The Future Of Transnational Self-Regulation – Enforcement And Compliance In Professional Services, Panagiotis Delimatsis
The Future Of Transnational Self-Regulation – Enforcement And Compliance In Professional Services, Panagiotis Delimatsis
UC Law SF International Law Review
The increased expansion of economic activity beyond national borders leads to a shift of regulatory power. Public authorities concede power, explicitly or tacitly, to private bodies, whereas the multilayered ecology of global governance inevitably increases the role of transnational institutional structures. This article examines such developments in the area of professional services. It starts by analyzing the self -regulation phenomenon in professional services and points to examples where professional associations accentuate their unique nature t o justify the importance of nonintervention in their internal affairs. Powerful professional associations have been thereby created, which, depending on the services subsector (e.g., legal, …

The Law And Big Data, Caryn Devins, Teppo Felin, Stuart Kauffman, Roger Koppl
The Law And Big Data, Caryn Devins, Teppo Felin, Stuart Kauffman, Roger Koppl
Cornell Journal of Law and Public Policy
In this Article we critically examine the use of Big Data in the legal system. Big Data is driving a trend towards behavioral optimization and "personalized law," in which legal decisions and rules are optimized for best outcomes and where law is tailored to individual consumers based on analysis of past data. Big Data, however, has serious limitations and dangers when applied in the legal context. Advocates of Big Data make theoretically problematic assumptions about the objectivity of data and scientific observation. Law is always theory-laden. Although Big Data strives to be objective, law and data have multiple possible meanings …

Undercompensating For Discrimination: An Empirical Study Of General Damages Awards Issued By The Human Rights Tribunal Of Ontario, 2000-2015, Audra Ranalli, Bruce Ryder
Undercompensating For Discrimination: An Empirical Study Of General Damages Awards Issued By The Human Rights Tribunal Of Ontario, 2000-2015, Audra Ranalli, Bruce Ryder
Osgoode Legal Studies Research Paper Series
The authors present the results of a comprehensive quantitative analysis of general damages awards issued by the Human Rights Tribunal of Ontario from 2000 to 2015. From the results, the authors argue that general damages awards continue to be too low to reflect the importance of the equality rights protected by the Ontario Human Rights Code. While many expected that general damages awards would increase as a result of amendments to the Code that took effect in 2008, the data reveals that the range of the vast majority of general damages awards has remained relatively unchanged following the legislative reforms. …
An Evaluation Of Lfucg Economic Development: Making Strides Towards Strategic, Performance-Driven Partnerships, Sarah Ausmus Smith
An Evaluation Of Lfucg Economic Development: Making Strides Towards Strategic, Performance-Driven Partnerships, Sarah Ausmus Smith
MPA/MPP/MPFM Capstone Projects
Like many other municipal governments, Lexington utilizes a web of partnerships to support economic development. These relationships take many forms; LFUCG employs grants, tax incentives for businesses, and contracts with other organizations. Unlike some of its peers, though, LFUCG does not have a strategic plan in place to drive decision-making processes and sharpen its focus on outcomes. This report sets the foundation for future strategic management efforts by identifying opportunities and weaknesses that might be addressed by LFUCG through an environmental scan and establishing a performance management framework for existing contractual economic development partners. The key findings are as follows: …
Who Gives A Dam? Political Influence And Institutions Of Dam Removal, Elaina Linz
Who Gives A Dam? Political Influence And Institutions Of Dam Removal, Elaina Linz
Theses & ETDs
By 2020 80% of dams in the U.S. will reach the end of their lifespan, increasing the risk of structural failure. This looming threat coupled with our progressing environmental standards provoked upwards of a thousand dam removals in the U.S. Not all dams should be eradicated, however, those that pose an environmental or safety risk should be considered. The purpose of this thesis is improving the reader’s understanding of the economic and political incentives for defending water projects, and the conducive conditions that support the likelihood of successful dam removal proposals. Included are two case studies that follow an analytical …
Medical-Legal Partnerships With Communities: Legal Empowerment To Transform Care, Tamar Ezer
Medical-Legal Partnerships With Communities: Legal Empowerment To Transform Care, Tamar Ezer
Articles
Medical-legal partnerships (MLPs) integrate legal services into health care settings to provide holistic care and address the social determinants of health. This article brings a legal-empowerment lens to MLP work, arguing for a stronger focus on communities. It examines the application to MLPs of bringing services to communities, investing in rights literacy, and partnering with community-based paralegals. It then outlines the potential for a transformation in health and legal services to a rights - rather than needs-based framework where communities are active partners in program design and development.

Who Will Regulate Tax Preparers? States Can Fill This Role, William Barksdale, Sharon Campbell, Rebecca Hamm, Mark Lawrence
Journal of Business, Industry, and Economics
The issue of regulation of tax return preparers has been a controversial topic in the United States in recent years. The IRS has attempted to regulate tax return preparers, but this has been met with great opposition from many accounting professionals, as well as, in the courts. The purpose of this paper is to discuss why states should regulate tax return preparers. We will summarize the events that have occurred in recent years regarding regulation of tax return preparers to heighten awareness of this issue, as well as, to serve as a foundation for future empirical research in this area. …

Choice Of Law In Lawyers'. Engagement Agreements, Francesca Giannoni-Crystal, Nathan M. Crystal
Choice Of Law In Lawyers'. Engagement Agreements, Francesca Giannoni-Crystal, Nathan M. Crystal
Dickinson Law Review (1908-2003)
The engagement agreement is the most important document in the attorney-client relationship. Properly drafted engagements clarify roles, responsibilities, and expectations, minimize disputes, and protect lawyers from liability to the maximum extent possible. Provisions on fees and expenses are, of course, fundamental, but lawyers should consider a wide range of other topics, such as scope of engagement, authority of counsel, client responsibilities and cooperation, attorney liens, file preservation and storage, use of technology in handling cases, and withdrawal and termination. This article considers an important but usually-ignored topic-choice of law ("COL") and choice of forum ("COF") clauses.

