"The Wrong Approach At The Wrong Time?": Maine Adopts Strict Liability For Abnormally Dangerous Activities In Dyer V. Maine Drilling And Blasting, Inc., Matthew M. Cobb

In 2009, the Maine Supreme Judicial Court, sitting as the Law Court, held in Dyer v. Maine Drilling and Blasting, Inc. that strict liability should be applied to abnormally dangerous activities in accordance with the Restatement (Second) of Torts §§ 519-20. In doing so, the court expressly overruled its decision in Reynolds v. W.H. Hinman Co., which had rejected a strict liability approach to blasting cases in favor of a negligence-based standard. In Dyer, a majority of the Law Court vacated the trial court’s grant of summary judgment for Maine Drilling and Blasting, Inc. (Maine Drilling) and held that strict …

Copyrights and patents grant property rights to creators and inventors in order to spur further innovation through the dual approach of increasing the amount of material in the public domain and rewarding inventors and creators for their efforts. However, in recent years, it has been postulated that extensive granting of copyrights and patents may in fact stifle additional creation and development. This led to a revolt in the computer programming industry and spawned the open source movement, which provides software with its source code and a license allowing for free creation and distribution of works. Xenotransplantation, Subsistence Hunting And The Pursuit Of Health: Lessons For Animal Rights-Based Vegan Advocacy, Nathan M. Nobis
Between the Species
I argue that, contrary to what Tom Regan suggests, his rights view implies that subsistence hunting is wrong, that is, killing animals for food is wrong even when they are the only available food source, since doing so violates animal rights. We can see that subsistence hunting is wrong on the rights view by seeing why animal experimentation, specifically xenotransplanation, is wrong on the rights view: if it’s wrong to kill an animal to take organs to save a human life, it’s wrong to kill an animal to eat that animal to save a human life or improve …

Homeobox proteins, a class of well conserved transcription factors, regulate the expression of targeted genes, especially those involved in development. In filamentous fungi, homeobox genes are required for normal conidiogenesis and fruiting body formation. In the present study, we identified eight homeobox (hbx) genes in the aflatoxin-producing ascomycete, Aspergillus flavus, and determined their respective role in growth, conidiation and sclerotial production. Disruption of seven of the eight genes had little to no effect on fungal growth and development. However, disruption of the homeobox gene AFLA_069100, designated as hbx1, in two morphologically different A. flavus strains, CA14 and AF70, resulted in …

The disturbance history, plant species composition, productivity, and structural complexity of a site can exert bottom-up controls on arthropod diversity, abundance, and trophic structure. Regulation alters the hydrology and disturbance regimes of rivers and affects riparian habitats by changing plant quality parameters. Fifty years of regulation along the Colorado River downstream of Glen Canyon Dam has created a no-analog, postdam “lower” riparian zone close to the water’s edge that includes tamarisk (Tamarix sp.), a nonnative riparian shrub. At the same time, the predam “upper” facultative riparian zone has persisted several meters above the current flood stage. In summer 2009, …

When, if ever, should psychological scientists be permitted to offer professional opinions concerning the mental health of public figures they have never directly examined? This contentious question, which attracted widespread public attention during the 1964 U.S. presidential election involving Barry Goldwater, received renewed scrutiny during and after the 2016 U.S. presidential campaign, when many mental health professionals raised pointed questions concerning the psychiatric status of Donald Trump. Although the Goldwater Rule prohibits psychiatrists from offering diagnostic opinions on individuals they have never examined, no comparable rule exists for psychologists. Toxoplasma gondii (T. gondii) is the protozoan parasite that causes toxoplasmosis, a potentially fatal disease to immunocompromised patients, and which affects approximately 30% of the world's population. Previously, we showed that purinergic signaling via the P2X7 receptor contributes to T. gondii elimination in macrophages, through reactive oxygen species (ROS) production and lysosome fusion with the parasitophorous vacuole. Moreover, we demonstrated that P2X7 receptor activation promotes the production of anti-parasitic pro-inflammatory cytokines during early T. gondii infection in vivo. However, the cascade of signaling events that leads to parasite elimination via P2X7 receptor activation remained to be elucidated. Here, we investigated …

Wildland recreation that does not involve animal harvests (non‐consumptive recreation) often influences various components of natural systems, including soils, water, air, soundscapes, vegetation, and wildlife. The effects of non‐consumptive recreation on wildlife have typically been assessed at spatial scales that are not only much smaller than the overall distributions of this disturbance but also much smaller than the areas that species use during a season or year. This disparity in scales has prevented effective assessment and management of broad‐scale recreation disturbance for many species, especially wildlife. © 2017 Elsevier Ltd. We review and evaluate human adaptations during the last glacial-interglacial climatic transition in southwest Asia. Stable isotope data imply that climatic change was synchronous across the region within the limits of dating uncertainty. Changes in vegetation, as indicated from pollen and charcoal, mirror step-wise shifts between cold-dry and warm-wet climatic conditions, but with lag effects for woody vegetation in some upland and interior areas. Palaeoenvironmental data can be set against regional archaeological evidence for human occupancy and economy from the later Epipalaeolithic to the aceramic Neolithic.
