Hiv-Serodiscordant Couples, Pre-Exposure, Prophylaxis And Relationship Satisfaction, Eli Latto
Theses, Dissertations, and Projects
This mixed-methods study explored the use of post-exposure prophylaxis (PrEP) and relationship satisfaction in HIV-serodiscordant couples. “Serodiscordant” refers to couples in which one partner is living with Human Immunodeficiency Virus (HIV) and one is not. PrEP is a daily dose of the antiretroviral medication Truvada, taken as a prevention measure by HIVnegative individuals at substantial risk for contracting the virus. This study was conducted via an anonymous online survey with both quantitative and open-ended questions to determine whether there is any relationship between the use of PrEP and relationship satisfaction in HIVserodiscordant couples. Data was analyzed by comparing people in …
Internalizing A Social Justice Identity Through Hip Hop Values In The Beats, Rhymes, And Life Academy : A Project Based Upon An Investigation At Beats, Rhymes And Life, Alfredo E. Laris
Theses, Dissertations, and Projects
This mixed method study investigates how the Beats, Rhymes, and Life Academy helps its members subvert systems of oppression. Through a quantitative survey and a qualitative 1.5-hour semi-structured interview, participants assessed their experience with social justice activism while in the BRL Academy. The study outlined three ways subversion of systemic oppression occurs: by developing one’s feeling of individual agency and empowerment to achieve one’s goals, developing a social justice identity, and empowering their community with the use of the first two factors.
The study found that Academy members felt like they had developed their own strength and were more aware …
Unhealthy Weight Control Behaviors In Adolescents : Are There Classes Of Risk?, Grace M. Van Schoick
Unhealthy Weight Control Behaviors In Adolescents : Are There Classes Of Risk?, Grace M. Van Schoick
Theses, Dissertations, and Projects
This quantitative secondary analysis was undertaken to determine if classes of risk exist for the use of Unhealthy Weight Control Behaviors (UWCBs) in adolescents. Engagement in UWCBs increases the likelihood that an adolescent would develop a full-syndrome eating disorder, which are both difficult and expensive to treat. Using data previously collected as part of the 2013 Youth Risk Behavior Surveillance System, it was possible to conduct a Latent Class Analysis (LCA) using 8,885 responses which contained data about a number of potential risk factors that might influence a participant’s likelihood to engage in UWCBs. Factors considered were gender, race/ethnicity, experiences …

Beats, Rhymes, Life & Resilience : Hip Hop Therapy With Youth Of Color : A Project Based Upon An Investigation At Beats, Rhymes And Life Inc, Emily S.L. Schwartz
Theses, Dissertations, and Projects
This study seeks to understand if participation in Therapeutic Activity Groups (TAGS) at Beats Rhymes & Life helps young people to develop greater resilience. In this paper, resilience is defined in two parts: the ability for participants to engage their inner strengths and characteristics to overcome adversity and the capacity to identify and utilize community and interpersonal resources. This study consists of a quantitative analysis to create a revision of the program’s existing pre/post treatment survey and examine resilience as reported by ten youth participants.
The findings revealed that participation in TAGs had a statistically significant impact on participant’s ability …
From Spitting Rhymes To Inspiring Minds : The Role Of Hip Hop Therapy In Treatment Engagement Amongst Latinx And Black Youth : A Project Based Upon An Investigation At Beats. Rhymes And Life, Tatiana R. Padilla
Theses, Dissertations, and Projects
The purpose of this study was to explore the implications of utilizing an innovative cultural framework to engage at-promise youth in clinical group work. This researcher collaborated with Beats, Rhymes and Life, an Oakland based organization that has effectively engaged youth at-promise through Therapeutic Activity Groups (TAGs). Treatment effectiveness is evident in the continued requests from mental health providers in community mental health clinics to partner with BRL’s TAG program, youth self-referrals, and youth requests to repeat the program. Based on this, the current study aims to understand what aspects of the TAGs promote treatment engagement- indicated by re-enrollment- for …

