It’s not uncommon for people to make reference to atmospheres, including in relationship with educational spaces. In this article, we investigate educational atmospheres by turning to Western and Chinese literature on the air and wind. We pursue this task in three phases. First, we examine the Western literature to see the possible strings of thought that would help us reinvigorate the element of air/atmosphere as a foundational component of an educational sphere. Second, we historicize the Chinese notion of wind as a style of reasoning which structures ancient Chinese cosmology, tempo-spatiality, teaching, and governing into a grid of intelligibility. Third, …

Recycling A Colonial Puritan Sermon: A Case Study, David M. Powers
Recycling A Colonial Puritan Sermon: A Case Study, David M. Powers
Conference on Sermon Studies
Notes which the teenager John Pynchon took in the 1640s as he listened to the Rev. George Moxon’s sermons in frontier Springfield, MA, have become the inspiration and the ingredients for sermon performances in 21st century New England. The project began with a word-for-word transcription of a symbol-for-symbol manuscript based on a code invented by Pynchon. Then a very few words which the notetaker skipped, in his rush to record just what he heard, were added to provide essential clarification. So, too, was introductory material to frame the experience by encouraging the listening congregation to “stretch” a bit to appreciate …

A "Delicate Balance": How Agency Nonacquiescence And The Epa's Water Transfer Rule Dilute The Clean Water Act After Catskill Mountains Chapter Of Trout Unlimited, Inc. V. City Of New York, Kevin J. Haskins
Maine Law Review
Congress enacted the Clean Water Act (CWA) in 1972 with the express objective of restoring and maintaining the health of the nation’s waters. To achieve this objective, Congress declared that discharges of pollutants into the nation’s waters are prohibited unless they comply with permit requirements. The CWA’s primary vehicle for regulating discharge permits is the National Pollutant Discharge Elimination System, or NPDES. The CWA defines the phrase “discharge of a pollutant” as the “addition of any pollutant to navigable waters from any point source.” Although the CWA further defines the terms “pollutant,” “navigable waters,” and “point source,” it fails to …
The Corporation As Sovereign, Allison D. Garrett
The Corporation As Sovereign, Allison D. Garrett
Maine Law Review
In the past two hundred years, sovereignty devolved from the monarch to the people in many countries; in our lifetimes, it has devolved in several significant ways from the people to the corporation. We are witnesses to the erosion of traditional Westphalian concepts of sovereignty, where the chess game of international politics is played out by nation-states, each governing a certain geographic area and group of people. Eulogies for the nation-state often cite globalization as the cause of death. The causa mortis is characterized by the increase in the power and normative influence of supranational organizations, such as the United …
Resurrecting The Rule Of Law In Liberia, Jim Dube
Resurrecting The Rule Of Law In Liberia, Jim Dube
Maine Law Review
The rule of law is more than a legal concept. It encompasses more than an established set of rules and legal institutions. In the case of Liberia, there can be no rule of law without the commitment of those relatively few people who administer those rules on behalf of a post-conflict state that has endured twenty-five years of civil war and exploitation. This Essay seeks to prove that existing legal architecture and institutions in a post-conflict state matter less to the rule of law than does the character of the people who run the legal system. The Essay does not …
Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez
Serving Their Country And Their Communities? An Exploratory Study Of The Impact Of Military Presence On County-Level Crime Rates, Rocio A. Paez
Theses and Dissertations
Criminologists have long established an association between social disorganization factors and crime. The majority of criminological literature on social disorganization, however, has overlooked the role that certain social institutions play into the equation. Specifically, the degree to which military presence, manifested by the exposure to the military institution and its personnel, influences local areas has yet to be examined from a criminological perspective. This dissertation was designed to extend this body of research by envisioning the military as a social institution salient in understanding variation in the of crime and delinquency across communities. To accomplish this, I relied on data …
A Little Birdy Told Me: Educators’ Experiences With Twitter As A Professional Learning Network, Valerie King
A Little Birdy Told Me: Educators’ Experiences With Twitter As A Professional Learning Network, Valerie King
Doctor of Education in Teacher Leadership Dissertations
This study reveals educators’ experiences with using Twitter as a professional learning network. The context of this study is framed by the notion of ubiquitous learning woven into the underpinnings of social learning theory, adult learning theory and connectivism. Current traditional professional learning does not adequately address the needs of today’s educators. There is growing evidence to suggest that teachers are more isolated and lacking the collaboration necessary to encourage and sustain best practices in the classroom. This research investigates the topics of traditional professional learning, online learning and social networks to lead to a keen understanding of the nuances …

Epidemiological data indicate that risk behaviors are among the leading causes of adolescent morbidity and mortality worldwide. Consistent with this, laboratory-based studies of age differences in risk behavior allude to a peak in adolescence, suggesting that adolescents demonstrate a heightened propensity, or inherent inclination, to take risks. Unlike epidemiological reports, studies of risk taking propensity have been limited to Western samples, leaving questions about the extent to which heightened risk taking propensity is an inherent or culturally constructed aspect of adolescence. In the present study, age patterns in risk-taking propensity (using two laboratory tasks: the Stoplight and the BART) and …

Studying The Role Of Axon Fasciculation During Development In A Computational Model Of The Xenopus Tadpole Spinal Cord, O Davis, R Merrison-Hort, Sr Soffe, R Borisyuk
School of Engineering, Computing and Mathematics
During nervous system development growing axons can interact with each other, for example by adhering together in order to produce bundles (fasciculation). How does such axon-axon interaction affect the resulting axonal trajectories, and what are the possible benefits of this process in terms of network function? In this paper we study these questions by adapting an existing computational model of the development of neurons in the Xenopus tadpole spinal cord to include interactions between axons. We demonstrate that even relatively weak attraction causes bundles to appear, while if axons weakly repulse each other their trajectories diverge such that they fill …

