Ohio's Modern Courts Amendment Must Be Amended: Why And How, Richard S. Walinski, Mark D. Wagoner Jr.
Cleveland State Law Review
A 1968 amendment to the Ohio Constitution granted the Supreme Court of Ohio the authority to promulgate “rules governing practice and procedure” for Ohio courts. The amendment also provided that “[a]ll laws in conflict with such rules shall be of no further force or effect after such rules have taken effect” and that no rule may “abridge, enlarge, or modify any substantive right.”
Although the amendment was explicit about automatic repeal of existing laws, it says nothing about whether the General Assembly may legislate on a procedural matter after a court rule takes effect. That silence has caused enduring confusion. …

LGBTQ youth are vulnerable to nearly all forms of childhood maltreatment and trauma and are disproportionately overrepresented in the child welfare system. Many LGBTQ youth in the child welfare system encounter a number of obstacles related to discrimination, rejection, placement instability, and further maltreatment. Despite recent insights and advances in the field of trauma informed care the trauma experiences of LGBTQ youth have largely gone unaddressed in major works and frameworks related to trauma informed care. The following article explores the unique trauma and maltreatment experiences of LGBTQ youth and provides considerations for enhancing and improving practice with LGBTQ youth …

Tolerance and diversity are at times lauded as the essential terms for modern social justice movements. From school to community settings teachers, public figures, and political leaders throw these terms around to great applaud and acclaim. And yet who are we trying to serve by using these terms, and whose humanity is preserved through tolerance and diversity? In the following article I address the difference between the simplicity and shortcomings posed by tolerating and diversifying spaces to the more radical movements of inclusion and celebration. Lived experience generates knowledge not available through formal education and training. If lesbian, gay, bisexual, transgender, and questioning (LGBTQ) youth and young adults (YYA) experiencing homelessness are to be effectively engaged, their needs met, and their successful transition out of homelessness facilitated, they must be partners in the creation of solutions meant to help them. That means that everyone working to address LGBTQ YYA homelessness – including policymakers, government officials, advocates, researchers, and service providers – need to understand how to partner authentically with YYA experiencing homelessness. Instead of occupying a marginal space within teacher preparation programs, special education courses and training should promote diversity in servicing marginalized groups such as lesbian, gay, bisexual, transgender, and questioning (LGBTQ) students. Within these programs, issues related to LGBTQ students should occupy a meaningful and formative space in the training of future teachers in special education. Often, special education teachers are at a loss about how to educate LGBTQ students with disabilities. Global environmental conventions are created to address and resolve global environmental problems. Assessments of the achievement of specific environmental goals, however, indicate that there is room for progress and that stronger collective action is required. Given that there are no empirical instruments to measure implementation and to determine the factors behind individual countries’ results, challenges emerge that require the expansion of existing analytical frameworks around environmental conventions and their role as global governance instruments. Neuropsychological impairment is a key characteristic of schizophrenia (SZ), but its cognitive profile and underlying information processing mechanisms are not yet well understood. We compare patterns of neuropsychological functioning in 85 persons with SZ and 76 healthy controls across measures of intelligence, memory, and executive function. We then test the hypothesis that neuropsychological impairment in SZ is related to dual deficits in two related but distinct information processes: processing speed and attentional control. All research participants completed Wechsler Adult Intelligence Scale-Third Edition (WAIS-III), Wechsler Memory Scale Third Edition (WMS-III), and Wisconsin Card Sorting Test (WCST), all of which provided measures …

Lesbian, gay, and bisexual (LGB) people face the burden of additional stressors as a result of their experiences of stigma and discrimination regarding their sexual minority status. Parental rejection of LGB people in the context of heterosexism serves as a powerful minority stressor associated with poorer mental health (e.g., Bouris et al., 2010; Ryan, Huebner, Diaz, & Sanchez, 2009). Few contemporary theories exist to describe the experience of parental rejection. In addition, the extant empirical research has focused primarily on youth experiences among White and urban LGB samples, signaling the need for research across the lifespan investigating more diverse samples. …

Although cognitive loss is part of normal aging, it has unfavorable consequences for older individuals, their family, as well as society. The prevalence of mild cognition impairment is expected to go up in China. How to maintain normal cognition for a longer period of time and to delay impair process is an emerging concern for older Chinese adults. Depression: The Often Overlooked Sequela Of Head Trauma, Samuel D. Hodge Jr., Jack E. Hubbard

Depression is a common sequela of head trauma. Approximately half of all individuals with a cranial injury will experience depression within the first year, regardless of the severity of the injury. The ailment is characterized clinically as a mood disorder, often associated with intense feelings of sadness. However, depression is more complex than mood disorders, as many mental and bodily complaints—such as insomnia, fatigue, anxiety, appetite changes, aches and pains, and lack of interest in previously enjoyable activities—are associated with depression. These intense feelings, particularly when combined with despair and hopelessness, can lead to suicide, a dreaded potential complication of …

The Applicability Of The Decisional Conflict Scale In Nursing Home Placement Decision Among Chinese Family Caregivers: A Mixed Methods Approach, Yu-Ping Chang, Loralee Sessanna, Joanne Kraenzle Schneider

This study aimed to 1) examine relationships between uncertainty, perceived information, personal values, social support, and filial obligation among Chinese family caregivers faced with nursing home placement of an older adult family member with dementia; and 2) describe the applicability of the Decisional Conflict Scale in nursing home placement decision making among Chinese family caregivers through the integration of quantitative and qualitative data.
We used a mixed-methods approach. Quantitative data analysis consisted of descriptive and correlational statistics. We utilized a thematic analysis for the qualitative data. Data transformation and data comparison techniques were used to combine qualitative and quantitative data. …
