Competition Law For A Post-Scarcity World, Salil K. Mehra
Competition Law For A Post-Scarcity World, Salil K. Mehra
Texas A&M Law Review
Writers, economists and IP scholars have hailed signs of an incipient shift to a post-scarcity world. Driving this change are rapid decreases not only in marginal cost, but also in the fixed or first-unit costs of production. Whether these changes become economy-wide, or remain confined to a subset of industries, they have dramatic implications for competition law and policy. This Article is the first to address these implications. In particular, because of the incentive for incumbent firms to engage in what may be termed “anti-disruption” – as examples such as the Apple/e-books antitrust case and the regulatory responses to Uber …

Inviting Everyone To The (Risk) Pool Party: Reforming The Premium Tax Credit To Boost Participation, Mary Leto Pareja
Inviting Everyone To The (Risk) Pool Party: Reforming The Premium Tax Credit To Boost Participation, Mary Leto Pareja
Faculty Scholarship
The year 2014 marked the first opportunity for American taxpayers to receive subsidized health insurance through the Affordable Care Act’s (“ACA”) new Premium Tax Credit (“PTC”). About 4.8 million people enrolled in an ACA plan in 2014 were eligible, and nearly 97% of these claimants were approved for advance payments of the PTC. The year 2015 marked the first tax return where taxpayers received the unpleasant surprise that they must repay excess credits due to reconciliation. Advance PTC estimates turned out to be highly inaccurate, with only 8% of claimants receiving accurate advance payments. A majority, 51%, had to repay …

Identifying Risk For Atypical Parenting Behavior Using Prenatal Profiles Of Interpersonal Trauma Experiences And Ptsd Symptoms, Katherine L. Guyon-Harris
Identifying Risk For Atypical Parenting Behavior Using Prenatal Profiles Of Interpersonal Trauma Experiences And Ptsd Symptoms, Katherine L. Guyon-Harris
Master's Theses and Doctoral Dissertations
Experiences of interpersonal trauma and symptoms of PTSD greatly impact the ability to form and maintain meaningful relationships, which is especially problematic during the perinatal period due to the formation of the mother-child relationship. Interpersonal trauma and symptoms of PTSD present considerable risk for the emergence of a concerning class of “atypical” maternal behaviors (e.g., contradictory communication, sexualized/role reversed behavior, and severe withdrawal) that have serious implications for child social-emotional development. However, past research has focused primarily on how maternal experiences of childhood maltreatment and, to a lesser extent, PTSD symptom severity, predict atypical parenting behaviors. The present study aimed …
A Comparison Of Two Methods Of Template Amplification For Next Generation Sequencing: Implications Of Polyclonal Formation On Dna Sequence For Several Cancer Tissues, Akram Aldilaimi
Master's Theses and Doctoral Dissertations
Next-Generation Sequencing (NGS) technology has advanced the field of personalized medicine by predicting effective treatments for cancer patients using genomic sequence data, including the detection of oncogenes (genes involved in cancer development). Simultaneous amplification of multiple DNA templates (referred to as polyclonal formation) is a primary disadvantage when preparing templates for NGS resulting in redundancies in DNA sequences or nonspecific noise in the sequencing. This study was conducted to compare DNA templates for sequencing prepared using two instruments the Thermo Fisher Ion Chef (IC) and Thermo Fisher OneTouch-2 (OT2). Six sequencing metrics obtained from 114 sequencing trials for evaluation: polyclonal …
The Diversity Of Participants In Clinical Trials Involving Allogeneic Hematopoietic Stem Cell Transplant Recipients, Tracey Churay
The Diversity Of Participants In Clinical Trials Involving Allogeneic Hematopoietic Stem Cell Transplant Recipients, Tracey Churay
Master's Theses and Doctoral Dissertations
This thesis set out to examine whether the demographic diversity of participants in clinical trials involving allogeneic stem cell transplant recipients matched the diversity of the actual allogeneic recipient population overall. It is important that clinical trials study new therapies in a population that represents characteristics of the overall treatment population in order to gain accurate safety and efficacy data. The actual diversity of the allogeneic transplant population was determined using data reported to the Center for International Blood & Marrow Transplant Research (CIBMTR) registry. Then, a comprehensive literature review was conducted to identify the population of allogeneic transplant recipients …
Maturational Pace And Performance In Female Collegiate Swimmers, Alan Duski
