'White Collar Crime': Still Hazy After All These Years, Lucian E. Dervan, Ellen S. Podgor Jan 2016

'White Collar Crime': Still Hazy After All These Years, Lucian E. Dervan, Ellen S. Podgor

Law Faculty Scholarship

With a seventy-five year history of sociological and later legal roots, the term “white collar crime” remains an ambiguous concept that academics, policy makers, law enforcement personnel and defense counsel are unable to adequately define. Yet the use of the term “white collar crime” skews statistical reporting and sentencing for this conduct. This Article provides a historical overview of its linear progression and then a methodology for a new architecture in examining this conduct. It separates statutes into clear-cut white collar offenses and hybrid statutory offenses, and then applies this approach with an empirical study that dissects cases prosecuted under …

Derivative Racial Discrimination, Kevin Woodson Jan 2016

Derivative Racial Discrimination, Kevin Woodson

Law Faculty Publications

This Article introduces the concept of derivative racial discrimination, a process of institutional discrimination in which certain social and cultural dynamics impede the careers of minority workers in predominantly white firms even in the absence of racial biases and stereotypes. Derivative racial discrimination is a manifestation of cultural homophily, the universal tendency of people to gravitate toward others with similar cultural interests and backgrounds. Although not intrinsically racial, cultural homophily disadvantages minority workers in predominantly white work settings due to various race-related social and cultural differences. Seemingly inconsequential in isolation, these differences produce racial disparities in the accrual of valuable …

Human Capital Discrimination, Law Firm Inequality, And The Limits Of Title Vii, Kevin Woodson Jan 2016

Human Capital Discrimination, Law Firm Inequality, And The Limits Of Title Vii, Kevin Woodson

Law Faculty Publications

This Article advances the legal scholarship on workplace inequality through use of evidence derived from interviews of a sample of black attorneys who have worked in large, predominantly white law firms. It does so by calling attention to the manner in which these firms operate as sites of human capital discrimination — patterns of mistreatment that deprive many black associates of access to the substantive work opportunities crucial to their professional development and career advancement. This Article identifies the specific arrangements and practices within these firms that facilitate human capital discrimination and describes the varied, often subtle harms and burdens …

The Myth Of Gender Equality In Turkey: Her Name Or Sir-Name?, Joseph Zand, Bahar Öcal Apaydın Jan 2016

The Myth Of Gender Equality In Turkey: Her Name Or Sir-Name?, Joseph Zand, Bahar Öcal Apaydın

Cardozo Journal of Equal Rights & Social Justice

Gender equality is one of the most contentious matters in the contemporary Turkish society. Unlike in many other parts of the developed world, Turkish women still struggle to use their maiden name, as well as to pass it on to their children upon marriage. A woman's surname is of crucial importance to her identity. Despite the fact that Turkey is a part of the European Civil Law tradition and the Turkish Civil Code has a specific provision regarding women's surnames, Turkey has failed to grant its female population a choice in relation to their surname after marriage. The European Court …

Religion's Power Over Reproductive Care: State Religious Freedom Restoration Laws And Abortion, Sophia Martin Schechner Jan 2016

Religion's Power Over Reproductive Care: State Religious Freedom Restoration Laws And Abortion, Sophia Martin Schechner

Cardozo Journal of Equal Rights & Social Justice

The note argues that state Religious Freedom Restoration Acts (RFRAs), such as those in Missouri and Alabama, can be strategically used by pro-choice advocates to challenge restrictive informed consent laws for abortion, as these laws may violate the Establishment Clause and unduly burden women's religious freedom. By leveraging state RFRAs, advocates can resist reproductive care restrictions imposed by such laws, offering a novel legal strategy to protect abortion access.

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley Jan 2016

Dirty Laws: A Critique Of The Audiovisual Media Services Regulations 2014 And Section 63 Of The Criminal Justice And Immigration Act 2008, Daniel Haley

Cardozo Journal of Equal Rights & Social Justice

The United Kingdom's recently enacted anti-pornography laws, the Audiovisual Media Services Regulations 2014 and section 63 of the Criminal Justice and Immigration Act 2008, are inconsistent with the European Convention on Human Rights, United Kingdom case law, and United Kingdom public policy. The Audiovisual Media Services Regulations 2014, which bans the sale of a wide array of domestically produced pornography, and the Criminal Justice and Immigration Act 2008, which criminalizes the possession of "extreme pornography, " are among the most restrictive anti-pornography laws in the democratic world. These laws were passed in response to the rise of the Internet, which …

