Teenage Pregnancy, Parenting, And Abortion: Legal Limits On Adolescents' Reproductive Rights, Maya Manian Jan 2017

Teenage Pregnancy, Parenting, And Abortion: Legal Limits On Adolescents' Reproductive Rights, Maya Manian

Scholarly Articles in Law Reviews & Journals

As numerous scholars have noted, the law takes a strikingly incoherent approach to adolescent reproduction. States overwhelmingly allow a teenage girl to independently consent to pregnancy care and medical treatment for her child, and even to give up her child for adoption, all without notice to her parents, but require parental notice or consent for abortion. This chapter argues that this oft-noted contradiction in the law on teenage reproductive decision-making is in fact not as contradictory as it first appears. A closer look at the law's apparently conflicting approaches to teenage abortion and teenage childbirth exposes common ground that scholars …

The Commercial Appropriation Of Frame: A Cultural Analysis Of Right Of Publicity And Passing Off, Peter Jaszi Jan 2017

The Commercial Appropriation Of Frame: A Cultural Analysis Of Right Of Publicity And Passing Off, Peter Jaszi

Scholarly Articles in Law Reviews & Journals

Over several centuries, the rhetoric of 'gap filling' has often been invoked to naturalise expansions of intellectual property ("IP") rights-copyright term extension, the patenting of life forms, trademark disparagement, and so forth. The ready pragmatism of the phrase has definite audience appeal, making big changes sound like straightforward responses to external conditions-rather than choices about how to draw the line between private ownership and public discourse. We know, however, that once filled, 'gaps' tend to stay filled. Retrospective debates about the wisdom of such decisions tend to be (both literally and figuratively) of merely academic interest. So what is most …

Is The Future Of Law A Driverless Car? Assessing How The Data Analytics Revolution Will Transform Legal Practice, Eric L. Talley Jan 2017

Is The Future Of Law A Driverless Car? Assessing How The Data Analytics Revolution Will Transform Legal Practice, Eric L. Talley

Faculty Scholarship

Machine learning and artificial intelligence technologies (“data analytics”) are quickly transforming research and practice in law, raising questions of whether the law can survive as a vibrant profession for natural persons to enter. In this article, I argue that data analytics approaches are overwhelmingly likely to continue to penetrate law, even in domains that have heretofore been dominated by human decision makers. As a vehicle for demonstrating this claim, I describe an extended example of using machine learning to identify and categorize fiduciary duty waiver provisions in publicly disclosed corporate documents. Notwithstanding the power of machine learning techniques, however, I …

Introduction: Judges As Diplomats In Advancing The Rule Of Law: A Conversation With President Koen Lenaerts And Justice Stephen Breyer, Fernanda Nicola

Scholarly Articles in Law Reviews & Journals

Introduction. On both sides of the Atlantic, Western countries have taken a well publicized and perhaps poorly understood turn toward leaders espousing extremist, xenophobic, and introspective politics that threaten the core tenets of liberal democracy. Electorates appear divided and confused as political leadership in Europe and the U.S. take measures that undermine the basic principles of the rule of law and human rights. Above all else, the designated defenders of the constitutional order, the supreme courts, have come under direct political attack in countries such as Hungary and Poland. Even in traditional bastions of Western democracy, like the United States …

The Washington Redskins Case And The Search For Dignity, Victoria Phillips

Scholarly Articles in Law Reviews & Journals

INTRODUCTION: For more than sixty years, Native American activists have been involved in discussions and protests over the appropriation and use of tribal references in sports names, logos, and mascots. During this same period, many of these uses have since been changed, driven by civil rights struggles and a growing awareness of the proven social harms and racism inherent in these references. Despite a gradual movement towards abolition and evolving signs of cultural understanding, many mascots invoking Native names and imagery persist today across professional, collegiate, and local school district sports. These mascots and team names, and the trademarks associated …

Characterizing Risk Factors Of Adolescent Electronic Cigarette Use, Paul T. Enlow Jan 2017

Characterizing Risk Factors Of Adolescent Electronic Cigarette Use, Paul T. Enlow

Graduate Theses, Dissertations, and Problem Reports (ETD)