Maturational Pace And Performance In Female Collegiate Swimmers, Alan Duski
Master's Theses and Doctoral Dissertations
purpose of this research was (1) to compare maturational pace between the female collegiate swimmers and non-athletic controls and (2) to determine whether maturational pace differs as a function of performance level. Maturational pace can be quantified retrospectively in women using age at menarche (AaM), with younger AaM corresponding to a faster maturational pace and older AaM a slower pace. Collegiate swimmers were significantly older at menarche (13.60 years ± 1.52 SD) than non-athletic controls (12.75 years ± 1.44 SD). In addition, the top-performing third of college swimmers in our sample were significantly older at menarche (14.06 years ± 1.59 …

"You Are Coming With Me": A Phenomenological Exploration Of Urban Speech-Language Pathologists, Audrey Michelle Farrugia-Bernard
Master's Theses and Doctoral Dissertations
Using phenomenology and symbolic action theory as a theoretical framework, this qualitative study explored the experiences and practices of urban, school-based speechlanguage pathologists (SLPs). The study focused on the assessment, certification, and service of students in urban schools, a majority of whom are members of minority groups in light of the disproportionality of students of color in special education. This study aimed to capture the urban SLP’s point of view and illuminate the power that they may use or abuse in a school system. The understanding of the lived experiences and practices of 11 White, female SLPs practicing in urban …
Peace Corps Culture And The Language Of Violence: A Feminist Discursive Analysis, Elizabeth Z. Johnk
Peace Corps Culture And The Language Of Violence: A Feminist Discursive Analysis, Elizabeth Z. Johnk
Master's Theses and Doctoral Dissertations
Peace Corps is an international volunteer service organization and an agency of the United States Federal Government. Like all American governmental institutions, Peace Corps has an institutional culture with a heteropatriarchal, settler colonial legacy. In recent years, this has manifested in Peace Corps’ mishandling of cases of sexual violence against Peace Corps Volunteers. The agency has undertaken many reforms in response to public pressure, including changes at the level of language in policy and protocol. This project has two objectives, the first of which is an analysis of Peace Corps discourse on violence, victimhood, and responsibility. This discursive analysis is …
Understanding Urgency In Borderline Personality Disorder: Disinhibition Or Impulsive Emotion Regulation?, Amy Paggeot
Understanding Urgency In Borderline Personality Disorder: Disinhibition Or Impulsive Emotion Regulation?, Amy Paggeot
Master's Theses and Doctoral Dissertations
Borderline Personality Disorder (BPD) is a serious and costly disorder characterized by emotional dysregulation and risky, impulsive behaviors. Urgency is a type of impulsivity that has been strongly associated with symptoms of BPD, and it remains unclear whether Urgency represents a failure of self-regulation under conditions of strong emotions or whether Urgency reflects short-term attempts to regulate strong emotions. A useful method for studying the role of strong emotions in impulsive behaviors is “mood freezing”. Mood freezing is a technique that uses a placebo to create a context in which individuals believe that they are unable to change their mood …
Comparing Healthy Eating Index Scores To Physical Activity Levels In Adults Using 20007–08 And 2009–10 Nhanes Data Sets, Lori Nedescu
Comparing Healthy Eating Index Scores To Physical Activity Levels In Adults Using 20007–08 And 2009–10 Nhanes Data Sets, Lori Nedescu
Master's Theses and Doctoral Dissertations
Research suggests diet intake among adults lacks in healthfulness, which contributes to poor quality of life and increased disease outcomes. This study assesses the relationship between diet quality, using the Healthy Eating Index (HEI), and presence of physical activity (PA). Participants included 11,167 adults ≥ 20yrs with valid NHANES 2007–08 and 2009–10 diet interviews and PA questionnaires. Subjects were divided into sedentary, 1–149 minutes per week of PA (moderate exercisers) and ≥150 minutes per week PA (meets or exceeds PA guidelines) groups based on guidelines set by the Department of Health and Human Services. Dietary interviews were scored for quality …

Biology Faculty Publications and Presentations
Premise of the study: Low-elevation surveys with small aerial drones (micro–unmanned aerial vehicles [UAVs]) may be used for a wide variety of applications in plant ecology, including mapping vegetation over small- to medium-sized regions. We provide an overview of methods and procedures for conducting surveys and illustrate some of these applications.
