Exploring Adoption Options, Carolyn Cole Jan 2017

Exploring Adoption Options, Carolyn Cole

Integrated Studies

All across the world, there are thousands of children in need of adoptive parents to provide them with a loving and stable home. These children include newborns placed for adoption, children living overseas, and children within the state’s child welfare system. “Exploring Adoption Options” is written to provide a general guide to someone who is interested in adoption. Adoption is a very complex process and a life-changing experience. It involves many professionals, such as adoption agencies, attorneys, social workers, facilitators, and state operated child welfare services. Children available for adoption can be found domestically or internationally, some of which are …

Benefits Of An Animal Traceability System For A Foot-And-Mouth Disease Outbreak: A Supply-Driven Social Accounting Matrix Approach, Man-Keun Kim, C. Michael Ukkestad, Hernan A. Tejeda, Deevon Bailey

Applied Economics Faculty Publications

This study reports the findings for an analysis using the computer program NAADSM (North American Animal Disease Spread Model) and a supply-driven social accounting matrix to examine the impact of a hypothetical foot-and-mouth disease (FMD) outbreak in a relatively isolated part of the United States, Utah, under various levels of livestock traceability. The analysis demonstrates that a significant regional economic impact in Utah would result from an FMD outbreak but that improved levels of traceability would be very important in helping to reduce the negative economic consequences of the outbreak.

The Twin Demons Of The Trump-Bannon Assault On Democracy, Joseph P. Tomain Jan 2017

The Twin Demons Of The Trump-Bannon Assault On Democracy, Joseph P. Tomain

Faculty Articles and Other Publications

On January 30, 2017, President Donald Trump signed an executive order "Reducing Regulation and Controlling Regulatory Costs." Then, on February 24, he signed an executive order on “Enforcing the Regulatory Reform Agenda.” Together these two executive orders constitute a severe threat to American society and the American economy. In the words of Stephen Bannon, Trump’s chief strategist, they represent a plan for “the deconstruction of the administrative state.”

The purpose of the administrative state can be most simply stated this way: Unless otherwise stated in the enabling legislation, government regulation makes sense when the benefits of regulation outweigh the costs …

Brief Of The Ethics Bureau At Yale Law School Et Al. As Amici Curiae Supporting Petitioner, Office Of The Public Defender V. Lakicevic, 215 So.3d 112 (2017) (No. 16- 1371)., Janet Moore

Faculty Articles and Other Publications

The vigilant defense of the attorney-client privilege by the courts is critical to preserving the integrity of the lawyer-client relationship. Accordingly, the Appellees’ attempt here to secure the client information from the client’s lawyer must be rejected with the same ardor as if the Appellees sought to swashbuckler through the lawyer’s entire file. If the principle that lawyer-client communications are sacrosanct were compromised in this case, the lessons from such a decision would eviscerate the attorney-client privilege in its entirety. Amici hope that their analysis will provide the Court with all of the constitutional, legal and practical reasons it needs …

Critical Issues And New Empirical Research In Public Defense: An Introduction, Andrew L.B. Davies, Janet Moore

Faculty Articles and Other Publications

When we co-founded the Indigent Defense Research Association (IDRA) in 2015, we wanted to create a meeting place for people who share the sense that empirical research has something to contribute to the field of public defense. With over 150 members and counting, IDRA has become a vibrant community of practitioners and researchers who engage via an active listserv, topical monthly conference calls, and the production of white papers and webinars. In addition, IDRA members present papers at conferences of the American Society of Criminology (ASC). Many of the papers in this volume were first presented at the November 2015 …

Knowing Defense, Janet Moore, Andrew L.B. Davies

Faculty Articles and Other Publications

The field of empirical research on public defense is in an early stage of development. Yet the field is also diverse, as a growing community of researchers applies training in disciplines ranging from law and criminology to economics and social psychology. These facts invite reflection on baseline questions about the field that may inform future work. For example, what factors shape our research agendas? What data, methods, and theories are in play? Do these new research agendas align with the research priorities of public defenders and the communities they serve? Should they do so? To begin exploring such questions, this …

