True German And Phony English Laughter: Schmidt-Hidding Was Still Schmidt, Christian F. Hempelmann Dec 2017

True German And Phony English Laughter: Schmidt-Hidding Was Still Schmidt, Christian F. Hempelmann

Faculty Publications

Schmidt-Hidding’s (b. 1903, d. 1967) lexical field study on the area of Humor und Witz [humour and wit/jokes] (1963b) receives attention in humour research to this day, especially in German-speaking countries. His diamond-shaped illustration of the two dimensions of the field of humour, not least in its aim to distinguish “earthy” German from “courteous” English humour, has become well-known. In view of this continued interest in the final write-up of Schmidt-Hidding’s work on humour (1963a, 1963b), in which he consistently ignores his earlier related publications under the name of Schmidt, this paper aims to discourage researchers from basing their work …

Effects Of Environment On Depressive Symptoms On Chinese Left-Behind Children, Lanyan Ding, Eric S. Buhs

The Nebraska Educator: A Student-Led Journal

Estimates indicate that about 70 million children in China have been left behind in their hometowns by one or both parents as their parents migrate to other places for work opportunities. However, the potential impact of parental migration on the emotional well-being of left-behind children is still unclear. The purpose of this study was to examine depression levels in Chinese left-behind children and to identify potential risk factors contributing to depressive symptoms in this population. Using a nationally-representative, stratified sample from the China Family Panel Studies (CFPS) database (3019 children, ages 10-15), an HLM model was applied at 1) the …

Arbitration Agreements And Actions For Antitrust Damages After The Cdc Hydrogen Peroxide Judgment, Katarzyna Sadrak Dec 2017

Arbitration Agreements And Actions For Antitrust Damages After The Cdc Hydrogen Peroxide Judgment, Katarzyna Sadrak

Yearbook of Antitrust and Regulatory Studies

On May 21st 2015, the Court of Justice of the European Union in CDC Hydrogen Peroxide decided whether the application of jurisdiction clauses in actions for damages impedes the effective enforcement of EU competition law. The CJ stayed silent, however, on how to treat arbitration clauses, which similarly to jurisdiction clauses, exclude a default court jurisdiction. The question of how to interpret arbitration agreements in the event of an antitrust violation and subsequent actions for damages remains thus unanswered. In light of the foreseen increase in private enforcement of EU competition law, this problem gains significance. This is because arbitration …

Stuck In Ohio's Legal Limbo, How Many Mistrials Are Too Many Mistrials?: Exploring New Factors That Help A Trial Judge In Ohio Know Whether To Exercise Her Authority To Dismiss An Indictment With Prejudice, Especially Following Repeated Hung Juries, Samantha M. Cira Dec 2017

Cira

Cleveland State Law Review

Multiple mistrials following validly-prosecuted trials are becoming an increasingly harsh reality in today’s criminal justice system. Currently, the Ohio Supreme Court has not provided any guidelines to help its trial judges know when to make the crucial decision to dismiss an indictment with prejudice following a string of properly-declared mistrials, especially due to repeated hung juries. Despite multiple mistrials that continue to result in no conviction, criminal defendants often languish behind bars, suffering detrimental psychological harm and a loss of personal freedom as they remain in “legal limbo” waiting to retry their case. Furthermore, continuously retrying defendants cuts against fundamental …

Carbon Fiber Electrodes For In Vivo Neural Recording, Esma Cetinkaya Dec 2017

Carbon Fiber Electrodes For In Vivo Neural Recording, Esma Cetinkaya

Theses

Multi-channel micro electrodes for neural recording is a growing field that thrives on novel materials and fabrication techniques offered by micro fabrication technology. The material and the design of microelectrodes have a critical role on the quality of neural signals recorded. The neural signals collected by chronic implantation of these devices in experimental animals reveal new information about the brain functions and guide the development of new diagnostic and treatment options for neurological disorders.

Ideally, a microelectrode should meet two important criteria: longevity after implantation and minimal tissue insult. Carbon fibers` high tensile strength and flexibility allow fabrication of micro-scale …

Notarial Acts As Written Evidence: Towards A Convergence Between Civil Law And Common Law Systems, Angelo Chianale Dec 2017

Notarial Acts As Written Evidence: Towards A Convergence Between Civil Law And Common Law Systems, Angelo Chianale

Journal of Civil Law Studies

This article studies the contrast between civil and common law systems regarding the significance of the notarial act. According to conventional scholarship, in the former, civil procedure requires written evidence and the notarial act is the strongest kind of evidence. In the latter, however, civil procedure requires oral evidence and the notarial act has no specific relevance. This article examines the extent of these two main principles: a) in civil law systems the notarial act is full evidence of the extrinsic and a document can be challenged only with an action for falsity; and b) in common law systems the …

The Reluctance Of Civil Law Systems In Adopting The Ucc Article 9 “Without Breach Of Peace” Standard—Evidence From National And International Legal Instruments Governing Secured Transactions, Asress Adimi Gikay, Cătălin Gabriel Stănescu

Journal of Civil Law Studies

One of the defining features of the Uniform Commercial Code Article 9 is the secured creditor’s ability to take possession of the collateral upon the debtor’s default “without breach of peace.” This standard is meant to protect the debtor from abusive secured creditors, the meaning of which has been shaped by courts on a case-by-case basis.

In reforming their secured transactions laws to enhance access to credit, continental legal systems have shown great reception to Article 9 by adopting the unitary concept and functional approach to security interests, introducing private enforcement mechanisms, including various forms of self-help repossession. However, the …

Open Access Competition In The Long-Distance Passenger Rail Services In Poland, Marcin Król Dec 2017

Open Access Competition In The Long-Distance Passenger Rail Services In Poland, Marcin Król

Yearbook of Antitrust and Regulatory Studies

This paper presents evidence of the head-on open access competition which took place on the market of long-distance passenger rail services in Poland in 2009-2015. The regional governments-owned challenger managed to raise its market share to more than 33% (2010) but eventually was forced out of the market (2015) due to a sudden change in its business strategy as well as the incumbent’s strategic pressure on the political and regulatory decision-makers. This case has not featured yet in the scientific discussion on the open access in the passenger rail markets in Europe and the main aim of this preliminary study …
