Meta-Mindfulness: A New Hope, Peter H. Huang
Meta-Mindfulness: A New Hope, Peter H. Huang
Publications
This Essay starts by tracing its humble origins to an earlier, related and unique law review article, namely, Tiger Cub Strikes Back: Memoirs of an Ex-Child Prodigy About Legal Education and Parenting. This Essay describes various professional responses to Tiger Cub Strikes Back, provides an update of some developments in research about parenting and legal education since Tiger Cub Strikes Back, and recounts a few personal stories about mindfulness and related to being an ex-child prodigy. This Essay then analyzes meta-mindfulness, defined as mindfulness about mindfulness. This Essay discusses how mindfulness about mindfulness can help facilitate the …
The Energy Prosumer, Sharon B. Jacobs
The Energy Prosumer, Sharon B. Jacobs
Publications
Decentralization is becoming a dominant trend in many industries, and the electricity industry is no exception. Increasing numbers of energy consumers generate their own electricity and/or provide essential grid services such as storage, efficiency, and demand response. This Article offers a positive account of the emergence of these new energy actors, which it calls "energy prosumers. " It then frames several doctrinal and procedural puzzles that prosumers create, including jurisdictional puzzles, distributional concerns, and democratic challenges. Ultimately, it concludes that prosumers can be a positive disruptive force in the electricity industry if courts and regulators can manage these challenges effectively. …
Beyond Legality: The Legitimacy Of Executive Action In Immigration Law, Ming H. Chen
Beyond Legality: The Legitimacy Of Executive Action In Immigration Law, Ming H. Chen
Publications
Recent uses of executive action in immigration law have triggered accusations that the President is acting imperially, like a king, or as a lawbreaker. President Obama’s Deferred Action for Childhood Arrivals (DACA) and Deferred Action for Parental Accountability (DAPA) programs, which provide protection from deportation and a work permit during a temporary period of lawful presence, serve as the lightning rod for these accusations. But even as legislative and litigation challenges to DACA proceed, many states appear to accept and comply with it, including nearly all of the states that have joined the Texas v United States lawsuit that challenges …
Consent Confusion, Aya Gruber
Consent Confusion, Aya Gruber
Publications
The slogans are ubiquitous: “Only ‘Yes’ Means ‘Yes’”; “Got Consent?”; “Consent is Hot, Assault is Not!” Clear consent is the rule, but the meaning of sexual consent is far from clear. The current state of confusion is evident in the numerous competing views about what constitutes mental agreement (grudging acceptance or eager desire?) and what comprises performative consent (passive acquiescence or an enthusiastic “yes”?). This paper seeks to clear up the consent confusion. It charts the contours of the sexual consent framework, categorizes different definitions of affirmative consent, and critically describes arguments for and against affirmative consent. Today’s widespread uncertainty …
Trust In Immigration Enforcement: State Noncooperation And Sanctuary Cities After Secure Communities, Ming H. Chen
Trust In Immigration Enforcement: State Noncooperation And Sanctuary Cities After Secure Communities, Ming H. Chen
Publications
The conventional wisdom, backed by legitimacy research, is that most people obey most of the laws, most of the time. This turns out to not be the case in a study of state-local participation in immigration law enforcement. Two enforcement programs involving the use of immigration detainers, a vehicle by which the federal government (through ICE) requests that local law enforcement agencies (LEAs) detain immigrants beyond their scheduled release upon suspicion that they are removable, demonstrate the breakdown of conventional wisdom. In the five years following initiation of the Secure Communities program, a significant and growing number of states and …
The Dynamics Of Excessive Force, Daria Roithmayr
The Dynamics Of Excessive Force, Daria Roithmayr
Publications
Existing scholarship suggests that police use of excessive force will be greatest in departments with "bad apple" officers or bad top-down incentive structures. This paper proposes an alternative theoretical account to argue that patterns of excessive force dynamically emerge from local interactions among individuals that aggregate to form more global patterns of escalation, contagion, and decay. I focus on two dynamic interactions in particular. First, I argue that excessive force spreads and escalates by way of a self-reinforcing arms race between civilians and officers that intensifies the use of excessive force over time. As officers use excessive force, civilians in …

