The Unbearable Lightness Of Alternative Dispute Resolution: Critical Thoughts On Fairness And Formality, Richard Delgado Jan 2017

The Unbearable Lightness Of Alternative Dispute Resolution: Critical Thoughts On Fairness And Formality, Richard Delgado

SMU Law Review

Years ago, I published Fairness and Formality: Minimizing the Risk of Prejudice in Alternative Dispute Resolution in Wisconsin Law Review. Arriving in the early years of the deformalization movement, Fairness and Formality sounded a warning about the risks this conflict resolution approach poses for disempowered disputants. Coming on the heels of an article in the same vein by Owen Fiss, Fairness & Formality attracted attention in part because its message ran counter to the prevailing ideology, according to which alternative dispute resolution is superior in many respects to the in-court variety—cheaper, faster, and friendlier, particularly for the uninitiated.

Soon, however, …

Implicit Bias And Prejudice In Mediation, Carol Izumi Jan 2017

Implicit Bias And Prejudice In Mediation, Carol Izumi

SMU Law Review

Mediators aspire and endeavor to meet their ethical duty of “neutrality” in mediation. Yet their ability to actually conduct mediations without bias, prejudice, or favoritism toward any party is extraordinarily difficult, if not impossible. Research shows that unconscious mental processes involving stereotypes and attitudes affect our judgments, perceptions, and behavior toward others. Implicit bias, the automatic association of stereotypes and attitudes with social groups, may produce discriminatory responses toward parties despite a mediator’s best efforts at creating an outwardly even-handed process. Even the most well-intentioned and egalitarian mediators must actively engage in bias reduction strategies to mitigate prejudice in mediation.

Effects Of Titania Phase And Tungsten Loading Content In W/Tio2 Catalysts On Dehydration Of Ethanol To Diethyl Ether, Pongsatorn Kerdnoi

Chulalongkorn University Theses and Dissertations (Chula ETD)

Nowadays, ethanol which is one of the most used renewable energies can be converted into the more valuable compounds. It was reported that titania-supported tungsten (W/TiO2) catalyst is able to convert ethanol into diethyl ether. However, titania support has different crystalline phases that can result in differences of physicochemical properties for the catalyst. Therefore, the present work reports on the catalytic behaviors of both different phases of titania and tungsten loading contents in catalytic ethanol dehydration to diethyl ether. To prepare the catalysts, the three different phases [anatase (A), rutile (R), and mixed phases (P25)] of titania supports were impregnated …

We report the discovery of two long-term intermittent radio pulsars in the ongoing Pulsar Arecibo L-Band Feed Array survey. Following discovery with the Arecibo Telescope, extended observations of these pulsars over several years at Jodrell Bank Observatory have revealed the details of their rotation and radiation properties. PSRs J1910+0517 and J1929+1357 show long-term extreme bimodal intermittency, switching between active (ON) and inactive (OFF) emission states and indicating the presence of a large, hitherto unrecognized underlying population of such objects. For PSR J1929+1357, the initial duty cycle was f ON = 0.008, but two years later, this changed quite abruptly to …

Female Student Veterans: A Survey Of Current Transition Challenges And Issues From Active Duty To Collegiate Life, Nicole Starr Biondoletti

Theses and Dissertations

Research on the student veteran population is extremely limited. The literature does tell us, however, that mental health difficulties in veterans has been present for thousands of years, and that recent warfare has led to a steady increased in posttraumatic stress and suicidality. In addition, there has been an exponential increase in veterans enrolling in post-secondary institutions due to the appealing benefits of the post-9/11 GI Bill. The result of these two facts are a relatively new population with unique challenges and needs. The present study utilized the PTSD Checklist, Military version (PCL-M), the Suicidal Behaviors Questionnaire-Revised (SBQ-R), the Combat …

Chulalongkorn University Theses and Dissertations (Chula ETD)

