'White-Collar Crime": Still Hazy After All These Years, Lucian E. Dervan, Ellen S. Podgor Jan 2016

'White-Collar Crime": Still Hazy After All These Years, Lucian E. Dervan, Ellen S. Podgor

Georgia Law Review

With a seventy-five year history of sociological and later legal roots, the term "white collar crime" remains an ambiguous concept that academics, policy makers, law enforcement personnel and defense counsel are unable to adequately define. Yet the use of the term "white collar crime" skews statistical reporting and sentencing for this conduct. This Article provides a historical overview of its linear progression and then a methodology for a new architecture in examining this conduct. It separates statutes into clear-cut white collar offenses and hybrid statutory offenses, and then applies this approach with an empirical study that dissects cases prosecuted under …

The Enduring Legacy Of Modern Efficient Market Theory After Halliburton V. John, Mark Klock Jan 2016

The Enduring Legacy Of Modern Efficient Market Theory After Halliburton V. John, Mark Klock

Georgia Law Review

In 1988 the U.S. Supreme Court approved the fraud on the market theory for securities trading in an efficient market thus enabling securities class action plaintiffs to establish their required reliance element of the case through a rebuttable presumption. Basic v. Levinson held that efficient markets incorporate publicly disseminated information and investors who purchased or sold securities in an efficient market therefore relied on any publicly disseminated misinformation. For more than a quarter century since Basic, the efficient market theory has sustained a barrage of assaults from commentators who object to the use of economic theory in legal decision making …

Measurement And Outcomes Of Identity Communication In Virtual Teams, Susan A. Brown, Sherry M. B. Thatcher, David W. Wilson Jan 2016

Measurement And Outcomes Of Identity Communication In Virtual Teams, Susan A. Brown, Sherry M. B. Thatcher, David W. Wilson

Faculty Publications

Virtual teams play an important role in the modern economy, and many organizations struggle to overcome the weaknesses inherent in technologymediated work. Drawing from a strong empirical foundation for identity-related outcomes in nonmediated settings, we propose that perceived virtual identity communication accuracy positively impacts virtual team trust and performance. We further propose that capabilities of the communication medium can either support or hinder perceived virtual identity communication accuracy. In three studies with a cumulative sample of N=410, this research-in-progress paper reports on the first phase of a two-phase study. We develop survey scales for a medium’s identity communication capabilities and …

Time-Chunking And Hyper-Refocusing In A Digitally-Enabled Workplace: Six Forms Of Knowledge Workers, James E. Gaskin, Tanner Skousen Jan 2016

Time-Chunking And Hyper-Refocusing In A Digitally-Enabled Workplace: Six Forms Of Knowledge Workers, James E. Gaskin, Tanner Skousen

Faculty Publications

Until the turn of the millennium, switching tasks required moving locations or reconfiguring physical workspaces. However, contemporary digital tools and workspaces allow knowledge workers to perform an increasingly diverse set of tasks, with an increasingly extending arm of influence, all from the same physical location without any physical reconfigurations or traversing of physical space. Along with this increased ambidexterity comes an increase in the quantity and frequency of demands on the time of knowledge workers. This digitalization of work now tethers their ability to perform largely to their ability to intensely focus in small chunks, and then “hyperjump” that focus …

Female Veterans’ Involvement In Outdoor Sports And Recreation, Neil Lundberg, Stacy Taniguchi, Rachel Mcgovern, Shauna Smith Jan 2016

Female Veterans’ Involvement In Outdoor Sports And Recreation, Neil Lundberg, Stacy Taniguchi, Rachel Mcgovern, Shauna Smith

Faculty Publications

Previous research has recognized the need to better understand the experience of female veterans and their adjustment upon returning home, especially considering that a growing number of veterans are women. Their stories, particularly as they relate to combat and the associated wounds of war, largely remain untold. Therefore, the purpose of this project was to employ a theoretical sample from Grounded Theory methodology to determine if similar recreation opportunity structure patterns existed in the use of outdoor sports and recreation for a sample of female veterans, as had been found in previous research with individuals with physical disabilities. The investigation …

#Thyghgapp: Instagram Content Moderation And Lexical Variation In Pro-Eating Disorder Communities, Stevie Chancellor, Jessica Pater, Trustin Clear, Eric Gilbert, Munmun De Choudhury

Health Services and Informatics Research

CSCW '16, FEBRUARY 27–MARCH2, 2016, SAN FRANCISCO, CA, USA

In Proceedings of the 19th ACM conference on computer-supported cooperative work & social computing.

