Enhancing Patent Damages, Dmitry Karshtedt Jan 2017

Enhancing Patent Damages, Dmitry Karshtedt

GW Law Faculty Publications & Other Works

Many policymakers, judges, and scholars justify patent law on economic-utilitarian grounds. It is therefore unsettling that when it comes to damages for patent infringement in excess of the compensatory baseline, courts have followed an approach that reflects primarily moral, rather than economic, considerations. In order to obtain enhanced damages, the prevailing plaintiff must show — among other things — that the defendant actually knew of the patent-in-suit. This subjective standard stems from pre-industrial tort actions designed to punish egregious interpersonal behaviors such as assault, piracy, libel, and seduction, and to preserve public tranquility. But as the law developed to cover …

The Regulatory Budget Debate, Richard J. Pierce Jr Jan 2017

The Regulatory Budget Debate, Richard J. Pierce Jr

GW Law Faculty Publications & Other Works

In this essay, Professor Pierce explains why both the hand wringing by environmental advocates and the cheers of coal miners elicited by the Executive Order in which President Trump ordered EPA to repeal the Clean Power Plan (CPP) were based on poorly supported beliefs about the effects of the CPP. The substitution of natural gas, wind and solar power for coal as a generating fuel that the CPP was intended to produce began long before EPA issued the CPP and will continue long after the CPP is repealed. That substitution was driven largely by changes in the relative prices of …

Stuck Or Rooted? The Costs Of Mobility And The Value Of Place, Naomi Schoenbaum Jan 2017

Stuck Or Rooted? The Costs Of Mobility And The Value Of Place, Naomi Schoenbaum

GW Law Faculty Publications & Other Works

David Schleicher has written an important Article on the relationship between law and mobility, arguing for policymakers to be more concerned with policies that stand in the way of individuals moving to bigger, more productive cities. This Response takes up the costs of mobility for productivity, welfare, and sex equality omitted by Schleicher, and addresses Schleicher’s treatment of place as a market. Schleicher’s argument fails to take account of how mobility interacts with critical relationships. While Schleicher’s view of productivity is premised in agglomeration economics, he ignores how mobility ruptures the very relationships on which the benefits of agglomeration (and …

A Critical Guide To Using The Legislative History Of The Fourteenth Amendment To Determine The Amendment's Original Meaning, Gregory E. Maggs Jan 2017

A Critical Guide To Using The Legislative History Of The Fourteenth Amendment To Determine The Amendment's Original Meaning, Gregory E. Maggs

GW Law Faculty Publications & Other Works

Judges, lawyers, and scholars often look to the Fourteenth Amendment’s legislative history for evidence of the Amendment’s original meaning. Members of the Supreme Court, for instance, have cited floor statements, committee records, preliminary proposals, and other documents relating to the drafting and approval of the Fourteenth Amendment in many important cases. The documents containing this legislative history, however, are difficult to use. As explained in this Article, the Amendment came about through a complex process, in which Congress rejected several prior proposals for constitutional amendments before settling on a markedly different proposal that became the Fourteenth Amendment. Although the primary …

Assaultive Words And Constitutional Norms, Catherine J. Ross Jan 2017

Assaultive Words And Constitutional Norms, Catherine J. Ross

GW Law Faculty Publications & Other Works

The tension between the competing demands of the First. Amendment’s guarantee of free expression and the Fourteenth Amendment’s implicit promise of dignity and equality has long been evident in societal debates about identity politics, in academic writing, and in disputes over regulation of campus speech. This article argues that the First Amendment generally protects campus speech that includes hurtful words, even those that verbally assault a target or are seen as perpetuating an environment that demeans or endangers women, minorities and others. Protection of such offensive speech also promotes the proclaimed norms of higher education, which is why so many …

Reducing Extreme Poverty Through Skill Training For Industry Job Placement, Abu S. Shonchoy, Selim Raihan, Tomoki Fujii Jan 2017

