Unsponsored Adrs Falling Through The Cracks: Adapting A Domestic Securities Regime To A Global Marketplace, Sarah Dotzel Jan 2016

Unsponsored Adrs Falling Through The Cracks: Adapting A Domestic Securities Regime To A Global Marketplace, Sarah Dotzel

Vanderbilt Journal of Entertainment & Technology Law

Investing in the securities market has become a commonplace activity for expert and amateur investors alike. As more and more companies transcend national boundaries with their business activities, investment in their securities becomes coveted by international investors. Since securities are regulated on a country-by-country basis, it is unclear which law applies when conflict arises. In an attempt to clarify one such situation, simplify the application of US securities laws, and respect the legal regimes of other nations, the Morrison decision created an unclear test which leaves investors in unsponsored American Depositary Receipts (ADRs), one of the most common international trading …

Patent Litigation In China: Protecting Rights Or The Local Economy?, Brian J. Love, Christian Helmers, Markus Eberhardt Jan 2016

Patent Litigation In China: Protecting Rights Or The Local Economy?, Brian J. Love, Christian Helmers, Markus Eberhardt

Vanderbilt Journal of Entertainment & Technology Law

Though it lacked a patent system until 1985, China is now the world leader in patent filings and litigation. Despite the meteoric rise of the Chinese patent system, many in the West believe that it acts primarily to facilitate local protectionism rather than innovation. Recent high-profile patent suits filed by relatively unknown Chinese firms against high-profile foreign tech companies, like Apple, Samsung, and Dell, have only added fuel to the fire. Surprisingly, given how commonplace assertions of Chinese protectionism are, little empirical evidence exists to support them. This Article contributes to the literature on this topic by analyzing five years …

Are Self-Perception Measures Used In School Library Research Transferable To The Context Of Public Library Summer Reading Programs?, Marilyn P. Arnone, Ruth V. Small, Shicheng Weng Jan 2016

Are Self-Perception Measures Used In School Library Research Transferable To The Context Of Public Library Summer Reading Programs?, Marilyn P. Arnone, Ruth V. Small, Shicheng Weng

School of Information Studies - Faculty Scholarship

Several instruments previously validated for use in school library research were tested for their appropriateness in the context of public libraries’ summer reading programs for youth. The researchers were also interested in whether the connection between perceived competence in one’s own information skills and perceived competence in one’s own reading skills, as found in school library research, might also exist for participants in public library summer reading programs. In addition, a separate research question explored whether youth participants connected the summer reading program to increased confidence and improvement in their reading abilities. Findings suggest that reliable measures that can be …

Nature Records Itself: Concepts Of Truth And Representation In Nature Film And Nature Television Shows, Rashaad Rosalle Jan 2016

Nature Records Itself: Concepts Of Truth And Representation In Nature Film And Nature Television Shows, Rashaad Rosalle

Electronic Theses and Dissertations

With the advent of nature photography and film came new ways to understand and interpret the natural world. Prior to the 1910s these formats involved a more scientific and objective approach to recording nature. This aesthetic was abandoned in favor for narrative recreations and Hollywood structure after the 1930s. It is my belief that the dominant use of anthropomorphization, manipulations of setting and animal life, and rugged explorer motifs, all have lead to a loss of a more contemplative and meditative appreciation of nature within the Nature television and film format. It is my goal to explore through a series …

Extracurricular Activities And Substance Use Among Adolescents: A Test Of Social Control And Social Learning Theory, Lynnette Coto Jan 2016

Extracurricular Activities And Substance Use Among Adolescents: A Test Of Social Control And Social Learning Theory, Lynnette Coto

Electronic Theses and Dissertations

The current research examines correlates of adolescent substance use with a focus on extracurricular activities. Given that marijuana is the most widely used illicit drug, and binge drinking can have an early onset the examinations of these two substances were important. Many studies have researched the correlation between substance use and sports, but have not included other extracurricular activities such as academic and fine art clubs. The current research fills this gap in the literature by using the National Longitudinal Study of Adolescent Health (Add Health) and by testing Hirschi's (1969) Social Control Theory and Aker's (1985) Social Learning Theory. …

Anger Maintenance And The Impact Of Shame, Attachment, And Experiential Avoidance, Ahva R. Mozafari Jan 2016

Anger Maintenance And The Impact Of Shame, Attachment, And Experiential Avoidance, Ahva R. Mozafari

EWU Masters Thesis Collection

Prior to the present study, the relationships between attachment, shame, experiential avoidance, and anger had not been empirically evaluated. This study investigated the influence of shame and attachment style on anger and experiential avoidance. Additionally, this study also explored the differences between those with anxious and avoidant attachment styles and their experiences of anger, as well as their ability to confront emotions. It was hypothesized that the combination of attachment, shame, and experiential avoidance would be predictors of anger. Finally, it was hypothesized that shame experiences would mediate the relationships between attachment and anger as well as attachment and experiential …