Money Norms, Julia Y. Lee Jan 2017

Money Norms, Julia Y. Lee

Loyola University Chicago Law Journal

Money norms present a fundamental contradiction. Norms embody the social sphere, a system of internalized values, unwritten rules, and shared expectations that informally govern human behavior. Money, on the other hand, evokes the economic sphere of markets, prices, and incentives. Existing legal scholarship keeps the two spheres distinct. Money is assumed to operate as a medium of exchange or as a tool for altering the payoffs of different actions. When used to make good behavior less costly and undesirable behavior more costly, money functions to incentivize, sanction, and deter. Although a rich literature on the expressive function of law exists, …

Capital Lawyering & Legislative Clinic, Rex D. Frazier Jan 2017

Capital Lawyering & Legislative Clinic, Rex D. Frazier

Duquesne Law Review

This article outlines an approach for teaching law students about advocacy beyond the judicial branch, with particular emphasis on legislative advocacy. Given the long and well-documented shift away from the judicial branch as the primary source of original public law, it is critical to teach law students that legislative advocacy is more than just an "alternative"o r "non-traditional" legal career option and, instead, is one which regularly involves "real lawyering." Just as law students learn practical trial skills through moot court, shouldn't they learn practical legislative advocacy skills through simulated legislative hearings? Further, can law students move beyond traditional approaches …

Expanding Our Reach: Direct Client Representation Vs. Policy And Advocacy Impact In A Transactional Clinic, Joseph R. Pileri Jan 2017

Expanding Our Reach: Direct Client Representation Vs. Policy And Advocacy Impact In A Transactional Clinic, Joseph R. Pileri

SENLC Papers & Reports

The 2016 presidential election was met immediately around the country with calls to action for lawyers to provide legal representation and resources to vulnerable populations that would inevitably be affected by the incoming presidential administration. Lawyers showed up en masse, for example, at airports to offer services to travelers and families impacted by the executive order banning individuals from several predominantly Muslim countries from entering the country. Those lawyers were not alone. Calls also went out around the clinical community to use clinicians’ positions and resources in ways that further our work on behalf of communities which suddenly found themselves …

Rethinking Self-Regulation: Antitrust Perspectives On Bar Governance Activity, Benjamin H. Barton Jan 2017

Rethinking Self-Regulation: Antitrust Perspectives On Bar Governance Activity, Benjamin H. Barton

Scholarly Works

This article discusses the American bar’s unfortunate over-protection against the unauthorized practice of law and the ways that the Supreme Court’s recent ruling in North Carolina Board of Dental Examiners v. Federal Trade Commission suggests that their anticompetitive practices may face new hurdles. The article surveys the background of federal antitrust doctrine and describes the scope and rationale of the Dental Examiner’s ruling. The article then offers some thoughts on the implications of the decision for bar regulatory activities, including a recent example involving the North Carolina bar’s UPL action against LegalZoom. We close with some suggestions about how the …

Reintegration In A Rural Community: Strengths, Barriers, And Recommendations For Reentry In Humboldt County, Vanessa E. Vrtiak Jan 2017

Reintegration In A Rural Community: Strengths, Barriers, And Recommendations For Reentry In Humboldt County, Vanessa E. Vrtiak

Projects

There is a current lack of reintegration services in rural Humboldt County, California. In an effort to understand the services available, and develop recommendations for future reentry services, I conducted focus groups and interviews with the currently incarcerated, service providers, and the formerly incarcerated. Some of the formerly incarcerated participants live in Humboldt County currently, and some have moved to other communities in the state of California. This research was conducted using a convenience sample, and snow ball sampling methods. The initial goal of this research was to promote communication between both community based service providers and those involved in …
