Rhetoric, Race, And Barack Obama's Discourse Of Division, Scott Matthew Lynn Anderson May 2016

Rhetoric, Race, And Barack Obama's Discourse Of Division, Scott Matthew Lynn Anderson

Electronic Theses and Dissertations Archive

The ascendance of Barack Obama prompted many news media outlets to proclaim the arrival of a post-racial twenty-first century. Although his presidency represents a milestone with regard to equlaity, Obama has been called to respond to exigencies that have manifested in the form of racial unrest on several occasions across his political career. This dissertation chronologically examines Obama's responses to events that have put racism or the perception of racial inequality on full display. It starts with an analysis of Obama's "A More Perfect Union" address, which followed the media firestorm surrounding Reverend Jeremiah Wright during the 2008 presidential campaign, …

Reconciliation: All Our Relations, Kelly Laurila May 2016

Reconciliation: All Our Relations, Kelly Laurila

Consensus

The author shares the national, community (local) and individual discourses taking place as they pertain to the reconciliation process that is happening with Indigenous and Settler peoples in Canada. Importantly, the author sheds light on a multitude of local efforts of reconciliation happening that have not yet made it to academic discourses and publications, but which could be instrumental in contributing to reconciliation. A key component emphasized in these reconciliation efforts and which could be the catalyst for change, is the importance of relationships. Stemming from an Indigenous epistemological perspective, the creation of positive relationships with others and ‘all our …

Prime Movers, Garvin Sealy

Theses

Prime Movers, exhibited from April 1-15 2016, at Bevier Gallery, Rochester Institute of Technology (R.I.T), explores the motivations behind human actions, and the inner workings of the self, through introspection, metacognition, research and experimentation. Inspiration for this work comes from a desire to gain better self-awareness and understanding. Social and personal mythologies are employed to investigate the contemporary human condition. Glass, porcelain, metal, wood, acrylic, soap, light and sound are the elements used to translate the concepts into tangible forms.

The Protection Of Sunken Warships As Gravesites At Sea, Jason R. Harris May 2016

The Protection Of Sunken Warships As Gravesites At Sea, Jason R. Harris

Ocean and Coastal Law Journal

On January 19, 2001, in the closing hours of his presidency, William J. Clinton issued the following statement entitled "United States Policy for the Protection of Sunken Warships:" Thousands of United States government vessels, aircraft and spacecraft ("State craft"), as well as similar State craft of foreign nations, lie within, and in waters beyond, the territorial sea and contiguous zone. Because of recent advances in science and technology, many of these sunken Government vessels, aircraft, and spacecraft have become accessible to salvors, treasure hunters, and others. The unauthorized disturbance or recovery of these sunken State craft and any remains of …

Understanding Perceptions Of Citizen Demeanour: Using An Experimental Design To Understand The Impact Of Encounter And Observer Characteristics, Kathleen M. Donovan, Rob Tillyer, Charles F. Klahm Iv May 2016

Understanding Perceptions Of Citizen Demeanour: Using An Experimental Design To Understand The Impact Of Encounter And Observer Characteristics, Kathleen M. Donovan, Rob Tillyer, Charles F. Klahm Iv

Political Science Faculty/Staff Publications

Systematic social observations of police-citizen encounters have revealed that citizen demeanour is an important predictor of outcomes (e.g. arrests and searches). Drawing from research on stereotypes and impression formation, we examine whether characteristics of the encounter and/or observer affect how respondents perceive demeanour. We exposed undergraduates (n = 255) to a randomly rotated series of five between-subjects design, in which characteristics of the encounter (citizen race, gender, or age; officer gender; neighbourhood context) and the level of demeanour displayed were manipulated. OLS regression was used to examine how these manipulations interact to produce our dependent variable – perceptions of …

Stop And Frisk Redux: Analysis Of Racial Bias In New York City, Abraham Gutman May 2016

Stop And Frisk Redux: Analysis Of Racial Bias In New York City, Abraham Gutman

Theses and Dissertations

Stop and Frisk is a policing practice used commonly in NYC. For some, equal arrest rates for non-white and white pedestrians indicate no racial bias. I challenge that conclusion and argue that heterogeneity masks lower arrest rates of non-white pedestrians. I conclude that Stop and Frisk is an uneven policing practice that carries racial bias.

Psychometric Evaluation Of The Offender Coping Self-Efficacy Scale In The Context Of Incarceration And Upon Re-Entry, Minhdan Thuy Ta May 2016

Psychometric Evaluation Of The Offender Coping Self-Efficacy Scale In The Context Of Incarceration And Upon Re-Entry, Minhdan Thuy Ta

Clinical Psychology Dissertations

Incarceration presents unique stressors that affect psychological well-being. Identifying self-efficacy for different types of coping strategies to manage stressors may help treatment teams develop appropriate interventions aimed at reducing recidivism. Consequently, I developed and evaluated the preliminary psychometric properties of the Offender Coping Self-Efficacy Scale (OCSS). An initial pool of 47 items was used to assess inmates’ confidence in their ability to cope with stressors related to incarceration and re-entry. The scale was completed by a sample of inmates (N = 144) who were 18 years or older and serving time at one of two county jails. The majority …

Submersibles And Transnational Criminal Organizations, Brian Wilson May 2016

Submersibles And Transnational Criminal Organizations, Brian Wilson

Ocean and Coastal Law Journal

In 2007, the U.S. Coast Guard approached a crudely constructed, aqua-blue vessel, containing nearly six tons of cocaine. The four crewmen aboard the self-propelled semi-submersible (SPSS) appeared to be well aware that they could avoid criminal prosecution if they destroyed all evidence of their drug trafficking before law enforcement officials arrived. As the boarding team neared the SPSS, the crew opened the scuttling valves to sink the fiber-glassed submersible. However, the Coast Guard was fortunate in this case; the crewmembers were unable to scuttle the eleven bales of cocaine valued at more than $350 million, though they did manage to …

Is Registering As An Animal Abuser In Illinois Abusive To The Offender? An Examination Of The Proposed Illinois Animal Abuse Registry, Alisha L. Biesinger May 2016

Is Registering As An Animal Abuser In Illinois Abusive To The Offender? An Examination Of The Proposed Illinois Animal Abuse Registry, Alisha L. Biesinger

Southern Illinois University Law Journal

This Comment explains why the proposed animal abuse registry in Illinois should not be passed because it pushes constitutional limitations, is impractical, and would be ineffective in meeting its goals. It first discusses background information on animal abuse registries, including Illinois’ proposed registry, and other relevant Illinois registries. The Comment then discusses the constitutional limits any registry in Illinois faces and focuses on how the proposed animal abuse registry pushes the constitutional bounds of due process. Lastly, the Comment analyzes the problems associated with an animal abuse registry in Illinois, most notably the lack of financial resources in Illinois and …

Beyond A Reasonable Disagreement: Judging Habeas Corpus, Noam Biale May 2016

Beyond A Reasonable Disagreement: Judging Habeas Corpus, Noam Biale

University of Cincinnati Law Review

This Article addresses ongoing confusion in federal habeas corpus doctrine about one of the most elemental concepts in law: reasonableness. The Supreme Court recently announced a new standard of reasonableness review for habeas cases, intended to raise the bar state prisoners must overcome to obtain federal relief. This new standard demands that errors in state court decisions be so profound that “no fairminded jurist could disagree” that the result is incorrect. Scholars have decried the rigid and exacting nature of this standard, but very little interpretive work has yet been done to theorize what it means and how it should …
