Us Government Antitrust Intervention In Standard-Setting Activities And The Competitive Process, Alden F. Abbott Jan 2016

Us Government Antitrust Intervention In Standard-Setting Activities And The Competitive Process, Alden F. Abbott

Vanderbilt Journal of Entertainment & Technology Law

The private sector historically has driven the setting of technical standards in the United States, with the federal government only intervening in response to perceived violations of specific statutes, such as antitrust laws. This concern is reflected in case law and in advice proffered by US antitrust enforcers. Recently, however, US enforcers have turned their attention primarily to the alleged misuse of monopoly power over patents that cover technologies embodied in standards. This new focus threatens to undermine innovation and departs from sound antitrust enforcement policy. American antitrust enforcers should redirect their priorities away from alleged single-firm, patent-related abuses associated …

Publication Of Government-Funded Research, Open Access, And The Public Interest, Julie L. Kimbrough, Laura N. Gasaway Jan 2016

Publication Of Government-Funded Research, Open Access, And The Public Interest, Julie L. Kimbrough, Laura N. Gasaway

Vanderbilt Journal of Entertainment & Technology Law

Public access to government-funded research is an issue of tremendous importance to researchers, librarians, and ordinary citizens around the world. Based on the notion that taxpayers finance research through their tax dollars, research data should be available to them. Rapid, unfettered access to research publications provides access to medical research to patients, encourages further exploration and inquiry by other researchers, informs citizens, and advances scientific research.

Scientists typically write articles that divulge the results of their government-funded research. Prior to the open access movement, these articles were published in commercially produced journals. Subscriptions to these journals are expensive, and cost …

Innovation Rewards: Towards Solving The Twin Market Failures Of Public Goods, Gregory N. Mandel Jan 2016

Innovation Rewards: Towards Solving The Twin Market Failures Of Public Goods, Gregory N. Mandel

Vanderbilt Journal of Entertainment & Technology Law

The challenge of achieving socially optimal incentives for innovation in public goods faces twin market failures: a market failure to adequately promote public goods invention and a market failure to implement innovative public goods once developed. Though innovation in private goods sometimes faces the former hurdle, often ameliorated by intellectual property law, the interaction of both market failures for public goods innovation raises unique difficulties.

Environmentally beneficial technology presents an illustration of the innovation problem for public goods. Private actors lack sufficient incentives both to engage in environmentally beneficial innovation and to implement such innovation. While traditional intellectual property law …

The Shaky Ground Of The Right To Be Delisted, Miquel Peguera Jan 2016

The Shaky Ground Of The Right To Be Delisted, Miquel Peguera

Vanderbilt Journal of Entertainment & Technology Law

It has long been discussed whether individuals should have a "right to be forgotten" online to suppress old information that could seriously interfere with their privacy and data protection rights. In the landmark case of Google Spain v. Agencia Espafiola de Proteccion de Datos, the Court of Justice of the European Union (CJEU) addressed the particular question of whether, under EU Data Protection Law, individuals have a right to have links delisted from the list of search results in searches made on the basis of their name. It found that they do have this right--which can be best described as …

The movement of clouds creates an unpredictable and mysterious energy that colors our thoughts. In this atmospheric energy I found the strength to contemplate my past and imagine my future. I even glanced at my horoscope to counter nostalgia, sadness and anxiety about my destiny. These coded …

Re-Thinking The Intentionality Of Fraud: Constructing And Testing The Theory Of Unintended Amoral Behavior To Explain Fraudulent Financial Reporting, Andrew Dill Jan 2016

Re-Thinking The Intentionality Of Fraud: Constructing And Testing The Theory Of Unintended Amoral Behavior To Explain Fraudulent Financial Reporting, Andrew Dill

