Understanding The Ethics Of Empowerment: An Elder Law Lawyer's Challenge Or Obligation?, Gregory T. Holtz
Northern Illinois University Law Review
This Article considers the concept of empowerment and the obligation lawyers have as they advise and counsel their clients, especially the elderly, in the use of estate planning documents which empower others to undertake responsibility on the client's behalf. The article proposes the lawyer achieve the "good result" for the client as a means of fulfilling that responsibility, applying it in the use of the durable power of attorney, advance directive, and psychiatric advance directive.

Taxing Systemic Risk, Eric D. Chason
Faculty Publications
A tax on the harmful elements of finance—a tax on systemic risk—would raise revenue and also lower the likelihood of future crisis. Financial institutions, which pay the tax, would try to minimize its cost by lowering their systemic risk. In theory, a tax on systemic risk is perfect policy. In practice, however, this perfect policy is unattainable. Tax laws need clear definitions to be administrable. Our current understanding of systemic risk is too abstract and too metaphorical to serve as a target for taxation.

Access to justice often equates to access to state courts, and for millions of Americans, using state courts to resolve their disputes-often with the government-is a real challenge. Reforms are regularly proposed in the hopes of improving the situation (e.g., better legal aid), but until recently a significant part of the problem has been structural. Using state courts today for all but the simplest of legal transactions entails at the very least traveling to a courthouse and meeting with a decision maker in person and in a one-on-one setting. Even minimally effective access, therefore, requires time, transportation, and very often …

Fees, Going Concern Opinions And Auditor Dismissals: An Empirical Assessment, Frances Ann Stott
Doctor of Business Administration Dissertations
Auditors issue going concern modified opinions when there is substantial doubt about the company’s ability to continue its operations into the foreseeable future. Companies frequently respond to this type of audit opinion by changing auditors. Critics, such as the SEC, suggest that this may be done in order to opinion shop (i.e., find an auditor who is likely to issue a more favorable unqualified opinion). However, prior research has indicated that opinion shopping may not be effective. Since firms receiving a going concern modified opinion are clearly under significant financial distress, the effect a change in auditor has on subsequent …

Dilemmas About The Core Values In The European Union, Elisabeth Kardos Kaponyi

The European integration was primarily about economic cooperation, but the European Union’s role in protecting the core values in its member states. EU values were first mentioned in the 1992 Maastricht Treaty on European Union, and since the Amsterdam Treaty the community law has a sufficiently precise description of this values, which should be respected not only by countries aspiring to the EU but also by the Member States themselves.