Green Is Good: How Green Bonds Cultivated Into Wall Street’S Environmental Paradox, Luke Trompeter
PEEL Alumni Scholarship
When the European Investment Bank issued the first green bond in 2007, few imagined this debt instrument would attract mainstream investors. Designed to finance projects ranging from climate change prevention to clean transportation development, green bonds were geared for socially responsible investors concerned with our planet’s sustainability. However, by 2015, green bonds were issued by major corporations like Apple and municipalities like New York City at a record $40 billion. Major players on Wall Street have taken notice and look to cash in on the rapidly growing green bond market. With this new influx of investment and the bonds’ tax-exempt …

Who’S Gonna Take The Weight: Using Legal Storytelling To Ignite A New Generation Of Social Engineers, 50 J. Marshall L. Rev. 231 (2017), Camille Lamar Campbell
UIC Law Review
So I ask the rhetorical question: “Who’s Gonna Take the Weight?” to mobilize law professors—the people responsible for shaping students’ professional identities—to use storytelling techniques to overcome the corrosive effects of stereotypes and implicit biases on controversial clients’ access to legal services and on the lawyer’s professional identity as a social engineer. This article precedes in two parts. Part II explores traditional client selection models and endorses a Houstonian approach to client selection, one that acknowledges the challenges of representing controversial clients within a framework that also acknowledges the social justice consequences of denying representation to controversial clients. Part III …

Beyond The ‘Resiliency’ And ‘Grit’ Narrative In Legal Education: Race, Class, And Gender Considerations, 50 J. Marshall L. Rev. 271 (2017), Christian Sundquist
UIC Law Review
The narrative on modifying legal education to produce entrepreneurial students with resiliency and “grit,” however, often has a troubling class and race-regarding dimension. This Essay argues that the “grit” reform initiative has the potential to rationalize future disparities, by shifting the focus from responding to the continuing impact of poverty and identity bias on student outcomes to bolstering individual character traits and resiliency. Our country has a long and troubling history of adopting such post-oppression “distancing moves” in order to discount the effect that systemic bias has on inequality, including disparate legal outcomes, by focusing solely on personal responsibility and …

Risks And Rewards Of Externships: Exploring Goals And Methods, Leah Wortham, Linda F. Smith, Jeff Giddings
Scholarly Articles
This article grew from a presentation relating externship clinical programs to the theme of the July 2016 International Journal of Clinical Legal Education and Association of Canadian Legal Education conference: The Risks and Rewards of Clinical Legal Education Programmes. Externships or field placement programs involve students placed away from the law school and supervised by a person who is not employed by the law school. Externships offer many potential rewards for students as well as other stakeholders, including especially community institutions. But there are also risks—risks that the externship will be expected to accomplish too much with too few resources …

Technically Bankrupt, Brook E. Gotberg

What is the difference between a robot and a lawyer? The answer is not a joke, and may soon be a matter of great urgency for attorneys, as the legal field attempts to adjust to disruptive technologies that are likely to permanently alter the way that law is practiced throughout the United States. The consequences for failing to adjust to technological disruption for any industry, as demonstrated in recent years by big-name, bankrupt companies, can be disastrous. Legal tools found in chapter 11 of the Bankruptcy Code are largely intended to assist debtors in reorganizing their business affairs, preserving value …

Responding To Marginalization: Language Practices Of African-Born Muslim Refugee Youths In An American Urban High School, Jie Y. Park
Education
This article offers an analysis of how refugee youths from Africa used and shifted languages and discourses in the United States. Drawing on sociocultural theories of language and utilizing ethnographic discourse and classroom observation data, the author illustrates the varied ways in which three high school–aged refugee youths used languages to make sense of who and where they are; respond to social, religious, and linguistic marginalization in the United States; and challenge narrow perceptions of African Muslims. This article brings to fore a group that, although facing a unique set of challenges in the United States, is rarely included in …

The Role Of An Ombudsman In Mitigating Conflict, Evelyn Addison-Laurie
Walden Dissertations and Doctoral Studies
Bullying behavior is a contributing factor to hostile work environments, and can cause human consequences that affect morale, performance, and productivity. The purpose of this qualitative exploratory case study was to identify the strategies that ombudsmen and human resource managers (HR) use in mitigating workplace conflict. Corporate social performance was the conceptual framework that guided this research. Nine HR managers, an ombudsman representative, and 8 ombudsmen located in New York City and in other states were interviewed based on their experience in conflict mitigation. Data extracted from the participants' shared stories along with position description documents were synthesized thematically and …
Relationship Between Mental Health Facilities' Pre-Intake Practices And Children's First Appointment Attendance Rates, Christine Marie De Santis-Collis
Relationship Between Mental Health Facilities' Pre-Intake Practices And Children's First Appointment Attendance Rates, Christine Marie De Santis-Collis
Walden Dissertations and Doctoral Studies
Between 20% and 57% of patients at community mental health centers miss their first mental health appointment, resulting in wasted resources and longer wait times for other patients. To date, only one peer-reviewed quantitative study examined the relationship between appointment reminder practices and children's and adolescents' first appointment attendance rates for community mental health centers. The purpose of this quantitative study was to examine the relationship between first appointment wait times, electronic appointment reminders, phone appointment reminders, and first appointment attendance for U.S. community mental health centers, along with the potential moderating effects of age, ethnicity, and gender. Blumer's symbolic …
