Prosecutorial Ethics In Retrospect, Bruce A. Green
Prosecutorial Ethics In Retrospect, Bruce A. Green
Faculty Scholarship
This essay examines the ethical regulation of prosecutors over the past three decades. The topic is important from the perspective of criminal justice, no less than legal ethics, because prosecutors are centrally responsible for administering the criminal law. Courts assume that the principal role in regulating prosecutors should be played by the states' formal attorney disciplinary processes rather than by civil liability or judicial oversight in criminal cases. However, there has been a well-justified academic and professional consensus that the disciplinary processes fail to fulfill their expected role because, when it comes to prosecutors, ethics rules are neither sufficiently restrictive …

Department of Nutrition and Health Sciences: Faculty Publications
Natural stable isotope ratios (δ15N) of humans can be used for nutritional analyses and dietary reconstruction of modern and historic individuals and populations. Information about an individual’s metabolic state can be obtained by comparison of tissue and dietary δ15N. Different methods have been used to estimate dietary δ15N in the past; however, the validity of such predictions has not been compared to experimental values. For a total of 56 meals and 21 samples of 24-h diets, predicted and experimental δ15N values were compared. The δ15N values were predicted from self-recorded food intake …

Less-Than-Expected Weight Loss In Normal-Weight Women Undergoing Caloric Restriction And Exercise Is Accompanied By Preservation Of Fat-Free Mass And Metabolic Adaptations, Karsten Koehler, M. J. De Souza, N. I. Williams
Department of Nutrition and Health Sciences: Faculty Publications
Background/Objectives: Normal-weight women frequently restrict their caloric intake and exercise, but little is known about the effects on body weight, body composition and metabolic adaptations in this population.
Subjects/Methods: We conducted a secondary analysis of data from a randomized controlled trial in sedentary normal-weight women. Women were assigned to a severe energy deficit (SEV: –1062 ± 80 kcal per day; n = 9), a moderate energy deficit (MOD: –633 ± 71 kcal per day; n = 7) or energy balance (BAL; n = 9) while exercising five times per week for 3 months. Outcome variables included changes in body weight, …
Parental Views Of Promoting Fruit And Vegetable Intake Among Overweight Preschoolers And School-Aged Children, Martha J. Nepper, Weiwen Chai
Parental Views Of Promoting Fruit And Vegetable Intake Among Overweight Preschoolers And School-Aged Children, Martha J. Nepper, Weiwen Chai
Department of Nutrition and Health Sciences: Faculty Publications
Given the importance of parental influence on children’s eating habits, we explored perceptions of parents of overweight (body mass index–for-age percentile ≥85%) preschoolers (3-5 years) and overweight school-aged children (6-12 years) regarding challenges in promoting fruit and vegetable intake and how they and other family members influence their overweight children’s dietary habits. Focus groups were conducted with 13 parents of overweight preschoolers and 14 parents of overweight school-aged children. Codes and themes were developed by inductive data analysis. Four common themes were identified: short shelf life of fresh fruits and vegetables prohibiting parents from purchasing, children’s taste changes in fruits …

Evaluation Of A Dietary Screener: The Mediterranean Eating Pattern For Americans Tool, L. A. Cerwinske, Heather Rasmussen, S. Lipson, A. S. Volgman, Christy C. Tangney
Department of Nutrition and Health Sciences: Faculty Publications
Background: Evidence exists for an association between accordance with a Mediterranean diet pattern and slower rates of cognitive decline. However, an ‘Americanized’ version of the Mediterranean diet screener is needed to assess accordance in the USA. Thus, the Mediterranean Eating Pattern for Americans (MEPA) tool was developed to assess accordance with a Mediterranean-like food pattern when time is limited. The present study aimed to determine whether the MEPA screener captured the key elements of the Mediterranean diet compared to the more comprehensive food frequency questionnaire (FFQ).
Methods: The study comprised a cross-sectional study in which 70 women completed both the …