Pro-eating disorder (pro-ED) communities on social media encourage the adoption and maintenance of disordered eating habits as acceptable alternative lifestyles rather than threats to health. In particular, the social networking site Instagram has reacted by banning searches on several proED tags and issuing content advisories on others. We present the first large-scale quantitative study investigating pro-ED communities on Instagram in the aftermath of moderation – our dataset contains 2.5M posts between 2011 and 2014. We find that …

Evaluation Of Knowledge And Practices Of Managing Citrus Pests And Diseases And The Willingness To Pay For An Integrated Pest Management Strategy In Selected Counties In Kenya, Dorothy Wangui Gitahi Jan 2016

Evaluation Of Knowledge And Practices Of Managing Citrus Pests And Diseases And The Willingness To Pay For An Integrated Pest Management Strategy In Selected Counties In Kenya, Dorothy Wangui Gitahi

All Master’s Theses

Citrus is a major source of income in Kenya for both large and small scale farmers. However, citrus productivity has been declining over the years mainly due to pests and diseases, particularly the African Citrus Triozid (ACT), Huanglongbing (HLB) and False Codling Moth (FCM). Management of pests and diseases is sorely dependent on synthetic pesticides, which not only increases production costs but also are associated with high health and environmental risks. Use of integrated pest management (IPM) is recommended as a more sustainable alternative to widespread broad-spectrum chemical pesticide application. The International Centre of Insect Physiology and Ecology (ICIPE) and …

Potential Economic Impact Of Integrated Thrips Management In French Bean And Tomato In Loitokitok And Mwea Sub - Counties Of Kenya, Esther A. Mujuka Jan 2016

Potential Economic Impact Of Integrated Thrips Management In French Bean And Tomato In Loitokitok And Mwea Sub - Counties Of Kenya, Esther A. Mujuka

All Master’s Theses

In Kenya, thrips inflict nearly 60-80% and 80% yield loss in French bean and tomato, respectively. Management of thrips in horticulture is currently based on application of pesticides. In addition to increased environmental risks associated with pesticides, frequent use of these chemicals substantially increase production costs and pesticide resistance. Further, exports are limited due to non-compliance to Maximum Residue Levels (MRLs) in important consumer export countries especially the European Union (EU). International Centre of Insect Physiology and Ecology (ICIPE) and its partners are proposing the use of Integrated Pest Management (IPM) for the control and management of thrips and tospoviruses …

The Impact Of Teacher Prompting And Questioning On Third Grade Students' Comprehension, Jenna Francois Jan 2016

The Impact Of Teacher Prompting And Questioning On Third Grade Students' Comprehension, Jenna Francois

Honors Program Theses

This qualitative research study explores how teacher prompting and questioning impacts students’ comprehension of texts. The researcher observed a third grade teacher, Mrs. G., at a local elementary school in order to discern patterns in how this teacher used verbal prompts and questions to assist her students in understanding what they read. An initial interview was conducted with Mrs. G. to determine how she typically teaches and assesses reading comprehension, as well as the types of verbal prompts and questions she utilizes to assist students in comprehension. The researcher observed two literacy lessons in which Mrs. G. instructed the whole …

The Relationship Between Problem-Solving Ability/Eating Motivation And Perceived Quality Of Life In Individuals Diagnosed With Celiac Disease, Vincenzo Zaccheo Jan 2016

The Relationship Between Problem-Solving Ability/Eating Motivation And Perceived Quality Of Life In Individuals Diagnosed With Celiac Disease, Vincenzo Zaccheo

PCOM Psychology Dissertations

Celiac disease (CD) is a digestive disorder resulting from gluten intolerance that leads to damage of the small intestine. The only current available treatment for CD involves adherence to a strict gluten-free diet. Due to the restrictive nature of this treatment diet, and the increasing prevalence of CD in recent years, much research has been conducted examining factors that impact the quality of life (QOL) of individuals with CD. However, there has been a dearth of literature identifying those factors which can be modified within a treatment setting. Thus, a need for further research in this area was identified. Through …

Rerum Novarum: New Things And Recent Paradigms Of Property Law, M C. Mirow Jan 2016

Rerum Novarum: New Things And Recent Paradigms Of Property Law, M C. Mirow

Faculty Publications

The two most recent paradigmatic moments in the development of property law were the construction of "social property" about a hundred years ago and of "international property" quite recently. This study analyses two important texts as illustrations of these changes: Leo XIII's encyclical Rerum Novarum (1891) and John Sprankling's book The International Law of Property (2014). Each text signals a paradigm shift in our understanding of property.