This study also has policy implications.
Resistant Acts : Challenges Of Older And Chronically Ill Mexican Women Living In 21st-Century United States, Lucy Sosa
Graduate Research Theses & Dissertations
Older and chronically ill Mexican women living in a 21st century working class neighborhood confront many challenges. The challenge of being older and chronically ill are exacerbated by the multiple socially constructed identities of difference they embody, such as, race, gender, class, linguistic competence, immigration and educational status. In their search for health and wellbeing, these embodied differences constructed for the women a number of care-searching, care-receiving and health outcome experiences that reveal the effect these differences can have in the lives of members of a vulnerable population. The women's experiences also reveal their determination to gain access to affordable, …
Professional Identity Of Student Conduct Administrators, Brian M. Glick
Professional Identity Of Student Conduct Administrators, Brian M. Glick
Graduate Research Theses & Dissertations
The functions of a Student Conduct Administrator (SCA) have existed on college campuses since the first institutions of higher education were established. Colleges and universities now employ specialized staff members to fulfill this role. The fundamentals of the position have changed only minimally over the years, but these responsibilities continue to become more complex. The question to be answered is whether or not the practice of student conduct administration constitutes a profession. If student conduct administration qualifies as a profession, SCAs hold a specific professional identity. This project provides the results of a national survey of SCAs who described how …
Relational Uncertainty Between Frenemies In Forensics, Benjamin Davis
Relational Uncertainty Between Frenemies In Forensics, Benjamin Davis
Graduate Research Theses & Dissertations
Intercollegiate forensics competition is a highly complex network of interconnected individuals. This study proposes that various contextual factors surrounding forensics competition may influence the communication between friends who compete against each other on the circuit ("frenemies"). Specifically, this study uses the lens of relational uncertainty to determine the significance and communicative behaviors of frenemies when faced with uncertainty-increasing events. Quantitative survey data were collected from 93 participants, in which they were instructed to complete various sets of scales related to team culture, the types of uncertainty, uncertainty reducing strategies, and other relational variables. Qualitative data were also collected from participant …

Adding Mental Health To The Treatment Of Mental Illness : A Qualitative Content Analysis Of The Construction Of Recovery In Psychiatric Journals, 1990-2016, Amy Ann Armstrong
Graduate Research Theses & Dissertations
During the past two and a half decades, recovery has come to dominate mental health policy and the discourse surrounding mental illness. In this thesis, I analyze how recovery from severe mental illness has been constructed within psychiatric journals between 1990 and 2016. I use data-driven qualitative content analysis to describe the discussion of recovery in articles published in the psychiatric journals Psychiatric Services, Psychiatric Rehabilitation Journal, the American Journal of Psychiatry and JAMA Psychiatry since 1990. This discussion centers on four main themes: the meaning of recovery, treatment methods used to promote recovery, the role of service providers in …
A Matter Of Size : Examining Representation And Responsiveness In State Legislatures And City Councils, Benjamin Bingle
A Matter Of Size : Examining Representation And Responsiveness In State Legislatures And City Councils, Benjamin Bingle
Graduate Research Theses & Dissertations
Representation and legislative responsiveness are vital components of a functional democracy. In representative democracies legislators are elected to stand for, and act on behalf of, the citizenry. Although fundamental to the effectiveness of America's political system, both representation and responsiveness can be influenced by external factors such as legislature and constituency size. What follows is an exploration of representation and responsiveness in American states and cities through the lens of legislature and constituency size. All 50 states are included in the analyses as well as cities with populations of at least 100,000 people as of the 2010 decennial census. In …

"Anonymous" And Frame Construction In Social Media, Justin Yates
Graduate Research Theses & Dissertations
Social movement organizations operate and communicate using new mediums, such as the use of social media. Anonymous is a non-hierarchical online activist group with unidentified members that engages in exploiting technology toward politically motivated goals. This study examined how a group without formal structure or identifiable members frames its activities as "righteous." Specifically, this study examined the rhetoric of a non-hierarchical online activist group with unidentified members and how it frames its activities as just. This study explored the challenges in maintaining and creating righteous rhetoric for a group with online, non-hierarchical, and unidentified members. Using social movement framing theory …