Methods: Aerial images were obtained by flying a small drone along transects over the area of interest. Images were used to create a composite image (orthomosaic) and a digital surface model (DSM). Vegetation classification was conducted manually and using an automated routine. Coverage of an individual species …
How Can A Focus On The Ethical Notions Of Dignity And Respect For Autonomy Help To Improve Healthcare For Elderly People In Islamic Countries?, Abeer Alamri
Electronic Theses and Dissertations
The purpose of this dissertation is to identify how can a focus on the ethical notion of dignity and respect for autonomy help to improve health care for elderly people in Islamic countries. An ethic for aging relies on the principle that the losses of age do not detract from a person's essential autonomy. Thus, care should be provided without assuming that older people are different from those of other ages. It is possible to determine that ethical values are similar in Islamic cultures as well as, Western countries. But these values are often neglected when people face the need …
Queer Farmers: Sexuality And The Transition To Sustainable Agriculture, Isaac Leslie
Queer Farmers: Sexuality And The Transition To Sustainable Agriculture, Isaac Leslie
Master's Theses and Capstones
Intimate relationships are foundational to farm viability. Such relationships affect how farmers share tasks, earn income, and access land, yet the role of sexuality and heteronormativity in agriculture remains understudied. Furthermore, queers are largely ignored as potential farmers by the sustainable agriculture and LGBT movements. Through participant observation and interviews with 30 sustainable farmers of various genders and sexualities in New England, I document the lived experiences of queer sustainable farmers, an under-researched group, and examine whether sexuality and gender affects why they farm. Whereas the perception of rural heterosexism can discourage queer participation in agriculture, queer farmers faced less …

Human Brain Reacts To Transcranial Extraocular Light, Lihua Sun, Jari Peräkylä, Anselmi Kovalainen, Keith Ogawa, Pekka J. Karhunen, Kaisa M. Hartikainen
School of Science Faculty Works
Transcranial extraocular light affects the brains of birds and modulates their seasonal changes in physiology and behavior. However, whether the human brain is sensitive to extraocular light is unknown. To test whether extraocular light has any effect on human brain functioning, we measured brain electrophysiology of 18 young healthy subjects using event-related potentials while they performed a visual attention task embedded with emotional distractors. Extraocular light delivered via ear canals abolished normal emotional modulation of attention related brain responses. With no extraocular light delivered, emotional distractors reduced centro-parietal P300 amplitude compared to neutral distractors. This phenomenon disappeared with extraocular light …

This article explains the motivations behind the National Park Service’s first urban parks and describes the National Park Service’s recent emphasis on urban areas. From designations such as Pullman Park in Chicago, to initiatives like the Urban Agenda, the National Park Service is poised to engage urban America and create a new generation of park visitors.
