Metal-nonmetal transition, or more specifically, metal-insulator transition (MIT) has been one of the most intriguing topics in condensed matter physics. Two theories describing fundamental driving mechanisms of MIT has been well-established over time: Mott-Hubbard theory and Anderson localization theory. The former mainly deals with contribution of electron interactions/correlations to the MIT, and the latter focuses on the role of disorder. However, it is an open topic how a system behaves when both effects exist in a system. Durability of reinforced concrete structures depends highly on the integrity of the concrete which protects the structure from the environment. However, concrete is a brittle material and as such it is prone to cracking which allows for detrimental agents to penetrate the structure and produce early deterioration. Embedding microcapsules with chemical healing agents in concrete materials for self-healing applications as well as implementing SMAs as reinforcement of concrete structures for self-closing of cracks are both state-of-the-art techniques with enormous potential for enhancement of concrete infrastructure durability. Based on my original empirical research, in this Article, I expose a disparity between the demographics of the roughly 650 religious congregations that have filed for chapter 11 bankruptcy during part of the last decade and congregations nationwide. Churches with predominately black membership — Black Churches — appeared in chapter 11 more than three times as often as they appear among churches across the country. A conservative estimate of the percentage of Black Churches among religious congregation chapter 11 debtors is 60%. The likely percentage is upward of 75%. Black Churches account for 21% of congregations nationwide.

Pregnant women sometimes ask employers for accommodations – such as being able to sit on a stool or avoid heavy lifting – to permit them to work safely and productively. In 2015, in Young v. United Parcel Service, the Supreme Court held that the Pregnancy Discrimination Act (PDA) requires courts to scrutinize carefully denial of such requests. The facts in Young arose prior to the effective date of the ADA Amendments Act of 2008 (ADAAA); accordingly, the Court did not address how the ADAAA, which expanded the range of health conditions that qualify as disabilities, affects claims for accommodations under …

Descendants of Abraham: A Comparative Approach to Jewish and Islamic Rhetorics provides two important correctives to modern scholarship. It emphasizes the importance of Jewish and Islamic rhetorics typically neglected by Western-centric historians of rhetoric, and it showcases the cultural relationship between Jews and Muslims that has been typically occluded by modern scholarship. Focusing on the early Islamic world, I demonstrate instantiations of interconnectivity between Jewish and Islamic rhetoric in Arabic from the 9th-12th centuries CE. Although the Gulf of Mexico is one of the most studied basins in the world, a majority of the focus has been driven by petroleum exploration and/or on seismic and sedimentological facies models. Rarely has the intent of previous studies been to characterize the Holocene climatic record of coastal Texas. Of those studies that discuss Holocene vegetation change, the majority focus on the Mississippi River Delta, the Edwards Plateau or central Florida, leaving an absence of insight to western Gulf of Mexico climate changes. The initial part of this dissertation is a symphony. Symphony No. 1 consists of three movements. Each movement begins with a monumental gesture designed to make a bold and unforgettable statement. Within each movement, there is an interesting array of harmonic and rhythmic schemes. In Symphony No. 1, the diametrically opposed concepts of “simple” and “complex” are featured prominently. These concepts are contrasted thematically, rhythmically, and harmonically. Abstract This research describes the life, compositional style and works of one of the most well-known Albanian composers, Aleksander Peçi, focusing on how the political climate affected his life and his art. Several of Peçi’s techniques are examined, including Carousel structure, Cartesian Production, Kabaoisos, and Polygravité. Albanian iso-polyphony and its influence on Peçi’s work are discussed. The research was done in hopes of reaching a better understanding of the effects Communism and the subsequent period of freedom have had on Albanian music.

As a nation, we have recently experienced a significant positive shift in norms against casual campus sexual violence. These changes are perhaps as dramatic as the attitudinal shifts over recent decades regarding drunk driving or cigarette smoking. In a world in which masculinity is too often associated with sexual conquest, and women still suffer under intense and conflicting pressures regarding their sexual behavior, pushing this potential transformation forward is both difficult and necessary. One hundred years after Albert Einstein predicted the existence of gravitational waves as a result of his theory of general relativity, the Laser Interferometer Gravitational-Wave Observatory (LIGO), made the first direct detection of a gravitational-wave signal from a binary black hole merger, GW150914. GW150914 was found not only by search methods specifically developed to find the distinctive waveform produced by coalescing binaries, but also by generic searches designed to find any arbitrary short-duration signal in the LIGO data. During the New Deal era, Congress created a then-unprecedented program of economic and regulatory reforms, establishing independent agencies, and empowering them to shape and enforce pragmatic industrial policies. Twenty-first century regulation looks strikingly different from the New Deal vision. While New Deal agencies continue to perform some regulatory functions, market approaches have replaced many traditional command-and-control formulations, with private entities stepping in to perform tasks historically reserved to government.

