Benford’s law quantifies the surprising fact that in many datasets, such as populations of counties, numbers on the World Wide Web, or incomes and expenses on tax returns, the numbers are much more likely to start with small digits like 1 or 2 than with large digits like 8 or 9. The law actually provides a specific probability distribution on the (significant) digits, telling exactly how likely each sequence of digits is.

Draining The Swamp Requires Robust Whistleblower Protections And Incentives, Jason Zuckerman, Tom Devine

The Trump Administration has promised to 'drain the swamp,' combat corporate corruption, and root out waste, fraud, and abuse in the federal government. To achieve those laudable goals, the new Administration will need to appoint effective leaders to the agencies or subagencies charged with enforcing whistleblower-protection laws, and Congress will need to preserve and, indeed, enhance whistleblower protections in the public and private sectors. This Article provides a detailed agenda for the new Administration to ensure effective enforcement of federal whistleblower-protection laws and an agenda for Congress to plug significant gaps in whistleblower-protection laws.

In later life, people are faced with a multitude of risky decisions that concern their health, finance, and personal security. Older adults often exercise caution in situations that involve risk. In this research, we asked whether older adults are also more responsive to warnings about potential risk. An answer to this question could reveal a factor underlying increased cautiousness in older age. In Study 1, participants decided whether they would engage in risky activities (e.g., using an ATM machine in the street) in four realistic scenarios about which participants could be expected to have relevant knowledge or experience. "I Made A Choice": Exploring The Persuasion Tactics Used By Online Romance Scammers In Light Of Cialdini's Compliance Principles, Aaron K. Archer

Online romance scams cause a disproportionately high amount of loss to victims when compared to other cybercrimes, and evidence suggests these scams may be more pervasive than official figures indicate. Unlike some other cybercrimes, an online romance scam is only successful to the extent that the scammer can persuade the victim to carry out requests. In his book, Influence: The Psychology of Persuasion, psychologist Robert Cialdini has identified six psychological principles often exploited by those seeking to gain the compliance of others; these principles may provide a good framework for understanding the effectiveness of the tactics used by online romance …

Historically, there has been little incentive for healthcare and pharmaceutical corporations to adhere strictly to federal administrative regulations. The monetary penalties, while in the billions of dollars, have paled in comparison to the profits reaped by the unlawful marketing, off-label usages, and fraudulent billing to federal healthcare programs. In 2015, former Attorney General, Sally Yates, issued the now famous Yates Memorandum to take the first step in curbing this trend of corporate misconduct. In sub-Saharan Africa, only 13% of new businesses show profitability and survive beyond start-up. Such a low rate of success has an adverse impact on the region economy as small and medium enterprises comprise 90% of African businesses. Understanding the cause of business failure can help existing and new entrepreneurs to focus on factors that may help to overcome barriers to business growth and increase entrepreneurs' chances of success. Since its inception in August 2011, the SEC’s whistleblowing program has received over 18,000 tips and has distributed over thirty awards. The Commission’s Enforcement Division has lauded the program, emphasizing its recoveries (over $500 million in the aggregate) as well as its generous bounties (over $100 million total). Nevertheless, an agency focused on deterrence must pay attention to the volume of credible reports it receives from insiders, particularly because deterrence has been shown to rest so strongly on the putative wrongdoer’s perceived probability of detection. Organizational research has long been interested in crises and crisis management. Whether focused on crisis antecedents, outcomes, or managing a crisis, research has revealed a number of important findings. However, research in this space remains fragmented, making it difficult for scholars to understand the literature’s core conclusions, recognize unsolved problems, and navigate paths forward. To address these issues, we propose an integrative framework of crises and crisis management that draws from research in strategy, organizational theory, and organizational behavior, as well as from research in public relations and corporate communication. Over the last 40 years, advocates for crime victims have succeeded in enshrining victims’ rights in state constitutions and other enactments. These provisions show that a consensus has developed around the country on certain core victims’ rights. Included in the core are, among other things, the right to notice of court hearings, to attend court hearings, to be heard at appropriate court hearings, to proceedings free from unreasonable delay, to consideration of the victims’ safety during the process, and to restitution. The current challenge for the country is ensuring that these core rights are fully and effectively implemented and that …

Passwords are broken. Multi-factor Authentication overcomes password insecurities, but its potentials are often not realised. This article presents InSight, a system to actively identify perpetrators by deceitful adaptation of the accessible system resources using Multi-factor Authentication profiles. This approach improves authentication reliability and attributes users by computing trust scores against profiles. Based on this score, certain functionality is locked, unlocked, buffered, or redirected to a deceptive honeypot, which is used for attribution. The novelty of this approach is twofold; a profile-based multi-factor authentication approach that is combined with a gradient, deceptive honeypot.