Oil & Gas Drilling In National Parks, Elizabeth Ann Glass Geltman
Oil & Gas Drilling In National Parks, Elizabeth Ann Glass Geltman
Natural Resources Journal
While a great deal of public attention addresses the Halliburton loophole of the Energy Policy Act of 2005 and Bureau of Land Management efforts to regulate hydraulic fracturing on public lands, less attention has been paid to the National Park Service “9B Regulations,” which provide a national regulatory framework governing the exercise of oil and gas rights in national parks. This article begins with a review of law pertaining to oil and gas drilling in national parks. The article examines the tension in striking a balance between environmental protection, conservation of national lands, and achieving energy independence, including National Park …
The National Park Service Organic Act And Climate Change, Eric Biber, Elisabeth Long Esposito
The National Park Service Organic Act And Climate Change, Eric Biber, Elisabeth Long Esposito
Natural Resources Journal
This article examines the future of the National Park Service Organic Act in a changing climate. Managers and scholars have raised questions about whether the Organic Act gives the Park Service sufficient authority to undertake the steps necessary to adapt to climate change. This article concludes that the Organic Act and park-specific enabling acts, as interpreted by the courts, grant the Park Service wide discretion to pursue management options for adaptation to climate change impacts on national park resources. It also concludes that the Organic Act, properly understood, does impose some necessary constraints on agency decision-making, constraints that prevent inappropriate …
Animal Suffering Calls For More Than A Bigger Cage, Simon R. B. Leadbeater
Animal Suffering Calls For More Than A Bigger Cage, Simon R. B. Leadbeater
Animal Sentience
Ng (2016) argues for incremental welfare biology partly because it would be impossible to demonstrate conclusively that animals are sentient. He argues that low cost changes in industrial practices and working collaboratively may be more effective in advancing animal welfare than more adversarial approaches. There is merit in some of Ng’s recommendations but a number of his arguments are, in my view, misdirected. The fact that nonhuman animals feel has already been adequately demonstrated. Cruelty to animals is intrinsic to some industries, so the only way to oppose it is to oppose the industry.
Student Preconceptions Of Arid, Urban Watershed Management And How Experiential Learning Might Contribute To Conceptual Change., Rachel Aliyah Thomas
Student Preconceptions Of Arid, Urban Watershed Management And How Experiential Learning Might Contribute To Conceptual Change., Rachel Aliyah Thomas
Water Resources Professional Project Reports
Voting-aged, freshman-level university students attending college in urban Southwest US cities are living in what is considered one of the most 'climate-challenged' regions of the entire country. Such students may not understand the issues and ways to manage an urban watershed. For instance, the Southwest faces climate change drought predictions and naturally occurring water scarcity. Urban populations continue to climb, pushing up demands on already scarce water resources. Urban watersheds present specific challenges, such as impermeable surfaces. Students need to understand these urban watershed management challenges and climate change stressors. I conducted a study in an introductory environmental science class …
Assessing The Geomorphological Effects Of Ungulate Exclosures On High Elevation Streams In The Valles Caldera National Preserve, New Mexico, Ryan Kelly
Water Resources Professional Project Reports
A catchment-scale approach to the connection between the terrestrial environment and aquatic ecosystems is important because of the context that it provides into stream form and function. A streams physical and chemical qualities are often delineated, in large part, by the surrounding catchment's terrestrial properties and features, such as geology, soils, vegetation and topography (Van Horn et al. 2012). For example, losses in catchment vegetation can result in a change in terrestrial organic carbon inputs into streams (Bunn et al. 1999). Four important dimensions of connection exist when describing the physical, chemical, and energetic interactions between the stream itself and …
A Bio-Ecological Perspective On Educational Transition: Experiences Of Children, Parents And Teachers., Leah O'Toole
A Bio-Ecological Perspective On Educational Transition: Experiences Of Children, Parents And Teachers., Leah O'Toole
Doctoral
This thesis explores the potential of Bronfenbrenner’s Bio-ecological Model of Human Development (Bronfenbrenner and Morris, 2006) as a framework for theory and research in psychology, sociology and education. It draws on other well-known conceptual approaches, particularly Bourdieu’s theories of social reproduction, habitus, field and cultural capital, investigating points of theoretical enhancement and synthesis. This culminates in the development of eight Propositions for a Bio-ecological Framework. These are then tested using data from a qualitative examination of two key educational transitions, pre-school to primary and primary to secondary school. Using qualitative methodologies, this research explores perspectives of children, teachers and parents …
