Redefining Reality: Why Design Patent Protection Should Expand To The Virtual World, John R. Boulé Iii Jan 2017

Redefining Reality: Why Design Patent Protection Should Expand To The Virtual World, John R. Boulé Iii

American University Law Review

Virtual reality (“VR”) and augmented reality (“AR”) technologies are rapidly maturing. Companies like Facebook and Microsoft are capitalizing on these technologies and actively releasing products to consumers. Both companies’ products blur the line between the real world and the virtual world. The blurring of this line presents novel questions regarding the protection of digital intellectual property that exists solely within the virtual world.

One such question is whether design patent protection will be available to three-dimensional digital models, models of real-world items that are digitally reproduced in the virtual world. To receive design patent protection, 35 U.S.C. § 171 requires, …

Waste In Space: Remediating Space Debris Through The Doctrine Of Abandonment And The Law Of Capture, Emily M. Nevala Jan 2017

Waste In Space: Remediating Space Debris Through The Doctrine Of Abandonment And The Law Of Capture, Emily M. Nevala

American University Law Review

With the growing commercialization of outer space, the threat of damage to satellites from detritus hurtling through space could prevent the continued installation of satellites. The cure for this issue cannot simply come from mitigation efforts; governments and organizations involved in spacefaring activities must participate in active remediation measures. International space agency guidelines and U.S. statutes and regulations are productive preventative measures against further accumulation of debris. In addition, a number of organizations are working on new technology to actively reduce orbital debris. These active processes for culling debris from orbit are essential for the reduction of debris buildup.

An Analysis Of Campus Civility: Best Practices From Student Affairs Professionals, Amy Zieziula

College of Graduate Studies: Theses & Dissertations

Incivility on college campuses is an issue that can disrupt the learning environment and the retention of students, as well as harm the reputation of a college campus. This is a pertinent issue for leaders in higher education to address and to promote a more civil campus both inside and outside of the classroom. There is no research that addresses how Student Affairs Professionals best promote civility on college campuses, and this study fills that research gap. This qualitative study was conducted using Student Affairs Professionals at eight SUNY institutions. The Generational Theory and Work Place Incivility Theory were utilized …

Exploring Job Satisfaction And Preceptorship Capacity Among Applied Epidemiologists, Jessica C. Arrazola

College of Graduate Studies: Theses & Dissertations

Job satisfaction is important to consider when developing strategies for recruitment and retention. The Public Health Workforce Interests and Needs Survey (PH WINS) conducted in 2014 was the first nationally representative assessment of the state public health workforce. Prior to this assessment, the job satisfaction of state agency public health workers and preceptor capacity had not been measured. This study fills the current research gaps by studying the job satisfaction among the applied epidemiology workforce, identifying factors influencing job satisfaction, and the describing the preceptorship capacity among epidemiologists. This research is based on the 2014 PH WINS data. The analysis …

The Parton Paradox: A History Of Race And Gender In The Career Of Dolly Parton, Lindsey L. Hammers Jan 2017

The Parton Paradox: A History Of Race And Gender In The Career Of Dolly Parton, Lindsey L. Hammers

College of Graduate Studies: Theses & Dissertations

With a career that has spanned over five decades, country music artist Dolly Parton has continually redefined her image and her music to remain relevant. By incorporating the musical and lyrical stylings of disco and other popular music genres into her songs, Parton moved beyond music’s color line to increase her popularity as an artist. This thesis shows how Parton established a distinct career that catered to different audiences as she traversed the musical color line and repackaged what feminism looked like to country music fans during the Women’s Movement of the 1960s. Placing Parton’s actions in conversation with music’s …

Reducing Substance Abuse Stigma In Employment Application, Timothy W. Curran

College of Graduate Studies: Theses & Dissertations

A history of substance use and having a history of legal charges can be a barrier to employment. Available research shows individuals with a criminal history of substance related charges have greater difficulty obtaining employment due to the presence of substance abuse stigma and criminal history stigma. Research also shows that employers with higher levels of fundamentalism and conservativism are more likely to negatively evaluate applicants with a criminal history of substance charges. Furthermore, available research demonstrates employers in rural areas are more likely to deny employment to an individual with a legal history of substance charges based upon higher …