Cryptorchidism is one of the most common congenital abnormalities observed in boars. One of the important obstacles to produce good quality pork is cryptorchidism. Pigs with cryptorchidism cause defects in spermatogenesis, low conception rate and/or infertility. This odor can be the cause of economic loss because consumers reject to buy meat with boar taint and flavor. In fattening farm, multi-sire mating system is normally used. Molecular genetic techniques allow the possibility of testing on genetic and parentage control. This research aimed to study i. To optimize microsatellite markers and develop the DNA fingerprint technique used to identify the parentage of …

Non-Hermiticity-Induced Flat Band, Hamidreza Ramezani Jan 2017

Non-Hermiticity-Induced Flat Band, Hamidreza Ramezani

Physics & Astronomy Faculty Publications

We demonstrate the emergence of an entire flat band with no complex component embedded in dispersive bands at the exceptional point of a PT -symmetric photonic lattice. For this to occur, the gain and loss parameter effectively alters the size of the partial flat band windows and band gap of the photonic lattice simultaneously. The mode associated with the entire flat band is robust against changes in the system size and survives even at the edge of the lattice. Our proposal offers a route for controllable localization of light in non-Hermitian systems and a technique for measuring non-Hermiticity via localization.

Verlinde proposed that the observed excess gravity in galaxies and clusters is the consequence of emergent gravity (EG). In this theory, the standard gravitational laws are modified on galactic and larger scales due to the displacement of dark energy by baryonic matter. EG gives an estimate of the excess gravity (described as an apparent dark matter density) in terms of the baryonic mass distribution and the Hubble parameter. In this work, we present the first test of EG using weak gravitational lensing, within the regime of validity of the current model. Although there is no direct description of lensing and …

Recasting The Founding Fathers: The Tea Party, Neoliberalism, And American Myth, Calvin Coker Jan 2017

Recasting The Founding Fathers: The Tea Party, Neoliberalism, And American Myth, Calvin Coker

Faculty and Staff Scholarship

This article analyzes representative texts from the Tea Party Movement (TPM), a conservative American political movement, to demonstrate the TPM uses the myth of the Founding Fathers as an argumentative strategy to craft and justify a sanitary neoliberal political project. The necessity of such of a project lies in the underlying democratic crisis of neoliberalism, a crisis navigated by the TPM through strategic use of political myth. Neoliberal policies require, in many instances, democratic consent, though those policies often serve to disenfranchise many of the groups supporting them. This essay argues the TPM uses myth for the purpose of creating …

Murder, Miscarriage, And Women’S Choice: Prudence In The Colorado Personhood Debate, Calvin Coker Jan 2017

Murder, Miscarriage, And Women’S Choice: Prudence In The Colorado Personhood Debate, Calvin Coker

Faculty and Staff Scholarship

This article analyzes texts circulated in the 2014 debate over Colorado’s Amendment 67, the so-called Personhood Amendment, to demonstrate that value claims within the abortion debate are subordinated in favor of discussing the potential legal and philosophical implications of granting fetuses personhood. Using prudence, Robert Hariman’s (1991) framework for understanding political action, as a theoretical lens, I argue the personhood debate offers scholars an opportunity to identify and evaluate competing value claims of and in relation to potential impacts of the amendment. Prudence offers a compelling area for political communication and rhetorical scholars to expand and develop in light of …

An Introduction To Ricci Flow For Two-Dimensional Manifolds, Paul Bracken Jan 2017

An Introduction To Ricci Flow For Two-Dimensional Manifolds, Paul Bracken

School of Mathematical & Statistical Sciences Faculty Publications

The study of diferentiable manifolds is a deep an extensive area of mathematics. A technique such as the study of the Ricci flow turns out to be a very useful tool in this regard. This flow is an evolution of a Riemannian metric driven by a parabolic type of partial differential equation. It has attracted great interest recently due to its important achievements in geometry such as Perelman's proof of the geometrization conjecture and Brendle-Schoen's proof of the differentiable sphere theorem. It is the purpose here to give a comprehensive introduction to the Ricci flow on manifolds of dimension two …