Reducing Extreme Poverty Through Skill Training For Industry Job Placement, Abu S. Shonchoy, Selim Raihan, Tomoki Fujii

Research Collection School Of Economics

Vocational training programs aimed at rapidly growing sectors have the potential to reduce skills gaps, improve income and employment potentials. Such programs often been unsuccessful, because they are not driven by industry-demand and market-linkages, and they are not well targeted. Our rigorous RCT-based impact study shows that a targeted training-program offered to poor rural households in northwest Bangladesh has significant effects on employment in garment factories. Data from a follow-up — six and twelve months’ after the intervention — shows a statistically significant and large employment effect of the training program when it is combined with the stipend or internship. This …

Determining Individual Or Time Effects In Panel Data Models, Xun Lu, Liangjun Su Jan 2017

Determining Individual Or Time Effects In Panel Data Models, Xun Lu, Liangjun Su

Research Collection School Of Economics

In this paper we propose a jackknife method to determine individual and time e⁄ects in linear panel data models. We rst show that when both the serial and cross-sectional correlation among the idiosyncratic error terms are weak, our jackknife method can pick up the correct model with probability approaching one (w.p.a.1). In the presence of moderate or strong degree of serial correlation, we modify our jackknife criterion function and show that the modied jackknife method can also select the correct model w.p.a.1. We conduct Monte Carlo simulations to show that our new methods perform remarkably well in nite samples. We …

Virtual Aids To Navigation, R. Glenn Wright Jan 2017

Virtual Aids To Navigation, R. Glenn Wright

World Maritime University Ph.D. Dissertations

There are many examples of master, bridge crew and pilot errors in navigation causing grounding under adverse circumstances that were known and published in official notices and records. Also dangerous are hazards to navigation resulting from dynamic changes within the marine environment, inadequate surveys and charts. This research attempts to reduce grounding and allision incidents and increase safety of navigation by expanding mariner situational awareness at and below the waterline using new technology and developing methods for the creation, implementation and display of Virtual Aids to Navigation (AtoN) and related navigation information. This approach has widespread significance beyond commonly encountered …

The Prairie Science Classroom: Original Outcome Durability And Impact On The Connection To Nature, Cedar Celestine Walters Jan 2017

The Prairie Science Classroom: Original Outcome Durability And Impact On The Connection To Nature, Cedar Celestine Walters

Biological Sciences

Environmental Education (EE) seeks to create an informed citizenry capable of taking action on environmental issues. Recent calls for more consistent evaluation of EE point to a need for more long-term evaluations as well as more qualitative evaluations if we are to understand if EE is actually meeting its stated goals. The current study evaluated long-term impacts of the Prairie Science Class (PSC), a formal EE partnership between the U.S. Fish and Wildlife Service and an independent school district. This study analyzed both quantitative and qualitative data to investigate outcome durability of the PSC, as well as the impact of …

Impact Of Uri Canonicalization On Memento Count, Mat Kelly, Lulwah M. Alkwai, Michael L. Nelson, Michele C. Weigle, Herbert Van De Sompel Jan 2017

Impact Of Uri Canonicalization On Memento Count, Mat Kelly, Lulwah M. Alkwai, Michael L. Nelson, Michele C. Weigle, Herbert Van De Sompel

Computer Science Faculty Publications

Quantifying the captures of a URI over time is useful for researchers to identify the extent to which a Web page has been archived. Memento TimeMaps provide a format to list mementos (URI-Ms) for captures along with brief metadata, like Memento-Datetime, for each URI-M. However, when some URI-Ms are dereferenced, they simply provide a redirect to a different URI-M (instead of a unique representation at the datetime), often also present in the TimeMap. This infers that confidently obtaining an accurate count quantifying the number of non-forwarding captures for a URI-R is not possible using a TimeMap alone and that the …

Efficient Core Utilization In A Hybrid Parallel Delaunay Meshing Algorithm On Distributed-Memory Cluster, Daming Feng, Andrey N. Chernikov, Nikos P. Chrisochoides Jan 2017

