Response To The Influence Of Exile: Three Stories, Bill Quigley
Response To The Influence Of Exile: Three Stories, Bill Quigley
Maryland Law Review Online
When I read Professor Sara Rankin’s article, The Influence of Exile,[I was reminded of three recent stories of how law, government, and business worked together to try to exile the homeless in our community. Though all parties continuously profess to be concerned only with the well-being of homeless people themselves, the laws transparently marginalize them. Though the following three stories about the impact of these laws are local to New Orleans, Louisiana, I am absolutely sure there are similar stories of similar happenings in most communities across the nation.
Professor Rankin’s article examines the very big picture …

Busting Up The Pretrial Industry, Andrew S. Pollis
Fordham Law Review
While some argue that “[r]eturning to a trial model would be a significant step toward fulfilling the traditional expectations for the federal courts,” that step backward is unlikely to occur. But I agree that fixes are in order, and I offer two. First, we should consider requiring at least some parties to engage in early settlement evaluation—ideally before extensive discovery gets underway—by submitting cases to summary jury trials and imposing consequences on parties who choose to disregard the results. Second, we should allocate a greater percentage of judicial resources to discovery management through the routine appointment of special masters to …

Restraining Lawyers: From “Cases” To “Tasks”, Morris A. Ratner
Fordham Law Review
These regulatory and market mechanisms for restraining lawyers share a common thread but differ in their purposes, efficacy, and fairness. Despite these differences, the growing intensity of their focus, and their possible amplification of each other, suggest the possibility of the emergence of new professional norms that call on litigators to think more deeply and inclusively about value from the perspective of court and client when making litigation choices.

The summer of 2014 was an exciting time full of announcements and transitions for the City of Cleveland, marking the return of LeBron James to the Cleveland Cavaliers and the Republican National Committee selecting Cleveland to host the 2016 RNC Convention. Two years later, 2016 saw the Cavaliers win the city’s first major sports championship in 52 years; just four weeks later, July 18-21, the City hosted its first Republican National Convention in 80 years.
The old saying, “As Ohio goes, so goes the nation” reflects the importance of the state in national politics; the only two candidates who have …

The Dawn Of Fully Automated Contract Drafting: Machine Learning Breathes New Life Into A Decades-Old Promise, Kathryn D. Betts, Kyle R. Jaep
The Dawn Of Fully Automated Contract Drafting: Machine Learning Breathes New Life Into A Decades-Old Promise, Kathryn D. Betts, Kyle R. Jaep
Duke Law & Technology Review
Technological advances within contract drafting software have seemingly plateaued. Despite the decades-long hopes and promises of many commentators, critics doubt this technology will ever fully automate the drafting process. But, while there has been a lack of innovation in contract drafting software, technological advances have continued to improve contract review and analysis programs. “Machine learning,” the leading innovative force in these areas, has proven incredibly efficient, performing in mere minutes tasks that would otherwise take a team of lawyers tens of hours. Some contract drafting programs have already experimented with machine learning capabilities, and this technology may pave the way …

The Relationship Between Online Students' Use Of Services And Their Feelings Of Mattering, Tracy L. Hart
Organization, Information and Learning Sciences ETDs
The purpose of this single case study was to examine the relationship between online students’ use of support services and their feelings of mattering using a convergent parallel research design to collect quantitative and qualitative data. Students enrolled exclusively in online classes during the academic year 2015-2016 at the University of New Mexico (UNM) were invited to participate. The survey was based on the theoretical and conceptual frameworks for comprehensive services and mattering theory. Responses provided descriptive statistics and correlation analysis with stories that added to the description of students’ service experiences.
Service-to-service correlations showed correlation strength of moderate, strong, …

The Negative Ramifications Of Hate Crime Legislation: It’S Time To Reevaluate Whether Hate Crime Laws Are Beneficial To Society, Briana Alongi
The Negative Ramifications Of Hate Crime Legislation: It’S Time To Reevaluate Whether Hate Crime Laws Are Beneficial To Society, Briana Alongi
Pace Law Review
Supporters of hate crime legislation suggest that the primary reason for the codification of hate crime laws is “to send a strong message of tolerance and equality, signaling to all members of society that hatred and prejudice on the basis of identity will be punished with extra severity.” However, hate crime laws may actually be accomplishing the opposite effect of tolerance and equality because they encourage U.S. citizens to view themselves, not as members of our society, but as members of a protected group. The enactment of hate crime legislation at the federal and state levels has led to unintended …

Justice For Noncitizens: A Case For Reforming The Immigration Legal System, Anna Paden Carson
Justice For Noncitizens: A Case For Reforming The Immigration Legal System, Anna Paden Carson
VA Engage Journal
The immigration legal system exists as a function of the executive branch rather than the judicial branch, and many of the constitutional rights guaranteed in a judicial court do not continue into the immigration legal sphere. Noncitizen defendants in the immigration court system are not guaranteed the same due process rights or right to appointed counsel as United States citizens, which severely limits their chance of a successful outcome. Moreover, while many noncitizens await their trials in these courts, they are often placed in one of the 234 immigration detention facilities across the nation, which further exacerbates the direness of …

Live Chat: Librarians Using Simple Technology To Provide Access To Justice (Social And Legal) To Patrons In Distress, Sheri Huppert, Elvira Embser-Herbert
Library Technology Conference
The reference librarians at the Minnesota State Law Library help staff a live chat service for Legal Services State Support (through LawHelpMN.org). We cover several chat shifts each week, providing our law librarian expertise to public patrons seeking help with legal and social issues. Most people using the service are trying to navigate legal and/or social services problems alone as they cannot afford to hire an attorney. They come to the chat service for help with legal questions, to find the correct forms to use for a legal matter, for other resources to use to help answer legal questions, and …
