Hamad V. Gates And The Continuing Interpretation Of Boumediene: A Note On 732 F.3d 990 (9th Cir. 2013), Paul Blenz

A particularly prevalent type of claims in post-Boumediene cases are Bivens claims by detainees. One such case is Hamad v. Gates. Hamad represents a typical claim made by such detainees, and is the focus of this note. In Hamad, the Ninth Circuit held that a statute that had previously thought to be entirely overruled by Boumediene actually survived. This statute, 28 U.S.C. § 2241(e), stemmed from years of back-and-forth debate between the Supreme Court and Congress. The result of this conflict is still unsettled. The recent political atmosphere in America has reflected a perceived lack of constituent representation in the political process leading to a volatile 2016 Presidential race. This paper examines voter preferences and their effect on senator voting behavior and finds that depending on the party, voter preferences have different levels of effect on Senators. Republicans struggle between meeting the demands of their more numerous moderate statewide constituency and their smaller yet more extreme core supporters which reflect contemporary attitudes expressed by conservative constituents and Republican candidates. Democrats do not suffer this problem, being mindful of their statewide constituency while being able …

The purpose of this study was to examine the relationship between courage, psychological well-being (PWB), and somatic symptoms in an adult population. Courage is the ability to pursue goals or a purpose despite risk or fear. While courage has been shown to be associated with decreased mental health symptoms, little is known about health outcomes associated with courage. The hypotheses of this study were that higher reported levels of courage would predict lower reported somatic symptoms, and that PWB would account for significant variance in the relationship between courage and somatic symptoms. This paper comprises of original research and analysis of contemporary news media discourse surrounding Central American immigration in the United States. Subjects of study included more than 50 news articles, images, and videos from a variety of major politically-unaffiliated news outlets for English-speaking audiences. Rhetoric was analyzed in representations of the Central American immigration “crisis” that sparked a trend of media coverage in 2014, as well as several articles that covered events leading up to the “crisis.” Common rhetorical analogies ascertained through media analyses include the representation of immigrants as aliens, diseases, parasites, floods, criminals, natural disasters, terrorists, and drug …

Terrorism in the new millennium has morphed drastically since the 1970s. The terrorist organizations of today are a hybrid between the insurgent group models of the 1960s and modern terrorist organizations such as Al Qaeda. This hybrid model has created what has become a transnational insurgency recruited, trained, and led by major terrorist networks such as the Islamic State of Iraq and the Levant (ISIL). Even smaller regional groups such as Boko Haram have surpassed merely conducting terrorist attacks. These smaller groups are also focused on controlling territory. The portrayal of women in Ancient Greek drama seems at times opposed to the societal gender roles within Classical Athens. In the plays, women are strong and dynamic figures who enact change and upheaval in their world. Ancient dramas, like Agamemnon, Medea, Antigone, and Lysistrata, portrayed women with strong autonomy and minds which matched their male counterparts; whereas the women in Classical Athens found themselves in more limited circumstances. Despite a legion of criticisms from frustrated and reflective practitioners of humanitarian aid working in Africa and elsewhere, the fundamental problems surrounding NGO aid work persist; a critical mass of westerners are insufficiently receptive to these voices. I will demonstrate that this lack of receptivity is due to a set of implicit and explicit ideological commitments that comprise what I call ‘Charitable Consciousness.’ In this project I will describe the history of humanitarianism in the west, the Hegelian perspective with which to understand this history, and nature and structure of Charitable Consciousness. In the investigation following the San Bernardino killings where fourteen people were murdered and twenty-two were left injured, authorities learned that one of the killers, Tashfeen Malik, had revealed violent inclinations in her social media activities. Since 2012, Malik had shown allegiance with radical jihad. CBS News made clear that Malik expressed her support in Facebook communications, which were initiated even before her arrival in the United States. This article analyses the changes in the law and practice of exclusion zones in the law of armed conflict at sea. It identifies three principal phases. First, it explores the exclusion zones of the Russo-Japanese War of 1904–1905, which were modest in size and defensive in character. Second, it turns to the exclusion zones of the First World War and several subsequent conflicts. The exclusion zones of this period were fundamentally different to those of the Russo-Japanese war: if a vessel was within an exclusion zone, it was deemed susceptible to attack.
