of legal pluralism into the transnational and international arena. During those two decades, a rich body of work has established pluralism as a …

Awareness As A First Step Toward Overcoming Implicit Bias, Cynthia Lee Jan 2017

Awareness As A First Step Toward Overcoming Implicit Bias, Cynthia Lee

GW Law Faculty Publications & Other Works

In this book chapter, Cynthia Lee explains that raising awareness of implicit bias is a necessary first step toward eliminating such bias. Lee discusses various ways legal actors can raise awareness about implicit bias, including implicit bias trainings and jury instructions attempting to educate jurors about implicit bias. She concludes that making racial bias (or other types of bias) salient is probably the most effective way to raise awareness of implicit bias in the courtroom setting and discusses the social science literature that supports this conclusion. In light of some studies suggesting that making bias salient may backfire, she suggests …

Accommodation For Adults With Intellectual Disability: Exploring The Lived Experiences Of Ageing Parent Carers And The Reasons Behind Their Decision To Continue To Care In The Family Home, Wendy Simpson Jan 2017

Accommodation For Adults With Intellectual Disability: Exploring The Lived Experiences Of Ageing Parent Carers And The Reasons Behind Their Decision To Continue To Care In The Family Home, Wendy Simpson

Theses: Doctorates and Masters

As life expectancy increases and mortality rates decrease, Australia is faced with an ageing population. This is particularly true of the population of people living with intellectual disability. Australian research has found that there is an increasing number of ageing parent-carers continuing to provide care for their adult child with an intellectual disability in the family home. Since deinstitutionalisation, many families made the choice to provide care at home, which may become a concern as they age and ask the question “who will care when I am gone?” The purpose of this study was to explore the reasoning behind decisions …

Little is known about the underlying factors that motivate Chinese nursing students to study in Australia, these students’ learning …

What Is English Now? The Construction Of Subject English In Contemporary Textbooks For Australian Secondary Schools, Shannon L. Wells Jan 2017

What Is English Now? The Construction Of Subject English In Contemporary Textbooks For Australian Secondary Schools, Shannon L. Wells

Theses: Doctorates and Masters

Australian educators are currently engaged in widening debates about the performance of the nation’s schools, teachers and students. Perceived literacy deficits among secondary students have fuelled the debate, and this has precipitated reforms to English curricula at both National and State levels. The newly revised curricula attempt to improve student achievement through more systematic teaching about the English language and language skills. In response to the changes, major education publishers in Australia have released revised textbooks for English that purport to engage with the new curriculum.

This research study considered whether such new resources offer genuinely fresh and effective approaches …

The Connection Between Drug Use And Crime In Western Australia, Kathryn Riordan Jan 2017

The Connection Between Drug Use And Crime In Western Australia, Kathryn Riordan

Theses: Doctorates and Masters

Despite decades of research, there is no consensus as to the factors that explain the association between drug use and criminal behaviour. While the evolving sophistication in research methodology has identified factors that are associated with involvement in both drug use and crime, exploration of the idiosyncratic factors that contribute to initiation, maintenance and desistence in drug use and criminal behaviour over time, across culture and social context remains unknown. In this research a grounded theory approach was used to develop an explanatory model based on the reported experiences of 22 non-Aboriginal and 11 Aboriginal adult male offenders, incarcerated in …

Workplace Bullying: An Exploratory Study In Australian Academia, Manish Sharma Jan 2017

Workplace Bullying: An Exploratory Study In Australian Academia, Manish Sharma

Theses: Doctorates and Masters

Workplace bullying is a behaviour which adversely affects individuals, organisations and the community at large. While substantial research has been conducted on workplace bullying in different work settings, limited research exists on this behaviour at universities; no comprehensive studies have to date been conducted in the context of Australian academia. This study therefore contributes through breaking new ground by exploring bullying within the increasingly corporatised and competitive Australian higher education sector. New Public Management (NPM) practices, diminished government funding, and limited resources risk transforming this sector into a full-fledged industry focused on corporate objectives to achieve operational profitability. Universities’ primary …

The Human Factors Associated With Responding To Emergency Vehicles, Pauline Grant Jan 2017

The Human Factors Associated With Responding To Emergency Vehicles, Pauline Grant

Theses: Doctorates and Masters

Emergency vehicles undertake emergency driving, using lights and sirens, to move rapidly through traffic in response to situations where life and property are at risk. For the emergency driving to be effective, other motorists need to drive in a manner that facilitates their passage. Despite laws to support this, problematic encounters can result in emergency vehicles being unable to get through. The current research expanded on earlier exploratory research into motorists’ encounters with emergency vehicles (Grant, 2010) to examine psychological factors involved with motorists’ responses to emergency vehicles. A construct validity approach was used to develop a scale …

Changes In Depressive Symptoms Among Older Adults With Multiple Chronic Conditions: Role Of Positive And Negative Social Supports, Sangnam Ahn, Seonghoon Kim, Hongmei Zhang

Research Collection School Of Economics

Depression severely affects older adults in the United States. As part of the social environment, significant social support was suggested to ameliorate depression among older adults. We investigate how varying forms of social support moderate depressive symptomatology among older adults with multiple chronic conditions (MCC). Data were analyzed using a sample of 11,400 adults, aged 65 years or older, from the 2006–2012 Health and Retirement Study. The current study investigated the moderating effects of positive or negative social support from spouse, children, other family, and friends on the association between MCC and depression. A linear mixed model with repeated measures …

Research outputs 2014 to 2021

Purpose

The purpose of this paper is to explore how HIWS may shape organisational capabilities, in particular organisational ambidexterity (OA) – the ability to be both adaptable to the wider world, and internally aligned so that existing resources are used well. Given the demands on public agencies to manage conflicting objectives, and to do more with less in increasingly complex environments, this paper improves our understanding of how HIWS can contribute to public sector performance. The paper sheds light inside the black box of the HIWS/organisational performance link.

Design/methodology/approach

This multi-level quantitative study is based on a survey of 2,123 …

Eat To Reproduce: The Role Of Diet Quantity On Honey Bee (Apis Mellifera) Caste Determination, Garett Slater Jan 2017

Eat To Reproduce: The Role Of Diet Quantity On Honey Bee (Apis Mellifera) Caste Determination, Garett Slater

Biological Sciences

The received wisdom is that diet quality drives this queen-worker dichotomy, even though diet quantity differs significantly between queen and worker diet. Diet quantity likely determines honey bee caste; yet it has never been explicated tested. In this paper, we tested the hypothesis of diet quantity induced caste determination by; first, determine the ubiquity of quantity induced caste systems among highly-related taxa; second, determining the relative contributions of diet quantity vs. diet quality on adult caste in honey bees; and third, determine the influence of diet quantity on important cellular and physiological pathways known during caste determination. I found that: …
