Problem Analysis In Community Violence Assessments: Reavealing Early Childhood Trauma As A Driver Of Youth And Gang Violence, Laurie Ross Phd, Samantha Arsenault, Sergeant Miguel Lopez Apr 2016

Problem Analysis In Community Violence Assessments: Reavealing Early Childhood Trauma As A Driver Of Youth And Gang Violence, Laurie Ross Phd, Samantha Arsenault, Sergeant Miguel Lopez

Mosakowski Institute for Public Enterprise

Problem analysis conducted by a university-based research partner can provide communities with data-driven options to address the local drivers of serious youth and gang violence. Situated in Worcester, Massachusetts, this article describes how after early childhood trauma was identified as a potential driver of adolescent and young adult violence, problem analysis using local data confirmed that being the victim or witness of a traumatic incident before the age of 12 was significantly correlated with involvement in violence in adolescence or young adulthood. While there is a robust literature on the relationship between early childhood trauma and later delinquency, local decision-makers …

Disentangling Flight Risk From Dangerousness, Lauryn P. Gouldin Apr 2016

Disentangling Flight Risk From Dangerousness, Lauryn P. Gouldin

BYU Law Review

There is a growing national consensus about the urgent need to shrink the population of pretrial detainees and to fix our broken money bail system. Even as scholars and reformers are showing renewed interest in pretrial detention and bail, however, they have neglected a fundamental pretrial problem: the conflation (by judges and in statutes) of flight risk and danger. Reformers have offered up an array of proposals and increasingly sophisticated risk assessment tools that promise to improve judicial decision-making, but many of these tools merge flight risk and danger in ways that reinforce problematic legislative and judicial practices.

Bridging The Implementation Of Nagoya-Kualalumpur Supplementary Protocol On Liability And Redress In Indonesia, Wahyu Yun Santoso Apr 2016

Bridging The Implementation Of Nagoya-Kualalumpur Supplementary Protocol On Liability And Redress In Indonesia, Wahyu Yun Santoso

Indonesia Law Review

Aside the Nagoya Protocol on Access and Benefit Sharing, which is already ratified by Indonesian government with Law No. 11 Year 2013, the Nagoya–Kuala Lumpur Supplementary Protocol on Liability and Redress (NKL Supplementary Protocol) offers great benefits for “megabiodiversity” country like Indonesia. Despite the lack of awareness of this supplementary protocol, the need for ratifying is urge. This legal-normative research aims to seek the existing regulation in Indonesia to support the implementation of the Nagoya–Kuala Lumpur Supplementary Protocol on Liability and Redress, and to explore the readiness of the national legal system on liability and redress for biodiversity. Based on …

Judicial Review On Administrative Action: Reflection On The Bank Century Bailout Policy, Lily Evelina Sitorus Apr 2016

Judicial Review On Administrative Action: Reflection On The Bank Century Bailout Policy, Lily Evelina Sitorus

Indonesia Law Review

Accountability is the key to good governance. In global administrative law, every policy made should be accountable. The given law should be accessible to the public. At the time of the global financial crisis, many countries did not have the necessary rules to solve the problems that arose. In Indonesia, the government’s decision to bail out Bank Century has remained controversial up to the present time. The need for a comprehensive law dealing with economic, political and social factors should be considered. The Indonesian Law regarding Government Administration provides for the code of conduct for government action. An entire chapter …

Why We Need Reed: Unmasking Pretext In Anti-Panhandling Legislation, Joseph Mead Apr 2016

Why We Need Reed: Unmasking Pretext In Anti-Panhandling Legislation, Joseph Mead

ConLawNOW

The First Amendment severely disfavors content-based restrictions on speech in public areas. In its 2015 decision in Reed v. Town of Gilbert, the Supreme Court clarified the test for determining whether a speech restriction is content-based, ratcheting up the number of laws subject to strict scrutiny. While this decision has been criticized by some, I argue that, at least in the context of anti-panhandling legislation, Reed was a needed answer to local governments passing overly broad restrictions motivated by a desire to drive an unpopular type of speech from the city square. I use anti-panhandling ordinances from three local jurisdictions—the …

Beyond The Façade: Haussmannization In Paris As A Transformation Of Society, Amy Rideout Apr 2016

Beyond The Façade: Haussmannization In Paris As A Transformation Of Society, Amy Rideout

Pursuit - The Journal of Undergraduate Research at The University of Tennessee

The Paris that tourists know and love today conceals under its romantic, ordered, urban environment a façade of division and social change. Following Napoleon II’s commissioning of an urban overhaul, Haussmannization in the nineteenth century addressed problems of circulation and disorder, but also created problems of separation and division. Annexing several neighborhoods into a fortified new boundary, and subsequently removing the poor, working class to the outskirts, helped make this division permanent. While modern concepts and building materials significantly improved the inner city, they also forced a reduction in housing supply coupled with increased housing prices. Slums were cleared, in …

Formulating New Models In The More Guns, Less Crime Debate, Justin Shane Carothers Apr 2016

Formulating New Models In The More Guns, Less Crime Debate, Justin Shane Carothers

Student Theses and Dissertations

Recent statistical studies suggest that the presence of right to carry (RTC) laws increase crime on all fronts. Like many before it, this debate hinges on model specification and our ability to conceptualize real world mechanisms into social science models. I evaluate and modify previous economic models concerning the “More Guns, Less Crime” hypothesis in order to test those findings. I also expanded previous panel data that originally ended in 2006 with the most up to date uniform Crime Reporting (UCR) data and created a new open-carry dummy variable. Each model uses data from 1970 to 2013 for all fifty …

Police Contracting In St. Louis County: Focusing Events And Changes In Image And Venue In Five Case Studies, Alan W. Karr Apr 2016

Police Contracting In St. Louis County: Focusing Events And Changes In Image And Venue In Five Case Studies, Alan W. Karr

Dissertations

St. Louis County, Missouri is a fragmented suburban area, covering 505 square miles, with ninety separate municipalities. Fifty-six municipalities maintain in-house police departments, while thirty-four contract police services from other governments. Previous research concerning interjurisdictional collaboration efforts has been rooted in the rational choice theory. However, the rational choice theory alone does not explain why some municipalities do or do not enter into contracts for police services. The purpose of this work is to examine police contracting decisions in St. Louis County, specifically the drivers behind contracting discussions and decisions in five sample municipalities in St. Louis County. The five …
