Inmate Legal Information Requests Analysis: Empirical Data To Inform Library Purchases In Correctional Institutions, Kimberli Kelmor Jan 2016

Inmate Legal Information Requests Analysis: Empirical Data To Inform Library Purchases In Correctional Institutions, Kimberli Kelmor

Georgetown Law Faculty Publications and Other Works

The introduction of legal content to Google Scholar made United States case law and law journal articles accessible to an unprecedented extent. With case law freely available and accurate bibliographic information for articles, could Google Scholar be accurate and complete enough for correctional institutions to forgo purchasing either print publications or fee-based services for these materials? This article empirically assesses whether Google Scholar can reliably answer the questions of inmates in a correctional facility, the Baltimore City Detention Center. As a comparison, the same questions are tested in Westlaw Correctional, a subscription database marketed to correctional institutions.

Miranda'S Truth: The Importance Of Adversarial Testing And Dignity In Confession Law, Meghan J. Ryan Jan 2016

Miranda'S Truth: The Importance Of Adversarial Testing And Dignity In Confession Law, Meghan J. Ryan

Faculty Journal Articles and Book Chapters

The landmark decision of Miranda v. Arizona focuses on the important values of adversarial testing and human dignity. These values can be found among a constellation of values ordinarily aligned with constitutional criminal procedure cases like Miranda. The constellation also includes values such as truth-finding and equality. With the regularization of DNA analysis and the realization that a large number of innocent people have been convicted, however, there has been a recent fixation on truth-finding. Other values have been overshadowed. The myopic pursuit of truth-finding may be somewhat misguided, as certainty of truth is generally impossible. This is recognized by …

Redskins: The Property Right To Racism, M. Alexander Pearl Jan 2016

Redskins: The Property Right To Racism, M. Alexander Pearl

Faculty Articles

Everyone has an opinion, from President Obama to Matthew McConaughey, about the Washington football team name. This Article comprehensively analyzes the legal and social issues surrounding the mascot controversy. I focus my inquiry on the interaction of trademark law and Indian law. I offer three primary contributions in this Article. First, the current mainstream conception of harm caused by the team name is subjective, and I argue that the harm caused by the team name and logo is objective, testable, and demonstrable. Psychological research shows that these images harm Native people. Second, the remedies offered by the Lanham Act are …

Crowd Crush: How The Law Leaves American Crowds Unprotected, Tracy Hresko Pearl Jan 2016

Crowd Crush: How The Law Leaves American Crowds Unprotected, Tracy Hresko Pearl

Faculty Articles

Crowd-related injuries and deaths are startlingly common both in the United States and worldwide. They occur in a wide range of situations and at a vast array of venues: at music concerts, sporting events, and retail holiday sales, and in and around airports, subway platforms, and parking lots, among other locations. These “crowd crush” incidents, however, are extremely underreported and rarely litigated, masking the seriousness of this issue and making it difficult for the few victims who pursue legal recourse to recover damages. Given that there is virtually no statutory law in the United States pertaining to crowd management and …

There’S A Skid Row Everywhere, And This Is Just The Headquarters: Impacts Of Urban Revitalization Policies In The Homeless Community Of Skid Row, Douglas Mungin Jan 2016

There’S A Skid Row Everywhere, And This Is Just The Headquarters: Impacts Of Urban Revitalization Policies In The Homeless Community Of Skid Row, Douglas Mungin

LSU Doctoral Dissertations

This dissertation tracks the historical shift from containment strategies for managing homeless populations in Skid Row to current strategies of using police and the penal system to periodically sweep the street of these unwanted bodies. This shift hinges on the construction of homelessness as a crisis requiring immediate and ongoing intervention. First, the state produces and reproduces homelessness as a state of crisis by withdrawing or denying support and public services and disallowing alternative, subsistence modes of survival. Then, it issues the performative utterance of the area as unclean or unsanitary. Developers and city officials mobilize the police to erase …

Bridge Rating Based On In-Situ Weigh-In-Motion And Health Monitoring Data, Dana Feng Jan 2016

Bridge Rating Based On In-Situ Weigh-In-Motion And Health Monitoring Data, Dana Feng

LSU Doctoral Dissertations

Parallel to the bridge design methodology changes from the Allowable Stress Design to the Load Factor Design, and then to the reliability based Load and Resistance Factor Design (LRFD), bridge load rating method has also been evolving. Applying the reliability theory to the bridge load rating is more complex than applying to the LRFD since any conservatism can have a significant effect on the assessment of bridge capacity, particularly in load posting and bridge replacement. Although the current Load and Resistant Factor Rating (LRFR) method applying the concept of reliability analyses, it uses very limited site-specific data due to practical …

The Threat Of Predatory Lending, Marko Stojkovic Jan 2016

The Threat Of Predatory Lending, Marko Stojkovic

Public Interest Law Reporter

This Article is part one of a two-part series exploring the dangers of predatory lending and how Dodd-Frank and the Consumer Financial Protection Bureau have solved predatory lending and ended the possibility of another subprime debacle. In this part, what will be shown is that due to the U.S. government's deregulation and the greed of banks and predatory lenders in the housing market, predatory lending wreaked havoc on minority, low-income, and immigrant communities, and was the main cause of the 2008 economic collapse.