Electronic Theses and Dissertations

My three-paper dissertation is aimed at applying the concepts of bounded ethicality and ethical fading to accounting fraud. Typical of relatively new fields such as behavioral ethics, theoretical models are scarce (Tenbrunsel & Smith-Crowe, 2008). As such, the purpose of Study 1 is to unify disparate theories and ideas from psychology and behavioral ethics as a means of constructing a theory, the Theory of Unintended Amoral Behavior (TUAB), which includes the concepts of bounded ethicality and ethical fading. In addition, the pressure for management to meet earnings expectations is discussed through the lens of the TUAB as an example of …

Under-Researched Areas Of Audit Quality: Inputs, Firms, And Institutions, Jared Eutsler Jan 2016

Under-Researched Areas Of Audit Quality: Inputs, Firms, And Institutions, Jared Eutsler

Electronic Theses and Dissertations

Francis (2011) lists three under-researched units of analysis that affect audit quality: inputs, firms, and institutions. This dissertation analyzes how each of these units of analysis contributes to audit quality. Study 1 examines audit inputs, specifically, characteristics of the individual auditor that affect professional skepticism. Study 2 examines how firm staffing decisions affect audit quality. Study 3 examines how the Public Company Accounting Oversight Board ("PCAOB"), as a regulatory institution, promotes audit quality through their risk-based inspection program. The first study reports the results of two experiments that examine professional skepticism as a function of moral agency. Consistent with the …

Decision Making In Corporate Taxation, Bonnie Brown Jan 2016

Decision Making In Corporate Taxation, Bonnie Brown

Electronic Theses and Dissertations

This dissertation is comprised of three experimental studies that examine corporate tax aggressiveness through an investigation of judgment and decision making in the corporate tax environment. Studies 1 and 2 examine individual judgment involved in decision making (i.e., assessments of tax positions based upon tax scenario facts and tax authority). Study 1 examines how advice from external tax advisors and a tax advisor's association with the company's audit firm influences the aggressiveness of experienced in-house corporate tax decision makers. Study 2 examines how situational factors in the corporate tax environment interact with individual traits to affect individual-level tax aggressiveness, focusing …

Circumcising The Mouth Of Moses: The Idolatrous Status Of Yahweh's Mediator Among The Idols Of Ancient Mesopotamia, Amy L. Balogh Jan 2016

Circumcising The Mouth Of Moses: The Idolatrous Status Of Yahweh's Mediator Among The Idols Of Ancient Mesopotamia, Amy L. Balogh

Electronic Theses and Dissertations

The thesis of this dissertation is that in the defining moment in which he is transformed from "uncircumcised of lips" to "god to Pharaoh" (Ex 6:28-7:1), Moses is best understood as Yahweh's idol, undergoing a status change akin to the induction ritual for ancient Mesopotamian idols, the Mīs Pȋ ("Washing/Purifying of the Mouth"). To make this point, I argue that Moses and idols be compared with respect to their status as mediator between divine and human realms. With their respective status changes, not only are idols and Moses transformed on an ontological level, but so are their relationships to their …

Books

This is rather the first book with a title "Philosophy of Law in the Arctic" in the literature. This philosophy of law is a very wide and cross-disciplinary area of research: between law, philosophy, anthropology, history, cultural ecology or environmental studies. I have no doubts that we have done such kind of philosophy in the academia so far, not using this term, but keeping up with the concept, the idea.

The book is a result of research conducted by many members of the Sub-group of Philosophy of Law in the Arctic (the University of the Arctic). This team seems a …

Computer Vision Based Structural Identification Framework For Bridge Health Mornitoring, Tung Khuc Jan 2016

Computer Vision Based Structural Identification Framework For Bridge Health Mornitoring, Tung Khuc

Electronic Theses and Dissertations

The objective of this dissertation is to develop a comprehensive Structural Identification (St-Id) framework with damage for bridge type structures by using cameras and computer vision technologies. The traditional St-Id frameworks rely on using conventional sensors. In this study, the collected input and output data employed in the St-Id system are acquired by series of vision-based measurements. The following novelties are proposed, developed and demonstrated in this project: a) vehicle load (input) modeling using computer vision, b) bridge response (output) using full non-contact approach using video/image processing, c) image-based structural identification using input-output measurements and new damage indicators. The input …

