A Functional Analysis Of Leader Behavior In A Behavioral Health Setting, Jason White
A Functional Analysis Of Leader Behavior In A Behavioral Health Setting, Jason White
All Theses And Dissertations
A requirement for Maine behavioral health organizations to provide all employees with evaluations lacks guidelines on how to evaluate leader behavior; best practices are to provide a multifaceted evaluation process that includes direct observation. A single-case research design and continuous partial interval recording procedures were conducted on a male behavioral health clinician leading clinical supervision in which the dependent variable was the clinician’s delivery of positive reinforcement and the independent variable was the provider’s increased discussion of case shares. The basic findings showed that leader behavior changed as follower behavior changed to manage the group and meet group goals. The …
Securing Sequences: Ensuring Adequate Protections For Genetic Samples In The Age Of Big Data, Elizabeth R. Pike
Securing Sequences: Ensuring Adequate Protections For Genetic Samples In The Age Of Big Data, Elizabeth R. Pike
Cardozo Law Review
Bulk collection of our personal data is increasingly common. Our internet browser history leads to personalized, targeted advertising; credit card companies aggregate billions of our collective transactions to gain insight into our spending patterns; and, as recently revealed, the National Security Agency engaged in the widespread collection of our telephone data without our knowledge or consent. But what if the data being collected, stored, shared, and used without our knowledge or consent is arguably the most personal of all data - our unique genetic sequence? In ways underreported and underexamined, the genetic information of nearly every American is likely to …

Criminalization And Welfare, Dan Priel
Criminalization And Welfare, Dan Priel
Articles & Book Chapters
A standard view about criminal law distinguishes between two kinds of offenses, “mala in se” and “mala prohibita.” This view also corresponds to a distinction between two bases for criminalization: Certain acts should be criminalized because they are moral wrongs; other acts may be criminalized for the sake of promoting overall welfare. This paper aims to show two things: First, that allowing for criminalization for the sake of promoting welfare renders the category of wrongfulness crimes largely redundant. More importantly, accepting welfare as a legitimate ground for criminalization implies a certain view about legitimate state action, which makes criminalization for …
Development And Validation Of The Nebraska Department Of Correctional Services Prison Classification System, Zachary Hamilton, Alex Kigerl
Development And Validation Of The Nebraska Department Of Correctional Services Prison Classification System, Zachary Hamilton, Alex Kigerl
Reports
Over the last 45 years, the Nebraska Department of Correctional Services (NDCS) has made two substantial changes to its classification system. The first system was created and implemented in the 1970s. In 2005, Patricia Hardyman was contracted to update and modify the classification and reclassification system. Using statistical analyses of available data, a set of prediction models were created to score inmates on items that predicted future infraction behavior. However, the primary issues of the tools were that inmates’ scores were routinely over-classified and that substantial uses of overrides (approximately 40%) were indicated. After a review of the tools’ development …

Sentence Structure: Prohibiting “Second Or Successive” Habeas Petitions After Patterson V. Secretary, Christina M. Frohock
Sentence Structure: Prohibiting “Second Or Successive” Habeas Petitions After Patterson V. Secretary, Christina M. Frohock
University of Miami Law Review
The Eleventh Circuit’s recent opinion in Patterson v. Secretary includes a heated dispute over the prohibition against “second or successive” habeas corpus petitions in 28 U.S.C.§ 2244(b). Considering an amended criminal sentence from Florida state court, the majority and dissenting opinions structure that sentence differently and, thus, apply the prohibition differently. This Article argues that both the majority and the dissent conceal policy judgments beneath the surface of legal decision-making. First, the Article analyzes the statutory prohibition against “second or successive” habeas petitions, as applied previously by the U.S. Supreme Court in Magwood v. Patterson and by the Eleventh Circuit …

Personal Security And Immigration In The European Union, Anna Kristi Muzzy
Personal Security And Immigration In The European Union, Anna Kristi Muzzy
Boise State University Theses and Dissertations
What is the impact of migration patterns on perceptions of personal security in the European Union countries over the past half-decade? Although the numbers of migrants from outside the EU are undeniably massive, their impact upon domestic public opinion is understudied. Following recent work that explores themes of fear of migrants in EU native populations (Bustikova 2014, d' Appollonia and Reich 2008, Ivarsflaten 2008), I propose a multivariate model that explains variation across EU countries in citizens' views of personal security that includes migration rates, unemployment rates, crime rates, the presence of terrorism, and views of government performance. The results …

