Transparency And Icao's Aviation Offsetting Scheme: Two Separate Concepts?, Aoife O'Leary Jan 2017

Transparency And Icao's Aviation Offsetting Scheme: Two Separate Concepts?, Aoife O'Leary

Sabin Center for Climate Change Law

The International Civil Aviation Organisation (ICAO), the UN specialised body for aviation, is developing a scheme to reduce the climate impact of aviation emissions, the Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA). From 2021, participating countries will (voluntarily at first) offset any growth in CO2 aviation emissions above the level those emissions have reached in 2020. This paper does not consider the climate implications of the scheme but rather focuses on whether the governance structure under which the scheme is being developed – especially its transparency and opportunities for public participation – meets an appropriate standard, given the …

Act Locally, Reflect Globally: A Checklist Of Options For U.S. Cities And States To Engage Internationally In Climate Action, Susan Biniaz Jan 2017

Act Locally, Reflect Globally: A Checklist Of Options For U.S. Cities And States To Engage Internationally In Climate Action, Susan Biniaz

Sabin Center for Climate Change Law

U.S. cities and states are increasingly asking how they can play a more visible and active role in international climate change efforts.

Cities and states have obvious incentives to take action to mitigate and adapt to climate change. But why engage internationally? They may seek to demonstrate leadership or gain appropriate recognition for “doing their part.” They may want to inspire others to follow suit or support them in doing so, such as through exchanging best practices. They may seek to join the global march toward low-emission and resilient societies. Or they may want to show the world that U.S. …

The Application Of Open Records Laws To Publicly Funded Science, Lauren Kurtz Jan 2017

The Application Of Open Records Laws To Publicly Funded Science, Lauren Kurtz

Sabin Center for Climate Change Law

The federal Freedom of Information Act (FOIA) and the state law equivalents promote government transparency by allowing citizens to request copies of administrative records. Any citizen can file a request with a government entity for copies of government documents, and the government must either produce the information or explain why it is exempt from production (for example, for national security purposes).

While these laws were originally written with an eye toward policy makers and bureaucrats, in recent years, these open records laws have been used increasingly to request information from publicly funded scientists. Scientists employed by federal agencies, state agencies, …

The Status Of Climate Change Litigation: A Global Review, Michael Burger, Justin Gundlach Jan 2017

The Status Of Climate Change Litigation: A Global Review, Michael Burger, Justin Gundlach

Sabin Center for Climate Change Law

Over the last decade, laws codifying national and international responses to climate change have grown in number, specificity, and importance. As these laws have recognized new rights and created new duties, litigation seeking to challenge either their facial validity or their particular application has followed. So too has litigation aimed at pressing legislators and policymakers to be more ambitious and thorough in their approaches to climate change. In addition, litigation seeking to fill the gaps left by legislative and regulatory inaction has also continued. As a result, courts are adjudicating a growing number of disputes over actions – or inaction …

Knowledge Activation For Patient Centered Care: Bridging The Health Information Technology Divide, Sajda Qureshi, Cherie Noteboom Jan 2017

Knowledge Activation For Patient Centered Care: Bridging The Health Information Technology Divide, Sajda Qureshi, Cherie Noteboom

Research & Publications

The provision of healthcare is a collaborative process. It follows evidence based treatments which are becoming increasingly data driven and focusing on the best clinical outcomes. Patient centered care requires participation of patients in the decision making of the best treatment options. Healthcare provision requires both evidence based and patient centered care. In practice, these two perspectives conflict with each other due to the use of an information technology designed primarily for billing purposes. Using the knowledge activation framework developed by Qureshi and Keen [25], we analyze data from two hospitals in the Midwest that aim to achieve quality of …

An Exploration Of Anchoring Female Millennial Students To An It Career Path: The Class Model, Cherie Noteboom, Pamela Rowland

Research & Publications

There has been much research conducted on the under-representation of women in Science, Technology, and Engineering & Math (STEM). Looking specifically at the area of Information Systems and Information Technology (IS/IT), women are largely under-represented in degree programs and the workforce. With the growth in the IS/IT workforce and the future demands of IS/IT career growth, the importance of understanding the perceptions and influences on the female IS/IT students grows. While there is research investigating the demographics of the IS/IT workforce, the relationship between female students and millennial influences has not been investigated. This research contends that addressing the demographic …

Health Social Network Websites: Design Features And Users’ Participation, Mohammad A. Al-Ramahi, Insu Park

Research & Publications

Patients are increasingly utilizing health Social Network Sites (SNSs) to share useful health information and support with peers. The long-term viability of health SNSs depends critically on voluntary contributions by their members, which in turn relies on members’ participation. Literature examined the drivers of users’ participation in online communities and suggested that social identity plays important roles in determining virtual community members’ participation and contribution to the community. However, little known regarding healthcare SNSs design features that facilitate users’ social identity. With such knowledge, it could determine the most effective design features that motivate higher levels of participation, which in …