Managing Racist Pasts: The Black Justice League’S Demand For Inclusion And Its Challenge To The Promise Of Diversity At Princeton University, Tomoyo Joshi Jan 2016

Managing Racist Pasts: The Black Justice League’S Demand For Inclusion And Its Challenge To The Promise Of Diversity At Princeton University, Tomoyo Joshi

Honors Papers

I examine online diversity initiative pages, student activism and administrative responses in Fall 2015 at Princeton University as a case study. In the first section, I analyze Princeton’s online diversity initiative page “Many Voices, One Future” by demonstrating how “diversity” becomes individualized, commodified, and quantified. In its claims to aspire to equality (or equal representation), the discourse of diversity ignores historical and sociopolitical contexts of oppression that produce and maintain difference in the first place. In the second section, I investigate how the actions of the Black Justice League challenge or the rhetoric of diversity that the administration embodies. Further, …

Starting From Scratch: Reasserting "Indian Country" In Alasky By Placing Alaska Native Land Into Trust, William H. Holley Jan 2016

Starting From Scratch: Reasserting "Indian Country" In Alasky By Placing Alaska Native Land Into Trust, William H. Holley

Florida A & M University Law Review

The Alaska Native Claims Settlement Act (ANCSA) was enacted for the purpose of promoting economic development in remote Alaska Native villages. ANCSA has fallen short of this goal. ANCSA dissolved the trust relationship between Alaska Native tribes and the federal government by transferring former tribal lands to state-chartered, Native corporations. As a result, ANCSA severed Alaska Native tribal authority from tribal lands. Today, tribal governments in Alaska are without the resources necessary to address issues that threaten the survival of their communities. Tribal governments throughout the lower 48 states have long used federal land-into-trust provisions to expand and consolidate former …

Recentering Tribal Criminal Jurisdiction, Addie C. Rolnick Jan 2016

Recentering Tribal Criminal Jurisdiction, Addie C. Rolnick

Scholarly Works

The boundaries of modern tribal criminal jurisdiction are defined by a handful of clear rules—such as a limit on sentence length and a categorical prohibition against prosecuting most non-Indians—and many grey areas in which neither Congress nor the Supreme Court has specifically addressed a particular question. This Article discusses five of the grey areas: whether tribes retain concurrent jurisdiction to prosecute major crimes, whether tribes affected by Public Law 280 retain concurrent jurisdiction to prosecute a full range of crimes, whether tribes may prosecute Indians who are not citizens of any tribe, whether tribes may prosecute their own citizens for …

An Implementation Analysis Of Needle Exchange Programs In Kentucky: Implementation Barriers And Facilitators Identified By Stakeholders, Samantha Jane Harris Jan 2016

An Implementation Analysis Of Needle Exchange Programs In Kentucky: Implementation Barriers And Facilitators Identified By Stakeholders, Samantha Jane Harris

MPA/MPP/MPFM Capstone Projects

Kentucky law authorizes county health departments to implement harm reduction needle exchange programs given that the county receives approval from all governing authorities including the local and/or district boards of health, the county government, and the city government in the jurisdiction in which the exchange is intended to operate. As of April 2016, five county health departments operate needle exchange programs and around 20 other county health departments are seeking approval from their governing authorities or beginning to discuss engaging in this process.

I conducted qualitative interviews with key stakeholders in the implementation process to determine the facilitators and barriers …

From Bail Bondsmen To Risk Assessments: Assessing Kentucky's Pretrial Release Approaches, Ismaila Ceesay Jan 2016

From Bail Bondsmen To Risk Assessments: Assessing Kentucky's Pretrial Release Approaches, Ismaila Ceesay

MPA/MPP/MPFM Capstone Projects

As one of only four states that ban bail bond companies, Kentucky is an experiment in the “laboratory of democracy,” which is made even more interesting because the state has tried three different approaches to pretrial release—the Pre-1976 approach, the 1976 to 2011 approach, and the 2011 to present approach. An assessment of these approaches show s how state actions and inaction can affect the right to pretrial release and underscores the importance of adopting appropriate state pretrial release policies.

Inside Safe Assets, Anna Gelpern, Erik F. Gerding Jan 2016

Inside Safe Assets, Anna Gelpern, Erik F. Gerding

Publications

“Safe assets” is a catch-all term to describe financial contracts that market participants treat as if they were risk-free. These may include government debt, bank deposits, and asset-backed securities, among others. The International Monetary Fund estimated potential safe assets at more than $114 trillion worldwide in 2011, more than seven times the U.S. economic output that year.

To treat any contract as if it were risk-free seems delusional after apparently super-safe public and private debt markets collapsed overnight. Nonetheless, safe asset supply and demand have been invoked to explain shadow banking, financial crises, and prolonged economic stagnation. The economic literature …

When Fantasy Becomes Reality: Attempts To Regulate The Highly Unregulated Daily Fantasy Sports Industry., Garrett Greene Jan 2016

When Fantasy Becomes Reality: Attempts To Regulate The Highly Unregulated Daily Fantasy Sports Industry., Garrett Greene

St. Mary's Law Journal

Legislation is beginning to creep into the once safeguard-devoid sphere of the daily fantasy sports industry. Daily fantasy sports are a subset of traditional season-long fantasy sports and are immensely lucrative, yet there are hardly any standard regulations. Ironically, the Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006, which was used to outlaw online poker gambling, paved the way for daily fantasy sports, because it federally exempted fantasy sports from being classified as illegal sports gambling. The UIGEA further protects daily fantasy sports from the Professional and Amateur Sports Prohibition Act (PASPA) of 1992 which prohibits states from sponsoring sports …
