Tier 1 Highway Security Sensitive Material Dynamic Risk Management, Steven Douglas Kreis Jan 2016

Tier 1 Highway Security Sensitive Material Dynamic Risk Management, Steven Douglas Kreis

Theses and Dissertations--Civil Engineering

Each year, over 2 billion tons of hazardous materials are shipped in the United States, with over half of that being moved on commercial vehicles. Given their relatively poor or nonexistent defenses and inconspicuousness, commercial vehicles transporting hazardous materials are an easy target for terrorists. Before carriers or security agencies recognize that something is amiss, their contents could be detonated or released. From 2006 to 2015, the U.S. Department of Transportation’s Pipeline and Hazardous Materials Safety Administration (PHMSA) recorded 144,643 incidents involving a release of hazardous materials. Although there were no known instances of terrorism being the cause, accidental releases …

Reforming High-Stakes Police Departments: How Federal Civil Rights Will Rebuild Constitutional Policing In America, Ivana Dukanovic Jan 2016

Reforming High-Stakes Police Departments: How Federal Civil Rights Will Rebuild Constitutional Policing In America, Ivana Dukanovic

UC Law Constitutional Quarterly

Over the past two decades, the Justice Department has untaken dozens of topdown interventions of local police departments plagued with unconstitutional policing. From Albuquerque, New Mexico, to Ferguson, Missouri, the Justice Department's Civil Rights Division has instituted reform in departments exhibiting patterns or practices that violate individuals' constitutional rights. The government's tool for imposing such reform and oversight on local, state power is a twenty-three-year-old statute: 42 U.S.C. 14141. This Note proposes that § 14141 is the change agent for rebuilding constitutional policing in America.

But with change comes challenge, and many pushback departments continue to resist reform. The Note …

Puff, The Magic Dragon, And The Estate Planner, Gerry W. Beyer, Brooke Dacus Jan 2016

Puff, The Magic Dragon, And The Estate Planner, Gerry W. Beyer, Brooke Dacus

Texas A&M Journal of Property Law

With the legalization of medical and recreational marijuana in almost half of the states, practitioners need to be aware of the interface between marijuana and estate planning. This Article provides a discussion of the major issues that arise in this context. After bringing readers current with the history of legalized marijuana, the Article focuses on how marijuana use may impact a user’s capacity to execute a will and other estate planning documents. The Article then examines other estate planning concerns such as will and trust provisions conditioning benefits on the non-use of “illegal drugs” and the impact of marijuana use …

The Risks Of Clouded Property Title For Cannabis Business Owners, Investors, And Creditors, Sean M. O'Connor, Jason Liu Jan 2016

The Risks Of Clouded Property Title For Cannabis Business Owners, Investors, And Creditors, Sean M. O'Connor, Jason Liu

Texas A&M Journal of Property Law

This Article provides a brief primer on the surprising range of assets that the CSA forfeiture provisions govern for the state-legal cannabis businesses. It outlines these provisions for tangible as well as intangible property, with an emphasis on risks to state-legal cannabis businesses’ intellectual property and issued securities. We argue that these forfeiture risks create clouded title for all subject tangible and intangible property—not only for the state-legal businesses and their proprietors, but also for those businesses’ outside investors, creditors, and suppliers/contractors.

Decision Making At The State And Local Level: Does Science Matter?, Susan G. Mason

Urban Studies and Community Development Faculty Publications and Presentations

Science is believed to be an important part of public policy decision making because of its inherent characteristics of measurability, rigor, objectivity, replication, and peer review. The purpose of this research was to explore the linkage of science to public policy decision making. The research explores what state and local public offi cials know about science and how much they actually use science in their decision making. Interview results with public offi cials in the State of Idaho demonstrate that policy makers ultimately see science as only one element in the mix. Findings suggest that equal attention and debate should …

Rape In Alaska, Caitlin Williams Jan 2016

Rape In Alaska, Caitlin Williams

Undergraduate Research Journal

The National Crime Victimization Survey shows that Alaska has the highest number of sexual assaults of all U.S. states. Rape is a paramount problem in Alaska, for Alaska triples the national average of reported rapes (at 27 per 100,000). In addition, according to the 2014 Council on Domestic Violence and Sexual Assault’s Dashboard, only 33.5 percent of reported forcible rapes resulted in an arrest. Data indicates that Alaska has a high population of Alaska Native (or ANs) women that are assaulted by both AN men and non-AN men. This research examines the core reasons behind the high incidence of AN …

