Arundo donax, giant reed is an invasive weed in the riparian habitats of the Rio Grande Basin. A biological control program using specialist insects from the native range in Mediterranean Europe, including the arundo scale, Rhi-zaspidiotus donacis has been implemented. The arundo scale is a sessile insect that spends most of its life cycle affixed to its host plant, thus creating challenges for its rearing and redistribution to field sites. A horticultural technique was developed which allowed for rearing of the scale on small, potted A. donax microplants, which could later be transplanted to field sites. Female scale reach maturity …

Emile Durkheim serves as one of the seminal contributors to the field of sociology; his contributions to criminology are numerous as well. Many authors consider Durkheim’s concept of anomie to be his most important contribution to the field of criminology (Lunden, 1972). Durkheim’s anomie theory has been subject to extensive empirical examination, these efforts have resulted in disparate findings. Graeff and Mehlkop (2007) insist this lack of coherence is due to improper operationalization of Durkheim’s anomie by some researchers. In recent years, the courts have invalidated a variety of campaign finance laws while simultaneously upholding disclosure requirements. Courts view disclosure as a less-restrictive means to root out corruption while critics claim that disclosure chills speech and deters political participation. Using individual-level contribution data from state elections between 2000 and 2008, we find that the speech-chilling effects of disclosure are negligible. On average, less than one donor per candidate is likely to stop contributing when the public visibility of campaign contributions increases. Moreover, we do not observe heterogeneous effects for small donors or ideological outliers despite an assumption in First …

The existing literature on diverse teams suggests that diversity is both helpful to teams in making more information available and encouraging creativity and damaging to teams in reducing cohesion and information sharing. Differences Between Multimedia And Text-Based Assessments Of Emotion Management: An Exploration With The Multimedia Emotion Management Assessment (Mema), Carolyn Maccann, Filip Lievens, Nele Libbrecht, Richard D. Roberts

People process emotional information using visual, vocal, and verbal cues. However, emotion management is typically assessed with text based rather than multimedia stimuli. This study (N=427) presents the new multimedia emotion management assessment (MEMA) and compares it to the text-based assessment of emotion management used in the MSCEIT. The text-based and multimedia assessment showed similar levels of cognitive saturation and similar prediction of relevant criteria. Results demonstrate that the MEMA scores have equivalent evidence of validity to the text-based MSCEIT test scores, demonstrating that multimedia assessment of emotion management is viable. This book chapter, which synthesizes several of the author’s articles, attempts to provide useful perspectives on regulating systemic risk. First, it argues that systemic shocks are inevitable. Accordingly, regulation should be designed not only to try to reduce those shocks but also to protect the financial system against their unavoidable impact. This could be done, the chapter explains, by applying chaos theory to help stabilize the financial system. The chapter then focuses on trying to prevent excessive corporate risk-taking, which is one of the leading triggers of systemic shocks and widely regarded to have been a principal cause of the …

Neuroscience And Behavioral Genetics In Us Criminal Law: An Empirical Analysis, Nita A. Farahany

The goal of this study was to examine the growing use of neurological and behavioral genetic evidence by criminal defendants in US criminal law. Judicial opinions issued between 2005–12 that discussed the use of neuroscience or behavioral genetics by criminal defendants were identified, coded and analysed. Yet, criminal defendants are increasingly introducing such evidence to challenge defendants’ competency, the effectiveness of defense counsel at trial, and to mitigate punishment.

This essay makes a case for the salience of tort law to fiduciary law, focusing on actors who culpably participate in a fiduciary's breach of duty, whether by inducing the breach or lending substantial assistance to it. Although the elements of this accessory tort are relatively settled in the United States, how the tort applies to particular categories of actors-most recently investment bankers who serve as M&A advisors-provokes controversy. Carl Georg von Wächter (1797-1880) was once considered 'one of the greatest German jurists of all times’, but was all but forgotten in the 20th century, despite an excellent dissertation on his work in private international law by Nikolaus Sandmann. In private international law, he is known mainly for his critique of earlier theories, in particular the theory of statutes. Positively, Wächter is mainly (and not accurately) known as a proponent of a strong preference for the lex fori and as such mainly presented in opposition to Friedrich Carl von Savigny’s theory (Savigny, Friedrich Carl von). One of the most vexing conundrums of 21st century warfare has been not just the explosive growth in the use of human shields, but the apparent systemization of the tactic, particularly by nonstate actors. In noting the international prohibition, the International Committee of the Red Cross (ICRC) defines the practice as the “intentional co-location of military objectives and civilians or persons hors de combat with the specific intent of trying to prevent the targeting of those military objectives.”

The U.S. Constitution gives Congress the power to grant rights to “Authors” for their “Writings.” Despite the centrality of these terms to copyright jurisprudence, neither the courts nor scholars have provided coherent theories about what makes a person an author or what makes a thing a writing. This article articulates and defends a theory of copyrightable authorship. It argues that authorship involves the intentional creation of mental effects in an audience. A writing, then, is any fixed medium capable of producing mental effects. According to this theory, copyright may attach to the original, fixed, and minimally creative form or manner …

The interconversion between epithelial and mesenchymal is proposed to be a key machinery responsible for metastasis-related deaths. Likewise, cancer stem cells (CSCs) have been proposed to be a key driver of tumor metastasis. The gaseous biological mediator nitric oxide (NO) is also reported to mediate metastasis. Although they served in dangerous contexts the Army had an exclusionary policy at the time that formally excluded the women from direct combat. This study explored the lived experiences of 15 incarcerated men with a history of intimate partner violence.This qualitative grounded theory study revealed the impact significant loss in childhood, the most critical being the loss of a parent, had on these men.The results showed a significant loss set in motion a series of adaptive and maladaptive interpersonal behaviors with significant others, primarily parents and intimate partners that continued through adulthood and incarceration.The grounded theory dimensional analysis revealed five primary dimensions that described the dominant social processes described by the participants.These processes were:seeking, overcoming, blaming, controlling, and disengaging behaviors.The consequences of these …
