Extraterritoriality Of The Regulations And Interconnections Of The Derivatives Market: Legal Implications For East And Southeast Asia, Christopher C. H. Chen Sep 2017

Extraterritoriality Of The Regulations And Interconnections Of The Derivatives Market: Legal Implications For East And Southeast Asia, Christopher C. H. Chen

Research Collection Yong Pung How School Of Law

This article examines the legal implications of the interconnections of the global derivatives market, such as the exchange and over-the-counter (OTC) markets, in East and Southeast Asia. First, we introduce the interconnectedness of the global derivatives market. We then examine some legal implications of such interconnectedness from several angles, such as the extraterritoriality of relevant regulations (notably the reporting, clearing and trading mandates prescribed by the G20 and the new initial margin rule), standard product documentation, the effect of substituted compliance, the potential competition effect due to shifting OTC trades to exchange trading and the effect of consolidating exchanges and/or …

The Gods Of The Hunt, Brian Campbell Sep 2017

The Gods Of The Hunt, Brian Campbell

School of Law, Humanities and Social Sciences

How do stereotypes – as rhetorical, homogenising claims about the Self and Other – survive despite their users having personal experiences that contradict them? This article addresses this question by examining why the Christian and Muslim inhabitants of the Spanish enclave of Ceuta insist the ‘moro’ is a cunning, hostile antagonist, even when their interactions with Moroccans tend to be profitable, and even as ethnographers of mainland Spain report widespread revisions of the Moorish migrant’s negative image and the country’s Islamic past. Building on the interpretative model of stereotypes developed by Herzfeld, Brown and Theodossopolous, I argue that the ‘moro’ …

The Limitations Of Hibonite As A Single-Mineral Oxybarometer For Early Solar System Processes, Aj Berry, Pf Schofield, An Kravtsova, La Miller, Et Al Sep 2017

The Limitations Of Hibonite As A Single-Mineral Oxybarometer For Early Solar System Processes, Aj Berry, Pf Schofield, An Kravtsova, La Miller, Et Al

School of Geography, Earth and Environmental Sciences

The relationships between the composition of hibonite with the general formula CaAl12-2x-yMgxTi4+xTi3+yO19, the oxidation state of Ti (Ti3+/ΣTi, where ΣTi = Ti3+ + Ti4+), and oxygen fugacity (fO2) were investigated experimentally. It was found that hibonite can be synthesised with a range of Ti3+/ΣTi values at constant fO2 and with a constant Ti3+/ΣTi value for a range of fO2s. It was also found that if hibonite with the formula CaAl12-yTi3+yO19 (Ti3+/ΣTi = 1) is equilibrated with a melt of CAI composition at fO2s below the iron-wüstite buffer then the resulting hibonite contained Mg, with Mg per formula unit (pfu) ~ …

A Phenomenological Study Of Military Veteran Student Attrition At Western Virginia Community Colleges, Gordon Cavendish Sep 2017

A Phenomenological Study Of Military Veteran Student Attrition At Western Virginia Community Colleges, Gordon Cavendish

Doctoral Dissertations and Projects

The purpose of this phenomenological study was to describe the experience of “discontinued enrollment” for military veteran students at western Virginia community colleges. The theory guiding this study was Schlossberg’s (1981) transition theory, as the military veteran students were in transition from the military to the community college. The research questions were, how did military veterans describe their experiences at the community college, and what factors did military veterans identify as influencing their decision to discontinue enrollment? The methodology chosen was transcendental phenomenology which followed a focused structure and data collection methods including interviews, a questionnaire, member checks, and collection …

Assessment Of Renewable Energy Resources In Iran; With A Focus On Wave And Tidal Energy, D Khojasteh, D Khojasteh, R Kamali, A Beyene, G Iglesias

School of Engineering, Computing and Mathematics

A growing world population and socio-economic development are at the root of an ever-increasing energy demand throughout the world. Much of this demand is met by means of fossil fuels, leading to greenhouse gas emissions and climate change – hence the need for increasing the share of renewable energy sources in the global energy mix. Marine energy is a reliable, high-density source of energy with limited environmental impacts. Iran, with its long coastline, growing population, increasing energy demands and extreme air pollution, has a great potential for the development of marine energy. However, this potential has not received sufficient legislative …

Programming Frameworks For Mobile Sensing, Hillol Debnath Aug 2017

Programming Frameworks For Mobile Sensing, Hillol Debnath

Dissertations

The proliferation of smart mobile devices in people’s daily lives is making context-aware computing a reality. A plethora of sensors available in these devices can be utilized to understand users’ context better. Apps can provide more relevant data or services to the user based on improved understanding of user’s context. With the advent of cloud-assisted mobile platforms, apps can also perform collaborative computation over the sensing data collected from a group of users. However, there are still two main issues: (1) A lack of simple and effective personal sensing frameworks: existing frameworks do not provide support for real-time fusing of …

Agriculture, Water Pollution, And The Future Of Epa’S Regulatory Authority In A Post-American Farm Bureau Federation V. U.S. Epa America, Henry Brudney Aug 2017

Agriculture, Water Pollution, And The Future Of Epa’S Regulatory Authority In A Post-American Farm Bureau Federation V. U.S. Epa America, Henry Brudney

Seattle Journal of Environmental Law

Until the recent decision of American Farm Bureau Federation v. U.S. EPA, the EPA’s total maximum daily load (TMDL) regulation under the Clean Water Act contained no substantive standard for water quality. However, in this decision, the Third Circuit added such substantive criteria to the TMDL, which should have a monumental effect on the improvement of water quality standards in the United States.