Use of electronic cigarettes (e-cigs, electronic vapor products) rose dramatically in the United States over the past decade and a half, most notably among high school students. This increase in use, coupled with concerns about renormalization of smoking and potential health risks, has raised concern that e-cigs represent a growing public health risk. Unfortunately, there is limited research on risk factors for e-cig use among teens, and many studies have methodological flaws that are unaddressed. The primary aim of the current study is to apply an empirically tested theory of health-risk behaviors in adolescents, Problem Behavior Theory (PBT), to lifetime- …

Development And Evaluation Of A Patient Decision Aid For The West Virginia Physician Order For Scope Of Treatment (Post), Jarred V. Gallegos

Graduate Theses, Dissertations, and Problem Reports (ETD)

Decision aids have been shown to be helpful for patients making medical decisions. The use of decision aids can increase patient knowledge, decrease decisional conflict, and increase overall satisfaction with the treatment decision made. The purpose of the study was to develop and evaluate a novel video decision aid for the West Virginia Physician Orders for Scope of Treatment (POST). There are no known decision aids developed to assist patients completing POST forms, thus there is a paucity of research investigating the nature, quality, and outcomes of the decision-making process of patients completing a POST form. Fifty English-speaking, community-dwelling older …

Ripple Effect Mapping Of Youth & Adult Dyad Pairs Demonstrating Community Impact From Icook 4-H Intervention, Sina J.E. King

Graduate Theses, Dissertations, and Problem Reports (ETD)

Introduction: Creating effective dissemination and implementation tools within community based, obesity prevention research is needed to bridge the current science to practice gap. Ripple Effect Mapping (REM) using Community Capitals Framework (CCF) is a community impact evaluation tool that is hypothesized to positively capture activity during dissemination within community programs. Although REM is a proposed impact evaluation method, it has not been widely adopted within the research sector. In order to facilitate the translation of research into evidenced based practice, a stepwise process must be described and tested to determine efficacy and effectiveness, followed by a method to translate findings …

Microbial Quality And Pathogen Decontamination Strategies For Locally-Grown, Fresh Produce From West Virginia And Kentucky, Ka Wang Li Jan 2017

Microbial Quality And Pathogen Decontamination Strategies For Locally-Grown, Fresh Produce From West Virginia And Kentucky, Ka Wang Li

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study aimed to evaluate the microbiological quality/safety of fresh produce from farmers' markets (FM) and assess the post-harvest washing practice with antimicrobials to inactivate Salmonella and Listeria monocytogenes on fresh produce. In study I, 212 produce samples were tested for the presence of Salmonella and Listeria spp. using modified FDA-BAM methods. Aerobic plate counts (APCs), total coliforms (TCCs), and yeast/molds were analyzed on petri-films. Among the 212 samples, the APCs, TCCs, and yeast/molds were 3.72-5.63, 3.67-5.47, and 3.07-4.13 log CFU/g, respectively, with spinach containing the highest (P<0.05) populations. Among all tested samples, Salmonella enterica spp. enterica was detected on 18.6% of spinach, 10.9% of tomatoes, 18.5% of peppers, and 56.3% of cantaloupes, which is much higher than previous reported. Only 3.78% of the samples were confirmed for Listeria spp., and 50% of them were identified as L. monocytogenes, based on multiplex PCR results. Due to the high percentage of pathogens detected on the farmers' marker produce, an evaluation of post-harvest produce washing with various antimicrobials was conducted in study II. Specifically, spinach, tomatoes, green peppers and cucumbers were inoculated with S. Typhimurium and Tennessee or L. monocytogenes and washed in tap water, vinegar water (10%), lactic acid (5%), a lactic and citric acid blend (2.5%), and sodium hypochlorite (200 ppm) for 30 sec or unwashed. Vinegar water (10%) showed better (P<0.05) reduction of S. Typhimurium and Tennessee on tomatoes and cucumbers, and L. monocytogenes on tomatoes and peppers than tap water. The three antimicrobials reached an additional reduction level of 0.9 to 2.7 (S. Typhimurium and Tennessee) and 0.2 to 1.4 log CFU/g ( L. monocytogenes) compared to tap water. Lactic acid caused the greatest (P<0.05) reduction of S. Typhimurium and Tennessee on spinach and green peppers, and sodium hypochlorite showed the great (P<0.05) reduction of L. monocytogenes on cucumbers. The results supplied important information for FM vendors to develop post-harvest protocols to control foodborne pathogens.

