The Mobile Shopping Engagement: Surveys’ Review And Empirical Study, Eftychia Gkiolnta, Vaggelis Saprikis, Maro Vlachopoulou

Journal of Marketing and Consumer Behaviour in Emerging Markets

Mobile shopping (m-shopping) has become extremely signifi cant for both marketing and retail selling. Despite the fact that m-shopping has evolved into a popular alternative approach for purchasing products and services worldwide, the research regarding the extent of its adoption is still on a mediocre level and in certain countries, such as Greece, is rather limited. It is highly important to analyze and fully comprehend several factors that infl uence the acceptance of mobile technologies by consumers in order to motivate and support sellers’ mobile strategy. The objective of this research is to approach the factors that affect m-shopping with …

Respectability & The Quest For Citizenship, Angela M. Banks Dec 2017

Respectability & The Quest For Citizenship, Angela M. Banks

Brooklyn Law Review

Within the United States there is a long history of immigration and citizenship law and policy being shaped by the idea that certain immigrant populations are a threat to American society. Such ideas justified the Alien and Sedition Acts, the Chinese Exclusion Act, the enactment of new deportation grounds in 1917, and the adoption of national origin quotas in 1924. The repeal or revision of these laws has required discrediting the immigrant threat narratives justifying them. Immigrants have done this by demonstrating their respectability—their commitment and adherence to mainstream American values, norms, and practices. Scholars in the humanities and the …

The "Blurred Lines" Of Copyright Law: Setting A New Standard For Copyright Infringement In Music, Joseph M. Santiago Dec 2017

The "Blurred Lines" Of Copyright Law: Setting A New Standard For Copyright Infringement In Music, Joseph M. Santiago

Brooklyn Law Review

In 2014, rock legends Led Zeppelin were sued by a relatively obscure band, named Spirit, for copyright infringement over the use of their iconic 1971 song “Stairway to Heaven.” Just a year before, musicians Robin Thicke and Pharrell Williams found themselves in the same position over their hit song “Blurred Lines.” Both cases, tried in the Ninth Circuit through the same signature “extrinsic/intrinsic” infringement analysis, had different outcomes—Led Zeppelin was victorious, while Thicke and Williams lost. These differing outcomes help to accentuate the problem with applying the typical copyright infringement tests—ones used for any type of artistic medium—to music. Music …

"Waiting On The (Music) World To Change": Licensing In The Digital Age Of Music, Gabriella A. Conte Dec 2017

"Waiting On The (Music) World To Change": Licensing In The Digital Age Of Music, Gabriella A. Conte

Brooklyn Law Review

The music industry appears to be thriving with constant record breaking sales and more ways to listen to music than ever before. But behind the scenes, government regulation has struggled to adapt to changes in the industry, leaving industry players uncertain of the bounds of copyright. Decades ago, the two most prevalent Performing Rights Organizations—entities that collect royalties for songwriters and publishers based on public performances of their musical compositions—in the United States, ASCAP and BMI, entered into consent decrees to assuage antitrust concerns. Last amended over fifteen years ago, these decrees govern the music licensing practices of a vast …

Secrecy For The Sake Of It: The Defend Trade Secrets Act, Lauren Rayner Davis Dec 2017

Secrecy For The Sake Of It: The Defend Trade Secrets Act, Lauren Rayner Davis

Brooklyn Law Review

With foreign economic espionage and national security concerns thrust to the forefront of the discussion, Congress nearly unanimously passed the Defend Trade Secrets Act after a concerted effort by the executive branch, federal law enforcement, and intellectual property scholars. While this landmark legislation provides the long sought-after grounds of original federal jurisdiction for trade secret misappropriation claims, the statute also offers litigants a powerful remedy—the ex parte seizure provision. This unprecedented provision in trade secrets law allows a plaintiff, with no notice to the defendant, to file an application with the court requesting that U.S. Marshals seize and hold the …

Evidence Based Protocol: Improving Nutrition Monitoring In Hospitalized Adults, Philip W. Jackson

Master's Projects

Malnutrition affects a large number of adult inpatients. For these patients, the implications of the high rate of malnutrition include impaired wound healing, higher rates of infection, and an increased risk of death. These complications contribute to increased healthcare costs and longer lengths of stay. The level of monitoring and documentation of patients’ meal consumption was acknowledged to be below expectations in an acuity-adaptable neurosciences unit situated in a downtown hospital located in the Midwestern United States. The define-measure-analyze-improve-control (DMAIC) quality improvement framework guided the quality improvement team to develop a standard process for meal related activities. The rate of …

A city’s infrastructure consists of complex systems, such as sewage treatment plants, water treatment plants, police stations, fire departments, utility services, schools, libraries, business, houses, etc. A smart city, on the other hand, is an urban vision that fosters citizens’ engagement and technological integration of the city’s infrastructure. The purpose of this mixed-method action research was to identify the characteristics of a smart …