Students’ Perceptions Of Restorative Conferences In An Urban High School, Robert Diflorio
Education Doctoral
Restorative justice practices allow students who violate school rules to face their victims and correct their offenses to repair the harm they have caused to someone or something. This study examined students’ perceptions of restorative conferences used in an urban high school. It examined students’ perceptions of the impact that restorative conferences have on students’ behavior and their rationale for that behavior. Qualitative research methods were used to collect and analyze data. This study identified three major themes a) types of behavior that caused a restorative conferences b) impact of restorative conferences on behavior c) conditions to have a positive …
College Experiences And The Socially Responsible Leadership Skills Of Community College Students, Ann Marrott Hamann
College Experiences And The Socially Responsible Leadership Skills Of Community College Students, Ann Marrott Hamann
Education Doctoral
Leadership development in higher education is increasingly emphasizing socially responsible leadership, a process that improves the human condition for everyone, not only those with power and privilege. College students’ experiences with other students through service, projects, and social interaction have been shown to cultivate socially responsible leadership, the type of leadership scholars are calling for to help communities adapt to geopolitical and socio-economic change continuing apace. Community colleges are typically omitted from college outcome studies, although they enroll almost half of all undergraduate students today and are serving an increasingly diverse population. This quantitative study used the Multi-Institutional Study of …
Agents Of Justice: Female Plaintiffs In The King’S Court In Thirteenth And Fourteenth-Century England, J. Savannah Shipman
Agents Of Justice: Female Plaintiffs In The King’S Court In Thirteenth And Fourteenth-Century England, J. Savannah Shipman
Masters Theses
It has often been assumed that medieval women, noble or common, had little or no agency, were forced into submissive roles by dominating men, and had little control over their day-to-day lives. Theoretical statements about law served to support these assumptions as they forbade women from prosecuting men for any crimes other than the murder of her husband or for rape. Yet the records of the court proceedings before the king and his justices and the Calendar of Patent Rolls paint a very different picture. The sources themselves show that women regularly came to court to gain compensation and justice …

Miranda Overseas: The Law Of Coerced Confessions Abroad, David Keenan
Miranda Overseas: The Law Of Coerced Confessions Abroad, David Keenan
UC Law Journal
In recent years, Article III courts have become the preferred venue for the U.S. government to try terrorism suspects captured abroad. Many liberals have welcomed this development, characterizing it as a proper extension of American rule of law principles to the so-called “War on Terror.” But while many have celebrated the marginalization of the military tribunal system, few have directly acknowledged its potential costs. This Article examines one of those costs: Reduced procedural safeguards for Article III defendants against statements procured through coercive interrogation techniques. As courts have repeatedly recognized, the core purpose of the Fifth Amendment’s Self-Incrimination Clause is …
Reader Engagement With Data Journalism: Comparing The Guardian And Washington Post's Coverage Of People Killed By Police, Dan Michalski
Reader Engagement With Data Journalism: Comparing The Guardian And Washington Post's Coverage Of People Killed By Police, Dan Michalski
UNLV Theses, Dissertations, Professional Papers, and Capstones
The issue of people killed by police has become a focus of current political and social discourse related to criminal justice reform in the United States. Two data journalism projects attempting to track previously missing data have been central to a changing discussion. The Guardian’s The Counted and The Washington Post’s Investigation: Police Shootings have each attempted to create a running log of fatalities resulting from law enforcement activities. Such endeavors have added to a collective consciousness about the scope and commonality of deadly police encounters, and has provided empirical reference points for various legislative pushes related to police accountability. …
The Link Between Recurrent Childhood Animal Cruelty And Recurrent Interpersonal Violence, Caleb E. Trentham
The Link Between Recurrent Childhood Animal Cruelty And Recurrent Interpersonal Violence, Caleb E. Trentham
Masters Theses and Doctoral Dissertations
In the early 1960s, researchers began to examine the potential link between childhood animal cruelty and future interpersonal violence. Findings since then have been inconsistent in establishing a relationship between the two. This may be due to researchers failing to measure the recurrency of childhood animal abuse and the recurrency of later violent acts committed in adulthood. The current study, using data from 257 inmates at a medium-security prison in a Southern state, is a replication of research conducted by Tallichet and Hensley (2004) and Hensley, Tallichet, and Dutkiewicz (2009), which examined this recurrency issue. The only statistically significant predictor …