In the United States, as the Hispanic population continues to grow, persistently low mathematics achievement among Mexican Americans continues to exist, particularly among girls. Low mathematics achievement places this group in a disadvantaged position. As such, a multistage mixed method study was implemented to investigate possible factors associated with mathematics achievement and the probability of taking mathematics courses beyond Algebra 2 among Mexican American female high school students. The Educational Longitudinal Study (ELS:2002) database provided the quantitative sample (n = 710) of respondents who self-identified as Mexican American, female, and had a math IRT score. This essay explains how the American Health Care Act (AHCA) – the House Republicans’ proposed replacement for Obamacare – would toss a hot potato to state governments. Were the AHCA to be enacted into law, state governments would need to act promptly if they are to save individual insurance markets within their states. This essay explains measures that state governments might take to respond to this threat.

This study explored the tenure experiences of seven Black female professors as they pursued tenure at select public higher/highest research activity predominantly white institutions. This study was pursued in an attempt to determine what challenges were presented during the tenure process. More importantly, this study sought to determine the role of mentorship in the pursuit of tenure. This dissertation details an intelligent tutoring system which aims to raise student trait abilities across concepts and levels of Blooms taxonomy within an educational program. The system utilizes Item Response Theory, a probabilistic theory of assessment which accounts for item discrimination, difficulty, and probability of guessing in its assessment of student trait ability. A modification to Item Response Theory which accounts for question dependencies is used to assess the probability that a student will answer a given question correctly given prior responses on the dependency questions. Self-healing concrete through microencapsulated calcium nitrate is a novel approach to enhance durability and decrease the costs associated with maintenance and repairs. Charles Wilkinson’s estimable contribution to public land law scholarship is widely cited but only partly understood. From the mid-1970s to the mid-1980s he upended the field by elevating the diffuse public interest, displacing creation and adjudication of private property interests as the field’s focus. However, his subsequent scholarship grappled with an even more important challenge that has been far less noted. Beginning in the late 1980s, Wilkinson explored how legal institutions should determine the pluralistic, public interest. In trailblazing articles and books, he rose to the challenge with site-specific details, compelling narratives, and aspirational themes. This work undermined the dominance …

ABSTRACT This research was designed to isolate a standard 3D scanning methodology using a popular 3D scanner (NextEngine®) used in biological anthropology to reproduce research-quality human skeletal remains. Settings using NextEngine® hardware were determined through three successive studies. The first study used minimum settings to create a topography of nine postcranial bones excavated from a Maya archaeological site, Moho Cay, Belize. The research was conducted in Louisiana State University’s (LSU) Digital Imaging and Visualization in Archaeology (DIVA) Lab. The resulting 3D scans were visually compared to the original bone specimens for similarities in five categories. The similarity ratings were used …

This Article addresses a policy question that has challenged scholars and lawmakers since the 1850s: Do the transaction cost benefits of patent pools outweigh their potential for consumer harm? This question has special importance today. Patent pools are on the increase, due to large numbers of patents in critical industries such as software and mobile phones. In this Article, we present the first empirically-based estimate of the transaction costs savings engendered by patent pools. Drawing on interviews with administrators of prominent pools, we document the costs of assembling and administering a functioning pool. We then estimate the transaction costs that …

Kalman filtering is a widely used recursive algorithm for optimal state estimation of linear stochastic dynamic systems. The recent advances of wireless sensor networks (WSNs) provide the technology to monitor and control physical processes with a high degree of temporal and spatial granularity. Several important problems concerning Kalman filtering over WSNs are addressed in this dissertation. Contrary to much commentary and possibly some seemingly settled law, this essay argues that an American President (or a similarly situated state officer or office) may issue individual and "blanket"-or mass-clemency benefiting classes of named or unnamed individuals, and in addition may pardon himself, but only if doing so comports with the principles of fundamental fairness that define due process of law under the Constitution's Fifth and Fourteenth Amendments. This article offers what has been needed but lacking in modern legal commentary: thorough, meticulous and timely proof that, pursuant to principles of Originalism, the Constitution - the highest law of the United States - mandates that any governmental act is unconstitutional if it is immoral.

Specifically, this article returns fundamental constitutional jurisprudence to where it rightly was until roughly a century ago; and, where, recently, it has been returning in the form of Supreme Court substantive due process precedents based on human dignity.
