Evolving Standards Of Reasonableness: The Aba Standards And The Right To Counsel In Plea Negotiations, Margaret Colgate Love
Evolving Standards Of Reasonableness: The Aba Standards And The Right To Counsel In Plea Negotiations, Margaret Colgate Love
Fordham Urban Law Journal
The ABA Criminal Justice Standards have been recognized by the Supreme Court as one of the most important sources for determining lawyer competence in right to counsel cases. Because the constitutional test under the Sixth Amendment is whether defense counsel’s performance was “reasonable” under “prevailing professional norms,” the standard of competence is necessarily an evolving one. The Supreme Court's decision in Padilla v. Kentucky underscores the defense bar’s stake in participating in the ABA standard-setting process to guide the development of defense counsel's obligations in plea negotiations. In addition, to the extent the courts give the ABA Standards credence in …

Will The Real Lawmakers Please Stand Up: Congressional Standing In Instances Of Presidential Nonenforcement, Bethany R. Pickett
Will The Real Lawmakers Please Stand Up: Congressional Standing In Instances Of Presidential Nonenforcement, Bethany R. Pickett
Northwestern University Law Review
The Take Care Clause obligates the President to enforce the law. Yet increasingly, presidents use nonenforcement to unilaterally waive legislative provisions to serve their executive policy goals. In doing so, the President’s inaction takes the practical form of a congressional repeal—a task that is solely reserved for Congress under the Constitution. Presidential nonenforcement therefore usurps Congress’s unique responsibility in setting the national policy agenda.
This Note addresses whether Congress has standing to sue in instances of presidential nonenforcement to realign and reaffirm Congress’s unique legislative role. In answering this question, this Note examines legislative standing precedent and argues that the …

Reclaiming Futures And Organizing Justice For Drug-Using Youth, Jeffrey A. Butts, Kathleen A. Tomberg, Jennifer Peirce, Douglas N. Evans, Angela Irvine
Reclaiming Futures And Organizing Justice For Drug-Using Youth, Jeffrey A. Butts, Kathleen A. Tomberg, Jennifer Peirce, Douglas N. Evans, Angela Irvine
Publications and Research
Reclaiming Futures is an organizational change initiative that supports coordinated and individualized responses for justice-involved youth with problematic substance use issues. The Research and Evaluation Center at John Jay College of Criminal Justice compared people's perceptions currently working in Reclaiming Futures communities with similar colleagues from nearly ten years ago. The study suggested that communities with the strongest engagement in Reclaiming Futures tended to have more positive perceptions of their youth justice and substance abuse treatment systems, including key facets of administration, collaboration, and overall system quality.

A Comparative Study Of User Experience Between Physical Objects And Their Digital Surrogates, Anastasia S. Varnalis-Weigle
Journal of Contemporary Archival Studies
Librarians and archivists have embraced innovative technologies in providing users a way to engage with collections. This engagement is increased through various forms of social media “sharing,” which broadens cultural institutions' visibility to new or remote users. While we make strides in designing new ways to access digital collections, the question remains: what are users losing in sensory (sight, touch, sound, smell) and emotional experience at the digital level? A phenomenological approach consisting of observation and semi-structured interviews was used to investigate user experience with physical objects and their digital surrogates. Students, faculty, and staff from a large academic institution …

The Impact Of Length Of Stay On Adjudicated Male Youths;' Language Use: Focusing On Linguistic Analysis Of Verbal Samples, Yousun Shin Ph.D., Terry P. Overton Ph.D., Ed.D., Zelica Espinoza M.Ed.
Journal of Human Services: Training, Research, and Practice
The primary purpose of the study was to examine the impact of the length of juvenile offenders’ stay in a residential facility on attitudinal changes, measured by language use of 22 participants’ interviews analyzed by using a computerized text tool called Linguistic Inquiry and Word Count (LIWC) to obtain a measure of language use. A series of one-way ANOVA (SPSS 18.0 version) were used to examine the differences between the groups identified by the length of stay and interview interval. The results indicate that the length of stay significantly impacts language use regarding the language categories of affective process words …

Electric Vehicles: Rolling Over Barriers And Merging With Regulation, Mark Detsky, Gabriella Stockmayer
William & Mary Environmental Law and Policy Review
Electric vehicles are merging into the mainstream of transportation. Although the technology still comprises a small fraction of the current market, it ismorewidely available due to competitivepricing, technological improvements, and available state and federal incentives. The benefits of electric vehicles include reduced fossil fuel emissions and associated climate change mitigation, new independence from oil-driven policies in foreignmarkets and international relations, and potential opportunities for increasing and complementing renewable energy electric resources. The risks of widespread electric vehicle deployment are largely thought to involve potential impacts on existingutility generation, distribution, and transmission systems and how the costs of any needed changes to …

Charging On The Margin, Paul T. Crane
Charging On The Margin, Paul T. Crane
William & Mary Law Review
The American criminal justice system has experienced a significant expansion in the number and severity of penalties triggered by misdemeanor convictions. In particular, legislatures have increasingly attached severe collateral consequences to misdemeanor offenses penalties such as requirements to register as a sex offender, prohibitions on owning or possessing a firearm, and deportation. Although there is a wealth of scholarship studying the effect this development has on defendants and their attorneys, little attention has been paid to the impact collateral consequences have on prosecutorial incentives. This Article starts to remedy that gap by exploring the influence that collateral consequences exert …
