Federalism And The Disappearing Equal Protection Rights Of Immigrants, Kevin R. Johnson
Federalism And The Disappearing Equal Protection Rights Of Immigrants, Kevin R. Johnson
Washington and Lee Law Review Online
Jenny-Brooke Condon’s article The Preempting of Equal Protection for Immigrants? analyzes important issues surrounding the constitutional rights of immigrants. Professor Condon in essence contends that the current legislative, executive, and scholarly focus on the distribution of immigration power between the state and federal governments has undermined the Equal Protection rights of legal immigrants in the United States. Despite the contentious national debates over immigration reform, immigrants’ rights have generally been of secondary concern in contemporary immigration scholarship, which is now dominated by analysis of immigration federalism.
Professor Condon undoubtedly is correct that we should not lose sight of the rights …

Cheating On Unproctored Internet Intelligence Tests: Strategies And Effects, Wim Bloemers, Arjan Oud, Karen Van Dam
Personnel Assessment and Decisions
A crucial issue concerning unproctored Internet-based testing (UIT) of cognitive ability is its susceptibility to cheating. Whereas evidence indicates that cheating during UIT occurs, there is still little information about possible cheating strategies and their effects on (sub)test performance. Using a randomized experimental design, this study investigated the direct effects of cheating on an Internet-based test of cognitive ability by comparing test performance of cheaters (participants who were instructed to cheat) and successful cheaters (participants who thought their cheating had been successful) with that of non-cheaters. Successful cheaters obtained substantially higher scores compared to cheaters who thought they had been …

Civil War Era Studies Faculty Publications
Gettysburg Burgess William E. Olinger was an unassuming local politician. Born during the Civil War, Olinger was the child of local farmers. A teacher and insurance salesman, Olinger was also a fastidious county auditor in the 1890s and served as clerk of the courts from 1912 to 1916. By the 1920s, Olinger was in charge of the Borough of Gettysburg, one of the most powerful political voices in the county. [excerpt]

Disparate Use Of Exclusionary Discipline: Evidence On Inequities In School Discipline From A U.S. State, Kaitlin Anderson, Gary W. Ritter
Education Reform Faculty and Graduate Students Publications
There is much discussion in the United States about exclusionary discipline (suspensions and expulsions) in schools. According to a 2014 report from the US Department of Education’s Office for Civil Rights, Black students represent 15% of students, but 44% of students suspended more than once, and 36% of expelled students. This analysis uses seven years of individual infraction-level data from public schools in Arkansas. We examine whether disproportionalities exist within schools, or are instead, a function of the type of school attended. We find that marginalized students are more likely to receive exclusionary discipline, even after controlling for the nature …
Jury Bias: Myth And Reality, Callie K. Terris
Jury Bias: Myth And Reality, Callie K. Terris
Politics Summer Fellows
Juries are often thought of as being fair and crucial to producing fair trials. Things such as scientific jury selection (SJS), peremptory challenges, jury size, and jury nullification skew jury verdicts by introducing biases that reflect the attitudes, characteristics, and behaviors of jurors. This paper demonstrates how bias is formed starting during the voir dire process and continuing until the rendering of a verdict. Each bias can lead to wrongful convictions such as conviction of the innocent or acquittal of the guilty. With a system that prides itself on the notion that justice is blind, the bias that is created …

A group of 16, mostly librarians, met in the Archives Reading Room of City College Library on Friday, June 17, 2016. The format of our meeting was an unconference, which means the conversations were driven by the concerns of the participants. I have no doubt that anyone who reads this document will come away with different impressions. The ideas that jumped out at me include learning a lot more about universal design for learning. Be aware that phones can be used in the classroom as assistive technology. Consider doing a usability study of library resources in concert with students with …

The Fragile Balance Of Power And Leadership, Angela M. Jones, Sheri L. York
The Journal of Values-Based Leadership
The aim of this article is to first define effective leadership and power, highlighting the differences between the two. The focal point is that power and effective leadership are not interchangeable and should not be treated as such. Power is a tool while effective leadership is a skill. Simply because a person wields power does not necessarily mean that he or she is an effective leader. Conversely, we will discuss how a leader is unquestionably endowed with a certain degree of power in order to maintain that particular position. Finally, because leaders have power at their disposal, we will explore …

Behold, She Stands At The Door: Reentry, Black Women And The Black Church, Kathryn V. Stanley
Journal of Prison Education and Reentry (2014-2023)
This paper examines the African American church’s response to the special problems of African American women who reenter the community post-incarceration. The first portion of the paper examines the impact of criminal justice policies on women of color and the attending problems of reentry which resulted. It then surveys the black church’s response to returning citizens, especially women. It concludes by proposing shifts in perspectives and theologies which create barriers to successful reintegration into the community at large, and the church in particular. The intended audience is individuals and faith communities who seek to work effectively with returning women.

AJiC Reports
This report presents the initial results of Alaska’s Results First Initiative, which is examining both the effectiveness and the efficiency of the state's adult criminal justice programs by conducting a comprehensive review of the full array of programs funded by the state. The review includes a thorough inventory of state-funded programs, determining the proportion of those programs that are evidence-based, and detailing both the costs of operating those programs, as well as the benefits derived from them via reductions in offender recidivism. The Alaska Results First Iniative is a participant in the Pew-MacArthur Results First Initiative, a "smart justice" approach …
