Every year, more than 100 reported court opinions consider the question of whether an outsider can sue for damages under a contract made by others—in part because the law is so ambiguous. While contract enforcement by a third party is controlled largely by the facts of the particular case, it also materially depends upon the relevant legal standards. At present, not just the standards, but also the reasons for these standards, are unclear. Computer Fraud And Abuse Act Enforcement: Cruel, Unusual, And Due For Reform, Tiffany Curtiss

Washington Law Review

This Comment argues that the Computer Fraud and Abuse Act (CFAA) uses an outdated concept of technology in everyday activities that can lead to unexpected and grossly disproportional federal criminal charges. The CFAA’s vague definitions passively provide broad prosecutorial discretion that may turn millions of everyday internet users into criminals, even in cases of a common breach of an online terms-of-service agreement. Congress should look to the Eighth Amendment and draw from its principles in reforming the CFAA. The Comment concludes with a proposed interpretation of the CFAA that would better align the statute with other criminal laws, namely trespass. …

Shear Wave Velocity And Its Anisotropy Of Polymer Modified High-Volume Class-F Fly Ash-Kaolinite Mixtures, X. Kang, B. Bate

This study investigated the effects of polymers on the small-strain stiffness behavior of high-volume Class-F fly ash-kaolinite mixtures. The shear wave velocity (Vs) and its anisotropy of organically modified fly ash-kaolinite mixtures were evaluated using a self-developed floating wall type consolidometer bender element (BE) testing system. Both synthetic polymers [polyethylene oxide (PEO)] and biopolymers (xanthan gum and chitosan) were used to modify the stiffness of fly ash-kaolinite mixtures. Shear waves generated and received by bender elements were measured to quantify the small-strain stiffness of the organically modified fly ash-kaolinite mixtures in three orthogonal directions, i.e., vh, hv, and hh. Rhetoric, and therefore persuasion, can be utilized to impact society in profound ways. These communication devices can also be used for more sinister and nefarious purposes that can leave black marks on any society’s history. For the purpose of this rhetorical analysis, I thoroughly investigated three artifacts used by the Monsanto Corporation. This project attempts to show how Monsanto utilizes rhetoric and persuasion to convince consumers their products are safe to purchase, although there is no scientific consensus regarding that safety to humans and the environment. I noticed that maintenance workers had the same itinerary when emptying trashcans, meanwhile some trashcans needed to be emptied urgently. Traditionally, ETSU maintenance operate on daily routes to pick trash on designated time, regardless the level of the containers. The time, resources and labor invested in collecting the trash could be saved. Therefore, I decided to use the Internet of Things (IoT) to create a device that will optimize trash collection, to reduce costs and pollution.

Since the early 1990s, a series of studies underscored the overwhelming presence of positive eugenics in modern Argentina. These works emphasized the marginal role which discourse on eugenics took on violent methods for selection. In recent years, this point of view has shifted, emphasizing the conceptual viscosity of eugenics as well as the presence of negative eugenic discourses. The so-called “sharing” economy presents one of the most important and controversial regulatory dilemmas of our time—yet, surprisingly, it remains undertheorized. This Article supplies needed analysis. Specifically, the Article offers a regulatory model that distinguishes between two separate kinds of transactions: conventional economic transactions and those that rely on temporary access to goods and services that would otherwise go underutilized (what I call “access-to-excess” transactions). The regulatory regime that this Article proposes would distinguish between true access-to-excess transactions and conventional transactions. Objective: In 2006, the American College of Surgeons’ Committee on Trauma and the Center for Disease Control released field triage guidelines with special consideration for older adults. Additional considerations for direct transport to a Level I or II trauma center (TC) were added in 2011, reflecting perceived undertriage to TCs for older adults. We examined whether age-based disparities in TC care for severe head injury decreased following introduction of the 2011 revisions.

BACKGROUND:  Few data exist describing pertussis epidemiology among infants and children in low- and middle-income countries to guide preventive strategies.

METHODS:  Children 1-59 months of age hospitalized with World Health Organization-defined severe or very severe pneumonia in 7 African and Asian countries and similarly aged community controls were enrolled in the Pneumonia Etiology Research for Child Health study. They underwent a standardized clinical evaluation and provided nasopharyngeal and oropharyngeal swabs and induced sputum (cases only) for Bordetella pertussis polymerase chain reaction. Risk factors and pertussis-associated clinical findings were identified.

Background

HIV populations often diversify in response to selective pressures, such as the immune response and antiretroviral drug use. We analyzed HIV diversity in Black men who have sex with men who were enrolled in the HIV Prevention Trials Network 061 study.

Methods

A high resolution melting (HRM) diversity assay was used to measure diversity in six regions of the HIV genome: two in gag, one in pol, and three in env. This project addressed the lack of a covenant of discipleship for the membership of the Gwinnett Church of Christ (GCC). The purpose of the project was to develop such a covenant document to help all the members of GCC better live out the process of becoming more like Jesus. The goal of this research was to examine portrayals of gender roles and expectations related to the human papillomavirus (HPV) vaccine for men and boys in U.S. newspapers within the theoretical framework of feminist theory, feminist media theory, hegemonic masculinity, and heteronormativity. The piecewise linear orthonormal floating search (PLOFS) is a wrapper method for feature selection that uses a piecewise linear network (PLN) to evaluate candidate subsets. PLOFS has difficulty working on high dimensional data due to overfitting and poor clustering in the PLN subset evaluation function (SEF), and high computational complexity. The presence of noise features aggravates these problems. In order to improve upon the SEF used by PLOFS we mapped the PLN to a SPLN. Then a second order embedded feature selection was used to generate improved distance measure weights. Next, a second order method for positioning center vectors was …