Of Mines And Men: Toward A Foundational Theory Of The Rise, Evolution And Decay Of Property, Guillermo Arribas Irazola Aug 2017

Of Mines And Men: Toward A Foundational Theory Of The Rise, Evolution And Decay Of Property, Guillermo Arribas Irazola

Seattle Journal of Environmental Law

Why and how is property created? Through a historical analysis, this paper proposes that property is created not out of ideology, but by chance. Depending on the resources encountered by newcomers, a rising civilization will establish property through a centralized controlling government (a top-down system) or through people’s recognized possession (a bottom-up or Lockean system). In the former, the government will create and allocate property at its own discretion, while in the latter, the government will recognize and provide protection for the property of individuals.

When the Spaniards conquered Peru in the 1528, they found immense amounts of gold and …

Canada-Ghana Engagements In The Mining Sector: Protecting Human Rights Or Business As Usual?, Cynthia Kwakyewah, Uwafiokun Idemudia

The Transnational Human Rights Review

While states have traditionally had the responsibility to protect human rights, multinational corporations (MNCs) are now increasingly expected to also respect human rights in their pursuit of profitability. However, the increased incidence of human rights violations associated with the activities of MNCs in developing countries has led to various efforts to promote the corporate duty to respect human rights. This article seeks to examine the extent to which Canada’s national Corporate Social Responsibility (CSR) strategy can contribute to the prevention or amelioration of incidences of human rights violation associated with the activities of Canadian mining companies operating in Ghana. The …

Spatial And Temporal Deformation Pattern Of The Brain From Blunt Trauma, Abdus Ali Aug 2017

Spatial And Temporal Deformation Pattern Of The Brain From Blunt Trauma, Abdus Ali

Theses

It is widely accepted that under extreme loadings the soft tissue of the brain will deform inside the skull, creating large amounts of both stress and strain on the tissue. This can result in a focal injury, or in the case of acceleration and deceleration, diffuse injuries. Any attempt at understanding the underlying mechanisms and effects of TBI, have to start by focusing on what is actually occurring within the brain. The objective of this experiment is to record differences in the spatial and temporal patterns of deformation within the brain during blunt trauma when changing impact parameters. A linear …

Indonesian Food Security Policy, Michelle Engel Limenta, Sianti Chandra Aug 2017

Indonesian Food Security Policy, Michelle Engel Limenta, Sianti Chandra

Indonesia Law Review

Food security has been an issue of endless discussions given its sensitive nature of being associated with the wellbeing of individuals. Pursuant to Article 33 of the Indonesian Constitution, the Indonesian Government, in principle, have the legal capacity to utilize to the greatest extent the nation’s natural resources for the sake of the welfare of Indonesian citizens through regulating and issuing relevant policies. As regards food security, Indonesian policies, in general, have been more focused on programs that aim to promote self-sufficiency in food production in order to achieve food security, as stated in Law No. 18 of 2012 regarding …

Numerical Simulation For Identification Of Insects Using A Cw Lidar System, Christo Videlov Aug 2017

Numerical Simulation For Identification Of Insects Using A Cw Lidar System, Christo Videlov

Theses

Mosquitos are the most common vector of disease in the world, causing millions of deaths a year. While curing the diseases they cause is one approach to this problem, another could be to avoid the mosquitos in the first place. Knowing their flight patterns, location, and population in one area could aid in this. Additionally, classifying the mosquitos in an area would be helpful. The age and sex of the mosquito is important to find as they affect the chances of the insect carrying diseases such as malaria or yellow fever.

Many current methodologies to monitor insects are based on …

Structural Poverty And College Enrollment: The Impact Of Rural American Determinism, Bryan Robinson Aug 2017

Structural Poverty And College Enrollment: The Impact Of Rural American Determinism, Bryan Robinson

Graduate Theses, Dissertations, and Capstones

Abstract

The pervasiveness of generational poverty in the US and the potential of a postsecondary (college) education to serve as an ameliorator and catalyst for societal change – both in individual, familial and broader community contexts – is established in the literature (Enberg & Wolniak, 2010; Kaufman, 2014; Turley, 2009; Rank, Yoon & Hirschl, 2015). Rank et al. (2003) found that American poverty is structural in nature as it relates to the labor market and related ineffective social policy, resulting in predictable and repetitious cycles of systemic and generational poverty, which is particularly relevant in rural contexts. Tickameyer and Duncan …

Hanford Nuclear Site: Remediating To A Standard Safe For All Or Some?, Dylane Jacobs Aug 2017

Hanford Nuclear Site: Remediating To A Standard Safe For All Or Some?, Dylane Jacobs

Seattle Journal of Environmental Law

The cleanup of the Hanford Nuclear Site is one of the largest cleanups undertaken in the U.S. and is governed by many Federal and State environmental statutes. While CERCLA and the later SARA amendments should require the U.S. Department of Energy to clean up the site to a level acceptable for Native American tribes, thus far they have failed to do so. The U.S. Department of Energy can, and should, act to be more effective at remedying the injustices and cleanup of Hanford to the level needed for the historical use of the land.

Problems Of Conducting Equal Education Rights For Non-Formal Education: Challenges For Batam Local Government, Win Sherly Tan Aug 2017

Problems Of Conducting Equal Education Rights For Non-Formal Education: Challenges For Batam Local Government, Win Sherly Tan

Indonesia Law Review

In order to fulfill the right to education as mandated by the 1945 Constitution, non-formal education has been introduced in Indonesian society. Non-formal education is provided for in Article 26 paragraphs 1-7 of Law No. 20 of 2003 on the National Education System. Since this provision has been mandated by the Law, the question arises as to whether the Government of Batam City has efficiently implemented the right to education for all. Another question is whether the system for implementing equal education through Community Learning Centers and Homeschooling in Batam City aimed at assisting the Batam City Government is the …
