Separated Same-Sex Parents’ Experiences And Views Of Services And Service Providers, Luke Gahan
Journal of Family Strengths
Same-sex parents are compelled to be more reflective, to plan, and to negotiate their contact with mainstream service providers and professionals in an effort to find those whom they feel comfortable with disclosing their sexuality and/or to find a service provider who would adequately understand their unique needs. This paper presents findings from an Australian qualitative study of separated same-sex parents and explores their experiences with professionals and service providers during and after their separation. As a consequence of their separation, same-sex parents encountered new service providers with whom they had to navigate relationships with; this paper will focus on …

Notarial Acts As Written Evidence: Towards A Convergence Between Civil Law And Common Law Systems, Angelo Chianale
Journal of Civil Law Studies
This article studies the contrast between civil and common law systems regarding the significance of the notarial act. According to conventional scholarship, in the former, civil procedure requires written evidence and the notarial act is the strongest kind of evidence. In the latter, however, civil procedure requires oral evidence and the notarial act has no specific relevance. This article examines the extent of these two main principles: a) in civil law systems the notarial act is full evidence of the extrinsic and a document can be challenged only with an action for falsity; and b) in common law systems the …

How Big Money Ruined Public Life In Wisconsin, Lynn Adelman

This Article discusses how Wisconsin fell from grace. Once a model good government state that pioneered many democracy-enhancing laws, in a very short time, Wisconsin became a state where special interest money, most of which is undisclosed, dominates politics. This Article identifies several factors as being critical to Wisconsin’s descent. These include the state’s failure to nurture and build on the campaign finance reforms enacted in the 1970s and both the state’s and the United States Supreme Court’s failure to adequately regulate sham issue ads. Psychological Conditions That Promote Job Engagement: Test Of A Model, Zhuo Chen

According to Kahn’s theoretical model (1990), the following three psychological conditions - meaningfulness, safety, and availability - are the key proximal predictors of job engagement. The current study examined the effects of these three psychological conditions (meaningfulness, safety, and availability) on three aspects of job engagement (JE), using both cross-sectional and daily diary data to examine between-person and within-person relationships among these variables. Psychological conditions were also examined as mediators of relationships between organizational and personal factors and job engagement. Furthermore, positive affect (PA) was tested as a moderator of the relationships between distal predictors and the three psychological conditions. …

This post discusses Forrest (Woody) Mosten and Elizabeth Potter Scully’s book, Unbundled Legal Services: A Family Lawyer’s Guide. Unbundling involves providing specified services to legal clients rather than “full service” representation. Unbundling is particularly helpful in family matters because parties generally understand the issues and may represent themselves well if they have some legal help. Many family courts are overwhelmed with large numbers of cases involving self-represented litigants, so providing unbundled legal services can make a significant contribution to the legal system. In virtually all types of cases, some people have the interests in unbundling, not just family matters.

Human Development Faculty Scholarship
Between October 2013 and July 2016, over 156,000 children travelling without their guardians were apprehended at the U.S.–Mexico border and transferred to the care of the Office of Refugee Resettlement (ORR). During that same period, ORR placed over 123,000 unaccompanied migrant youth – predominantly from Central America – with a parent or other adult sponsor residing in the U.S. Following placement, local communities are tasked with integrating migrant youth, many of whom experience pre- and in-transit migration traumas, family separation, limited/interrupted schooling, and unauthorised legal status, placing them at heightened risk for psychological distress, academic disengagement, maltreatment, and human trafficking. …

Modern penal theory, like prevalent western theories of law, adopts a determined model of autonomy, one in which people are separable from social and family contexts. Taken to the criminal law context, this model proposes people can be defined without taking into account the social context. The use of prisons thus presupposes that individuals can be removed from their communities and families to be reeducated, readapted, treated or—in the retributive approach—simply punished. This notion of autonomy, however, hides from sight the group of people who not only maintain family ties with the men and women in prison, but who also, …

Benjamin Barton and Stephanos Bibas’s new book, Rebooting Justice: More Technology, Fewer Lawyers, and the Future of Law, is an eloquent exemplar of the deregulation literature. What sets Rebooting Justice apart from other works in the genre is that Barton and Bibas do not treat deregulation as a panacea. Their starting point is that Americans are not well served by lawyers’ monopoly over the legal services market, but they do not envision a world in which every legal problem is resolved ably and efficiently. Program for a December 2017 Problem Solving Initiative at the University of Michigan Law School on the topic of identifying human trafficking victims in health care settings.
It is estimated that up to one third of all victims of human trafficking come into contact with a health care provider during their trafficking and are unrecognized. Health care settings offer a unique opportunity to identify victims of human trafficking and connect them with services and support. In a collaborative, multidisciplinary setting, students were tasked with developing innovations to increase the identification of victims of human trafficking in health care settings.

A program for a December 2017 Problem Solving Initiative by the University of Michigan Law School on the topic of economic integration of refugees and victims of human trafficking during and after resettlement.
Both refugees and foreign national victims of human trafficking are eligible for refugee resettlement benefits. How can these benefits be optimized to increase individual economic empowerment and economic development for the communities in which these individuals are resettled? Students in this class were tasked with developing innovations to facilitate the economic integration of refugees and victims of human trafficking both during and after the resettlement process.