Video Review; Routine Data Sharing Practices Place Video-Streaming Providers In The Crosshairs Of The Video Privacy Protection Act, Jeremiah P. Ledwidge Dec 2017

Video Review; Routine Data Sharing Practices Place Video-Streaming Providers In The Crosshairs Of The Video Privacy Protection Act, Jeremiah P. Ledwidge

Brooklyn Journal of Corporate, Financial & Commercial Law

The Video Privacy Protection Act of 1988 (VPPA) creates a private cause of action for any consumer whose personally identifiable information has been disclosed by a video tape service provider to a third party. The rapid growth of media companies that provide free internet-based video-streaming services, and the technologically-advanced advertising methods employed to fund this business model, have created uncertainty regarding the specific consumer segments the VPPA is designed to protect. The extensive role that third-party providers play in the collection, analysis, and segmentation of user data in the personalized advertising process raises justifiable privacy concerns for consumers. Recent VPPA …

Student Theses and Dissertations

The proliferation of online educational leadership programs has led many aspiring principal candidates to complete their entire degree or licensure program online. While the online education is convenient and flexible for the learner, there is sparse research to determine the acceptability of online degrees in educational leadership, especially among school superintendents. School superintendents actively act as the gatekeepers into the field of educational leadership. The purpose of this study was to gather and analyze the perceptions of public school superintendents regarding online education for principals. The research questions posed sought to determine superintendent’s perceptions concerning the value of educational leaders …

Three Essays On Tax Abuse And The Fulfillment Of Economic And Social Rights, Ute Reisinger Dec 2017

Three Essays On Tax Abuse And The Fulfillment Of Economic And Social Rights, Ute Reisinger

Master's Theses

Global tax abuse is one of the key obstacles to sustainable development. Each year more than USD one trillion are lost to cross border tax abuse and stored away in tax havens. We establish that tax abuse accumulates capital, makes tax systems more regressive and diminishes government revenues. Tax abuse consequently indirectly increases economic inequality and relative poverty and reduces social expenditure affecting both dimensions of economic and social rights fulfillment: the ability of people to claim their rights in the market place or through the provision of entitlements. We test our theory in a cross-sectional study and find empirical …

The Impact Of Democratization And International Exposure To Indonesian Counter-Terrorism, Ali Abdullah Wibisono Dec 2017

The Impact Of Democratization And International Exposure To Indonesian Counter-Terrorism, Ali Abdullah Wibisono

Global: Jurnal Politik Internasional

This article explains the influence of the United States of America to Indonesian counter-terrorism. Two aspects of counter-terrorism are explained: effectiveness and adherence to human rights values. It argues that America’s emphasis on the need to forge security cooperation in responding to terrorism facilitated human rights values to be adopted as justification of counter-terrorism, rather than a balancer to its effectiveness. Indonesia’s cooperation with the U.S in counter-terrorism has facilitated the growth of the restitutive or kinetic measures, but neglects a strengthening of political leadership over institutional development of counter-terrorism. The latter can be judged from the absence of policy-evaluation, …

Antioxidant Trace Elements And Oxidative Stress Status In Dairy Cattle Suffering From Mastitis, Medhat Nassif, Hussam Ibrahim, Heba Moharam

Mansoura Veterinary Medical Journal

Mastitis is an inflammation of the mammary glands caused by several pathogens. Reactive oxygen species are natural end products of the intensive cellular metabolism. Oxidative stress occurs when there is a disturbance of homeostasis causing inflammation of the mammary gland. This study was performed to evaluate blood antioxidant profile and trace elements in dairy cows with clinical mastitis. For this aim, venous blood samples were collected from 116 cows (100 mastitic, 16 control). In cows with clinical mastitis, there was a significant (p < 0.05) increase in the clinical index score compared with control group. Biochemically, there was a significant (p < 0.05) decrease in super oxide dismutase, catalase and total antioxidant capacity as well as in the level of zinc. However, there was a significant (p < 0.05) increase in the levels of malondialdehyde and glutathione reductase as well as in that of copper. The results of the current study indicate that the body antioxidant defense system was compromised in dairy cows with clinical mastitis creating a state of oxidative stress.

Regional International Courts In Search Of Relevance: Adjudicating Politically Sensitive Disputes In Central America And The Caribbean, Salvatore Caserta Dec 2017

Regional International Courts In Search Of Relevance: Adjudicating Politically Sensitive Disputes In Central America And The Caribbean, Salvatore Caserta

Duke Journal of Comparative & International Law

The Central American and the Caribbean Courts of Justice (CACJ and CCJ) are hybrid judicial institutions. While their Member States envisioned them as "EU-style" regional economic courts, they have explored the whole extension of their formally delegated functions and have developed peculiar expertise in matters relating to freedom of movement, human and fundamental rights, and other politically fraught issues. The article explains how two International Courts (ICs) seemingly established to build common markets have come to adjudicate high-stakes political disputes, which, ostensibly, have little to do with regional economic integration. The article posits that the scholarship on delegation to ICs …