The Forgotten Signature: An Observational Study On Policy Of Securing Identity In Prevention Of Identity Theft And Credit/Debit Card Fraud At Retail Store Pos Terminals, Belinda R. Wilson
Electronic Theses and Dissertations
Identity theft and credit and bank card fraud is increasing in America and worldwide. Given the current statistics of its prevalence and practices around the world, many in government are starting to take critical notice due to its impact on a nation’s economy. Limited amounts of research have been conducted regarding the practices of applying the Routine Activities Theory (Cohen & Felson, 1979) to better equip store managers in understanding the critical need for capable and effective point of sale guardianship for in-store prevention of credit or bank card fraud due to identity theft. This research has used qualitative observational …

School Killers Speak: A Comprehensive Examination Of Perpetrators, Events, And Characteristics Of K-12 School Violence In America, Gordon A. Crews
Criminal Justice Faculty Publications
This book resulted as part of a comprehensive and ongoing research project investigating the causes of K–12 school violence and disturbance in America. Between 2008 and 2012, all publicly available lists and news reports were scoured to obtain a population of names of perpetrators who committed violence on kindergarten to 12th-grade school property or at a school function since the 1700s (approximately 500-plus incidents initially identified).
Then the deceased, released, un-adjudicated, and otherwise un-locatable individuals were eliminated from the sample (decreasing cases to approximately 120 incidents). Finally, state correctional systems were extensively searched to determine the number of these offenders …

Black Male Emerging Adults: Investigating Inequalities In Adult Transitions, Social Learning, And Criminality, De Andre' Terrell Beadle
Black Male Emerging Adults: Investigating Inequalities In Adult Transitions, Social Learning, And Criminality, De Andre' Terrell Beadle
Graduate Theses and Dissertations
Emerging adulthood is a life stage that developed as a result of numerous macro-structural changes in recent decades (Arnett 2015), and which has implications for life course criminality and identity formation (Massoglia & Uggen 2010). Much research has been done in the area of the new life stage known as “emerging adulthood,” however little to no research has been done on how emerging adulthood relates to or changes classic findings in criminology, especially about the importance of disadvantages embedded in racial inequalities. This mixed method study analyzes data from the National Study of Youth and Religion (NSYR) to examine Social …

Civil Liability And The Response Of Police Officers: The Effect Of Lawsuits On Police Discretionary Actions, Anthony P. Chiarlitti
Education Doctoral
The purpose of this study was to determine if there is a relationship between police discretion in carrying out arrests and the fear of retaliation litigation. Quantitative methods were used to examine the concerns of 88 police officers and first-line supervisors regarding civil litigation and the impact these concerns have on the discharge of their duties. The results indicate that the police officers in the study were not significantly concerned with the deterrent effects of lawsuits on their arrest activity, but there was a difference between the opinions of the police officers and their superiors regarding civil liability. A significant …

Revisiting Social Isolation In America: An Egocentric Analysis Of "Feel Close To" Networks, Chao Liu
Revisiting Social Isolation In America: An Egocentric Analysis Of "Feel Close To" Networks, Chao Liu
Graduate Theses and Dissertations
Evidences from interpersonal networks in which Americans discuss “important matters” (core discussion networks) suggest that Americans have become increasingly isolated. Using the national representative Science of Generosity Survey 2010, this paper revisits the issue of Social isolation. The survey asked respondents to name the people they felt close to in the last six months. On average, respondents mentioned 3.87 people they felt close to, a significant increase from the 1985 (2.94) and 2004 (2.08) core discussion networks. Education, income, and gender are significant explanatory variables for the “feel close to” networks. People with high education, those with high income, and …