A Case Study Exploring Saudi Special Education Teachers' Perceptions Toward The Use Of Mobile Technology For Teaching Purposes, Adel Ibrahim Qahmash
Graduate Research Theses & Dissertations
Within the last few decades special education has benefited from the vast revolution of technologies. These technologies have contributed in facilitating cognitive development as well as learning processes for students with disabilities. One of these emerging technologies is the tablet device and its applications. Due to increasing demands to integrate the latest technology into educational settings, previous studies have looked at the potential of adopting tablet devices and their applications as instruction technology tools in special education classrooms. This case study sought to explore male special education teachers' perceptions toward using tablet devices for teaching purposes in Saudi Arabia. The …
African American Males' Perceptions Of A Midwestern Community College, Marietta Turner
African American Males' Perceptions Of A Midwestern Community College, Marietta Turner
Graduate Research Theses & Dissertations
The educational statistics continue to report dismal persistence and completion rates for male African American community college students. Many scholars have noted the fact that African American males remain further behind all other demographics in college enrollment and completion. In this study, I sought to advance the literature on student engagement and academic success by exploring these students' perceptions of their college-going experience. The purpose of the study was to better understand African American male community college students' perceptions of their academic and social experiences at one midwestern community college. The theoretical framework for this study was achieved by combining …
Clerics In Arms : Militant Catholicism And Religious Violence In France, 1584-1598, Gregory D. Bereiter
Clerics In Arms : Militant Catholicism And Religious Violence In France, 1584-1598, Gregory D. Bereiter
Graduate Research Theses & Dissertations
This dissertation examines the participation of Catholic clergy in religious violence and sectarian conflict at the height of the French Wars of Religion, a series of protracted armed conflicts that ravaged the kingdom of France between 1562 and 1629. It aims to produce a cultural history of clerical militancy at the height of these disastrous wars, when a "Holy League" of extremist Catholics formed across France with the twin goals of eradicating French Protestantism and preventing the crown from passing to a Protestant "heretic," Henri de Navarre. The dissertation investigates the violent practices of militant Catholic clergy in the 1580s …
Connecting Philosophy And Practice In The Fabric Of Public Education : An Analysis Of K-12 Instructional Technology Discourse Inspired By Foucault's Technologies Of The Self, Alan Clemens
Graduate Research Theses & Dissertations
This study was undertaken to better understand the discourse surrounding K-12 instructional technologies as represented in published articles of three trade publications whose target audience is educational practitioners. The study additionally sought to test the viability of an analytical framework inspired by Michel Foucault's technologies of the self. Two hundred and thirty-seven articles published in three trade periodicals (Education Week, Learning & Leading with Technology, and The School Administrator) over a two-year sample period were analyzed using NVIVO, a qualitative data analysis software product from QSR, International.
The Effect Of #Blacklivesmatter : The Relevance Of Communities And Collective Identity, Stephanie D. Jones
The Effect Of #Blacklivesmatter : The Relevance Of Communities And Collective Identity, Stephanie D. Jones
Graduate Research Theses & Dissertations
In this paper I analyze the impact that the social movement #BlackLivesMatter (#BLM) has on how communities frame the issue of police brutality within protests. Protests that occurred before the #BLM movement focused on policing issues only within their own communities, while the protests that occurred after #BLM make connections from local cases to a national problem. I examine YouTube videos of protesting the police after incidents of police brutality for three different cases. The first case is the murder of Oscar Grant in Oakland, California, which was before the #BLM movement emerged. The second case was the choking of …

Is Legal Action The Right 'Idea' : An Examination Of Client-Based Legal Action And Its Effects On Organizational Responses To The Individuals With Disablities Education Act Of 2004 (Idea), Maureen A. Lowry-Fritz
Graduate Research Theses & Dissertations
The Individuals With Disabilities Education Act of 2004 (IDEA) is a piece of federal legislation that directs schools and districts to provide students with disabilities a "free appropriate public education." It contains numerous legal tools that parents can use to compel schools to develop appropriate educational programming for their children. But does parent-initiated legal action actually cause schools and districts to change their behavior? And if so, does the change in behavior affect the educational outcomes of students with disabilities? This dissertation attempts to answer those questions and determine whether law influences organizational behavior and if it does, whether it …