Property's Immortality, Shelly Kreiczer-Levy Jan 2016

Property's Immortality, Shelly Kreiczer-Levy

Cardozo Journal of Equal Rights & Social Justice

The law ofpost most-mortem transfers assumes an autonomous individual, free to will their property as they see fit. This Article offers a relational critique of this legal reality, and highlights the implications ofsuch a critique for gender equality. Although property's role in supporting relationships and facilitating cooperation has long been celebrated, post-mortem transfers pose a challenge to relational legal theory. It is commonly held that death puts a stop to all relationships and defies all relational commitments. This Article builds on a different perception of death, and argues that the need to transcend mortality is profoundly relational. Property-related projects can …

Measuring Well-Being: A Review Of Instruments, Philip J. Cooke, Timothy P. Melchert, Korey Connor Jan 2016

Measuring Well-Being: A Review Of Instruments, Philip J. Cooke, Timothy P. Melchert, Korey Connor

College of Education Faculty Research and Publications

Interest in the study of psychological health and well-being has increased significantly in recent decades. A variety of conceptualizations of psychological health have been proposed including hedonic and eudaimonic well-being, quality-of-life, and wellness approaches. Although instruments for measuring constructs associated with each of these approaches have been developed, there has been no comprehensive review of well-being measures. The present literature review was undertaken to identify self-report instruments measuring well-being or closely related constructs (i.e., quality of life and wellness) and critically evaluate them with regard to their conceptual basis and psychometric properties. Through a literature search, we identified 42 instruments …

Inequity In Private Child Custody Litigation, Dale Margolin Cecka Jan 2016

Inequity In Private Child Custody Litigation, Dale Margolin Cecka

Law Faculty Publications

This article explores the history and implications of a two-tiered system for adjudicating matrimonial-as opposed to nonmatrimonial- custody matters. As the author uncovered by calling every clerk's office in every major city in the country, matrimonial matters are under a different jurisdiction or part of court in nine states.' This differential treatment has implications for the outcome of private custody cases. It also reflects a bias in the administration of justice, based on race and socioeconomic class. Perhaps most importantly, it causes the government and other outside parties (such as court appointed guardians ad litem) to be more involved …

The Western Australian Clinical Senate As A Model For State-Wide Clinical Engagement, J Quinlivan, T Basile, K Gibson, D Xu, N Croker

Medical Papers and Journal Articles

International reforms in healthcare have established the principal that embracing clinical engagement can drive healthcare reform and improved safety and quality outcomes. Most attention has focussed on how clinicians might be engaged at a local or hospital level. However, healthcare reforms are usually initiated at a state or national level. Less attention has gone into exploring the key elements of a model to achieve clinical engagement at state or national level. This paper explores the key elements of a successful state-wide clinical engagement model including culture and leadership, membership, decision-making processes and accountability and discusses how the current model of …

Impact Of Technology On Learning And Scholarship, And The New Learning Paradigm, Arnoud Cyriel Leo De Meyer Jan 2016

Impact Of Technology On Learning And Scholarship, And The New Learning Paradigm, Arnoud Cyriel Leo De Meyer

Research Collection Lee Kong Chian School Of Business

Recently I took on the challenge of teaching a course to Undergraduate students at Singapore Management University. It had been more than 20 years since I had taught any Undergraduates, having spent most of my career at Graduate Business Schools. I did it partially because many of my younger colleagues had told me that teaching had changed tremendously. Deep down I may have felt that I was perhaps a little out of touch with what happened inside and, as I would soon discover, outside our classrooms. I was indeed intrigued by the experience. When I entered the classroom for my …

Maize Landraces Are Less Affected By Striga Hermonthica Relative To Hybrids In Western Kenya, Charles A.O. Midega, John Pickett, Antony Hooper, Jimmy Pittchar, Zeyaur R. Khan Jan 2016

Maize Landraces Are Less Affected By Striga Hermonthica Relative To Hybrids In Western Kenya, Charles A.O. Midega, John Pickett, Antony Hooper, Jimmy Pittchar, Zeyaur R. Khan

All Peer-Reviewed Publications

Production of maize in western Kenya is severely constrained by the parasitic weed striga. Although productivity of maize can be improved through adoption of improved varieties, adoption of such varieties remains low in the region, as the majority of smallholder farmers still grow unimproved open-pollinated varieties (landraces). The performance of two improved hybrid varieties was evaluated against six landraces in striga-infested soils in western Kenya. The varieties were planted in plots under natural striga infestation and were supplemented with pot experiments under artificial infestation. Striga emergence was lower in landraces than in the hybrid varieties in both field and pot …

Toward Epistemological Diversity In Stem-H Grantmaking: Grantors’ And Grantees’ Perspectives On Funding Indigenous Research, Programming, And Evaluation, Jessica C. Venable