Comparative Defamation Law: England And The United States, Vincent R. Johnson Jan 2016

Comparative Defamation Law: England And The United States, Vincent R. Johnson

Faculty Articles

England and the United States share a common legal tradition that has been shaped by principles dating back at least 800 years to the time of the Magna Carta. Even after the American colonies declared their independence from England in 1776, English law was still widely followed in the new nation unless it was inconsistent with American institutions or new ideas. As late as 1964, American libel law was essentially "identical" to English libel law. This was true, in part, because until the mid-twentieth century, defamation law in both countries was defined "mainly by the common law and decisions of …

Emerging Technologies To Measure Neighborhood Conditions In Public Health: Implications For Interventions And Next Steps, M. Schootman, E. J. Nelson, K. Werner, E. Shacham, M. Elliott, Kendra Ratnapradipa, M. Lian, A. Mcvay Jan 2016

Emerging Technologies To Measure Neighborhood Conditions In Public Health: Implications For Interventions And Next Steps, M. Schootman, E. J. Nelson, K. Werner, E. Shacham, M. Elliott, Kendra Ratnapradipa, M. Lian, A. Mcvay

Journal Articles: Epidemiology

Adverse neighborhood conditions play an important role beyond individual characteristics. There is increasing interest in identifying specific characteristics of the social and built environments adversely affecting health outcomes. Most research has assessed aspects of such exposures via self-reported instruments or census data. Potential threats in the local environment may be subject to short-term changes that can only be measured with more nimble technology. The advent of new technologies may offer new opportunities to obtain geospatial data about neighborhoods that may circumvent the limitations of traditional data sources. This overview describes the utility, validity and reliability of selected emerging technologies to …

A Study On Immigrant Activism, Secure Communities, And Rawlsian Civil Disobedience, Karen J. Pita Loor Jan 2016

A Study On Immigrant Activism, Secure Communities, And Rawlsian Civil Disobedience, Karen J. Pita Loor

Marquette Law Review

This Article explores the immigrant acts of protest during the Obama presidency in opposition to the Secure Communities (SCOMM) immigration enforcement program through the lens of philosopher John Rawls’ theory of civil disobedience and posits that this immigrant resistance contributed to that administration’s dismantling the federal program by progressively moving localities, and eventually whole states, to cease cooperation with SCOMM. The controversial SCOMM program is one of the most powerful tools of immigration enforcement in the new millennium because it transforms any contact with state and local law enforcement into a potential immigration investigation. SCOMM has now been revived through …

Cyber-Physical Systems: Complex System Governance As An Integrating Construct, Polinpapilinho F. Katina, Charles B. Keating, Adrian V. Gheorghe

Engineering Management & Systems Engineering Faculty Publications

This paper examines contributions of Complex System Governance (CSG) as an integrating construct for the emerging fields of critical cyber-physical systems (CPS). CPS is concerned with physical entities that are controlled by computational elements. The field is relatively new, emerging, and also somewhat fragmented in development. There are multiple agencies, entities, and activities being undertaken to address a nexus of emerging issues (e.g., cybersecurity) in critical infrastructures. However, the development of critical CPS, as a field, albeit with good intentions and efforts, appears to be largely ‘self-organizing.’ In response, we suggest CSG as an organizing construct capable of provided a …

Agencies And Science-Experiment Risk, Eric E. Johnson Jan 2016

Agencies And Science-Experiment Risk, Eric E. Johnson

Faculty Articles

There is a curious absence of legal constraints on U.S. government agencies undertaking potentially risky scientific research. Some of these activities may present a risk of killing millions or even destroying the planet. Current law leaves it to agencies to decide for themselves whether their activities fall within the bounds of acceptable risk. This Article explores to what extent and under what circumstances the law ought to allow private actions against such non regulatory agency endeavors. Engaging with this issue is not only interesting in its own right, it allows us to test fundamental concepts of agency competence and the …