Teach Us To Teach You: Experiences Of Black Males In Urban High Schools In Georgia, Judy Ward Jan 2017

Teach Us To Teach You: Experiences Of Black Males In Urban High Schools In Georgia, Judy Ward

College of Graduate Studies: Theses & Dissertations

Why do we not ask our students what they need from us as teachers? This study is a look at my teaching through the eyes of my former students - ten black males in two urban high schools in Georgia. My research relies on critical race theory (Bell, 1992; Ladson-Billings & Tate, 2006) as a lens to analyze how institutional racism creates obstacles to black male achievement. I explore how an “opportunity gap” provides the foundation for an achievement gap between blacks and whites (Tate, 2008; Ladson-Billings, 2006a) that prevents black males from achieving academic success. I use counter-storytelling (Bell, …

Accounting For Taste In Irish Traditional Music, Eryn T. Wagnon

College of Graduate Studies: Theses & Dissertations

Although it is self-evident that people care about music, we don’t know how they make sense of their taste in it. In this study, I will explore how individuals explain their taste in music. I will specifically be focusing on the genre of Irish traditional music (ITM). One way to explore how people account for their taste in this genre is through a qualitative content analysis of online comments. I hope to demonstrate the vocabulary of motives for music preference, by focusing on how individuals account for their taste in Irish traditional music online. Also, this study will help show …

White Actors In The Civil Rights Movement: Social Progressives In Americus, Georgia, Garret A. Moye

College of Graduate Studies: Theses & Dissertations

This research explicates the complexity of race relations between whites and blacks during the mid-twentieth century by using the story of Koinonia Farm (now Koinonia Partners) in Americus, Georgia. Founded in 1942, Koinonia actively practiced and promoted equality between all ethnicities and emerged as a vanguard for liberal policies over a decade before the Civil Rights Movement reached Sumter County. Notably, Koinonians effected this change while refusing to engage or align with either the white liberal movement or the Civil Rights Movement, electing to avoid politicization of their endeavors in hopes of inspiring what they felt to be a truer …

“I’M Not Good At Math”: Mathematical Illiteracy And Innummeracy In The United States, G. Wesley Rogers

College of Graduate Studies: Theses & Dissertations

Why do we view mathematics the way we do in the United States and how have these views created an environment where we consider mathematical illiteracy and innumeracy socially and culturally acceptable when a lack of this knowledge and ability can function to enslave, exploit, restrict, and oppress. Throughout this investigation, I have explored some of the possible reasons for why we view education, mathematics, and the learning of mathematics the way we do and the impact of these views on our motivation and desire to learn mathematics. Using my over 20 years of teaching experience and the review of …

Romantic Interest Selection From An Imago Relationship Therapy Perspective, Lauren O. Patterson Jan 2017

Romantic Interest Selection From An Imago Relationship Therapy Perspective, Lauren O. Patterson

College of Graduate Studies: Theses & Dissertations

Imago Relationship Therapy (IRT) is a model of couples therapy that is not empirically validated (Jakubowski et al., 2004). IRT proposes that individuals select Romantic Interests (Interests) that are similar to their Childhood Caregivers (Caregivers) in an effort to heal childhood wounding (Hendrix, 1988). The current study sought to evaluate the IRT proposition of romantic interest selection by evaluating patterns in romantic interest selection, particularly the relationship between Caregiver and Interest personality characteristics, adult attachment dimensions, gender, and geographical location of origin. In addition, the study considers similarities in participant narratives of positive and negative experiences with Caregivers and Interests. …

Neon Nature, Jessamy G. Mcmanus Ms. Jan 2017

Neon Nature, Jessamy G. Mcmanus Ms.

College of Graduate Studies: Theses & Dissertations

The goal of this work is to explore my painting of nature in our contemporary time, considering the current geological epoch termed the Anthropocene, an era I think of as postnatural. Neon Nature is a collection of portraits of hypernatural creatures I call “pseudo-specimens”. These pseudo-specimens symbolize hypernature, which describes manufactured nature as better than authentic nature. These specimens are painted in vanitas-inspired still life scenes to act as a reminder of our changing nature, or new-nature.

Influenced by living in suburbia where nature is manicured and controlled, I am interested in the divide between the “born” and the “made,” …