Theses and Dissertations

Mainstream institutions have, historically, dismissed Indigenous worldviews, knowledges, and research approaches (Bowman-Farrell, 2015; Harrington & Pavel, 2013). However, in recent years, a literature has emerged articulating Indigenous research methodologies (IRMs), and their distinctiveness from Western, Eurocentric perspectives on inquiry (Denzin, Lincoln, & Smith, 2008; Kovach, 2009; Smith, 1999 & 2012; Wilson, 2008). This has coincided with increased need for IRM scholars and practitioners to secure extramural funds to support their activities. But questions remain as to how the U.S. federal grant making enterprise has accommodated Indigenous frameworks. This research explores synergies in the ways that grantees, grant makers, and other …

A Correlational Analysis Of Secondary Data For Factors Influencing Graduation From Adult Drug Court, David N. Masri Jan 2016

A Correlational Analysis Of Secondary Data For Factors Influencing Graduation From Adult Drug Court, David N. Masri

Theses and Dissertations

The proliferation of drug courts throughout the world over the last two decades presents an opportunity and a challenge. The drug court approach involves a combination of treatment and judicial supervision which is a diversion from incarceration and/or ‘traditional’ criminal justice supervision. Despite widespread study of drug courts, there is much that researchers still do not know and there is still controversy as to how and why drug courts work. This research study is an examination of secondary data from an urban, mid-Atlantic drug court to attempt to correlate factors that contribute to success (as defined by graduation) in drug …

Considerations In The Provision Of Mental Health Services Toward Arabs, Dalia Khoury Jan 2016

Considerations In The Provision Of Mental Health Services Toward Arabs, Dalia Khoury

Theses and Dissertations

Existing evidence suggests that disparities exist in the use of mental health services by Arabs in the U.S. While there are likely many factors that contribute, lack of cultural competence of mental health providers is one potentially important barrier for mental health service use among racial/ethnic minorities, including Arabs. The primary purpose of this study was to identify and examine factors related to the development and existence of cultural competence toward Arabs. Variables measuring demographics, professional characteristics, familiarity with Arabs, prior experience and knowledge of Arabs, and readiness for change were tested with a randomly selected sample of mental health …

The Politics And Ethics Of Food Localism: An Exploratory Quantitative Inquiry, Sean T. Doody Jan 2016

The Politics And Ethics Of Food Localism: An Exploratory Quantitative Inquiry, Sean T. Doody

Theses and Dissertations

The local food movement has become a prominent force in the U.S. food market, as represented by the explosive expansion of direct-to-consumer (DTC) marketplaces across the country. Concurrent with the expansion of these DTC marketplaces has been the development of the social ideal of localism: a political and ethical paradigm that valorizes artisanal production and smallness, vilifies globalization, and seeks to recapture a sense of place and community that has been lost under the alienating conditions of capitalism’s gigantism. Supporters of localism understand the movement to be a substantial political and economic threat to global capitalism, and ascribe distinct, counter-hegemonic …

Courageous Solstice: Reconstructing Fairy Tales For A Black Youth Aesthetic, Tanya Boucicaut

Theses and Dissertations

This thesis interrogates the historical, philosophical, and existential implications of the Black Arts Movement and its major artists on the recurring themes of social injustice, Western hegemony, and the fight for aesthetic authenticity to reimagine fairy tales for the youth Black Aesthetic. As a personal reflection and foundational document for a larger project, this work weaves these implications through the practical application of the varied stages of program development for youth artists. This project also is a handbook that encompasses scholarly research, reflective analysis and anecdotal journal evidence. The subsequent chapters explore the theological and theatre pedagogical educational influences that …

The Entertainment Is Terrorism: The Subversive Politics Of Doing Anything At All, Joe Woods Jan 2016

The Entertainment Is Terrorism: The Subversive Politics Of Doing Anything At All, Joe Woods

Theses and Dissertations

When the body is observed through a certain combination of technologies, there can be subversive politics to doing anything at all. The nature of media and biopolitics has permitted for a set of systems aimed at total control of the human body; a power which can permeate all facets of life. This thesis is a collection of essays which argues that speculative fiction contains multitudes of approaches to biopolitical discourse, permitting the reader of the text to approach politics from their own set of experiences, but not allowing the political to be ignored. These chapters contain three separate but interrelated …

Heritage Hotel: A Marriage Of Heritage Tourism And Boutique Hospitality, Leah A. Embrey Jan 2016

Heritage Hotel: A Marriage Of Heritage Tourism And Boutique Hospitality, Leah A. Embrey

Theses and Dissertations

As defined by Wai Mun Lim and Mel Endean in 2009 in their article “Elucidating the aesthetic and operational characteristics of UK boutique hotels” in the International Journal of Contemporary Hospitality Management, Boutique hotels have less than 100 rooms, have an individualistic and unique design, are often in historic buildings, and have highly personalized service for guests. I found that a boutique hotel that focuses on historic preservation and heritage tourism does four things. First, it respects the history of the building it is housed in, preserving as much of the original structure as possible. It also takes advantage of …