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky Jan 2017

Simplexity: Plain Language And The Tax Law, Joshua D. Blank, Leigh Osofsky

Articles

In recent years, federal government agencies have increasingly attempted to use plain language in written communications with the public. The Plain Writing Act of 2010, for instance, requires agencies to incorporate "clear and simple" explanations of rules and regulations into their official publications. In the tax context, as part of its "customer service" mission, the Internal Revenue Service bears a "duty to explain" the tax law to hundreds of millions of taxpayers who file tax returns each year. Proponents of the plain language movement have heralded this form of communication as leading to simplicity in tax compliance, more equitable access …

How Women Could Save The World, If Only We Would Let Them: From Gender Essentialism To Inclusive Security, Catherine Powell Jan 2017

How Women Could Save The World, If Only We Would Let Them: From Gender Essentialism To Inclusive Security, Catherine Powell

Faculty Scholarship

We increasingly hear that empowering women and placing them in positions of leadership will lead to a safer, more prosperous world. The UN Security Council’s groundbreaking resolutions on Women Peace, and Security (WPS) — and U.S. law implementing these commitments — rest on the assumption that women’s participation in peace and security matters will lead to more sustainable peace, because women presumably “perform” in ways that reduce conflict, violence, and extremism. This idea is of heightened importance today because women are still vastly underrepresented in positions of leadership in the peace and security field, having yet to “shatter that highest …

The Price Of Judicial Economy In The Us, Bruce A. Green Jan 2017

The Price Of Judicial Economy In The Us, Bruce A. Green

Faculty Scholarship

In the US, courts widely perceive that judicial scarcity is a common problem threatening the fair and timely resolution of disputes. Courts cite the attendant interest in judicial economy to justify interpreting the procedural and substantive law to reduce the judicial workload or accelerate the resolution of cases. But courts’ assumption that there are too few judges to handle the current caseload is hard to substantiate. First, it may not be possible to infer from excessive judicial backlogs or other perceived judicial deficiencies that a shortfall of judges is to blame. Second, even when one confidently perceives that a judicial …

Relationships Between Access To Mobile Devices, Student Self-Directed Learning, And Achievement, Scott R. Bartholomew, Edward M. Reeve, Raymond Veon, Wade Goodridge, Victor R. Lee, Louis Nadelson

Applied Sciences, Technology and Education Faculty Publications

Today’s students are growing up in a world of constant connectivity, instant information, and ever-changing technological advancements. The increasingly ubiquitous nature of mobile devices among K–12 students has led many to argue for and against the inclusion of these devices in K–12 classrooms. Arguments in favor cite instant access to information and collaboration with others as positive affordances that enable student self-directed learning.

In this study, 706 middle school students from 18 technology and engineering education classes worked in groups of 2–3 to complete an open-ended engineering design challenge. Students completed design portfolios and constructed prototypes in response to the …

Design And Development Of An Educational Intervention On Nurse Perceptions Of Caring, John S. Norris Iii Jan 2017

Design And Development Of An Educational Intervention On Nurse Perceptions Of Caring, John S. Norris Iii

Walden Dissertations and Doctoral Studies

Caring is central to the nursing profession and important to patients and family members who expect nurses to display caring attributes. The acute care hospital in this study did not have an education program on caring practices for nursing staff although the organization acknowledged the importance of and need for a culture of caring practices in the organization. The purpose of this project was to design an educational program based on Watsons' theory of caring for registered nurses at the acute care hospital where the project took place. Rosswurm and Larrabee's model for change and Watson's theory of caring were …

Cyber-Security Policy Decisions In Small Businesses, Joanna Patterson Jan 2017

Cyber-Security Policy Decisions In Small Businesses, Joanna Patterson

Walden Dissertations and Doctoral Studies

Cyber-attacks against small businesses are on the rise yet small business owners often lack effective strategies to avoid these attacks. The purpose of this qualitative multiple case study was to explore the strategies small business owners use to make cyber-security decisions. Bertalanffy's general systems theory provided the conceptual framework for this study. A purposive sample of 10 small business owners participated in the interview process and shared their decision-making methodologies and influencers. The small business owners were vetted to ensure their strategies were effective through a series of qualification questions. The intent of the research question and corresponding interview questions …

On March 31-April 1, 2016, Touro Law Center and the Jewish Law Institute hosted a national conference: Louis D. Brandeis: An Interdisciplinary Retrospective. More than thirty judges, lawyers, and scholars, across a broad range of disciplines and hailing from across the United States, explored a variety of themes that included, among others: Brandeis’s groundbreaking work as a lawyer and a scholar; his commitment to his Jewish heritage; his historic appointment to the United States Supreme Court; and his jurisprudence on the Court. In addition to the timeless quality of these themes, the timing of the conference was significant, taking place …
