The Worship Experience We Long For: The How Of Worship, S. Joseph Kidder
The Worship Experience We Long For: The How Of Worship, S. Joseph Kidder
Faculty Publications
Have you ever longed for meaningful worship? In the previous article of this series, we discovered that God’s identity as the powerful and good God is the reason—the why—of worship. Now that we know the why behind our worship, it’s time to answer the question of how. Amidst all our discussions of worship, we often center on the style of worship. The intent of this article is to describe how to behave in a worshipful way, whether in a personal or corporate setting, given insights gleaned from Psalm 100.
A Research Agenda For The History Of Property Law In Europe, Inspired By And Dedicated To Marc Poirier, Anna Di Robilant
A Research Agenda For The History Of Property Law In Europe, Inspired By And Dedicated To Marc Poirier, Anna Di Robilant
Faculty Scholarship
Proposes the following research agenda: (a) understanding the relation between property and long-term economic change by focusing on the relation between property law and what historians call "social property" relations; (b) understanding property concepts and ideas in the context of the larger ideological and philosophical ideas that shaped the immediate world of jurists and property lawyers; (c) looking beyond the single, contingent episodes of the history of property law and identifying longterm patterns and regularities in the way jurists conceptualized property; and (d) understanding European property culture in its many entanglements with the non-European world.
Trusting Big Data Research, Neil M. Richards, Woodrow Hartzog
Trusting Big Data Research, Neil M. Richards, Woodrow Hartzog
Faculty Scholarship
Although it might puzzle or even infuriate data scientists, suspicion about big data is understandable. The concept doesn’t seem promising to most people. It seems scary. This is partly because big data research is shrouded in mystery. People are unsure about organizations’ motives and methods. What do companies think they know about us? Are they keeping their insights safe from hackers? Are they selling their insights to unscrupulous parties? Most importantly, do organizations use our personal information against us? Big data research will only overcome its suspicious reputation when people can trust it.
Some scholars and commentators have proposed review …

On Questioning Automation, Woodrow Hartzog
Faculty Scholarship
Given the rapid pace of innovation and adoption, it can be hard to make sense of automated technologies. New products that leverage algorithms and artificial intelligence seem to be both promising and frightening. Law and policymakers, as well as the general public, are grappling with when to be excited and when to be concerned. If you're confused, you're not alone
The Selection Of Litigation Against Government Agencies: Evidence From China, Wei Cui, Zhiyuan Wang
The Selection Of Litigation Against Government Agencies: Evidence From China, Wei Cui, Zhiyuan Wang
All Faculty Publications
We test the relevance of the selection theory of litigation in a contemporary, civil law setting, using Chinese judicial data that span 25 years regarding lawsuits against government agencies. Civil law systems may be characterized by lower costs of litigation and lower rates of settlement than the U.S. legal system, and therefore the presence of selection effects cannot be assumed. We show that selection effects are indeed manifest in Chinese administrative litigation, and suggest that this may be explained by hidden or intangible litigation costs. Our test for selection effects builds on the approach of previous U.S. studies and potentially …
Flexible Regulation Scholarship Blossoms And Diversifies: 1980-2012, Cristie Ford
Flexible Regulation Scholarship Blossoms And Diversifies: 1980-2012, Cristie Ford
All Faculty Publications
This piece reviews the 198 US law review articles that were most influential within flexible regulation scholarship (which includes meta regulation, responsive regulation, reflexive law, principles based regulation, new governance, and more) between 1980 and 2012, which also discussed innovation. It is chapter 4 of a forthcoming book on financial innovation and regulation. The analysis demonstrates that across this time period, flexible regulation scholars advocated for regulatory structures that were permeable to three main non-legal forces: market forces, deliberation and community norms, and industry standards. The image that emerges is of a diverse scholarly community, within which many adopted economics-derived …
Equality And The Defence Of Provocation: Irreconcilable Differences, Isabel Grant, Debra Parkes
Equality And The Defence Of Provocation: Irreconcilable Differences, Isabel Grant, Debra Parkes
All Faculty Publications
Recent amendments to the defence of provocation have limited access to the defence to those who are provoked by conduct that, if prosecuted, would have been an indictable offence punishable by at least five years imprisonment. The paper argues that these amendments are both over- and under-inclusive and fail to confront the central problem surrounding provocation which is that it privileges loss-of-control rage often in the context of male violence against women or in response to same-sex advances. The paper supports the abolition of the defence of provocation but only if mandatory minimum sentences for murder are abolished providing trial …

To Err Is Human: Can American Medicine Learn From Past Mistakes?, Jeffrey B. Ritterman
To Err Is Human: Can American Medicine Learn From Past Mistakes?, Jeffrey B. Ritterman
The history of medicine includes many errors. Some persisted for decades and caused great harm. Several are highlighted in this article, including the mythical thymic diseases: thymic asthma and status thymicolymphaticus. Some medical mistakes, such as the diet-heart hypothesis of Ancel Keys, continue to cause harm. To avoid future errors and their associated harm, I suggest a cultural shift encouraging professional humility and greater questioning of medical dogma. Medical education focused on teaching students this history may help with this cultural shift.

