Enforcing Corporate Social Responsibility Codes Under Private Law: On The Disciplining Power Of Legal Doctrine, Jan M. Smits
Indiana Journal of Global Legal Studies
A central question in the debate on corporate social responsibility is to what extent CSR codes can be enforced among private parties. This contribution argues that this question is best answered by reference to the applicable doctrinal legal system. Such a doctrinal approach has recently regained importance in American scholarship, while it is still the prevailing method of legal analysis in Europe. Applying a doctrinal analysis of CSR codes allows for the possibility of private law enforcement, that is, enforcement by means of contract or tort, dependent on three different elements: the exact type of claim that is brought, the …

War On Drugs: A Prophetic Mission Of Resisting Evil, Albert E. Alejo, Manuel V. Francisco, Jojo M. Fung

This article critically examines the moral, theological, and human rights crises emerging from the violent "War on Drugs" campaign. Writing from a contextual Philippine perspective, the authors challenge state-sanctioned violence and extrajudicial killings by framing opposition as an imperative Christian duty. Grounded in Catholic social teaching and liberation theology, the paper argues that the Church must reclaim its prophetic mission to voice the plight of the marginalized and actively resist systemic evil. Ultimately, it calls for a pastoral approach rooted in restorative justice, human dignity, and communal healing rather than punitive bloodshed.

Catholic Girls All Grown Up: A Practical Theological Exploration Of Sexuality Formation In Young Adult Women, Emily Susanne Kahm

The Roman Catholic Church promotes exacting norms about the sexual behavior expected of Catholics, but prior qualitative and quantitative studies have shown a mixed effect on the decisions made by young adult Catholics, especially women. This qualitative study interviewed young adult women who were raised Catholic and sought to determine both what they were taught about sex and sexuality while growing up Catholic and how they think those teachings affected their lives and decision-making as young adults. Analysis of their responses indicated an anxious climate in their childhood educational experiences where adults were hesitant to answer questions or engage in …

In the 1993 encyclical Veritatis Splendor Pope John Paul II stated that the “morality of the human act depends primarily and fundamentally on the ‘object’ rationally chosen by the deliberate will.” Since that time the interpretation of the moral object has garnered increased attention among Thomist scholars. Yet it remains a source of dispute. Two scholars who take rather opposed views on what Aquinas means by the moral object are Martin Rhonheimer and Steven Long. Following the election of Donald Trump to the US Presidency, there was a surge in the number of racial and ethnic attacks on minorities across the country, and an increased concern over the place of minorities in the United States. The current regime of international human rights suffers from three shortcomings: First, it has failed to adequately address the reality of cultural diversity. Second, the formalized human rights treaties have been ineffective in their ability to compel states to reform their behaviors, and third, the uncontrolled growth in the number of human rights weakens the impact of appeals to that standard.
Although treated as independent problems, this paper finds that these three limitations are sufficiently linked such that a remedy to the first will simultaneously resolve the others. Parts I and II of the paper describe how the imposition of …

The first section of this article will describe what Restorative Justice is to get a better understanding of this alternative to the punitive criminal justice system. It will then describe the work done by the Community of Sant’Egidio in Rome through the lens of Restorative Justice. It will move on to the state of the criminal justice system in Cook County and the United States, particularly in how it treats criminal behavior. Individualism is a popular cultural trope in the United States, often touted for its promotion of industriousness and rejection of laziness. This essay argues that, ironically, America's brand of individualism actually promotes a more fundamental form of the very vice it purports to oppose. To make this case, the essay defines the unique form of individualism in the United States and then retrieves the classical definition of sloth as a vice against charity (not diligence), contrasting Aquinas and Barth with Weber to demonstrate that this peculiarly American individualist impulse undermines civic charity by reaping the benefits of civic relationships while …

Pope Emeritus Benedict XVI has elements of a cosmic eschatology embedded in his theological oeuvre that have not heretofore been extensively systematized. This dissertation fills this gap by contextualizing Benedict’s cosmic eschatology in the twentieth and twenty-first centuries, examining his Logos theology and his view on the fate of the cosmos, exploring his cosmic liturgy, and evaluating his concept of human ecology and pneumatology. Benedict insufficiently links his cosmic eschatology to his papal teachings on the environment; however, his cosmic eschatology can be developed in fruitful ways. Throughout Laudato Si’, Pope Francis decries what he calls the “throwaway culture.” At first blush, given the over-arching ecological theme of Laudato Si, this may seem to be solely a critique of wasteful consumerism. However, it is far more than that. It is a critique of a mindset and world view that discards people, promises, values and community bonds when they seem to lack immediately obvious or quantifiable value in the eyes of the world. The Spirit Of A Weak God: Reimagining Divine Providence After The Critique Of Ontotheology, Wendy Theresa Crosby

The question of this dissertation is whether and how divine providence can function within the framework of a weak God theology. While theories of divine providence traditionally depend on a powerful God capable of bringing all to a good end, I argue that providence remains essential to Christian hope and participation even if God is rethought as weak. This dissertation develops a concept of providence within weak God theology through an understanding of the Holy Spirit which is non-totalizing and dependent on creation's response. Therefore, providence empowers human action rather than ensuring victory despite our actions.

This Article examines issues posed by the equation of religious liberty with secular conscience, utilizing federal law and the law in those states which have adopted religious freedom restoration acts (RFRAs). The Article initially addresses the definition of religion through an examination of applicable literature and federal and state case law. The same approach is utilized to define conscience. The Article then examines similarities between the two concepts and the implications of their equivalence. The Article concludes that religion and conscience are moral equivalents that require equal legal treatment. However, equal treatment should proceed with caution in order to address …