Consumer Financial Education And Financial Capability, Jing Jian Xiao, Barbara O'Neill Jan 2016

Consumer Financial Education And Financial Capability, Jing Jian Xiao, Barbara O'Neill

Human Development and Family Science Faculty Publications

The purpose of this study was to explore potential effects of financial education on the financial capability of American consumers. Data from the 2012 National Financial Capability Study were used to test the hypothesis that financial education is positively associated with financial capability. Four financial literacy and behaviour variables were used to form a financial capability index. Multivariate linear regression results showed that, after controlling for demographic and financial variables, respondents who ever received financial education had higher scores in all financial capability indicators (objective financial literacy, subjective financial literacy, desirable financial behaviour, perceived financial capability and the financial capability …

Mentors, Hyunjin Kim Jan 2016

Mentors, Hyunjin Kim

Human Development and Family Science Faculty Publications

One possible origin of the concept of mentor is the Odyssey, where it is discussed in terms of the role an older person might play in relation to a protégé. However, the relationship between mentors and protégés can be understood differently across circumstances and contexts. Correspondingly, mentoring roles have been conceptualized differently in different professions and types of organizations. Nevertheless, with few exceptions, in the field of education, a mentor is typically understood to refer to an experienced teacher in the same subject area who helps new teachers adjust to the teaching environment and supports them to succeed in the …

The Young And The Restless: Socializing Trumps Sleep, Fear Of Missing Out, And Technological Distractions In First-Year College Students, Sue K. Adams, Desirée N. Williford, Annemarie Vaccaro, Tiffani S. Kisler, Alyssa Francis, Barbara M. Newman

Human Development and Family Science Faculty Publications

College students are a sleep-deprived population, with first-year students facing a number of specific challenges to sleep. As students transition into and through the first year of college, sleep may be sacrificed for a variety of reasons. Semi-structured interviews were conducted with fifteen first-year students, exploring factors that impacted sleep during the first semester of college. Study participants identified three unique but related themes that impacted their sleep: socializing trumps sleep; fear of missing out; and social/technological distractions. Implications are provided for balancing social, academic and biological demands in emerging adulthood.

Outcome Measures For Mild Balance And Cognitive Decline In A Pre-Old Adult: A Case Report, Melissa Chan, Shari Rone-Adams Jan 2016

Outcome Measures For Mild Balance And Cognitive Decline In A Pre-Old Adult: A Case Report, Melissa Chan, Shari Rone-Adams

Internet Journal of Allied Health Sciences and Practice

Background and Purpose. Early detection and treatment of age-related decline, particularly balance and cognition, are increasingly being emphasized in current research. However, the majority of research on older adults focuses on participants who are 65 years and older. For individuals who are 60-64 years old, this is an age range where they may or may not be considered an older adult. This poses a problem applying the results of these studies to pre-old adults to accurately diagnose, measure and classify risk in the areas of cognition and balance. Case Description. The patient is a 61-year-old woman with a clinical diagnosis …

Variant Discovery And Fine Mapping Of Genetic Loci Associated With Blood Pressure Traits In Hispanics And African Americans., Nora Franceschini, Cara L. Carty, Yingchang Lu, Ran Tao, Yun Ju Sung, Ani Manichaikul, +20 Additional Authors Jan 2016

Variant Discovery And Fine Mapping Of Genetic Loci Associated With Blood Pressure Traits In Hispanics And African Americans., Nora Franceschini, Cara L. Carty, Yingchang Lu, Ran Tao, Yun Ju Sung, Ani Manichaikul, +20 Additional Authors

Clinical Research and Leadership Faculty Publications

Despite the substantial burden of hypertension in US minority populations, few genetic studies of blood pressure have been conducted in Hispanics and African Americans, and it is unclear whether many of the established loci identified in European-descent populations contribute to blood pressure variation in non-European descent populations. Using the Metabochip array, we sought to characterize the genetic architecture of previously identified blood pressure loci, and identify novel cardiometabolic variants related to systolic and diastolic blood pressure in a multi-ethnic US population including Hispanics (n = 19,706) and African Americans (n = 18,744). Several known blood pressure loci replicated in African …

Identification And Use Of Frailty Indicators From Text To Examine Associations With Clinical Outcomes Among Patients With Heart Failure., Yijun Shao, April F Mohanty, Ali Ahmed, Charlene R Weir, Bruce E Bray, Rashmee U Shah, Douglas Redd, Qing Zeng-Treitler Jan 2016