Appeals to greed in support of various tax proposals are often seen in response to populist moods in politics. Such appeals may be used to garner political support for a policy or proposal. However, there has been little academic consideration of the role of greed (or attitudes towards greed) in the law, and in tax law in particular. This Article seeks to fill that gap by taking a close look at the concept of greed. Intangible Fish And The Gulf Of Understanding: Yates V. United States And The Court's Approach To Statutory Interpretation, John M. Garvin

Is a fish a tangible object? The answer in most cases is obviously “yes.” But in Yates v. United States, the Supreme Court held that fish are outside the meaning of the phrase “tangible object” as it is used in the Sarbanes–Oxley Act of 2002. This Note argues that the Yates decision provides a lens with which to examine the Court’s contemporary methods of statutory interpretation. In adopting the textualist vocabulary most famously associated with the late Justice Scalia, the Justices have committed to speaking the same language. Still, fundamental differences between the Justices remain. These differences expose the …

Purpose
The purpose of this paper is to review research on litigation in corporate finance.
Design/methodology/approach
This paper surveys studies on the estimation of litigation risk, litigation costs, stock reaction to lawsuit announcement, and the effect of litigation on corporate financial policies and outcomes.
Findings
The first section presents a survey of studies that estimate litigation risk. The authors then discuss a set of studies that focus on the various costs associated with litigation. Professor Byrnes offers a preliminary narrative to examine the serious challenge of Control Firsters' vision that every jurisdiction should have complete information on all transactions by any taxpayer. A question that Control Firsters must address is whether it is prudent for taxpayers to trust the governments of the 117 countries that scored a fifty or below on Transparency International's corruption index. Quite possibly, the complete information system invoked by Control Firsters encourages, even prolongs, the bad behavior by providing fuel (financial information) to feed the fire of corruption and suppression of rivals. In lawsuits about data breaches, the issue of harm has confounded courts. Harm is central to whether plaintiffs have standing to sue in federal court and whether their claims are viable. Plaintiffs have argued that data breaches create a risk of future injury from identity theft or fraud and that breaches cause them to experience anxiety about this risk. Courts have been reaching wildly inconsistent conclusions on the issue of harm, with most courts dismissing data breach lawsuits for failure to allege harm. A sound and principled approach to harm has yet to emerge, resulting in a lack of consensus …

Visual analytic systems have long relied on user studies and standard datasets to demonstrate advances to the state of the art, as well as to illustrate the efficiency of solutions to domain-specific challenges. This approach has enabled some important comparisons between systems, but unfortunately the narrow scope required to facilitate these comparisons has prevented many of these lessons from being generalized to new areas. At the same time, advanced visual analytic systems have made increasing use of human-machine collaboration to solve problems not tractable by machine computation alone. Ethical transgression is an ongoing problem in higher education. There is a relationship between the perceived ethical climate of an organization and the ethical behavior of its employees, and that ethical climate can be a predictor of ethical behavior. The ethical climate types are: egoistic, deontological, and utilitarian. This quantitative study measured and identified the perceived ethical climate of administrators and full-time faculty at a higher education institution, and then compared the results to determine if there was a significant difference in perception. There are many decisions that Americans have to make about retirement before, at, and after retirement. For example, Americans have to decide when to start saving for retirement, how much to save, how to invest those savings, when to retire, when to claim social security, and how to take required minimum distributions from 401(k) plans or Individual Retirement Accounts. Different things can go wrong at each of these decisions for different reasons. Many Americans, for various reasons, including insufficient energy, money, motivation, time, and understanding, do no retirement planning.