Computational Ultrasound Elastography: A Feasibility Study, Yu Wang Jan 2017

Computational Ultrasound Elastography: A Feasibility Study, Yu Wang

Dissertations, Master's Theses and Master's Reports

Ultrasound Elastography (UE) is an emerging set of imaging modalities used to assess the biomechanical properties of soft tissues. UE has been applied to numerous clinical applications. Particularly, results from clinical trials of UE in breast lesion differentiation and staging liver fibrosis indicated that there was a lack of confidence in UE measurements or image interpretation. Confidence on UE measurements interpretation is critically important for improving the clinical utility of UE. The primary objective of my thesis is to develop a computational simulation platform based on open-source software packages including Field II, VTK, FEBio and Tetgen. Design And Manufacturing Of Variable Stiffness Cellular Architecture, Ruinan Xie Jan 2017

Design And Manufacturing Of Variable Stiffness Cellular Architecture, Ruinan Xie

Industrial and Manufacturing Engineering

Cellular structures are highly evaluated due to their high material efficiency. Both theoretical and experimental studies have done on periodic cellular structures. However, the mechanical performance can be stochastically distributed in the cellular architecture. This thesis presents the design and manufacturing of variable stiffness cellular architecture to achieve optimized topology by changing the unit cell parameters. The author applies image analysis technique to extract and digitize the information from the performance distribution map. Two types of cellular cells are studied for their relationship of stiffness and relative density. The methods of voxelization for both cells are also given in this …

With the advent of social media and an ever-increasing demand for information, today’s users request more flexible spaces for a variety of uses including the traditional library, but also for e-government services, information literacy education, social liaisons, gaming, safe and neutral spaces for all kinds of public discourse and a host of other societal projects for all ages. An outstanding study of the library as place was captured a decade ago by John Buschman and Gloria Leckie.[i] …

A Framework For Profiling Prospective Students In Higher Education, Santhosh Kumar Lakkaraju, Deb Tech, Shuyuan Deng Jan 2017

A Framework For Profiling Prospective Students In Higher Education, Santhosh Kumar Lakkaraju, Deb Tech, Shuyuan Deng

Research & Publications

Prospective student acquisition is a prominent issue in higher education marketing. Noel-Levitz (2012) estimated that higher education institutions are losing as high as 75% of the prospects after receiving an inquiry. Another study reported that 80% of the students who decide to apply to a program were influenced by the post-inquiry communications they had received from the higher education institutions (Aarinen, 2012). This chapter attempts to study the underlying concepts from literature and design a framework to extract prospective student profiles and further extend a discussion on how these profiles can be used to address the prospect engagement.

Although, the usage of healthcare information systems (HIS) has provided many potential benefits such as enhancing the availability, accessibility and readability of information, healthcare information security has become a growing public concern. Most of the studies have shown the importance of sanctions, information security policy, and information awareness programs in reducing IS misuse behavior, but individuals may still tend to engage in inappropriate behaviors, especially under the context of disasters. The vulnerabilities and risks associated with the HIS could be very extreme under disasters, which may cause employees to misuse their HIS for the sake of delivery of health services …

I Love My Team! Factors Leading To A Relationship With A Sports Team., Carly Odom, Jamye Foster, Melanie Bruce Jan 2017

I Love My Team! Factors Leading To A Relationship With A Sports Team., Carly Odom, Jamye Foster, Melanie Bruce

AMTP Proceedings 2017

What makes people connect with a particular sports team? Sports marketing research typically focuses on the sport specific elements of loyalty (geography, family history, social interactions), and general marketing research also considers the emotional component. Going a step further, and examining the factors within the larger relationship context could improve our understanding of why people connect with certain sports teams. Therefore, the purpose of this research is to examine the impact of specific factors (socialization, proximity, attitude toward the team, and self-image congruence) on the initiation of a relationship with a sports team – which includes both the (1) development …

The Reason(S) Small, Private Schools Start Football Programs, Ania I. Rynarzewska, Steven R. Mcclung

AMTP Proceedings 2017

The number of college football programs in the United States currently totals 774, which is an all-time high. It’s clear there is a demand for football as there are 128 schools in 10 conferences at the highest level FBS and 125 schools participating at the second highest level, FCS. Both of these subdivisions are required to provide scholarships for players, making these two levels the most expensive for universities to offer (NCAA.com, ND).