Identification And Use Of Frailty Indicators From Text To Examine Associations With Clinical Outcomes Among Patients With Heart Failure., Yijun Shao, April F Mohanty, Ali Ahmed, Charlene R Weir, Bruce E Bray, Rashmee U Shah, Douglas Redd, Qing Zeng-Treitler

Clinical Research and Leadership Faculty Publications

Frailty is an important health outcomes indicator and valuable for guiding healthcare decisions in older adults, but is rarely collected in a quantitative, systematic fashion in routine healthcare. Using a cohort of 12,000 Veterans with heart failure, we investigated the feasibility of topic modeling to identify frailty topics in clinical notes. Topics were generated through unsupervised learning and then manually reviewed by an expert. A total of 53 frailty topics were identified from 100,000 notes. We further examined associations of frailty with age-, sex-, and Charlson Comorbidity Index-adjusted 1-year hospitalizations and mortality (composite outcome) using logistic regression. Frailty (≤ 4 …

Reimagining Equity And Egalitarianism: The Basic Income Debate In Australia, Jennifer M. Mays, Gregory Marston Jan 2016

Reimagining Equity And Egalitarianism: The Basic Income Debate In Australia, Jennifer M. Mays, Gregory Marston

The Journal of Sociology & Social Welfare

Reimagining equity and egalitarianism calls for rethinking traditional welfare responses to poverty and economic security in Australia. Similar to other advanced Western democracies, Australia has pursued policies underpinned by neoliberal economics in an effort to curtail perceived excesses in public expenditure over the past three decades. In response to these policy settings, commentators and policy activists have increased their attention to the potential of a universal and unconditional basic income scheme to address economic insecurity. This paper positions basic income within the context of Australia's welfare state arrangements and explores the potential of the scheme to respond to economic insecurity, …

Lessons From Sweden: Solidarity, The Welfare State, And Basic Income, Almaz Zelleke Jan 2016

Lessons From Sweden: Solidarity, The Welfare State, And Basic Income, Almaz Zelleke

The Journal of Sociology & Social Welfare

Progressive critics of a universal basic income argue that most nations face a budgetary choice between a full basic income and investment in public goods, including universal health care, free and well-funded education, and universal pensions, and have prioritized a robust welfare state, or the "Swedish Model," over basic income. But examination of Swedish economic policy reveals that the welfare state is only one of the ingredients of the Swedish Model, and that another is an interventionist labor market policy unlikely to be expandable to larger states without Sweden's cultural and demographic characteristics. Indeed, evidence suggests that Sweden's own recent …

Susu: Capitalizing Development From The Bottom Up, David Stoesz, Isabella Gitau, Richard Rodriguez, Frank Thompson Jan 2016

Susu: Capitalizing Development From The Bottom Up, David Stoesz, Isabella Gitau, Richard Rodriguez, Frank Thompson

The Journal of Sociology & Social Welfare

Susu, a common way of saving money in the majority of developing countries, has migrated to developed nations. Originating in the 18th century in Ghana and Nigeria, susu is an indigenous method of microfinance, benefiting poor and minority groups. Significantly, susu relies on social capital as collateral, enhancing solidarity and building community. When American public assistance programs deny benefits to immigrants, susu becomes an important source of savings. The differentiation of susu from other savings strategies in the United States is explored.

Prospects For A Universal Basic Income In New Zealand, Keith Rankin Jan 2016

Prospects For A Universal Basic Income In New Zealand, Keith Rankin

The Journal of Sociology & Social Welfare

New Zealand is a small liberal capitalist country with a history of egalitarian values and political reform—including the early introduction of universal welfare benefits—and with an uncomplicated relatively flat income tax structure. As such, it has sometimes been seen as a "social laboratory," a theme of writing about New Zealand and of New Zealand social historians. It therefore has all of the elements in place that could make New Zealand a candidate to become a world leader in integrating income tax and social welfare regimes into a form of universal basic income. Nevertheless, through a combination of intellectual inertia, media …

Next Steps On The Road To Basic Income In Canada, James Mulvale, Sid Frankel Jan 2016

Next Steps On The Road To Basic Income In Canada, James Mulvale, Sid Frankel

The Journal of Sociology & Social Welfare

Canada has had recurring debates about guaranteed or basic income over several decades. This article outlines reasons for implementing basic income in the Canadian context—reducing poverty and inequality, addressing precarious employment, and building an ecologically sustainable economy. Recently there has been a strong renewal of interest in basic income in Canada. Expressions of interest have come from the Liberal federal government elected in 2015, from provincial governments, from political parties not in power, and from municipal governments. Support for basic income also is found in a growing range of prominent individuals and organizations. While basic income advocates are encouraged by …
