The Power Of Community Action:Anti‐Payday Loan Ordinances In Three Metropolitan Areas, Nathalie Martin, Robert N. Mayer, Steve Graves

Faculty Scholarship

Local ordinances that restrict payday lending constitute an important strategy in the overall attack on this problematic form of lending. In this report, made possible by the generous support of Silicon Valley Community Foundation, we describe and analyze campaigns in three locales that differ markedly in the opportunities and challenges faced by ordinance advocates. The locales are Santa Clara and San Mateo counties in California (“Silicon Valley”); Dallas, Denton, and Tarrant counties in Texas; and Salt Lake County in Utah. This report finds both commonalities and important variations among these campaigns. While there is no single recipe for a successful …

721-735 Walton/Gerard Llc V Marrero Jan 2017

721-735 Walton/Gerard Llc V Marrero

All Decisions

LL commenced a holdover alleging the tenant breached her lease agreement, and nuisance conduct. The Tenant made a pre-answer motion to dismiss arguing the notices are ambiguous and unclear and fails to provide her with an adequate method to cure the alleged breach. For one the breach was for propping an entrance door open but the landlord wrote that the cure would be removal of an AC appliance. The tenant also argued the notice of termination is confusing because the date cited there is prior to the date of the letter. The Court dismissed the petition based on defective notices. …

Considerations For The Next Administration: Criminal Justice Reform And Prisoner Reentry, J. C. Lore Iii, Jason S. Kanterman

Emory Business Law Review

This Article explains the concept of prisoner reentry, which are Reentry programs that are designed to assist incarcerated individuals to successfully transition back into society after being released from prison. One critical component for reforming our system is through enhanced reentry programming and support: ensuring that offenders are provided adequate support and guidance post-incarceration, so that they may re-enter society as a contributing member of the global community. For the next administration, criminal justice reform will present an opportunity to implement rehabilitative justice through an investment of resources. The benefits of doing so appear clear'the community is safer when people …

Poverty, The Great Unequalizer: Improving The Delivery System For Civil Legal Aid, Latonia Haney Keith Jan 2017

Poverty, The Great Unequalizer: Improving The Delivery System For Civil Legal Aid, Latonia Haney Keith

Catholic University Law Review

When individuals in the United States face civil justice issues, they are not entitled to legal counsel and therefore must secure paid counsel, proceed pro se or qualify for free legal assistance. As a result of the economic downturn, the number of Americans who are unable to afford legal counsel is now at an all-time high. In response to this ever-widening justice gap, the public interest community has launched multiple initiatives to supplement the underfunded legal aid system. Though valiant, this article argues that this approach has unfortunately created a complex, fragmented and overlapping delivery system for legal aid. This …

An Interview With Charles Holton, Prasad Hurra, Zalak Raval Jan 2017

An Interview With Charles Holton, Prasad Hurra, Zalak Raval

Emory Business Law Review

Many important economic indices show that the economy has improved markedly under the Obama administration, but, there are communities that are still struggling with loss of jobs and housing. Courts are seeing an increased number of eviction cases presenting some very serious concerns, particularly for the tenants. However, the evictions can be reduced, and educating the judges, tenants and landlords is the first step. The struggling tenants can seek public funding or legal aid available in their counties that provide alternatives to eviction, but unfortunately, the cutbacks in funding to legal aid organizations have affected many states of late. On …

Identification Of Disability-Related Competencies For Student Affairs Generalists: A Delphi Study, Adam R. Lalor Jan 2017

Identification Of Disability-Related Competencies For Student Affairs Generalists: A Delphi Study, Adam R. Lalor

Doctoral Dissertations

Lack of disability-related knowledge and skills by higher education faculty and student affairs professionals are recognized as barriers to the promotion of equal access and success of students with disabilities. Although an expanding body of research exists on the preparation of faculty to meet the needs of students with disabilities, little focus has been placed on the preparation of student affairs professionals beyond those working in disability services offices. Despite research noting that all student affairs professionals need to possess disability-related knowledge, skills, and dispositions; no comprehensive listing of disability-related competencies exists for student affairs practitioners outside of disability services. …

Remembering Ed Muskie: His Commitment And Contributions To Civil Access To Justice, Andrew M. Mead Jan 2017

Remembering Ed Muskie: His Commitment And Contributions To Civil Access To Justice, Andrew M. Mead

Maine Law Review

It is a special honor and pleasure to speak to you today about Ed Muskie and his enduring contribution to the cause of equal access to justice. I am the current Chair of Justice Action Group, an organization that traces its roots directly to Senator Muskie’s efforts in the late 1980s. JAG, as it is known, continues to keep his vision alive. I will speak more about JAG in a moment, but first some brief reminiscences. In the late 1980s, I was a member of the Commission chaired by Senator Muskie that conducted the first comprehensive legal needs study in …

Legal Aid And Legal Services: An Overview, Howard Dana Jan 2017

Legal Aid And Legal Services: An Overview, Howard Dana

Maine Law Review

You have asked me to summarize in under ten minutes the entire history of civil legal aid and civil legal services to the poor since the beginning of recorded history. I hope in this undertaking not to slight the substantial contributions of many of this room. Legal aid to the poor for all but the last fifty years has been almost exclusively the responsibility of the private bar. Dating back to at least the fourteenth century it was understood that in exchange for the privilege of being a compensated advocate in court, a lawyer had the responsibility to devote some …

Connecting Law And Legislature: The Legacy Of Ed Muskie, Samuel J. Baldwin Jan 2017

Connecting Law And Legislature: The Legacy Of Ed Muskie, Samuel J. Baldwin

Maine Law Review

Edmund Muskie’s work impacts each of our lives, every day. The truth of this statement should become apparent as one explores the topics addressed in this symposium issue of the Maine Law Review, presented in honor of the centennial of Muskie’s birth. And yet, among the great American politicians, he may seem forgotten. His memory is in many ways confined to those who were present for his rise to national prominence in the 1960s, and to those steeped in environmental law, Maine political history, or one of the other fields in which he was most active. I will admit that …

Experimental Educating In The Classroom: Designing An Administrative Law Practicum Meeting New Aba Requirements And Student Needs, Jeffrey Thaler Jan 2017

Experimental Educating In The Classroom: Designing An Administrative Law Practicum Meeting New Aba Requirements And Student Needs, Jeffrey Thaler

Maine Law Review

In 1992, the American Bar Association ("ABA") published a lengthy report, which became known as the MacCrate report (the "Report"), examining the connection between the profession and legal education.2 In part, the Report recognized the value of a more practice-oriented curriculum that would include a combination of externships, clinics and classroom-based activities. One result of the Report was a significant increase in the number of clinical and externship programs offered by law schools, as well as many more law review articles on such programs. However, the concept of combining experimental educating techniques with traditional doctrinal case method courses utilizing simulations …