Using Technology To Determine Factorability Or Non-Factorability Of Quadratic Algebraic Trinomials, John E. T. Bernard, Olga Ramirez, Cristina Villalobos Jan 2017

Using Technology To Determine Factorability Or Non-Factorability Of Quadratic Algebraic Trinomials, John E. T. Bernard, Olga Ramirez, Cristina Villalobos

School of Mathematical & Statistical Sciences Faculty Publications

This paper is aimed for mathematics educators who teach algebra, more specifically, the factoring of quadratic algebraic expressions, and who want to enhance student learning of this topic using technology in conjunction with the Middle Term Splitting Method (Donnell, 2010; MTSM 2016a; MTSM 2016b). We will use technology-based algebra and geometry connections to help determine factorability or nonfactorability of quadratic algebraic trinomials over the integers, over the real numbers, and over the complex numbers, both with clarity, certainty and with understanding by using two equations, one derived from the coefficients of the outer terms and the other from the middle …

Physics & Astronomy Faculty Publications

The first observation of a binary neutron star (NS) coalescence by the Advanced LIGO and Advanced Virgo gravitational-wave (GW) detectors offers an unprecedented opportunity to study matter under the most extreme conditions. After such a merger, a compact remnant is left over whose nature depends primarily on the masses of the inspiraling objects and on the equation of state of nuclear matter. This could be either a black hole (BH) or an NS, with the latter being either long-lived or too massive for stability implying delayed collapse to a BH. Here, we present a search for GWs from the remnant …

Can Experience Reduce Collisions Between Birds And Vehicles?, T. L. Devault, T. W. Seamans, Bradley F. Blackwell, S. L. Lima, M. A. Martinez, E. Fernandez-Juricic

United States Department of Agriculture Wildlife Services: Staff Publications

Bird collisions with vehicles cause serious safety, financial and conservation concerns worldwide, but the causes of such collisions are poorly described. We investigated how experience with vehicles influenced avian avoidance responses. We trained three groups of vehicle-naiıve rock pigeons Columba livia with 32 near-miss vehicle approaches over 4 weeks at 60 and 120 km h-1, and also included individuals that heard but did not see the approaches (control group). We subsequently measured flight initiation distance (FID) and whether individuals ‘collided’ with a virtual vehicle directly approaching at 120 or 240 km h-1 using video playback. We found …

Recent focus on climate change and global energy production has increased interest in developing biofuels including perennial native grasses (e.g. switchgrass [Panicum virgatum]) as viable energy commodities while simultaneously maintaining ecosystem function and biodiversity. However, there is limited research examining the effects of biofuel-focused grasslands on grassland bird reproductive success and conservation. In 2011–2013 we studied the effects of vegetation composition and harvest regimens of switchgrass monocultures and native warm-season grass (NWSG) mixtures on nest success, nest density, and productivity for dickcissels (Spiza americana) in Clay Co. MS, USA. There was no effect of vegetation metrics, …

Management And Modeling Approaches For Controlling Raccoon Rabies: The Road To Elimination, Stacey A. Elmore, Richard B. Chipman, Dennis Slate, Kathryn P. Huyvaert, Kurt C. Vercauteren, Amy T. Gilbert

United States Department of Agriculture Wildlife Services: Staff Publications

Rabies is an ancient viral disease that significantly impacts human and animal health throughout the world. In the developing parts of the world, dog bites represent the highest risk of rabies infection to people, livestock, and other animals. However, in North America, where several rabies virus variants currently circulate in wildlife, human contact with the raccoon rabies variant leads to the highest per capita population administration of post-exposure prophylaxis (PEP) annually. Previous rabies variant elimination in raccoons (Canada), foxes (Europe), and dogs and coyotes (United States) demonstrates that elimination of the raccoon variant from the eastern US is feasible, given …