A Clinical Response To A Community Issue : Exploring Hartford's Youth Exposure To Community Violence In A Community-Based Agency, Alicia M. Mamula
Theses, Dissertations, and Projects
The purpose of this study was to explore what clinicians and managers at a Hartford, Connecticut community-based mental health agency are doing to integrate an effective collaboration between micro, mezzo, and macro level interventions to help youth clients residing in Hartford build competent communities. Fellin, (as cited in Hardcastle, 2011) defined a competent community as “one that has the ability to respond to a wide range of member needs and solve its problems and challenges of daily living” (p.96). Given the increased rate of community violence in Hartford in 2015, this research is especially important because the majority of clients …

Theses, Dissertations, and Projects
This quantitative descriptive study sought to explore any differences in stigmatization by social workers and other mental health professionals. The second research question explored whether mental health professionals felt their degree program actively challenged them to explore stigma towards those with mental illness. Fifty participants completed an anonymous online survey that included the Community Attitudes Towards Mental Illness scale, measuring stigma of mental illness. There were an additional four Likert scale questions exploring stigma of mental illness, and the participants perspectives of their education about stigma. The findings indicated that social workers had a lower mean score on the subscale …

Adult Adoptees And Considerations Of Parenthood : An Exploratory Study Examining Adoption Experiences And Effects, Katherine E. Green
Theses, Dissertations, and Projects
This exploratory, qualitative study sought to investigate how the experience of adoption affects an adoptee’s decision to start a family (or not). One reason to conduct this study was to isolate a particular developmental stage – entering parenthood – to observe deliberations related to the experience of being adopted. This study adds to the limited but growing body of research dedicated to adult adoptees with the aim of assisting clinicians in the field of social work to enhance their knowledge about the experiences of adopted people, especially those who are considering starting a family.
The study was conducted by interviewing …

Toxic Stress : Exploring Mental Health Narratives Of Environmental Justice In Richmond, California, Elizabeth Gonzalez
Theses, Dissertations, and Projects
The purpose of this exploratory study was to gather narratives of residents and/or community members who perceive the presence of the Richmond Chevron Oil Refinery in their community as a psychological stressor. The study used semi-structured interviews with eight community organizers and activists to gather qualitative data providing personal accounts of the possible psychological impact of living near a toxic facility with great political power in the city. The common trend among the narratives was the tendency of the participants to focus on a macro interpretation of how mental health is affected by a corporate giant. A collective sense of …

Theses, Dissertations, and Projects
The current study explored the possible relationship between disclosure of Holocaust related narratives and emotional well-being among Holocaust survivors as well as children and grandchildren of Holocaust survivors. This study further considered how methods of disclosure and number of disclosure methods used related to emotional wellbeing and overall benefit or harm of the disclosure experience among first, second, and third generation Holocaust survivors. A sample of 147 Holocaust survivors and descendants completed an online survey consisting of Likert scales to rate the perceived benefit or harm of their disclosure experience and opportunities to offer narrative describing their disclosure experience. Three …
Levels Of Perceived Stress Among Clinicians Who Work With Client Suicidal Behavior With An Organizational Context, Elyse A.S. Chastain
Levels Of Perceived Stress Among Clinicians Who Work With Client Suicidal Behavior With An Organizational Context, Elyse A.S. Chastain
Theses, Dissertations, and Projects
This quantitative study set out to explore the relationship between clinicians’ levels of stress and perceptions of agency or organizational support when working with clients exhibiting suicidal behaviors, attempts or completed suicide, known throughout this thesis as client suicidal behavior (CSB). It is well documented in the literature that clinicians experience a range of personal and professional reactions when working with CSB that, if left unacknowledged, can have negative implications for clinicians, clients and the agency or organization at large. With the theoretical underpinning of person in the environment, the reciprocity between an individual and their environment can be understood. …