Effects Of Fatigue And Recovery On Electromechanical Delay During Isokinetic Muscle Actions, Cory M. Smith, Terry J. Housh, Ethan C. Hill, Josh L. Keller, Glen O. Johnson, Richard J. Schmidt
Department of Nutrition and Health Sciences: Faculty Publications
Objective: To examine muscle-specific differences and the effects of fatigue and recovery on electromechanical delay (EMD) during maximal isokinetic muscle actions.
Approach: Thirteen men performed maximal isokinetic knee extension muscle actions at 60° s−1, pretest, posttest, and after 5 min of recovery from 25 maximal isokinetic knee extensions. The onsets of the electromyographic, mechanomyographic, and force signals were used to identify EMD measures from the vastus lateralis (VL), vastus medialis (VM), and rectus femoris (RF).
Main results: There were posttest increases in all EMD measures for all muscles that returned to pretest levels after 5 …

Department of Nutrition and Health Sciences: Faculty Publications
We examined the neuromuscular adaptations following 3 and 6 weeks of 80 vs. 30%one repetition maximum (1RM) resistance training to failure in the leg extensors. Twenty-six men (age = 23.1 ± 4.7 years) were randomly assigned to a high- (80% 1RM; n = 13) or low-load (30% 1RM; n = 13) resistance training group and completed leg extension resistance training to failure 3 times per week for 6 weeks. Testing was completed at baseline, 3, and 6 weeks of training. During each testing session, ultrasound muscle thickness and echo intensity, 1RM strength, maximal voluntary isometric contraction (MVIC) strength, and contractile …
Resilience In Ecotoxicology: Toward A Multiple Equilibrium Concept, Mirco Bundschuh, Ralf Schulz, Ralf B. Schäfer, Craig R. Allen, David G. Angeler
Resilience In Ecotoxicology: Toward A Multiple Equilibrium Concept, Mirco Bundschuh, Ralf Schulz, Ralf B. Schäfer, Craig R. Allen, David G. Angeler
School of Natural Resources: Faculty Publications
The term resilience describes stress-response patterns across scientific disciplines. In ecology, advances have been made to clearly define resilience based on underlying mechanistic assumptions. Engineering resilience (rebound) is used to describe the ability of organisms to recover from adverse conditions (disturbances), which is termed the rate of recovery. By contrast, the ecological resilience definition considers a systemic change, that is, when ecosystems reorganize into a new regime following disturbance. Under this new regime, structural and functional aspects change considerably relative to the previous regime, without recovery. In this context, resilience is an emergent property of complex systems. In the present …

Assessment Of A Channel Catfish Population In A Large Open River System, A. J. Blank, M. J. Hamel, Jonathan J. Spurgeon, Mark A. Pegg
School of Natural Resources: Faculty Publications
Estimates of dynamic rate functions for riverine channel catfish, Ictalurus punctatus (Rafinesque), populations are limited. The open nature and inherent difficulty in sampling riverine environments and the propensity for dispersal of channel catfish impede estimation of population variables. However, contemporary population models (i.e. robust design models) can incorporate the open nature of these systems. The purpose of this study was to determine channel catfish population abundance, survival and size structure and to characterize growth in the lower Platte River, Nebraska, USA. Annual survival estimates of adult channel catfish were 13%–49%, and channel catfish abundance estimates ranged from 8,281 to 24,261 …

The production cross section of a W boson in association with two b jets is measured using a sample of proton–proton collisions at [?] = 8 TeV collected by the CMS experiment at the CERN LHC. The data sample corresponds to an integrated luminosity of 19.8 fb−1. The W bosons are reconstructed via their leptonic decays, W → [?]ν, where [?] = μ or e. The fiducial region studied contains exactly one lepton with transverse momentum [?] > 30 GeV and pseudorapidity |η[?]| < 2.1, with exactly two b jets with pT > 25 GeV and |η| < 2.4 and no other jets with pT > 25 GeV and |η| < 4.7. The cross section is measured to be σ (pp → W([?]+bb) = 0.64 ± 0.03 (stat) ± 0.10 (syst) ± 0.06 (theo) ± 0.02 (lumi) pb, in agreement with standard model predictions.