Efficient Core Utilization In A Hybrid Parallel Delaunay Meshing Algorithm On Distributed-Memory Cluster, Daming Feng, Andrey N. Chernikov, Nikos P. Chrisochoides

Computer Science Faculty Publications

Most of the current supercomputer architectures consist of clusters of nodes that are used by many clients (users). A user wants his/her job submitted in the job queue to be scheduled promptly. However, the resource sharing and job scheduling policies that are used in the scheduling system to manage the jobs are usually beyond the control of users. Therefore, in order to reduce the waiting time of their jobs, it is becoming more and more crucial for the users to consider how to implement the algorithms that are suitable to the system scheduling policies and are able to effectively and …

The Dyadic Influence Of Attachment And Affection On Relationship Satisfaction, Gemme M. Campbell, Grace Ellen Brannon, Emily A. Rauscher, Colin Hesse, Sara L. Trask Jan 2017

The Dyadic Influence Of Attachment And Affection On Relationship Satisfaction, Gemme M. Campbell, Grace Ellen Brannon, Emily A. Rauscher, Colin Hesse, Sara L. Trask

Iowa Journal of Communication

Using affection exchange theory, this study proposed a mediating model between attachment style, affectionate communication, and relationship satisfaction. This dyadic model used marital couples to test actor and partner effects. Overall, results supported the predicted model, including several significant indirect effects. Specifically, affection mediated the relationships between anxious attachment for wives and relationship satisfaction for both wives and husbands. Affection also mediated the relationship between anxious attachment for husbands and husband relationship satisfaction. Affection also mediated the relationship between avoidant attachment for wives and wife relationship satisfaction, as well as between avoidant attachment for husbands and husband relationship satisfaction. Additionally, …

Haunted By The Past: Examining The Breakup Story Through Duck's Dissolution Model, Sara L. Trask Jan 2017

Haunted By The Past: Examining The Breakup Story Through Duck's Dissolution Model, Sara L. Trask

Iowa Journal of Communication

After a breakup, individuals are often haunted by the presence of their past relationships, making relationship termination one of the most emotionally painful events that individuals throughout their lifetime (Sprecher, Felmlee, Metts, Fehr, & Vanni, 1998). Some individuals even go as far to believe that relationship termination is like experiencing the death of one they loved (Emery, 2004). Using three of the five processes of Duck's Dissolution Model (DDM) (1982; 2005), this study examined what individuals' breakup stories reveal about their ability to adjust after a breakup has occurred. The study interviewed 18 individuals who shared their personal stories of …

Knapp's Model Of Relational Development In The Digital Age, Robert L. Duran, Lynne Kelly Jan 2017

Knapp's Model Of Relational Development In The Digital Age, Robert L. Duran, Lynne Kelly

Iowa Journal of Communication

The purpose of this study was to re-examine Knapp's (1978) model of the stages of relationship development to identify the ways in which communication technologies are used within those stages as romantic relationships progress. The goal was to incorporate technological activities into the descriptions of Knapp's stages of relational growth to better reflect how college students conduct their romantic relationships. Undergraduate students (N = 251) completed a survey, including a measure of their relationship stage (Welch & Rubin, 2002) as well as measures of their uses of Facebook, texting, and cell phone calling in the context of the relationship. Results …

Students With Specific Learning Disabilities; Perceptions Of Postsecondary Accommodations, Barriers, And Self-Advocacy, Jodi Elizabeth Stohl Jan 2017

Students With Specific Learning Disabilities; Perceptions Of Postsecondary Accommodations, Barriers, And Self-Advocacy, Jodi Elizabeth Stohl

All Electronic Theses and Dissertations

Once students graduate from public education, the supports for individuals with disabilities change significantly. The law requiring school districts to support students with disabilities no longer applies upon graduation. As the familiar support structure no longer exists, the transition for students with disabilities is very difficult. The purpose of this qualitative case study will be to learn the perceptions of students with Specific Learning Disabilities (SLD) in regard to accessing accommodations from the Office of Disability Services in a public community college setting, identifying barriers, and utilizing self-advocacy skills.