Social Work Professional Ethics, As Affected By The Concept Of The Wounded Healer : An Investigation Into The Gatekeeping Practice Of Clinical Social Work Supervision, Cristina B. Bloom
Theses, Dissertations, and Projects
The objective of this exploratory qualitative study was to assess how the field of social work currently maintains and preserves professional social work ethics in the clinical practice field. This study sought to understand how, in a field where the self is one of the main tools utilized, the field ensures that the practitioner’s self is fit to practice and to do so ethically. This is of particular significance in a field that research indicates that high percentages of people are attracted to because of challenging personal life experiences (Lackie, 1982; Marsh, 1988; Vincent, 1996). More specifically, this study centered …
Standing On The Edge Of The "Rubyfruit Jungle" : Lesbians Recall The Experience Of Questioning In Therapy, Emily Willstatter
Standing On The Edge Of The "Rubyfruit Jungle" : Lesbians Recall The Experience Of Questioning In Therapy, Emily Willstatter
Theses, Dissertations, and Projects
The purpose of this study was twofold: to pursue an existing gap in the literature on therapy with people questioning their sexuality; and to represent a lesbian perspective on the experience of questioning one’s sexual orientation. A previous study (Jones et al., 2003) found that gay and bisexual people who were uncertain of their sexual orientation at the start of therapy rated the treatment as overall less beneficial than gay and bisexual people who had begun therapy while certain of their identities. This study explored the possible reasons behind this finding by investigating a small (N=13) but diverse group of …
Decision-Making Process : A Mixed Methods Study Of Somatic Awareness Use By Psychodynamic Clinicians In The Treatment Of Trauma-Related Disorders, Mary P. Curry
Theses, Dissertations, and Projects
This exploratory study examined clinical experiences and perspectives of psychodynamic clinicians on assimilative integration of neurobiologically informed somatic awareness and somatic interventions for the treatment of posttraumatic stress disorder (PTSD) and other trauma related disorders. Using an online mixed-methods study survey, quantitative and qualitative data were collected and analyzed. The primary study cohort respondents (N=156) met all study inclusion criteria and an excluded study sub-cohort respondents (N=56) met partial criteria. Psychodynamic relational practice and neurobiological concepts are formulated from the perspective of assimilative integration. The results, derived from integrating both data sets, reveal clinically relevant elements of the decision-making processes …

The Experience Of Same-Sex Partner Loss Among People Age 55 And Older, Courtney Woodburn
Theses, Dissertations, and Projects
The purpose of this exploratory study was to gain a deeper understanding of how people ages 55 and older experience the death of a same-sex partner. Recruitment occurred using snowball sampling primarily through a social organization for older gay men, resulting in a homogenous convenience sample. The study used semi-structured in-person, phone, and Skype interviews with 12 gay men to gather qualitative data about their experience of losing a same-sex partner at the age of 55 or older. Areas of inquiry within the interview included participants’ emotional experience of grief, social supports, meaning making and coping strategies, and practical matters …
From Entrenched To Empowered : The Factors Promoting Resiliency And Healing For Lgbtqia Identified Adult Survivors Of Childhood Sexual Assault, Hal Brown
Theses, Dissertations, and Projects
The objective of this study was to examine the experiences of adults, who as a result of their incidents of childhood sexual abuse were predisposed to present with a variety of negative outcomes, in pursuit of identifiable interventions, practices, and supportive factors effective in mitigating the negative outcomes and promoting survivor resiliency. The bulk of the previous studies of the critical elements for survivor resiliency had been conducted in religious communities. Ensuring a sample composed of individuals with access to an identity-based community, noting that community and connectedness had frequently been considered significant, this study was limited to LGBTQIA identified …

Self-Shock : The Experience Of Individuals Relocating Within The United States, Michelle Mieko Kaiulani Daggett
Theses, Dissertations, and Projects
This qualitative study explored the experience of relocation on self-identity. More specifically, this study focused on the concept of self-shock, the idea that being in a foreign environment impacts an individual’s ability to maintain a consistent identity. This research was based on 12 interviews that were conducted via video-conferencing call or in-person with individuals who have relocated domestically for the first time within the United States. The findings of this study suggest that individuals relocating domestically within the United States can and do experience self-shock. One reason for conducting this study is because relocating is commonplace within the United States …