Asynchronous online discussion has become a staple of many higher education courses. The current study was designed to understand more fully the student experience within online discussions, with an emphasis on the experiences of undergraduate students outside the field of education. The research described in the current paper was a case study designed to examine the experiences of five students aged 20-25 who had senior status at a four-year university in the Midwest. Specifically, the research examined students' experiences using elements of social presence and impression management techniques to develop social identities within asynchronous online discussions, knowingly or unknowingly. Analysis …
Libyan Women And Revolution : A Study Of The Changes In Women's Political And Social Roles During And After The Libyan Revolution, Haala Hweio
Graduate Research Theses & Dissertations
Several uprisings against some long-term dictatorships in the Arab region took place during the year of 2011. The phenomenon, commonly known as the Arab Spring, started in December 2010 in Tunisia, a small North African Arabic country that was going through tough economic times. The domino effect of the Tunisian revolution spread quickly through the region. Almost all Arab countries witnessed political unrest and protests demanding reforms, but in a few of them--- Egypt, Libya, Syria, and Yemen---the situation escalated to the level of popular revolution. The Arab Spring phenomenon opened the door for studies on collective behavior and revisiting …
Mass Mobilization And The Breakdown Of Democratic Regimes : Egypt And Indonesia In A Comparative Perspective, Testriono
Graduate Research Theses & Dissertations
Why do elite conflicts in new democratic countries produce divergent political outcomes? Under what conditions do elite conflicts lead to the survival or the breakdown of democracy? Previous studies emphasize structural, institutional, and elite factors in explaining democratic breakdown, while overlooking popular mobilization as a factor. In proposing the interaction of two variables, elite conflict and mass mobilization, this thesis argues the divergent levels of the embeddedness of mass mobilization in elite conflict during political crisis result in either the survival or the breakdown of democratic regimes. I examine Egypt and Indonesia because they underwent severe elite conflict but had …
Media's Influence On Attitudes Towards Gay Men, Anna Rossi
Media's Influence On Attitudes Towards Gay Men, Anna Rossi
Graduate Research Theses & Dissertations
This thesis research examines the importance of media in influencing public perceptions. There is little empirical evidence that negative portrayals of gay characters in movies and television shows cause individuals to have negative attitudes towards gay men. I further the research in this field by measuring participants' views on gays, directly showing them a stereotypical or non-stereotypical clip depicting gay men, and then again measuring their attitudes towards gays. I evaluate the claim that the quality of portrayals of gays in movies and television shows influence the viewer's acceptance of gays by conducting an experiment and using a comparison of …
Potent Legacies : The Transformation Of Irish American Politics, 1815-1840, Mathieu W. Billings
Potent Legacies : The Transformation Of Irish American Politics, 1815-1840, Mathieu W. Billings
Graduate Research Theses & Dissertations
This dissertation explores what "politics" meant to Irish and Irish American Catholic laborers between 1815 and 1840. Historians have long remembered emigrants of the Emerald Isle for their political acumen during the 19th century---principally their skills in winning municipal office and mastering "machine" politics. They have not agreed, however, about when, where, and how the Irish achieved such mastery. Many scholars have argued that they obtained their political educations in Ireland under the tutelage of Daniel O'Connell, whose mass movement in the 1820s brought about Catholic Emancipation. Others have claimed that, for emigrant laborers in particular, their educations came later, …

Adpr 450: Public Relations Theory And Strategy—A Peer Review Of Teaching Project Inquiry Portfolio—"Using Crisis Simulation To Enhance Crisis Management: The Role Of Presence", Ming Wang
UNL Faculty Course Portfolios
Simulation-based training (SBT) is a common pedagogical tool used in crisis management training. This paper explores the effects of a crisis simulation activity on students’ crisis management competencies. Pre- and post-test surveys indicated that students significantly improved crisis management competencies after the crisis simulation activity. Moreover, presence was found to be positively associated with crisis management competencies, suggesting that presence is critical in designing an effective simulation activity.
Pols 430: Political Communication—A Peer Review Of Teaching Project Benchmark Portfolio, Brandon Bosch
Pols 430: Political Communication—A Peer Review Of Teaching Project Benchmark Portfolio, Brandon Bosch
UNL Faculty Course Portfolios
This course portfolio was created to articulate, assess, and reflect upon my course objectives for a political communication class that I taught in Spring 2016. Of particular note was my objective in trying to use a Verbal Exam to assess student learning. Although I encountered some difficulties in implementing the Verbal Exam, students seemed to be either neutral or somewhat supportive of having a Verbal Exam, with students generally inclined to thinking that they learned something about interviews from the process and showing some mild support for them being used in other classes. It is worth noting that the Verbal …