The Impact Of Education On Legislative Responsiveness In Three Field Experiments, Jayme Neiman Jan 2017

The Impact Of Education On Legislative Responsiveness In Three Field Experiments, Jayme Neiman

Faculty Work

Three field experiments were used to investigate whether a constituent’s education level influences state legislators’ responsiveness to their request for assistance. Legislators were sent emails that were randomly varied as to the education level of the writer. Results indicate that communication from constituents with lower education levels receive fewer replies. Two potential explanations for the variation in legislative response are explored—political party and the legislator’s own education level. Analysis suggests that neither of these variables account for the response differential to the email manipulations.

Patents And Mobile Devices In India: An Empirical Survey, Jorge L. Contreras, Rohini Lakshane Jan 2017

Patents And Mobile Devices In India: An Empirical Survey, Jorge L. Contreras, Rohini Lakshane

Vanderbilt Journal of Transnational Law

Though India has the second-largest wireless subscriber base in the world, with more than 150 domestic mobile device vendors, it has, until recently, remained relatively unaffected by the global smartphone wars. Over the past few years, however, a growing number of patent enforcement actions have been brought by multinational firms against domestic Indian producers. These actions, which have largely resulted in judgments favoring foreign patent holders, have given rise to a variety of proposals for addressing this situation. In order to assess the potential impact of patents on the mobile device market in India, and to assist policy makers in …

An International Model For Vicarious Liability In Franchising, Robert W. Emerson Jan 2017

An International Model For Vicarious Liability In Franchising, Robert W. Emerson

Vanderbilt Journal of Transnational Law

Vicarious liability in the franchising context is a fundamental issue, both in the United States and foreign jurisdictions. With no all-encompassing, clear precedent in the United States, other nations' approaches may provide lessons for American lawmakers and the U.S. franchising community. Together, the division between jurisdictions and the absence of uniform standards for imposing vicarious liability on franchisors demonstrate the need for more comprehensible and predictable case law. This need can be met through an examination of European regulations, model laws, and guidelines, as well as the laws in a number of nations worldwide, which indicate a pathway to better …

A Plurilateral Investment Treaty: Marrying Trade And Investment To Re-Establish A Customary International Norm, Kellie Travis Jan 2017

A Plurilateral Investment Treaty: Marrying Trade And Investment To Re-Establish A Customary International Norm, Kellie Travis

Vanderbilt Journal of Transnational Law

Despite some inherent risks, foreign direct investment (FDI) is for some the preferred method of investment. The rising number of bilateral investment treaties governing FDI is merely reflective of this investment vehicle's popularity. Since the early-nineteenth century, developed countries have sought to gain protection for investors engaging in these investment opportunities. One such protection, the Hull Doctrine, requires national governments to fully compensate investors in cases of unlawful expropriation. Until World War II, when developing countries began applying their own domestic eminent domain law to foreign investors, the Hull Doctrine was considered binding, customary international law. This Note analyzes the …

Sovereign Display And Fiscal Techniques, Magnus Hornqvist Jan 2017

Sovereign Display And Fiscal Techniques, Magnus Hornqvist

Vanderbilt Journal of Transnational Law

Over recent decades, the state has come to increasingly rearticulate sovereignty at the very center of society. To support the thesis of a migration of sovereignty from the periphery to the center, from the punishment of marginalized groups to the regulation of economic transactions, this Article sketches the development of rules, monitoring, and sanctions--the three phases of regulation in the strict sense--with respect to first tax evasion and undeclared work and then organized crime, money laundering, and terrorist financing. Unbounded reasons of state, symbolic authority, and conflicts with formidable foes are found to be expressed in the economic sphere, which …