Ten professionals who are involved in sexual assault prevention programming on college campuses were interviewed using semi-structured interviewing. Participants were from a variety of educational settings across the country. This study found that the biggest obstacles faced in implementing preventive programming are a lack of time and money, with an overwhelming need for …
Expanding The Core: Pregnancy Discrimination Law As It Approaches Full Term, Joanna L. Grossman
Expanding The Core: Pregnancy Discrimination Law As It Approaches Full Term, Joanna L. Grossman
Faculty Journal Articles and Book Chapters
The advocates behind the Pregnancy Discrimination Act (PDA) of 1978 had one very specific mission: to override the Supreme Court’s 1976 decision in General Electric v. Gilbert, in which it had curiously held that pregnancy discrimination had nothing to do with gender and was thus not a form of actionable sex discrimination under Title VII of the Civil Rights Act of 1964. The Court was not acting on a blank slate; it had used the same reasoning two years earlier to hold, in Geduldig v. Aiello, that pregnancy discrimination was not sex discrimination for equal protection purposes and therefore was …
An Historical Overview Of Ucc Article 9, Peter Winship
An Historical Overview Of Ucc Article 9, Peter Winship
Faculty Journal Articles and Book Chapters
This book chapter traces the history of Article 9 (Secured Transactions) of the U.S. Uniform Commercial Code. After setting out the pre-1940 legal setting in the United States for the use of movable property in secured transactions, the chapter studies three stages in the evolution of Article 9: (1) the drafting of the first “official” text (1947-1951), (2) the continuing revision of the text and its slow adoption by states (1952-1990), and (3) the thorough-going revision that lead to the present 1998 official text and subsequent minor amendments (1990-present). The chapter notes the growing complexity of the text and the …
Clearing The Air: How Canadian Lng Exports Could Help Meet World Greenhouse Gas Reduction Goals, James W. Coleman, Sarah Marie Jordaan
Clearing The Air: How Canadian Lng Exports Could Help Meet World Greenhouse Gas Reduction Goals, James W. Coleman, Sarah Marie Jordaan
Faculty Journal Articles and Book Chapters
With a glut of natural gas in North America, Canada’s natural gas sector is looking to reach new global markets for liquefied natural gas (LNG) exports. The federal government will likely rule soon on environmental assessments of LNG exports facilities on Canada’s west coast.
If LNG from Canada serves coal-dependent countries, mostly in Asia, Canadian LNG will likely lower global greenhouse gas emissions. However, LNG exports to less coal-dependent countries could result in a net emissions increase.
It is impractical for regulators to assess how individual LNG export facilities will affect overseas greenhouse gas emissions because of uncertainty in markets, …
Justice Scalia's Bottom-Up Approach To Shaping The Law, Meghan J. Ryan
Justice Scalia's Bottom-Up Approach To Shaping The Law, Meghan J. Ryan
Faculty Journal Articles and Book Chapters
Justice Antonin Scalia is among the most famous Supreme Court Justices in history. He is known for his originalism and conservative positions, as well as his witty and acerbic legal opinions. One of the reasons Justice Scalia's opinions are so memorable is his effective use of rhetorical devices, which convey colorful images and understandable ideas. One might expect that such powerful opinions would be effective in shaping the law, but Justice Scalia's judicial philosophy was often too conservative to persuade a majority of his fellow Justices on the Supreme Court. Further, his regular criticisms of his Supreme Court colleagues were …
A Rose By Any Other Name: How The United States Charges Its Service Members For Violating The Laws Of War, Chris Jenks
A Rose By Any Other Name: How The United States Charges Its Service Members For Violating The Laws Of War, Chris Jenks
Faculty Journal Articles and Book Chapters
This chapter examines the US practice of not charging its service members with war crimes. The chapter briefly explains how the United States asserts criminal jurisdiction over its service members before turning to how the US military reports violations of the laws of war. It then sets out the US methodology for charging such violations as applied to its service members, and compares this methodology to that applied to those tried by military commissions. The chapter then discusses the varied meanings of the term ‘war crimes’ and the way in which the 1949 Geneva Conventions can provide a benchmark against …