Examining The Board Of Immigration Appeals' Social Visibility Requirement For Victims Of Gang Violence Seeking Asylum, Elyse B. Wilkinson
Examining The Board Of Immigration Appeals' Social Visibility Requirement For Victims Of Gang Violence Seeking Asylum, Elyse B. Wilkinson
Maine Law Review
Since the late 1990s, Latin America has been plagued by gang violence. The increasingly organized and progressively larger gangs are known as the Mara Salvatrucha 13 (MS-13) and the 18th Street Gang (collectively referred to as the “Mara” in this Comment). These gangs are ubiquitous within certain Latin American countries and pose a serious threat to the economic and social stability of the region. The targets of the Mara are mostly youth between the ages of fifteen and eighteen (but as young as eight), women, and those who decry the gang's violence. Resistance to the Mara has resulted in death …

Residents ' Perception Of Tourism Impacts And Involvement: A Cluster Analysis Of Kilimanjaro Residents, Tanzania, Dev Jani
Business Management Review
This study aimed at segmenting residents around Mount Kilimanjaro on the basis of their perception of economic, environmental, and socio-cultural impacts of tourism. A structured questionnaire yielded 160 cases that were clustered and analyzed using non-hierarchical analysis followed by hierarchical cluster analysis. Two clusters were noted to differ with respect to their perceived impacts of tourism. Among the demographic variables, only gender served in differentiating the clusters. The two clusters were observed to differ in terms of economic, political, and social involvement of residents with tourism industry. Residents who are involved in tourism industry are likely to be positive on …

Spread Of Domestic Animals Across Neolithic Western Anatolia: New Zooarchaeological Evidence From Uğurlu Höyük, The Island Of Gökçeada, Turkey, Levent Atici, Suzanne E. Pilaar Birch, Burçin Erdoğu
Anthropology Faculty Research
The zooarchaeological research presented here investigates Neolithic and Chalcolithic (ca. 6500–5000 cal. BC) animal exploitation strategies at Uğurlu Höyük on the Turkish island of Gökçeada in the northeastern Aegean Sea. Toward this end, we first discuss the results of our analysis of the zooarchaeological assemblages from Uğurlu Höyük and then consider the data within a wider regional explanatory framework using a diachronic approach, comparing them with those from western and northwestern Anatolian sites. The first settlers of Gökçeada were farmers who introduced domestic sheep, goats, cattle and pigs to the island as early as 6500 years BC. Our results align …

Time Series Uav Image-Based Point Clouds For Landslide Progression Evaluation Applications, Abdulla Al-Rawabdeh, Adel Moussa, Marzieh Foroutan, Naser El-Sheimy, Ayman Habib
Lyles School of Civil Engineering Faculty Publications
Landslides are major and constantly changing threats to urban landscapes and infrastructure. It is essential to detect and capture landslide changes regularly. Traditional methods for monitoring landslides are time-consuming, costly, dangerous, and the quality and quantity of the data is sometimes unable to meet the necessary requirements of geotechnical projects. This motivates the development of more automatic and efficient remote sensing approaches for landslide progression evaluation. Automatic change detection involving low-altitude unmanned aerial vehicle image-based point clouds, although proven, is relatively unexplored, and little research has been done in terms of accounting for volumetric changes. In this study, a methodology …

An Exploratory Examination Of Perceptions Of Impacts To A Coastal Destination: Tourists Versus Locals, Eric Frauman
An Exploratory Examination Of Perceptions Of Impacts To A Coastal Destination: Tourists Versus Locals, Eric Frauman
Journal of Tourism Insights
Do tourists believe they positively or negatively impact the destinations they visit, particularly those that rely on coastal nature and heritage-based environments to attract visitors? How do tourist’s perceptions compare to residents, and what additional insight might this information provide for destination management organizations (e.g., Convention and Visitors Bureau’s) and local government officials? Furthermore, how do residents perceive their own impacts to the communities they live in? As such, this exploratory study, unlike previous studies, compared tourists and residents perceived impacts to a coastal destination. Statistically significant mean differences were found across the social, economic, and environmental condition impact items …

Bedrock Geology Of Dfdp-2b, Central Alpine Fault, New Zealand, Virginia Gail Toy, Angela Halfpenny
All Faculty Scholarship for the College of the Sciences
During the second phase of the Alpine Fault, Deep Fault Drilling Project (DFDP) in the Whataroa River, South Westland, New Zealand, bedrock was encountered in the DFDP-2B borehole from 238.5–893.2 m Measured Depth (MD). Continuous sampling and meso- to microscale characterisation of whole rock cuttings established that, in sequence, the borehole sampled amphibolite facies, Torlesse Composite Terrane-derived schists, protomylonites and mylonites, terminating 200–400 m above an Alpine Fault Principal Slip Zone (PSZ) with a maximum dip of 62°. The most diagnostic structural features of increasing PSZ proximity were the occurrence of shear bands and reduction in mean quartz grain sizes. …

Abstract
To classify trees along a spectrum of isohydric to anisohydric behavior is a promising new framework for identifying tree species' sensitivities to drought stress, directly related to the vulnerability of carbon uptake of terrestrial ecosystems with increased hydroclimate variability. Trees with isohydric strategies regulate stomatal conductance to maintain stationary leaf water potential, while trees with anisohydric strategies allow leaf …