Economics Of The Firm: Identifying Factors Affecting The Performance Of Agribusiness Corporations, Casey Engel Jan 2016

Economics Of The Firm: Identifying Factors Affecting The Performance Of Agribusiness Corporations, Casey Engel

Research Papers

This paper is about identifying the factors that affect firm performance. Many economists have attempted to explain how to define an economy based off of many different aspects, but the focus of this paper is to find out what factors affect the performance of a company. This paper discusses different economic theories, and research which is related to the topic. Then I show a few factors that I found in my research regarding how a firm performs, and finish by interpreting and discussing those factors.

Evidence Of The Military's Sexual Assault Blind Spot, Eric R. Carpenter Jan 2016

Evidence Of The Military's Sexual Assault Blind Spot, Eric R. Carpenter

Faculty Publications

In response to the American military's perceived inability to handle sexual assault cases, many members of Congress have lost confidence in those who run the military justice system. Critics say that those who run the military justice system are sexist and perceive sexual assault cases differently than the public does. This article is the first to empirically test that assertion. Further, this is the first study to focus on the military population that matters – those who actually run the military justice system. This study finds that this narrow military population endorses two constructs that are associated with the acceptance …

Yik Yak Posts: A Discourse Analysis, Snehal Ravindra Shirke

Masters Theses

"Anonymity and geolocation create a unique environment for users to communicate with each other. Discourse analysis was conducted to study the posts made on Yik Yak, an anonymous social networking mobile application to understand the communication patterns on an anonymous platform and the posts about taboo topics. The posts were analyzed specifically for patterns on taboo topics and how students interact on the anonymous platform on a particular campus (Missouri S&T campus). Student research assistants coded the collected posts into the pre-defined taboo categories namely sexual activity, non-sexual bodily functions, sexual orientation, mental/emotional health, and "other" taboo topics. I found …

Experiencing The Death Of A Formerly Abusive Parent, Heather Spence Jan 2016

Experiencing The Death Of A Formerly Abusive Parent, Heather Spence

Antioch University Dissertations & Theses

It is well documented that approximately 25–33% of children experience abuse, many of those at the hands of a primary caretaker. Within the literature on child maltreatment, there exists a paucity of research about the long-term effects of early maltreatment on adult attachments with the previous abuser, including the experiences of adults who experience the death of their previous caretakers. Additionally, most of the research on grief and bereavement assumes positive affect for the deceased by survivors. This dissertation is an in-depth examination of five adults, aged 50–70 years old, who experienced the recent death of a parent or stepparent …

Nature As Spiritual Lived Experience: How Five Christian Theologians Encounter The Spirit In And Through The Natural World, Brad A. Martell Jan 2016

Nature As Spiritual Lived Experience: How Five Christian Theologians Encounter The Spirit In And Through The Natural World, Brad A. Martell

Antioch University Dissertations & Theses

This qualitative study explored five Western Christian theologians’ religious lived experience of God’s Spirit in and through Nature. The hermeneutic phenomenological research method was utilized. Rich descriptions of lived experience were collected through 60-90 minute long phenomenological interviews which were recorded and transcribed verbatim into a text for analysis. Analysis included repeated readings of the text, identification of themes, and validation and/or correction of themes. Synthesis looked at the research as a whole and established implications and applications for Christian theology, particularly ecotheology. The study contributes to the literature of phenomenology and theology, calls for a place for lived experience …

The Deserving Patient: Blame, Dependency, And Impairment In Discourses Of Chronic Pain And Opioid Use, Maureen Nickerson Jan 2016

The Deserving Patient: Blame, Dependency, And Impairment In Discourses Of Chronic Pain And Opioid Use, Maureen Nickerson