Misalignment: Corporate Risk-Taking And Public Duty, Steven L. Schwarcz
Misalignment: Corporate Risk-Taking And Public Duty, Steven L. Schwarcz
Faculty Scholarship
This article argues for a “public governance duty” to help manage excessive risk-taking by systemically important firms. Although governments worldwide, including the United States, have issued an array of regulations to attempt to curb that risk-taking by aligning managerial and investor interests, those regulations implicitly assume that investors would oppose excessively risky business ventures. That leaves a critical misalignment: because much of the harm from a systemically important firm’s failure would be externalized onto the public, including ordinary citizens impacted by an economic collapse, such a firm can engage in risk-taking ventures with positive expected value to its investors but …
Competing For Refugees: A Market-Based Solution To A Humanitarian Crisis, Joseph Blocher, Mitu Gulati
Competing For Refugees: A Market-Based Solution To A Humanitarian Crisis, Joseph Blocher, Mitu Gulati
Faculty Scholarship
The current refugee crisis demands novel legal solutions, and new ways of summoning the political will to implement them. As a matter of national incentives, the goal must be to design mechanisms that discourage countries of origin from creating refugees, and encourage host countries to welcome them. One way to achieve this would be to recognize that persecuted refugee groups have a financial claim against their countries of origin, and that this claim can be traded to host nations in exchange for acceptance. Modifications to the international apparatus would be necessary, but the basic legal elements of this proposal already …
Customary International Law: An Instrument Choice Perspective, Laurence R. Helfer, Ingrid B. Wuerth
Customary International Law: An Instrument Choice Perspective, Laurence R. Helfer, Ingrid B. Wuerth
Faculty Scholarship
Contemporary international lawmaking is characterized by a rapid growth of “soft law” instruments. Interdisciplinary studies have followed suit, purporting to frame the key question states face as a choice between soft and “hard” law. But this literature focuses on only one form of hard law—treaties—and cooperation through formal institutions. Customary international law (CIL) is barely mentioned. Other scholars dismiss CIL as increasingly irrelevant or even obsolete. Entirely missing from these debates is any consideration of whether and when states might prefer custom over treaties or soft law.
Pricing Sovereign Debt: Discretion V. Expropriation, Michael Bradley, Irving De Lira Salvatierra, Mitu Gulati
Pricing Sovereign Debt: Discretion V. Expropriation, Michael Bradley, Irving De Lira Salvatierra, Mitu Gulati
Faculty Scholarship
The Greek restructuring of March 2012 illustrates how non-price contract terms can have a significant effect on the pricing of sovereign debt. In the Greek restructuring, bonds governed by local law suffered NPV haircuts in the range of 60-75%, whereas those bonds governed by foreign law were paid in full and on time. Other contract parameters such as the currency in which the debt is denominated and the exchange on which it is listed can also affect the leeway a sovereign debtor has in dealing with its creditors. In general, we find that sovereigns with strong institutions and investor protections …
Privatizing Public Litigation, Margaret H. Lemos
Privatizing Public Litigation, Margaret H. Lemos
Faculty Scholarship
Government litigators increasingly use private resources—human and financial—to support their efforts in court. In some cases, government entities hire private lawyers to perform legal work on behalf of the government; in others, they draw on private donations to fund litigation; and in some cases they do both, relying on privately funded private lawyers to litigate cases in the government’s name. These mergers of public and private can be understood as part of broader trends toward the privatization of government services. This Article uses lessons from the privatization debates to illuminate the likely costs and benefits of bringing private actors into …