There are a number of reasons that schools establish and fund football programs. At the highest level, there is a lot of money through media rights and …

The ‘Digital Native’ Myth And Marketing Simulation Success, Melanie Eva Bruce Jan 2017

The ‘Digital Native’ Myth And Marketing Simulation Success, Melanie Eva Bruce

AMTP Proceedings 2017

Simulations are increasingly popular as a method of teaching in business colleges as educators move away from passive learning towards more active/experiential learning (Young, Klemz, & Murphy, 2003). Simulations are designed to replicate real world experiences and have been shown to increase students’ enthusiasm, interest and involvement, and help them to connect theory to practice. Business course simulations are predominantly computer based online programs that allow students to make discipline specific decisions for a hypothetical company.

The generation born roughly between 1980 and 1994 has been characterised as ‘digital natives’ (Prensky, 2001a) or the ‘Net generation’ (Tapscott, 1998) because of …

Development Of Bio-Based Wood Adhesive By Using Cellulose Nanofiber Reinforcement And Crosslinking Agent For Improved Bonding Strength, Myungkeun Oh Jan 2017

Development Of Bio-Based Wood Adhesive By Using Cellulose Nanofiber Reinforcement And Crosslinking Agent For Improved Bonding Strength, Myungkeun Oh

Materials and Nanotechnology

Engineered woods, plywood, particle board, and oriented strand board, are widely used as a low-cost wood replacement in many applications. Many of the currently used wood adhesives contain chemicals that are harmful to human health and the environment. Increasing environmental and human health concerns have made the development of safe bio-based adhesives a priority. In this study, two plant proteins, zein from corn and wheat gluten, were used to develop wood adhesives. To increase their bond strength, cellulose nanofibers were added to create nanocomposite adhesives and a crosslinking agent was also used. Single-lap shear test, flexural and internal bond tests …

Mc-Ppea As A New And More Potent Inhibitor Of Clp-Induced Sepsis And Pulmonary Inflammation Than Fk866., Peixin Huang, Mark W Lee, Keivan Sadrerafi, Daniel P. Heruth, Li Q. Zhang, Dev Maulik, Shui Qing Ye

Manuscripts, Articles, Book Chapters and Other Papers

Our previous study indicated that overexpression of nicotinamide phosphoribosyltransferase (NAMPT) aggravated acute lung injury, while knockdown of NAMPT expression attenuated ventilator-induced lung injury. Recently, we found that meta-carborane-butyl-3-(3-pyridinyl)-2E-propenamide (MC-PPEA, MC4), in which the benzoylpiperidine moiety of FK866 has been replaced by a carborane, displayed a 100-fold increase in NAMPT inhibition over FK866. Here, we determined the effects of MC4 and FK866 on cecal ligation and puncture (CLP) surgery-induced sepsis in C57BL/6J mice. MC4 showed stronger inhibitory effects than FK866 on CLP-induced mortality, serum tumor necrosis factor α (TNFα) levels, pulmonary myeloperoxidase activity, alveolar injury, and interleukin 6 and interleukin1β messenger …

Knockdown Of Delta-5 Desaturase To Elicit Anti-Cancer Effect Of Dihomo-Γ-Linolenic Acid: Development Of An Ω-6 Fatty Acid-Based Therapeutic Strategy For Pancreatic Cancer, Xiaoyu Yang Jan 2017

Knockdown Of Delta-5 Desaturase To Elicit Anti-Cancer Effect Of Dihomo-Γ-Linolenic Acid: Development Of An Ω-6 Fatty Acid-Based Therapeutic Strategy For Pancreatic Cancer, Xiaoyu Yang

Pharmacy

Pancreatic cancer is one of the most common causes of cancer death in the United States. Unlike ω-3 fatty acids, which have been commonly used as complementary therapy to treat pancreatic cancer, ω-6s (more abundant fatty acids in the human diet) have received much less attention in cancer treatment due to generation of deleterious metabolites from cyclooxygenase (COX)-catalyzed peroxidation of arachidonic acid, a downstream ω-6. However, dihomo-γ-linolenic acid (DGLA), the immediate precursor of arachidonic acid, has been recently reported to be associated with some anti-cancer effects on various types of cancer cells. Recent studies from Dr. Qian’s lab have shown …