Antioch University Dissertations & Theses

Negative stereotypes about people with chronic pain pose a barrier in the delivery of care; contribute to worsening symptoms of physical and psychological distress; and play a role in policy decisions that adversely affect patients and providers. Pain-care seekers may be accused of malingering, laziness, mental aberration, attention seeking, and drug seeking. The propagation of stigmatizing attitudes was explored in this Critical Discourse Analysis of online-reader-comments responding to a series of pain-care policy articles published by a large metropolitan newspaper. Results suggest that framing pain patients as legitimate and deserving can inadvertently reproduce the inequities advocates seek to redress. Ascriptions …

Vicarious Battering: The Experience Of Intervening At A Domestic Violence-Focused Supervised Visitation Center, Tracee Parker Jan 2016

Vicarious Battering: The Experience Of Intervening At A Domestic Violence-Focused Supervised Visitation Center, Tracee Parker

Antioch University Dissertations & Theses

This descriptive phenomenological research illustrated the experience of women who worked in a supervised visitation program (SVP) specifically developed to address safety concerns related to allegations of domestic violence. The SVP policies and procedures were designed not only to prevent physical assault and abduction but also to intervene in vicarious battering—a term introduced to describe the attempts by men who battered to exert control over, undermine, and/or intimidate the mothers of their children via interactions with their children and the visitation staff. The results of this research demonstrated the challenges of intervening in the context of court-ordered supervised visitation. Data …

Good Grief, Alexandra Deabler Jan 2016

Good Grief, Alexandra Deabler

Master's Theses

Good Grief is a novel that follows one family as they move through the five stages of grief. The purpose of the creative work is to focus on the complicated relationships of a blended family, and further complicate that with the added pressure of mourning a loved one, while still fulfilling familial and societal obligations. It is a meditation on the different ways people handle emotional trauma. Grief is a universal concept, but often mistreated or misunderstood. Grief, as a process, takes several different forms, some of which—expressing pain through joviality or sensuality—are shrouded in shame. My thesis challenges the …

Assessing Educators’ School Safety And Security Preparedness At A New Jersey K-12 Nonpublic School, Ronald P. Rinaldi Jan 2016

Assessing Educators’ School Safety And Security Preparedness At A New Jersey K-12 Nonpublic School, Ronald P. Rinaldi

Theses and Dissertations

School shootings and emergencies have created the need for educators to be proficient in emergency response procedures; yet they do not always receive the requisite training. The lack of an established delineated training program for New Jersey, kindergarten to Grade 12 institutions has created a situation where educator preparedness varies immensely at schools. Numerous national events of targeted school violence have exemplified the need for quick and proper responses by educators to mitigate the tragic results until first responders arrive. The purpose and goal of this study was to assess educators’ perceptions and to determine the best practices in creating …

Are Hispanics Discriminated Against In The Us Criminal Justice System?, Maria A. Eijo De Tezanos Pinto Jan 2016

Are Hispanics Discriminated Against In The Us Criminal Justice System?, Maria A. Eijo De Tezanos Pinto

Graduate Research Posters

Recent publications have contributed to increase the perception among Hispanics of an unfair and unequal treatment of this community by the US Criminal Justice System. One of the major concerns was the claim that Hispanics are incarcerated before conviction nearly twice as often as Whites. Unfair treatment perception by the population reduces legitimacy of police and government, and thus, it is imperative to analyze these uninvestigated allegations. Therefore, the purpose of this study is to address said allegations of discrimination against Hispanics and analyze with updated and reliable statistics whether Hispanics are incarcerated before conviction more often than Whites. There …

What Mediates The Relationship Between Religious Service Attendance And Aspects Of Well-Being?, Scott A. Baldwin, Patrick R. Steffen, Kevin S. Masters

Faculty Publications

Religious service attendance predicts increased well-being across a number of studies. It is not clear, however, whether this relationship is due to religious factors such as intrinsic religiosity or due to nonreligious factors such as social support or socially desirable responding. The purpose of the present study was to examine the relationship between religious service attendance and well-being while simultaneously examining intrinsic religiosity, social support, and socially desirable responding as potential mediators of the relationship. A sample of 855 participants (71 % female, average age 19.5) completed questionnaires assessing religiosity, social support, socially desirable responding, and well-being. Path models were …