Low Impact Development Analysis And Comparative Assessment Of Wet Detention Ponds With Floating Treatment Wetlands, Nicholas Hartshorn Jan 2016

Low Impact Development Analysis And Comparative Assessment Of Wet Detention Ponds With Floating Treatment Wetlands, Nicholas Hartshorn

Electronic Theses and Dissertations

The aim of this thesis is to examine, develop, and assess innovative best management practices (BMPs) in stormwater management for pollutant reduction, flood control, and environmental sustainability. Previous research has clearly shown that urban stormwater runoff quickly transports pathogens, metals, sediment, and chemical pollutants to receiving waterbodies, resulting in the degradation of receiving waters and disruption of ecological networks. In response to this growing concern, regulatory agencies, such as the Environmental Protection Agency (EPA) and the Florida Department of Environmental Protection (FDEP), have set forth regulations aimed at protecting and restoring waterbodies. These regulations include numeric nutrient criteria (NNC) and …

Are They Listening?: Revisiting Male Privilege And Defensive Learning In A Feminist Classroom, Cameron A. Tyrrell

All Graduate Theses, Dissertations, and Other Capstone Projects

Privileged students, particularly male-identified students, in women’s studies classrooms have been a population of study previously. Many feminist educators have encountered resistance from a male-identified student in their classroom. Scholarship has been done that analyzes the discourses around how male privilege is invoked by men in women’s studies classrooms. This study defined defensive learning with specific acts of disengagement that hinder privileged students, particularly male-identified students in Gender and Women’s Studies, from taking classes that are considered “feminist,” and from learning about systems of privilege. A series of semi-structured interviews with six male-identified students who were enrolled in women’s studies …

How Multilinguals Perceive Linguistic Interference, Amanda Ruskin Jan 2016

How Multilinguals Perceive Linguistic Interference, Amanda Ruskin

All Graduate Theses, Dissertations, and Other Capstone Projects

When someone begins a third (or nth) language they often struggle to inhibit previously learned languages, something that established multilinguals do without much difficulty. In this qualitative survey encompassing 298 multilinguals representing different languages, proficiency levels, and learning histories, an attempt was made to identify what strategies, if any, multilinguals are aware of using which help them to successfully inhibit competing lexemes from non-target languages, with the goal of identifying strategies or commonalities that may assist budding multilinguals. Multilinguals reported noticing their interference most in conversing and mostly as applied to vocabulary; however, for most it did not occur very …

Strategies Of Student Activism: A Qualitative Study Examining Racial And Social Justice Organizing On A Midwest College Campus, Rebecca J. Lambert

All Graduate Theses, Dissertations, and Other Capstone Projects

A college campus can serve as a reflection of the larger issues occurring within society. In working to address topics such as racism, sexism, classism, or homophobia, student activism plays a critical role in an individual’s experience in higher education. The need for a safer campus, the desire to change university policies and various other factors contribute to the motivation for students to join campus organizing groups, but such activism is a practice that has significantly contributed to the college student experience. What may not be as apparent, however, are the strategies that are used by students to organize on …

La Actitud Estoica Como Táctica De Subversión Y Reconstrucción De La Identidad Femenina En Tres Novelas De Piedad Bonnett Y Laura Restrepo, Deisy Esperanza Cañón

All Graduate Theses, Dissertations, and Other Capstone Projects

In the following thesis, I analyze the role of women characters facing patriarchal oppressions in Piedad Bonnet’s literary works-Después de todo (2001) and El prestigio de la belleza (2010), and Laura Restrepo’s literary work La novia oscura (1999). The major characters in these three novels are immersed in a society where the division between the sexes appears as normal, natural, or inevitable. Pierre Bourdieu, Michel Foucault, Michel De Certeau, and Lucía Guerra provide the theoretical background for my investigation of how each of these characters (men and women) embodied the historical structures of the masculine order. This thesis identifies and …