Midwives’ And Patients’ Perspectives On Disrespect And Abuse During Labor And Delivery Care In Ethiopia: A Qualitative Study, Sahai Burrowes, Sarah Jane Holcombe, Dube Jara, Danielle Carter, Katheryn Smith
Background: It is increasingly recognized that disrespect and abuse of women during labor and delivery is a violation of a woman’s rights and a deterrent to the use of life-saving, facility-based labor and delivery services. In Ethiopia, rates of skilled birth attendance are still only 28% despite a recent dramatic national scale up in the numbers of trained providers and facilities. Concerns have been raised that women's perceptions of poor quality of care and fear of mistreatment might contribute to this low utilization. This study examines the experiences of disrespect and abuse in maternal care from the perspectives of …
Prevention Of Common Pathogens: Development Of Quantitative Structural Activity Relationships For Quaternary Ammonium Compounds Against Foodborne Pathogens And A Computational Analysis Of Intergenic Srna In Streptococcus Pyogenes, Ethan C. Rath
All-Inclusive List of Electronic Theses and Dissertations
The presence of pathogenic bacteria on the surface of meat and produce causes many issues for the consumer including food-borne disease and infection. There are many techniques that have been proposed for food sterilization. Most of these techniques pose many problems including meat discoloration, toxic residues, inefficient application, and high cost of use. One compound, Cetylpyridinium Chloride (CPC), has become the gold standard for food antimicrobials. However, CPC is in need of being replaced due to the development of bacterial resistance, toxic residue developed during the treatment process, and environmental hazards. Using Quantitative Structural-Activity Relationships (QSAR) we have developed predictive …

Statute Language And Clinicians' Judgments Of Treatment Amenability In Juvenile Waiver Cases, Anthony S. Lawrence Jr.
All-Inclusive List of Electronic Theses and Dissertations
Reflecting concerns regarding the suitability of managing certain juvenile offenders within the juvenile justice system, the Court has embraced the transfer of juveniles to adult court as a necessary measure. Among the factors to be considered when deciding between retaining an offender in the juvenile system and transferring him to the adult court concerns his amenability to treatment. Little empirical research has been devoted to this topic, especially with regard to the circumstances that may influence these clinical decisions. The present study explored how clinicians conceptualize and assess treatment amenability, and whether judgments are context dependent when presented with a …

The Impact Of Evidence Drive I/O And Processing Cores In A Forensics Distributed Processing Array, Todd D. Koonts
The Impact Of Evidence Drive I/O And Processing Cores In A Forensics Distributed Processing Array, Todd D. Koonts
All-Inclusive List of Electronic Theses and Dissertations
As drive sizes increase at a relentless rate in computer systems, it has become far more time consuming to process the data sets for the forensic examiner. The advent of cloud computing and the significant size of data queries in e-discovery litigation has also significantly impacted the processing times for cases in the digital forensics field. It is not uncommon for significant delays to occur in processing of this digital evidence. Distributed Processing will likely become a primary method to process evidence in digital forensics due to these increasingly problematic conditions. While there are recommendations from companies that sell distributed …

The description of genetic population structure over a species' geographic range can provide insights into its evolutionary history and also support effective management efforts. Assessments for globally distributed species are rare, however, requiring significant international coordination and collaboration. The global distribution of demographically discrete populations for the humpback whale Megaptera novaeangliae is not fully known, hampering the definition of appropriate management units. Here, we present the first circumglobal assessment of mito - chondrial genetic population structure across the species' range in the Southern Hemisphere and Arabian Sea. We combine new and existing data from the mitochondrial (mt)DNA control region that …

The project is composed of three studies. In Study One a pilot questionnaire was distributed to …
Optimisation Of The Isolation And Identification Of Circulating Melanoma Cells, Anda-Gabriela Marsavela
Optimisation Of The Isolation And Identification Of Circulating Melanoma Cells, Anda-Gabriela Marsavela
Theses: Doctorates and Masters
Although melanoma is largely curable when detected in its earliest stages, it can metastasise to other tissues, drastically reducing survival rates. The most recent therapies used to treat metastatic melanoma are effective long-term in only 11 to 33% of patients. Our ability to monitor treatment failure is limited. New prognostic markers are urgently required to allow monitoring of treatment response and disease progression.
Circulating tumour cells (CTCs) are released into the bloodstream by the tumours within a patient, this being a key step in melanoma spread. Since CTCs can be detected in the blood of metastatic melanoma patients, these cells …
